Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.I do understand that they stick to the business agreement and it was a mistake on my part to have not read the full contract but at the same time they cannot have their employe make falls promises and services that they cannot provideThey main reason for me to have joined Gold's Gym is that they said they had a Racquetball CourtIt was purely because of this reason that we decided to join the gymI was willing to accept the carelessness on my end for the day money back program (which was actually their fault) but the lack of service which they promised is not acceptableAt this point, I would like them to deduct the monthly membership for the past months and reimburse the remainingIt's been extremely discouraging for me to go to Gold's gym because of the treatment that I have received from themThey need to honor their verbal agreement as well if they are going by the contractThey should not be allowed to do business if they feel that they can lie to the customers day in and out and then fool them into joining their facilityBusiness ethics is something that they need to follow Regards, [redacted] ***

Dear Mr [redacted] , After reviewing the account, the billing company is indeed stating they did not receive a cancellation request The agreement specifically states to send request via certified mail, this requirement is to protect the consumer and to avoid these exact situations It is impossible to take action on a request we never received The billing company did inform you if you can provide the receipt for the certified mail we can proceed from there.This is in no way an attempt to "scam" you out of your money We will be more than happy to process the cancellation request as soon as we actually receive itThank you

On February 10, Gold's Gym Houston entered into a Member Transfer Agreement with [redacted] [redacted] Houston was closing their Barker Cypress location and this agreement provided the Blast members the opportunity to continue working out without interruption Notification concerning the transfer of the memberships to Gold's Gym was [redacted] 's responsibility It is understandable that not all members were immediately aware of the transfer and while some appreciated the opportunity provided by Gold's, it did not work for others [redacted] has the option to cancel her Gold's membership as requested Effective today, February 24, 2016, her membership has been cancelled with no further payments dueThank you

***'s complaint, the member should have received clearance from her doctor before signing the gym membershipThere is a Health Representations and Agreements clause the member has signed off stating the member represents and warrants they are in good physical condition and has no medical impairment that could prevent use of facilitiesThis paragraph also states the member acknowledges Gold's Gym has not given any medical advice before or after member joins the gymThe member is also acknowledging and agreeing to discuss any health or medical concerns with their physician or health professional before using Gold's Gym facilities. Per the *** Health Spa Act, all members have business days to cancel the agreement and receive a full refund if they disagree with the terms and conditions of the agreement they signed.
A member may cancel if they become totally and permanently disabled after the date the agreement was signedMember's are required to submit proof from their doctorThe Dr.'s note that was provided by the member, states *** is under the doctor's care and should avoid strenuous activity for one yearThis does not prove she has a permanent disability, therefore, her proof was not sufficient.
The member will have to contact *** *** *** to resolve her debt and cancelAttached is her gym membership and Personal Training membership for review.

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint I find this response to be utterly disrespectfulPlease find the attached second letter from a second physician that was provided to themI sent the original copy from my oncologist to their corporate office in ***, which was "never received." When I spoke to their onsite Manager, he told me that cancer which debilitated me from exercising did not qualify me from terminating their contract, which is contradictory to their contract(This is confirmed by the multiple veterans across the US who have filed suits against Gold's Gym after losing limbs and being sent to collections after failing to be able to terminate their contract due to medical necessity.) Because I did not want to be sent to collections, I gave my credit card information to the onsite manager to pay go on auto-pay for the remainder of my membership(Which is still utterly absurd!) Even after that, they charged my very valid credit card one time and sent me to collectionsSo, after it all, I provided them medical proof, on letter head TWICEClearly cancer at the age of which makes you go into cardiac arrhythmia while walking is not medically debilitating enough for those who have to squeeze out every pennyI gave up and paid the unethical crooks, told them to set me up on auto-pay, and they still sent me to collectionsEveryone knows someone who has been touched by cancer--I surely hope that they would not treat a loved one this way, because it's despicable.

In the agreement that was signed by *** *** and ***, it states you may cancel the agreement if the health spa goes out of business and does not provide facilities within miles of the facility in which you are enrolled or if the health spa moves miles from the facility in which you are enrolled.
Mr*** became a member of Gold's Gym due to the agreement that was signedThe cancellation policy is stated in the agreement and *** *** is able to assist member's with their cancellation requestsOn 2/19/16, the member and *** spoke and the member stated not to cancel the account yet.
*** *** *** is Gold's Gym's collection companyThrough *** *** ***, Gold's Gym offers an Amnesty program that allows a delinquent member in collections to take advantage of signing the Amnesty agreement and fulfilling those terms, in order to resolve their debtIt is an opportunity for the member to remain active and continue reaching the goals set in place when joining the gym as well as resolving their debt with *** *** ***.

Good afternoon, Per the agreement that was signed between Gold's Gym and *** ***, the member may cancel if they become totally and permanently disabled after the date the contract takes affectThe member must be able to provide proof from their doctor, on a letterhead, stating they've become permanently disabledThe member did not qualify to cancel per medical at the time of her requests because Gold's Gym did not receive sufficient proof from this member.
The member spoke with *** in June and to a club representative in August in regards to the cancellation and what needed to be provided in order to qualifyThe club was informed by the member that she was going to contact *** and take advantage of the $buyout option.
The member is responsible for the agreement that was signed and will need to contact *** *** *** to resolve the debt on file in order to cancelGold's Gym does stick to the terms and conditions that were signed by the memberAttached is the agreement and notes taken by the club representatives and by *** representatives for review

After reveiwing *** *** situation Gold's Gym has cancelled his Personal Training agreement and will be refunding him $ The refund includes the initial $downpayment and drafts of $each The refund will be in check form mailed to his current address and should be received within days Gold's Gym apologizes for the time and trouble this misunderstanding has caused *** *** Thank you

Gold's Gym is more than happy to work with Mr*** to improve his Gold's Gym experience Our offer to have him meet with a trainer to help get him started towards his fitness goals stands Gold's Gym apologizes for any misinformation or miscommunication but always stands by the agreement signed between Gold's Gym and the member The agreement is never between the member and Gold's Gym staff This is written in detail in the agreement:
