Still we have yet to speak with the consumer to fix the problems she is having with the company.  We have attempted to reach out in any way possible to contact the consumer to help.  Its obvious that she had no intentions to handle the situation and this is a ploy to avoid paying a legal debt.

This Complaint has been reviewed by management and has been found to be false.  The number is a correct extended line to the office, after checking the call recordings on this particular call in no way was the consumer violated.  No court date was EVER explained, in fact no mention of...

court was even involved.  This consumer has history through his bank checking account of taking out payday loans yet he claims does not recall taking out a payday loan.  Again, no mention of taking out a payday loan was even in the conversation yet the consumer miraculously explains in his statement that we called him in concern with a payday loan.  The collector stated he has a "LOAN" never once mentioning that it was a payday loan, so again the consumer appears to be famous for things like this.  Secondly, the consumer could have simply asked for upper management to formulate a complaint but instead contacts the Revdex.com.  We are positive that he wishes to simply get out of yet another payday loan that he has taken out by making yet another complaint in his history with the Revdex.com.  We will close his account here and send it back to client for we have no intentions of trying to work with someone as untruthful as Mr. [redacted] and his false statements.

There is no such debt owed from me at all. In fact it was not a debt that they were calling me at my employer about. They are saying there is a judgement against me for bank fraud and bouncing checks. And each time they identify themselves as being from my local States Attorney's office. I personally called myself over there and asked for said person and there is no such person that works there by that name and there is nothing on my file with any such charges. And since I have called there and also the Attorney General's office they have not called back since harrassing me. They were very ignorant and rude to my employer divulging personal information to them as to what they are calling for. If it was for a legit debt and not a scam then I certainly would have taken care of what I owed. Maybe they should tell you the address that they give is for a dentist office in that area. I am sure the dentist would like to know that!

Hello,        Management has gone over this complaint repeatedly to find ANY evidence of what this debtor has complained about and naturally we have found none.  On EACH recording the law has been followed to a "T" and of course in no way has this debtor made mention of...

PAYING her debt or how we have ALL information that came from HER own PERSONAL bank and 2 others she put down as references to take out loans.  Management has never talked to her husband and we have done all possible to bring resolution to someone who has NO intentions to pay her debts.  For every complaint we have a ratio of people we have helped to responsibly pay their debts.  We have NO intentions of entertaining this slandering complaint to a reputable company.  If she wishes to contact the office management that we may assist her in getting to the bottom of her complaint we will help and take ALL necessary steps to assure we continue to help and offer the best in customer service from the voices you do not hear on this site or others like it.  When a company deals in debt naturally we must deal with these situations as well.

This company is a scam and they took 600 from us. I know they are a scam because they would not give me their address when asked and the number they called from first was no longer active they said they were transferring me to the payment department but they never transferred someone else...

just picked up the phone when I asked for proof of the debt they would not give me any and when I called back after I told them I know they are a scam they hung up and quit answering the phone. Hello Reader, firstly no one "Took" Anything from anyone.  The DEBTOR WILLINGLY paid her bill like a responsible adult.  The address is on the email the consumer received which is and always has been 8701 Buffalo ave, Niagara Falls NY 14304 and the phone number at 877-216-0745? So where is there a scam and anything to hide.  This is just a debtor who paid their bill and realized it left them too little money to scam another creditor out of money.  No one in this office will EVER refuse to give account information.  So try another one or just keep this lie going.

I am responding to the  company's offensive...

response to my complaint. Their response calls my complaint slanderous,  however, I have recorded messages proving their illegal tactics, so no slander is involved other than on that company's part. I also requested verification of the debt and the company refused, therefore stating I am avoiding a debt owed is slanderous. I want a written validation and until they can provide that I want no contact from this company utilizing illegal collection practices and untrue threats to scam money.

