Bought a vehicle based on Gateways description and pictures weeks agoI live miles away, so I was trusting their wordWhat a big mistake!

I contacted Gateway Classic Cars to inquire on a Ford PickupI ended up making an offer on the pickup and placed a $1,deposit on December 2, When I got off the road, I called the dealership to pay for balance for the vehicle, I was informed they had sold the car and proceeded to tell me that they were going to keep my $1,deposit and that I could use that money for a future purchase so long as it was within 6-monthsI told *** the salesman that I wanted a refund and he said he would have to contact his accounting department and get back to me

When the car is described by representatives of the dealer as a like new perfect condition car I would understand the argument, but this vehicle in my opinion should have been represented as rough rebuild conditionIf

This car was on sale on Consignment from a private Seller. We advertised this car with the information provided by the Seller. Every car on our website is advertised for Sale and AS-IS, Where-Is basis. We issue no warranties, verbal or written. We encourage every Buyer to verify all information on...

their own. Mr [redacted], came to personally inspect the car and spent nearly two hours looking and test driving this vehicle. He pointed to the rust issues this car had in the under carriage and offered a lower price due to these imperfections. Mr. [redacted], after he had personally inspected the car, text driven it and offered a lower than asking price, signed a Purchase Agreement, that included a written clause that this car was being sold AS-IS, Where- Is. After receiving payment on the car we shipped it to an address of Mr. [redacted]'s choosing. Mr. [redacted] is now asking us to discount the car further after negotiating a lower price on the same issues. Mr. [redacted] has received the car that he contracted and paid for and the Seller has been paid. We consider this sale final.

Please be advised that Mr. [redacted] contacted us regarding our stock #18, a 1997 Pontiac Trans Am advertised for sale on our website.
At the request of Mr. [redacted], we reserved the car in his favor pending inspection by the Buyer.
Mr. [redacted] inspected the vehicle and rejected it for purchase. Immediately thereafter, we refunded his deposit. He was given full access to the vehicle prior to purchase, as is our normal practice.
Mr. [redacted]'s demand we pay him for his travel expenses are not valid and not the industry standard.

Firstly thank you for the response from Gateway Motors.This response is totally unacceptable.I spoken dozens of times with [redacted] and reviewed over 120 pictures that were supplied with the add, these have...

since been removed. NONE of the pictures showed any areas of damage which had been deliberately NOT photographed.When quizzed the response was I don’t have a hoist to look under the car and rely on our photographer, but I can assure you we do not buy cars with rust.The issues are listed in emails to [redacted] below which were never addressed. When the car arrived here in Australia it was not driving and had to be pushed out of the container, due to broken wires to the alternator, a faulty alternator and many, many other faults as detailed below.I do not accept the flippant response from Gateway, dozens of attempts were also made to contact the owner and senior management through email, telephone calls and Linked In email contact details. [redacted] was given full access to the vehicle to inspect the vehicle prior to purchase either on his own or through a third-party inspection. Which [redacted] got a third party inspection done as we would like for all of our customers to do. Here at Gateway we want all of our customers happy with the condition and price of the car.[redacted] was given the green light from the inspector that this car is a good buy. The next step for Gateway Classic Cars is to secure a One Thousand Dollar Deposit along with [redacted]s offer. [redacted] made a offer of Sixty Thousand but refused to give us any kind of deposit knowing that we would not run his credit card unless his offer was accepted. I shared with [redacted] that this deposit helps the buyer and seller. Once we run the card for the deposit the deal is done. The seller can't go back on the deal and the buyer is secure on price as well. [redacted] felt like it shouldn't have to pay a deposit at all. I did all I could to aid [redacted] in this matter. The customer contacted our staff about purchasing a 1934 Ford Pickup.  On 12/2/17 a non-refundable deposit of $1,000 was given toward the purchase.  Our policy of all deposits being non-refundable, and all purchases to be complete within 7 days of a deposit was clearly explained....

Both written and oral.  These policies were also printed on the purchase agreement which the customer received on 12/2/17.  Our sales staff was in daily contact and were consistently brushed off by the customer over the following week.  From 12/11/17-12/22/17 our sales staff attempted contact via phone, text message, and email and did not hear back from the customer. (see attached emails as well) Given all contact attempts were being ignored, we ended attempted contact a full 3 weeks after the deposit was given.  The vehicle went back on the market and sold a short time after.  Three months later the customer contacted via phone.  Our sales staff explained that his lack of response gave us no choice but to relist the vehicle and it had been sold.  We explained our policy that all forfeited deposits can be used toward another purchase for a 6 month period after the initial deposit date.

