We hired the Gibbs company under the *** name to do work on our home foundation work after nine months of *** telling us if they were running behind he sent us an email telling us that they were no longer going to be working with *** that they were changing systems we told him at that time that we did not want no longer want to do business with him that we wanted to continue to do business with *** we can’t tact and *** at that point and we found out that *** was filing bankruptcy *** promised to give us a refund of our $4000 which in fact he had never had any intentions of giving us our money back so basically *** stalled our $4000 Never completed any work and lied to us for nine months about having the work done he’s a thief and a fraud the only saving grace is that *** is working with us to try to rectify the problem and from what we’ve been told *** is filing bankruptcy and probably open up under another name and we are not the only ones that he’s done this to taking good honest people’s money and running off with it what a scam shame on you

In response to *** he is a *** he has told myself as well as my husband that he would refund the money .this was months ago. As well as the contract was never intended to be fulfilled we are working with the company he spilt from and are fully aware he has no intentions of giving us our money back. Unfortunately we are not the only ones he has done this too. Again SHAME ON YOU!

THE ACTUAL DEPOSIT WAS $3361.50 FOR THE PROJECT. WE NO LONGER HAVE AN OFFICE OR CREW IN ST. LOUIS DUE TO EMPLOYMENT PROBLEMS AND FINDING COMPETENT WORKERS. BECAUSE OF THAT WE HAVE FALLEN WAY BEHIND ON THE WORK SCHEDULE. AS WE WERE UNABLE TO PERFORM THE WORK IN A TIMELY MANOR, *** CHOOSE TO CANCEL THE CONTRACT WHICH IS HER RIGHT. WE DO AGREE TO SEND BACK HER DEPOSIT IN FULL BUT DUE TO THE SAME EMPLOYMENT PROBLEMS HERE IN THE HOME OFFICE, WE ARE GOING THROUGH SOME MAJOR CASH FLOW PROBLEMS. THE WEATHER IS NOT HELPING OUR PRODUCTION SCHEDULE AS WELL. AS I STATED WE WILL RETURN THE DEPOSIT AS SOON AS POSSIBLE TO ***.

I am rejecting this response because:

*** is being untruthful and is planning on filling bankruptcy and is just buying time. He had no problem taking my money and being deceitful. When I call he will not answer my calls He’s been promising to give me my money back for quite some time no explanation other than what he is written in the last response that times are tough they’re tough on me too because I have to shell out the rest of the money for someone else to do the work so it’s really not my problem we had a deal he didn’t stick to it he should give me my money back

We signed a contract for foundation stabilization with Gibbs in March 2018, paid the down payment in April 2018, they began work on September 6, 2018 and finally completed on November 20, 2018 after assuring us that the work itself would take no more than a week and a half. We paid in full (except for the additional billing added later) long before they ever began work. The job we chose was quoted at $17,000 but it wound up costing over $23,000. They defended themselves by referring to a contract clause that would allow them additional billing if they had to dig deeper. They later acknowledged that the typical depth in our area was 40', yet they quoted the job at 21'. They dug holes in the front yard that were approximately 15' deep, and left them exposed for several weeks. They put up no caution signs and no safety barriers of any kind. The owner was dishonest and routinely ducked calls about the condition of the work site and about completion of their work. We had to argue with him repeatedly to get him to come out and finish things left undone after he said it was completed. He has lost his franchise with ***, but he didn't disclose that to us at any time. Gibbs encouraged us not to register the warranty with the *** because they wouldn't be going out of business any time but didn't mention that they had lost the franchise with them. The new *** franchisee has agreed to come and correct the grading and drainage problems they had done incorrectly in order to try to restore ***'s reputation in the area. This business was *** and dishonest.