RE: This business called my mothers home in Spokane, Wa. Leaving a message for me in my maiden name. They called from number [redacted] and stated they were serving me with a summons or affidavit today at 4pm, and I needed to be there or there would be "consequences". This same caller then called...

my brother in Seattle, Wa, relaying the same information. I called the number back and spoke to "Yolanda". I asked the name of the business and was told Goldstein, Cruz and Smith and a callback number was [redacted]. I stated I needed to know the nature of their call so I could file a police report. She became agitated and referred me to another worker. This worker was also agitated and asked me to provide my social security number so they could confirm it was me. I refused and she then hung up on me. This is a scam.Hello Consumer, Our records indicate the consumer [redacted] (The Assumed Name when a payday loan was taken out, verified by drivers ID, SSN [redacted] and reference infomation which was the mother) was contacted by the office of Goldstein Cruise and Smith on 7/23/15 for the first time.  Of course in the complaint the facts were scrambled to the favor of the consumer.  The mother's information was put down with the consumers bare hands as reference to take out the loan, threatening the police because she was called about a legally owed loan is a common scare tactic professional debtors use.  We stay well within the laws we are governed by and are subject to such scare tactics as threatening the Revdex.com and Police.  If the consumer had requested to be contacted in any way other than phone, this would have be done. This complaint comes the next day after contact giving no opportunity to oblige to the needs or requests of the consumer.  We cannot give out a consumers SSN so as any business we request the last 4 digits as can be seen above we already are in possession of the entire SSN.  This complaint has been fielded by management and we will do all we can to assure that we can resolve this.  Thank You

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I would like to have a copy of said recording which they state they don't mention a court date but who did I come up with the date out of thin air.  In addition, they state "a loan" and I have a history of writing bad checks, which is a lie.  They also mentioned specifically that I had a payday loan.  They make claims that I am untruthful, I'd like to hear a copy of the recording as proof that I am untruthful.  In addition I should mention that I have worked for a government agency in which homeland security clearance was needed.  If I was "untruthful" I wouldn't have been employed there.My request is for the company to supply the recording of the call. I'd also like proof that they are a properly licensed Collections agency.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.The company was asked on May 27th to cease calls to my mother-n-law during both calls made to me that day.  As you can see in the attachment, I requested twice proof of the debt and what I received was an original email from a gmail account with misspelled words.  A reputable company that truly owns a debt would provide the date loan was taken out, signed agreement, etc.  As you can see by the attached, that it not what I was provided.  I have stated on multiple calls that if I truly owe the debt, I would pay it but first required proof before giving out my payment information.  As of today, I have not received the proper documentation.Regarding slandering their name with the Revdex.com, they already have an F on the Revdex.com website and it had the company flagged, so I by no means have  slandered them.  It would appear their reputation has spoken for itself.    Regards,

I reviewed this response and find it pathetic. I saved the message from this "collection agency" and it does indeed say that I am going to be served at my mothers home that day at 4pm. That is a illegal business tactic used by corrupt collection agencies, especially considering this "business" has already acknowledged that it was the FIRST time they had contacted me, so there would obviously be no reason for the threat of serving official papers. I can recall no payday loan taken out EVER in my maiden name of [redacted]. This business has violated my consumer rights:
Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don’t have an attorney, a collector may contact other people – but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.
What does the debt collector have to tell me about the debt?
Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.
What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
•use threats of violence or harm;
•publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
•use obscene or profane language; or
•repeatedly use the phone to annoy someone.
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
•falsely claim that they are attorneys or government representatives;
•falsely claim that you have committed a crime;
•falsely represent that they operate or work for a credit reporting company;
•misrepresent the amount you owe;
•indicate that papers they send you are legal forms if they aren’t; or
•indicate that papers they send to you aren’t legal forms if they are.
Debt collectors also are prohibited from saying that:
•you will be arrested if you don’t pay your debt;
•they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
•legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action.
Debt collectors may not:
•give false credit information about you to anyone, including a credit reporting company;
•send you anything that looks like an official document from a court or government agency if it isn’t; or
•use a false company name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
•try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;
•deposit a post-dated check early;
•take or threaten to take your property unless it can be done legally; or
•contact you by postcard.
Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General’s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau. Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General’s office can help you determine your rights under your state’s law.

