Complaint: [redacted] I am rejecting this response because: the terms and conditions were not as clear as they indicate We did call Fanta Sea and they indicated to us that we could extend the vacation to December for a price of $USD We knew that the time was coming to a close but because we were verbally offered an extension we did not actively seek out vacations Had we not been given the verbal promise, we would have searched However, because we found a vacation in the [redacted] for most of our points unexpectedly, we will allow this to drop Also, we want to keep favorable relations with RCI Although this is not the vacation we originally planned, we are resolved that it is the one we want on short notice Regards, [redacted] Aka [redacted]

9/4/2015In response to this complaint I have the following factual account of the service providedThe vehicle was brought to us to evaluate a tapping noise within the engineWe removed the valve cover for inspection and found the camshaft timing chain tensioner had collapsed due to oil pressure lossThe oil level was checked and found to be correctWe removed the oil drain plug and found a significant amount of metal attached to the magnet on the plug.After a discussion with the vehicle owner we agreed to do more exploratory work by removing the oil pan to inspect the oil pump pick up screenWe found the screen clogged not only with more metal but also oil sludge(a common condition for Volkswagen engines due to extended oil change intervals) This combination of debris prevented the pump from producing an adequate amount of pressure to lubricate the engineWe reviewed this with the owner and recommended a replacement oil pump and cylinder head which had suffered wear due to the lack of lubricationThis service was declined(See RO ***)The owner decided that the best course of action was to reinstall the oil pan after cleaning off the oil pick up Screen and refilling the crank case with fresh oil and hope for the bestWe drove the car on our two mile test drive and reported that a ticking noise was still present but the car ran normallyHe came to Collect the car and as stated it failed completely on his way homeThis outcome is not the result of our service but the result of negligent servicing of the oil and filter changes over the life of the engine which may well have begun prior to his ownership of the carNo matter what decision is made to arbitrate this complaint certainly did not authorize the owner to rent a car nor do I feel we are even remotely responsible for the residual loan on the carRegards, John R

The consumer toured on Wednesday December 28, 2016, received all of their giftsThey also stayed overnight for two nights arriving on Tuesday December 27, on a marketing rate of $plus room taxCan the consumer provide what specific information they did not receive when taking the

As stated in our previous response the consumer must convey or sell his deed on his ownThis is not something that we participate in doing for any of the ownersThe owner acknowledged in our contract documents that they agreed we would not resell their unit any time in the futureIt is unfortunate that the owner feels they no longer want to be an ownerAlthough it is unclear if their owner's rate privileges will be re-established as a result of the abuses they made, their owner week remains available to enjoy every off providing their mortgage and Maintenance Fees accounts remain currentPlease have the owners refer to their original contract documents to validate my claim regarding the resale of their unit and out collective original agreementA copy can be provide if they no longer have these documents

This matter has been settled privately with the consumer

I reviewed the customer;s complaintsAs per the contract terms, they purchased an RCI points membership for the term of years, and years w/ FantaSea Resorts. They received 50,points to travel with during a year period which would have expired in February of 2016. We cannot
extend RCI points and RCI will not extend the pointsWe could not make promises on inventory that is available int he RCI network as the consumer suggestsThey would have needed to check the inventory continuously for the desired travel location to become availThe fees are laid out in the paperwork so it is unclear how there could be any misunderstandingThey also have owner rates here to use for months, along with receiving a "frozen purchase price" for when they come back for their revisit to purchase ownership. The total cost of the membership is $2599.00- $for the membership & $closing cost. The $they can use as equity if they choose to purchase and that will be applied to the purchase price of actual ownershipWe currently do not sell this program any longer, but of course honor all of our RCI points membersEverything is laid out in the contract signed by both customers. To expect an extension beyond the agreed upon terms cannot be honored.In an effort to resolve this matter, they can still use the equity as promised for the purchase of a vacation ownership package as per our original agreement

I read the consumer's complaintI can confirm the assertion that we stated we could extend the plan is as this plan is managed by one party and they have stated this was not discussedWe are unable to extend the plan beyond the contract termsThe consumer can refer to our written agreement which outlines the various expiration datesAs the consumer was aware when entering into the agreement, the plan was a limited time offer and woudl permit the price freeze to purchase a fulle time share unit at it's endIt is unclear to us why the consumer is lodging this complaint at all as we have been advised by two seperate high ranking RCI reps that the *** confirmation in question was previously confirmed to the consumer directlyWe are requesting that this complaint be marked as resolved as the consumer has already confirmed the *** Reservation

I am rejecting this response because: We are certain we are not the only ones that fell victim to your fraudulent sale tacticsWe were promised free airline ticketsWe spoke to several people at the Atlantic Palace about selling the timeshare because we do not want itThey told us that we could not so we had to advertise our owners week for rentI do not want the use of your bonus weeks and I do not want your time shareWe want to be released from this contract

I have read the consumer’s complaint. The free airfaretickets were an incentive to take a tour and are not associated with theiractual ownership in anyway. The terms and conditions of the airline tickets aredisclosed on the materials provided and are only intended to be used inconjunction with the...

resort stays as noted on the actual certificate. The consumer was able to utilize their vacation at [redacted] immediately (day 1) and didagree by initialing and signature that any travel outside of the [redacted] would utilize their [redacted]Membership and agreed to wait the necessary 90 after their full deposit for [redacted] Membership activation. Theowner is stating they were able to use their week for trading to Cancun(At a resort of their choosing) and then claims their unit doesn’t have enough tradingvalue for most resorts. Their exchange to Cancun to a resort of their choosing that they subsequently cancelledis evidence that this allegation is untrue. We are available to assist theconsumer in any and all vacation requests either at [redacted] or can offer assistance withexchanges via [redacted] . The certificate for theairline tickets must be redeemed with the gifting agency per their policies asexpressed on the actual certificate in the consumers possession and asexplained to the consumers.

The Consumer has grossly misrepresented the facts as stated in their complaint. They have rented their owners rates privileges for profit as a direct violation of the Owners Rates agreement that limited this benefit  to personal use or that of the owner’s immediate family which is defined as...

children, spouse and parents only.  They have engaged in a business enterprise to advertise this personal privilege to the general public. They stated they were unaware of any wrong doing by provide written confirmation to the renters and presented their personal id and payments at each check in an effort to conceal the fact that another party was the actual occupant of the unit they stated to be maintained by themselves. As a result of the blatant violation of the owners rate privileges that limited this benefit for the owner’s personal use or that of their immediate family, we have called all pending reservations and are waiting for Board approval to determine if the privileges will be reinstated. Their claim regarding the airlines ticket is considered frivolous as they were provided written confirmation that the airline ticket redemption required additional purchase of a hotel stay in advance of receiving the gift. The tickets were presented as a gift in conjunction with time needed in taking the tour regardless if they purchased a vacation ownership program. The tickets are in no way affiliated with their ownership. It should also be noted that this did not come to be reported as an issue since 2014 and only after the suspension of the Owners Rate Program to their account.  We will not be providing a refund. We will make the owner aware once the board has decided on this matter at their next meeting. The owner should also contact us directly to arrange the payment of their past due July Mortgage payment.
