Initial Business Response / [redacted] (1000, 15, 2016/02/25) */ ***Document Attached [redacted] I did receive a request for a service animal and processed the request in a timely mannerThe resident was given rules at the time of the approvalThe two violations received were a result of not following the companion/service animal rulesIn the rules, section 5., it states, "When the dog is not in my apartment/townhouse, the dog must be on a leashMy dog is not allowed to run free in the indoor or outdoor common areas." In section it states, "Acts of aggression toward persons or interference with other tenants' peaceful enjoyment of the premises is not allowedIn section it states, "Failure to comply with any of the above rules will constitute a lease violation and can result in the termination of your tenancy." Initial Business Response / [redacted] (1000, 5, 2015/08/27) */ We received the complaint and after reviewing this is what we found [redacted] & [redacted] moved into Oakmont Apartments on June 1st, They signed a one year lease which would have ended May 31st,In the lease it states in section Dunder TERMINATION OF LEASE WITH SPECIFIED ENDING DATE, "if resident wishes to move out of the apartment on the date this lease ends, Resident must give Management prior written notice equal to the notice period (days)." It also states in section Dlabeled MOVING OUT BEFORE LEASE ENDS that "if Resident moves out of the apartment before the date this lease ends, Resident is responsible for rent for the duration of this lease or until the apartment is reoccupied and any other losses, Resident further agrees to pay an administrative fee of $plus any other costs associated with breaking this lease and as outlined elsewhere in the body of this lease." They had stated they talked with Bill, who was the On-Site Manager at the time but unfortunately they are still held responsible to their lease termsWe do apologize if there was any miscommunicationThey were charged out the remainder of their lease for rent but someone did move into that unit on April 26, so we did credit them back $1,for future rent charges that was previously chargedThey could have contacted someone in the corporate office to ask about the stipulations of their lease if they were not getting answers from the on site managementThe balance owed on their account is true and accurate

I am rejecting this response because: I called that number already on December 19, and also, I called their Minneapolis office, at [redacted] ***At both numbers, they transfer to the same person, Anita [redacted] She insists she is right and they are not going to give me my security deposit back and on the top of it, we have to pay for paintingSo we owe them, I completely do not agree with itFor Revdex.com to know, it is useless to talk with herI am taking actionsI never was treated like that before, so unfair and dishonestThank you, Revdex.com [redacted]

Much like the termination letter Gaughan Companies sent to your residence back in December,

I asked for a copy of all files for the time period Gaughan was my association management company (December 2011-March 2015) and was told in March I would be provided these via USB back in April (due to bank reconciliation)In the same request I stated that this should be sent to a BUSINESS address provided and NOT my residence since I will not be home to sign for itPlease send this to the BUSINESS address in Minneapolis provided
I followed up regarding this request in April and received no response over the following month indicating it was sent or confirmation for what had been sentI do not think would have been unreasonable to ask to confirm or provide that since communicated that I had not received it well after it should have arrived in a reasonable amount of time
As with the termination letter referenced in the response (but not initial complaint), no certified mail confirmation was ever provided (even when asked) although an extension was promptly granted in the case of the termination since this was also never officially communicatedThough I had been in communication with my property manager who only mentioned the termination after I complained about serviceFor the record, no other communications (less important) I was to receive from Gaughan had ever been lost throughout the time we had Gaughan (3+ years) for property management when they were sent

Management has received the complaint and is reaching out to the tenant directly in order to arrive at a solutionIt is always our goal to provide excellent customer serviceWe appreciate the feedback received

After further review of the complainant’s file we can assure you that the file was handled to the standards of the lease that was signed. It appears that when she left the unit, it was full of furniture, garbage, and several tenant damages were noted and billed back in accordance to the
lease. In regard to section residents, we haven’t accepted new applications for some time now, and anyone receiving subsidy is grandfathered in. We apologize for any inconvenience she may have experienced, but we do stand by what is currently being reported to the credit bureaus, as this is an accurate reflection of what was found when we took possession of the unit after the lease ended

In response to complaint #12245448: The managerial team mailed a letter to the resident to ask her to come to the office to discuss the issue, but the team never heard from her. On August 9, a refund was issued and an email was sent. If the resident would still like to discuss the issue, the team would absolutely like to meet with her. Thank you, Kayla

I am rejecting this response because:Nobody made any contact with me, I didn't hear anything from Gaughn.

I live at one of the properties managed by Gaughan Companies and the building is not well kept up. When we moved in we were told it was non smoking yet everyone in the building but us seems to smoke in their units and common areas. We ask about garage rental and storage locker and never hear back. Don't live at a Gaughan Property.
