I am submitting this correspondence because I am unhappy with the services provided by GMAC. Now a subsidery of [redacted] and I want to register a complaint and get someone to give me a resolution to my problem. Here are the details of my complaint, as brief as I can make it.

I initiated two HARP refinance applications for my elderly parents in November 2012. I submitted all of the information for the two properties on the same day to [redacted]. All of the information was the same for both properties. One property closed in a relatively short period of time. My father has Alzheimer's Disease and my mother was allowed to sign for him during the closing of the first property, because of the various legal documents that were in place (power of attorney, healthcare directives, ETC.) The second property; GMAC loan [redacted] got delayed for unknown reasons. They requested additional documentation from his personal physician, that they didn't ask for with the first loan, which was submitted at the same time. A lawyer called me Friday Feb 15, 2013 and told me that he couldn't allow the loan to go forward because my mother has a general power of attorney and a living trust and according to him those two instruments couldn't be in place at the same time. I pointed out to him that they were in place when they authorized the refinance of the first property and he said "we made a mistake". "It is not my job to give you legal advice. I advise you talk to a laywer. I asked him to send me a written correspondence of his legal opinion, so I would have something to show my attorney, and he agreed he would. He never sent any written justification for his legal opinion or any other correspondence. I spoke to a my attorney Monday February 18, 2013. She drew up the papers to remove the property from the trust, since that was the apparent stumbling block, and filed them with the court February 20th. I contacted the loan processor [redacted] email [redacted] to let her know that the property was no longer in a trust, so that we could proceed with the refinance and I have sent her several emails in regard to this transaction since that time, with no reply. I did however receive a call Friday Mar 1, 2013, from the Lawyer who called me with his legal opinion on February 15, 2013 and he said that he had canceled my loan application. "You need to start the process all over again". I asked him why he canceled the application and he couldn't give me a good reason. I told him that his actions were unaceptable and I needed him to reactivate the application. He said he would talk to his law partners and call me back Monday Mar 4th, 2013. He never called back. The GMAC website and letters stated they would honor all refinance applications that were in process February and the Title company [redacted] said that they had cleared the title [redacted]. There has to be some oversight for this process. Who is it and how do I access that consumer help? I am requesting help please.

I am rejecting this response because: [redacted] correspondence is factually incorrect. My mother is married to a retired career military serviceman. The marriage would not have survived during numerous overseas deployments, if she had not had a Healthcare directive and a durable general power of attorney, which entitled her to sign for my father and conduct the family business. We made this document available to both GMAC and [redacted] company. Neither GMAC nor the title company brought this up as an issue. That is why I am pushing this issue so hard. My parents did everything they were asked to do. over a 4 month period. They provided all of the documentation that was requested of them, yet they were denied a loan they were qualified for, and that had been promised to them if they met the qualificatons. They didn't even receive the courtesy of a letter of explanation. I will FAX the durable general power of attorney over to [redacted] office today 3/28/2013. I am pleading with [redacted] to quit looking for technicalities and excuses for why GMAC didn't follow through with their committment to fund the home refinance loan; and escalate this complaint to the administrators and individuals who have the authority to correct the error.

They have removed all my past bills from their website so I can no longer access those. I also call their number and they tell me they can not help but someone will call me back that can. Review: They are incorrectly reporting information on my credit report stating that my past account was paid for less than the full balance when it was a mortgage refinance with another lender. My credit essentially is showing I had a short sale when I did not sell my house, and I am still living there, I just have a different mortgage company now.Desired Settlement: Remove this incorrect information from all the credit reporting agency's since this was a refinance between banks.

Review: In 2006 my wife and I filed chapter 13 bankruptcy. At the time we had a mortgage loan with GMAC that we did not include in the bankruptcy. We have keep the loan current and have not missed a payment to date. GMAC is reporting to the creidit bereau that this loan was included in bankruptcy. I have contacted them as well as the credit berearu several times trying to resolve this matter. Every dispute filed with the credit bereau gets a response saying that GMAC has verified that the information is being reported correctly. This is incorrect, this loan was not included in bankrupcty.Desired Settlement: I would like the GMAC to stop reporting that this loan was included in Bankruptcy. And give credit bereau permission to remove prior incorrect information

This letter is in response to correspondence received by Ocwen Loan Servicing, LLC (Ocwen) on August 30, 2013 from your office. Specifically, this is regarding the Greens’ concerns surrounding the credit reporting on the above-referenced account.

When bankruptcy is filed by a customer the account will be reported to the credit bureaus as a bankruptcy account, regardless if the customer included the loan in the bankruptcy or not. Filing bankruptcy affects all debts tied to the filing party(s)’s social security number(s). The credit bureaus are notified of the bankruptcy filing and which chapter has been filed.