Our company has provided all documents sent to this customer which take aim at his claim of not receiving "anything" in writing. Since 1999, all of our sales have been contractual, in writing, and accompanied by a non-refundable credit card receipt slips. Why would we start avoiding this now? We are selling over 75M in gross sales annually, it would terribly irresponsible, and illegal, not to have contracts in place itemizing the terms of our agreement. Again, we consider this complaint false and without recourse. GCC

Response: This vehicle was on consignment with Gateway Classic Cars and was purchased As Is, Where Is with No Warranty. We are sorry to hear that the buyer had engine trouble after the purchase, but the vehicle was running and driving when it was in our possession, as our video shows. We have signed contracts from the buyer stating that he understands it is As Is, Where Is, and that he has been given every opportunity to inspect the vehicle before purchase. He chose not to do so and took the vehicle sight unseen with no warranty. It left our showroom in good running order and we cannot be held responsible for what happens to it after the buyer takes delivery. We will not issue a refund to cover an engine rebuild. We can provide 4 places on our contracts and one spot on every page of our website where it discusses this matter: "This vehicle is being sold AS-IS, WHERE-IS, with no warranty, expressed, written or implied. For starters I had to notify gateway classics about the cracked window after I spoke to Vinny the transporter during transit. At that time Vinny had told me about the broken window and that the truck was having a hard time idling. I then contacted [redacted] and not til then did he tell me that "YES" the window was cracked and that the truck had a problem idling but it's just from "Bad Gas". [redacted] stated that gateway would pay for repair of window, which til this day has not happened. One would think that after purchasing a vehicle it would run/start/idle. Gateway classics still doesn't see an issue with the fact that the truck should have never been put on flatbed for transport unless it was properly running. I was told by [redacted] and [redacted] that it was the "Bad Gas". It was not bad gas truck still did not start after trucks gas was siphoned. There were many problems with truck, broken headlight,broken choke, broken speedometer, front brakes worn down to nothing to name a few. I was then asked what the sea level was in New York by [redacted], That was comical being that the truck came from Memphis Indiana. [redacted] and [redacted] were now stating that it was the carbeurator which needed adjustment. After bring it to a mechanic and 1300$ after [redacted] offered me 250$. It was there lack of fairness or accomadation to me as the customer who was delivered a non working truck. I tried to explain to [redacted] that a mechanic in NY is 75-100$ an hour. So 250$ was not going to cut it. So [redacted] and gateway classics can keep the 250$ and I will continue to post  truthful reviews and comments on all car related sites. And inform potential or existing customers about how that operate.

They are only interested in SALES only, and they said they had integrity, which is why I know now why they want all the legal papers signed. They should be held to a lemon law. Will never recommend this company to anyone.  This company is worst then a shady used car dealer. Yes it barley ran and drove, leaked oil all over, no oil pressure, and all kinds of aluminum in the crankcase, rod bearings were shot, rocker arms worn out. Oh and they said the engine had less then 10k miles on it.

A 1965 Chevrolet C10 was purchased from our Gateway Classic Cars Louisville Showroom by [redacted] on April 16th 2015. The vehicle was picked on April 23rd by D&D Auto Transit and delivered to [redacted]. The shipper noticed a small crack in the driver side window. We made note of that, and also...

informed [redacted]. The previous owner had only driven the truck 30 miles in the last 3 years due to his failing health, this is the main reason the truck was brought to our showroom. The previous owner could no longer drive it and enjoy it. The truck had developed a rough idle condition, due to the older gas being in the tank. After several texts from [redacted] to [redacted], another Gateway Salesman, [redacted] was referred to me. Each time [redacted] called I gave him suggestions to try. He would immediately say he had tried those suggestions, which seemed strange to me that he was so fast to reply to them. [redacted] then contacted our director in Florida, [redacted], and he told him to get an estimate for the window and a basic tune up for the engine. [redacted] sent a bill of $1300 that included other items that did not pertain to the window or the tune up. [redacted] assessed the bill and determined that a reimbursement of $250 was fair and equitable. [redacted] agreed to this and I informed him I would need to send him our Standard Agreement and Release Form. [redacted] read the release, called me back and indicated he would not sign the form. I informed [redacted] we could not send out a check until this matter was resolved. At this time [redacted] became border line belligerent and I ended the conversation. [redacted]’s wife then went to our Face Book pages to give Gateway Classic Cars poor reviews. At all times, I ([redacted]), [redacted] and [redacted] conducted ourselves in a professional manner with [redacted]. The $250 settlement was offered as customer goodwill and was based on the estimate of $100 to fix the window, and that left $150 for spark plugs and a carburetor tune. The estimate he sent also had wheel cylinders, a transmission flush and filter, brakes and other items that are basic maintenance that the buyer wanted to have done. Everything we sell is AS IS, WHERE IS, and we are not going to pay for the first 30,000 miles of basic maintenance. We agreed to fix the problems that he had asked us about and $250 should cover that just fine. The release simply says that IF he agrees to take the $250, he cannot ALSO go on websites leaving negative reviews, sue us, or ask us for more money in the future. It is a standard release. No company will settle with you by reimbursing you, and then allow you to do damage with negative reviews, lawsuits etc. If you are able to do that, what was the point in settling in the first place?    The video did show a running and driving vehicle and it was running and driving when we shipped it. We offered $250 to be helpful when we very easily could have stuck firm to the AS IS, WHERE IS contract and offered nothing. Now, our offer of $250 is off the table since the negative feedback has already been left. We consider this sale final and will offer no reimbursements or refunds.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Although I agree with everything stated by Mr. [redacted] response, the issue of "False Advertisement" was not responded to.  As stated in my original complaint, they have shown proper advertisement for a AC equipped NON-WORKING vehicle, but this one was NOT advertised as such.  This was advertised as an AC car!  And although I discovered the issue prior to the sale, they have a 1K Non-Refundable deposit.  I am requesting the 1K refund as their advertisement of AC car was the deciding factor with this car amongst many others.  If not resolved, I have intentions of continuing action with Consumer Affairs as well as offering my negative review a very large Military network including associates at BOEING St. Louis.
