We have contacted the customer and discussed this issue The delay occurred due to a miscommunication in which the customer has not been able to return the necessary signed document required to proceed We have sent them a corrected document to sign so that we can proceed as planned and get their refund to them as quickly as possible

On September 24th, [redacted] ***t were contacted by [redacted] legal counsel retained by Gehan Homes, and was informed that the Timeline expressly stated in their contract with Gehan Homes that the "construction dates are projected and are subject to changes due to conditions both beyond and with (Gehan Homes) ControlHowever, Gehan Homes is willing to refund [redacted] earnest money in the amount of $3,000.00, plus one-half of the option deposits ( [redacted] /= $ [redacted] ), for a total of $ [redacted] This settlement offer represents Gehan Homes best and final settlement offerShould the Crist's choose to decline this offer, Gehan Homes shall retain the $3,earnest money as well as the full $ [redacted] in other deposits as allowed under the express terms of the Contract

An Area Manager has scheduled to meet with the homeowner on Friday, May 20, to investigate his concerns with the door and the HVAC system Our construction records show this home did, in fact, receive a larger HVAC system than the base planDue to the extra living area that the homeowner selected; we don’t believe there is an issue of the system being undersized We will have the system inspected to ensure it is operating correctly We have worked on the door previously, but if it is still leaking, we will inspect and determine what needs to be done

Complaint: [redacted] I am about to close on a home with Gehan Homes and have several issues that have arisen that have not been adequately addressed by Gehan1) I upgraded to a one bowl stainless steel extra depth kitchen sink and throughout construction observed sub-contractors utilizing the sink for cleaning brushes and other equipment despite having a utility sink in the garage and water spigots on the outside of the houseThe sink was also cleaned several times throughout build by GehanI noticed that the sink has since obtained many scratches and there are warranty restrictions on the care of the sink and I fear this may have voided that warranty in addition to giving me a "used' product" in a new homeThe sink also does not properly drain and leaves standing water in the bottom of the sink basinGehan has refused address these issues2) The hot water heater that has been installed in my future home is beginning to rustThis was noted during the pre-drywall inspection by my independent inspector and at final inspectionThe inspector noted during the pre-drywall inspection that the water heater was sitting in a pan full of water as a consequence of being installed in a home that did not have a complete roof during a period of torrential rainsThe inspector reported that rust is corrosive and once begun continues to progress into a possible default of the applianceGehan has refused on two occasions to address this issue and replace the hot water heater as recommended by a licensed inspector in the state of TexasConsumer’s Desired Resolution: I am looking to Gehan to uphold their promise of delivering a quality product by replacing the damaged defective sink and the damaged hot water heater

With regard to the light fixture in the master bath vanity, the standard that is shown in the catalog is for a single light fixture for a single contiguous vanity top (bulbs)When a master bath has a split vanity, as this customer has on their plan, the light fixture layout calls for two light fixtures (for a total of bulbs)This is what she received in her home.With regard to the stainless steel tilt out tray, the cabinet supplier is going to replace the existing tilt out sponge tray with a stainless steel sponge tray.Thank you

Complaint: [redacted] I am rejecting this response because:the substance of the business response continues to not address the basic premise of the complaintI do not feel a company should have free reign to choose what the term "NEW" will be.I would never accept a new product from any company that had scratches and /or rust spots as those conditions belie the term! When we began our process of building our house the builder insisted on my lender get my appraisal done too earlyWhen it came up for the appraisal to expire our sales person told us, "Don't worry it's Gehan's fault, we never have lenders do what we ask and get it done this quick." My RE agent and Lender were saying a different story, that she was acting like this will be on us if it expiresSo I verified further and received an email from our sales associate said it was Gehan's fault and again that it's because our lender was the first ever to be on top of things and not to worryNow today they come back and say that Gehan will not be paying for another appraisal because Gehan never authorized itI believe there is some conflict of interest here with them getting kickbacks from their preferred lender then sabotaging outside lenders.I need Gehan to do the right thing and pay for the new appraisal

Below are the responses (already conveyed to customer on several occasions) to the items listed below: 1. An onsite inspection of the sink was performed and the fit and finish of the sink is acceptable and the warranty on the sink has not been affected2. The water heater and the overflow pan were inspected by both Gehan Homes and the plumbing contractorWhat few cosmetic blemishes that were present were cleaned off and the warranty on this unit has in no way been compromised. As was stated before, when a master vanity is split (ie in different locations), two bulb vanity strips are provided in lieu of one - bulb strip which is used when the vanity is contiguous (ie in a single location)What was installed in this customers home is according to these specifications. To Whom it May Concern: The customer was allowed to personalize the home by selecting structural and design optionsAll options that were selected and signed for by the customer have been installed. The home in question is built to or above industry standardsWe have been in constant
communication with the customer and their realtor throughout the build process. We allowed the customer to make a late change adding wood flooring to their stairsThe wood flooring that was selected and signed for by the customer is now installed. We feel that we have held up our end of the contractual agreement and we expect the customer to do the same

To Whom it May Concern:  We were not able to come to an agreement with the customer.
The customer will be refunded all of their money and their contract will be canceled.

Thank you for your inquiry. We appreciate the candid and thoughtful comments. While we understand the customers desire to have a gated community, Gehan Homes has never represented, in writing or otherwise, that this community was going to be a gated community. That would be the decision of...

HOA, through its members, to evaluate and decide upon the installation of an owners only access gate. With regard to the appraisal, please understand that independent licensed appraisers in the State of Texas are a third party entity which have no affiliation to any business they are performing an appraisal on,including Gehan Homes. While not privy to the appraisal this customer is referencing, if it was so stated then that was an oversight on the appraisal company's part. We would urge them to contact the appraisal company directly. Their contact information should be in the report.Again, thank you for your inquiry.

I spoke with Mr. [redacted] and listen to his concern. I explained that there wasn't anything we could do at this point, I reminded him that he signed the plans (attached) showing where he wanted the pool plug. I ask him if he brought up the concern during the pre-sheetrock meeting, the initial...

buyers orientation meeting or the sign off meeting. Mr. [redacted] acknowledge that he did not and only learned that the plug wasn't in a good location once the pool company came out to discuss. Originally we did tell Mr. [redacted] that we could get him the electricians number and he could see what they would charge to move it for him. The price was going to be 300.00 to do the work, I called the electricians and asked them to reduce this to 200.00 to help Mr. [redacted] out which they did. At this point we feel we placed the plug in the location that Mr. [redacted] asked for and it was never an issue during the build and at sign off. I am rejecting this response because:We feel that Gehan does not understand the gravity of this issue for the consumer. Gehan offered homes for purchase, indicated that by the completion of construction it would gate the community, and urged purchasers to utilize its lender. Homes purchased from Gehan utilizing Gehan's lender have appraisals stating the community is gated--a fact Gehan has previously recognized and we have supporting documentation confirming the statement.  Homes purchased through other means do not have the statement about the View being a "gated community."  As Gehan states, appraiser should not include information that they are unable to confirm. The appraiser could have only received that information from Gehan since there is no actual gate present.  We ask that Gehan perform as promised and put in the gate as indicated to the customers directly and as it influenced the appraiser to do. Indicating to the consumer and to the appraiser that the community would be gated and having no intent to gate the community is deceptive.