While in bankruptcy, Ocwen will continue to report the credit to the bureaus in the same manner that all other loans are reported. Bankruptcy information will remain on a consumer's credit report for 7 years after a chapter 13 bankruptcy.

Review: GMAC Mortgage, my new loan lender after refinancing my property located within the [redacted], failed to notify me and without my knowledge or consent sent to [redacted] Law firm located at [redacted], $7,197.53 based on the law firm's claim that I owed that amount for past due condominium association fees. This is not true.

This came to my attention for the first time, when I received a letter from GMAC Mortgage dated February 13, 2013 stating the following:

"Please be advised that $7,197 has been sent to [redacted] Attorneys At Law for the delinquent common expenses due to [redacted] Condominium association (#1), Corp. It was necessary for GMAC Mortgage, LLC, to forward this amount in order to prevent a action by the association for delinquent common expenses that would have jeopardized our lien position. As the common expenses are your responsibility, payment was made and will be charged to your account as an uncollected fee. If you have any questions concerning this matter, please call [redacted]"

The letter had not a signature but "Default Support Department, Mortgage Loan Servicing" at the bottom.

The same month, I received a letter from Ocwen Loan Servicing, LLC, [redacted], dated as of February 19, 2013 stating the following:

"We have not yet received your loan payment for this month. On 02/19/2013, a late fee of $30.51 was charged to your account. The total amount due is now $8,123.47, which may include additional unpaid items. Please pay this amount immediately to avoid additional fees".

The following month, I received a letter from Ocwen Loan Servicing, LLC, [redacted] dated March 19, 2013 stating the following:

"We have not yet received your loan payment for this month. On 03/19/2013, a late fee of $30.51 was charged to your account. The total amount due is now $8,153.98, which may include additional unpaid items. Please pay this amount immediately to avoid additional fees".

The phone number provided on both these letters is: [redacted].

I contacted Ocwen Loan Servicing, LLC twice since I received their last letter requesting payment. I requested that this amount, $8,153.98 be removed from my loan. I explained that neither GMAC Mortage nor Ocwen Loan Servicing, LLC had ever informed me of this action, nor did I give my consent to such action. I was reassured by the representative who took the calls that they had been documented and that Ocwen would contact [redacted] as well as my condominium association to inform them of my disputing their claim.

To this day, April 4, 2013, although I have requested updates in writing as to the status of my dispute, I have not been contacted neither by mail nor via phone.

Please I am requesting your collaboration as this I have researched and it looks like the three parties involced have acted in bad faith for the purpose to gain a profit illegaly and without any proof for forclosure rescue scam. I am a victim of their unlawful actions and I am requesting your help in this matter.

[redacted] collected from GMAC $ 7,197.53, without informing me nor with my consent from GMAC, prior to 2/25/13 which is the date the Superior Court at the Judicial District of [redacted], located at [redacted], issued a notice stating that ..I quote " the Plaintiff's motion for default for failure to appear (102.00) is DENIED for improper service of process. Notice sent 2/25/13 by [redacted] (T.A.C). Docket number : [redacted].

The first, and only, letter I received from GMAC, which was dated 2/13/13 to inform me of their decision to disimburse to [redacted] the amount stated above, without my previous knowledge ior consent, is dated as of 2/13/13, long before the Superior Court issued letter of DENIAL of the Plaintiff's motion for improper service of process.

Subsequently, the letter I received from OCWEN, which is dated as of 2/19/13 requesting payment of $8,123.47, approximately 1,000 over the initial amount requested by GMAC, is dated as of 2/19/13. Where do the $1,000 difference come from???? Again, this letter was sent to me prior to the 2/25/13 Superior Court noticed issued DENYING the Plaintiff's motion.

I am requesting that this be investigated as the amount I owed to [redacted] Condominium Association was $1,200. The Association charges a late fee of $35.00 if fees are not received prior to the 15th of the month. However, the Association failed to cash four months worths of condo fees, which I forwarded on time, hung on t four of my checks for the months of March, April, May and June of 2012 and cashed them in August of 2012 from [redacted]. This is the reason I was not able to pay for July, August, September and October of 2012 as their delayed procesing caused my account with [redacted] to go under by approximately $700....as during the almost eight (8) years I have resided in this complex, my checks were clearedon a monthly basis. However, the Association failed to follow through, although they charge a $35 dollar fee when condo fees are not paid prior to the 15th of each month. They hung on to four of my checks for 5 months prior to cashing them.

I contacted [redacted] and explained the situation. However, he refused to accept my offer to pay $50.00 per month starting in January, 2012 towards the $1,200 overdue fees.

I reiterate, The court denied their motion. I am requesting for you to reconsider this infraction and remove the $8,153.98 from my loan.