MS. IS UP SET BECAUSE THE PROJECT TAKE LONGER THAN EXPECTED DUE TO RAIN AND MOST OF THE PIERS WENT DEEPER THAN THE BASE DEPTH OF 21'. THIS CAN HAPPEN AS WE NEVER KNOW FROM HOME TO HOME, HOW DEEP THE PIERS WILL GO AHEAD OF TIME. THIS IS A GUESS AT BEST UNTIL PRODUCTION. THESE DEPTH CLAUSES ARE ON THE FRONT OF THE SERVICE PLAN IN PLANE SITE AND INITIALED BY THE OWNER AT TIME OF SIGNING, SO THERE IS NOTHING HIDDEN OR DISHONEST ABOUT IT. THIS IS CALLED DEPTH CLAUSE AND ALL PIERING CONTRACTORS USE A FORM OF IT AS WE DO NOT HAVE EX-RAY VISION TO TELL HOW DEEP EACH PIER MIGHT GO. AS FAR AS THE WARRANTY, ***. DOES NOT HAVE A WARRANTY. THE WARRANTIES AVAILABLE ARE HONORED BY GIBBS COMPANY'S INC. DBA *** OF MID MISSOURI AND *** WHICH IS DESIGNED TO HAVE THE FUNDS IN PLACE TO SERVICE THE CUSTOMERS WARRANTY IF GIBBS WAS TO GO OUT OF BUSINESS. ***'S INSTALLATION WAS UPGRADED TO A BETTER PRODUCT WHICH INCLUDED A 25 YEAR MANUFACTURERS WARRANTY AND THE GIBBS WARRANTY. THE WARRANTY THE *** WANTED TO REGISTER WAS FOR THE TRUST AND *** PRODUCT ONLY SO WOULD NOT BE VALID. WE HAVE NEVER BEEN CONTACT BY *** ABOUT ANY GRADING PROBLEMS HOWEVER WE HAVE BEEN CONTACT BY THERE REALTOR TO RESUPPLY PAPERWORK THAT *** HAD LOST FOR A NEW BUYER OF THE PROPERTY. AS FAR AS A NEW FRANCHISEE, *** PRODUCT WAS NOT USED SO NO *** FRANCHISEE WOULD SERVICE IT ANYWAY. THAT WHY WE PROVIDED THE NEW AND CORRECT WARRANTY DOCUMENTATION, AS WE ARE THE INSTALLING DEALER OF THE NEW PRODUCT. AS FAR AS BEING DISHONEST, EVERYTHING *** IS SAYING IS IN PLAIN ENGLISH (NOT SMALL PRINT) ON THE CONTRACT AND SERVICE PLAN THEY SIGNED. I BELIEVE THAT IS AS UP FRONT AS A BUSINESS CAN BE. AT THIS POINT, IF THE PROPERTY WAS SOLD AS WE WERE TOLD, THE WARRANTY WAS NEVER PASSED ON TO THE NEW OWNER BY THE SELLER WHICH IS NOT BEING HONEST WITH THE BUYER AS WE HAVE NO IDEA WHO THAT MIGHT BE AND CAN'T HONOR A WARRANTY TO SOMEONE THAT WE DON'T EVEN KNOW EXISTS.

As has been the norm with Gibbs Company, the information in his response is untrue. *** corporate has taken over our warranty because of the poor performance of Gibbs Company. *** transferred the warranty to the new owners of the property and they did so without charging the ransom Gibbs planned to charge. All of this information is verifiable through the closing documents. This company is no longer a franchisee of ***, and the corrections to the grading are being completed by the new owners of the franchise. Our realtor made repeated attempts to contact Gibbs about this but received no response or acknowledgement.

The work was very slow and unprofessional. It was suppose to be a 3 month project and took 5 months because of constant turnover in employees and no one showing up. Constant new employees that damaged our siding,gutters,concrete. It took 1 year for them to come back and fix things and then they damaged more in the process. We finally asked them to leave and we would fix the rest ourselves. I would not recommend this company.

Mrs. is correct about some of the things that happened and we have had a hard time finding new employees to train properly to return to any job. We are constantly working to find new trainable people to solve this situation. That being said part of the one year period was waiting for Mrs. Johnson to pay for completed work. I was told she was going through a financing situation however she would not respond to us about any kind of progress towards payment. Then when I did hear she wanted more work done and continually adding more to the punch list. Then we had days that she did not want us there unless she was around. This turned into a very difficult situation for both parties but I can say we have grown from it. We now have policies and procedures in place to prevent this from happening again.

I contracted with *** of Mid Missouri on 6/21/18 to perform Poly jacking at my house, under the driveway. They took a 501.33 dollar deposit, and promised to perform the work within 2 weeks. I have called 5 times since then, but have received no timeline about when the work would be done. Every time, the person who picks up the phone informs me that *** would call me back or write an e-mail to me, but nothing happens. Randy Gibbs never comes on the phone - he is either out of town or busy somewhere.

Do to no fault of our own. Our equipment is down and being repaired right now but he wants his money back so we are returning it and settles the contract.
