Hello, Our response to this complaint is attached to this emailPer the lease agreement the customer is responsible for the condition of the vehicle until such time that it can be inspectedAfter the vehicle was returned the vehicle was inspected by a licensed, third party inspector and found
to be damagedThe customer was not charged for every instance of damage, only those which fell under the Fusion Auto Finance wear and tear policy which was provided to the customer before the end of the leaseAlso attached is the condition report from the final inspection which outlines the damage. I am rejecting this response because:After reading the lease agreement in more detail, I understand the disposition fee and will pay the $400.00. As to the other charges, there was no damage to the vehicle when I dropped it off at Adesa Boston. The pictures of the scratches that you sent to me were not on the vehicle when I left. As for the tires, the vehicle only had 30,miles on them. So how can a tire be worn that much. Warrentes on tires state that they last at least 50,miles unless they were defectiveI would like this taken off of the bill

I am rejecting this response because:I only made the payment to avoid aversely affecting my credit. I expect a refund for the fraudulent charges of $85 plus...

taxes to "clean" a car. Those were unfair charges and nothing more than a scheme you and your employees have to see who can pull in the most money every month with charges like this. I have the screenshots from [redacted], [redacted], and [redacted] bragging about this on Facebook. The $400 disposition fee is more than enough to cover vacuuming up pet hair which was not mine. By the way, I don't see how making up thousands of dollars of fictitious charges, but then settling on $85 and threatening sometimes credit with collections threats being "amicable."This company has a long history of doing this according to the reviews found with a simple Google search. If they refuse to refund the $85 plus tax, I will leave this complaint open and seek opening a class action lawsuit against Fusion Auto. And that is not a threat. I already have 2 interested attorneys, and as mentioned above, I have plenty of evidence to move ahead confidently.

To whom it may concern,   Per section 22. subsection B of the original lease agreement the lessee (customer) is responsible for any damage present on the vehicle at the time it is returned to Fusion Auto Finance as determined by a licensed, third party inspector. The contract also stipulates...

that the vehicle is to be returned directly to one of our return locations in New York or New Jersey so that the customer may be present for this final inspection and any damage will be made known to them at that time. Fusion Auto Finance was notified that the vehicle had been surrendered to a third party dealership on May 2nd of 2017. The vehicle was retrieved on May 5th 2017 and subsequently inspected by a third party inspector from [redacted]. During this inspection the vehicle was found to be damaged as noted in the enclosed itemized invoice and condition report from same inspection.        Lease Number:  [redacted]   Dear Valued Credit Union Member,   A transfer of interest is a service that is granted in circumstances when a contracted lessee is no longer able to drive their leased vehicle such as in the event of a death. This process is completely voluntary to the party assuming the lease and the costs and timeframe of the process are made clear before initiating the transfer.  The fee of $495 is not waived unless the person assuming the lease is a member of the lessee’s immediate family. Our [redacted] offered to lower the fee to $250 to resolve this issue amicably. Regarding the paperwork, we apologize for the inconvenience at the Department of Motor Vehicles but the template for what is accepted in a transfer of interest is up to the interpretation of the individual DMV office and employee dealt with on that day. The same documents are sent for each TOI that we complete. When we were informed with exactly what was necessary for that office we forwarded the necessary documents.   Sincerely,   [redacted]

Fusion Auto Finance utilizes a third-party inspection company, AutoVIN, to complete all vehicle inspections at the end of lease. The report is attached - please see that we also reduced the charges (see N/C which means no charge) from the inspection report. Fusion fairly billed the consumer and...

acted in good faith. The customer was billed in March and did not pay until July. All collection activity has ceased and the account is considered paid in full.