Again, We have no intentions of going around and around about the validity of a loan in which ALL information is correct for the consumer and always has been.  As well as past history of activity from the consumer.  We have closed the account and returned it to the creditor, we have no intentions of working with someone who does not want to help themselves. Thank You.

Hello,  This complaint has been reviewed by management and have come to terms with the fact that there is no reference of dates, names, phone numbers or any other information to try and put together a better understanding of how to handle this complaint.  Simply asking for management is...

the best way to get all complaints answered in that particular conversation.  Naturally we are well within the law to contact a person in concern with a debt that is owed and no evidence supports the fact that ANY number that the consumer has been contacted at is an employer or that any personal information has been divulged.  All this complaint seems to be is the act of someone trying to get a reputable company to stop calling in concern with a debt they owe which is popular among people simply avoiding paying their debts.  We will take this as a formal cease and desist and not contact the consumer again to leave him to clearing up his debt one day.Thank You

"The debt was not known until contact was made. Never heard of the company or bank (whichever it is). All that was asked for is documents of proof of debt (original and official documents that indicate original lender name and signed contract mailed).  It wasn't even on credit report.  They made it sound like I was stalling or unwilling to pay a debt.  No personal information should be given out until there's proof of debt.  Especially one you did not know of.Apparently there's a company rule not to mail things out because people tend to say they didn't receive it.  That contradicts with what was said the first conversation.  Also was said that they don't need it.Felt like they were not listening or didn't even care. To say I was trying to stall or avoid this was enough.  All because I want official documents/contract to prove something that I didn't know exist. "

RE: Started receiving threatening calls about 2 month's ago in regards to an unpaid payday loan. They called multiple people in our family and continue to call my mother-n-law even though they were notified she had a heart attack and I went to the website on the voicemail and removed her number....

They started threatening us with check fraud due to the payday loan remaining unpaid. They call from multiple numbers at various times of the day. I have requested twice proof of the debt be emailed to me and what I got was an email from a Michael C[redacted] gmail account with a bunch of rambling about validation of the debt but no attachment. They hijacked a line for [redacted] County Clerk's fax number to make it look like they were calling from [redacted] County court and said they were on their way to serve me but I could call the number before being served to make a payment. I have told them to serve me with the papers as I did not feel the debt was valid or they would have already sent me what I requested. A legit business would have a legit email address and would be able to provoide proof of the debt they are collecting on. I have also contacted [redacted] County Clerks and they did not have anyone by the name of the process server who hijacked the fax line. When the business was confronted they acted offended by what I said but couldn't provide an explanation on how she called from a fax line, just offered to set up an arrangement using my debit card.Hello,  Firstly let it be known to the consumer that management is looking into this issue diligently as we pride ourselves on customer service and fielding all complaints.  However, at the present point calls to be assumed threatening when a person owes a legally viable debt is outstanding.  When information is not updated to the creditor calling others to reach the debtor is well within the law.  It was NEVER explained to the staff that any one person was not to be called.  All recording in concern with this consumer have been listened to and this is a lie.  Now the issue with the checking account however was brought up and the words check fraud were never used. However the debtor knows PERFECTLY well and did use the checking account to assume the loan with FULL intentions to defraud the client of the loan which still to this day is being avoided.  Proof of debt has been given and still no progress on repaying a debt owed.  In this complaint not one mention of paying the bill has been made.   Secondly, it is not possible to the knowledge of professionals we contacted to "Hijack" a phone line, so this again is a lie.  So in closing we do understand the complaint and as can be seen in this document we field ALL complaints in a timely fashion.  However, we are not going to be bullied or slandered to the Revdex.com or any other institution by a disgruntled consumer who has no intentions to pay a debt they know they owe and deliberately are avoiding.  Thank YouGOLDSTEIN CRUISE AND SMITH STAFF
