Dear Sir or Madam,We made contact with this client immediately upon receiving her response to the Revdex.com We will save disputing each and every statement, but we do st***gly feel that many of the statements made are not only one sided, but untrue We are working to find optional mold remediation products that the client will accept since she refuses to let us use the one recommended and that is commonly used in this type of situation It should be noted that the proposed product to be used is the one specifically asked for by the client, and now she will not allow us to use it We have mutually agreed that any questions or discussion regarding potential compensation is not warranted until we have come to an agreed upon resolution to her mold concerns We still maintain that years is an unacceptable mold warranty when we have no control over or envi***ment inside the building during this timeframe We are fully aware that this building will be used for animal confinement, as well as calving operations, and those conditions are not conducive to maintaining a dry envi***ment As discussed with this client, we will continue to work with her to rectify and remedy her issues and concerns to the best of our ability, and we are to speak again at the end of the week to discuss additional options for remediation [redacted] General Manager of Operations, Western Division

This response is in regards to Cleary Building Corporation not wanting to work this mold problem out in a safe or professional mannerFirst, we do not want our animals subjected to chemicals subjected to chemicals that are clearly stated on the bottle that it is known to cause cancer Cleary Corporation has no regard to letting one of their employees apply this chemical by hand spraying it on to the wood frame of the building They have tried this method before, and it didn’t work There is no way that they can completely spray the wood on both sides This building is 104’ long and 36’ wide There is tin covering the wood, and you cannot get to the mold on the backside In order to be sure that all the mold gets treated and killed is to encapsulate the building with plastic and treat the wood There are professional people who can perform this service and know what they are doing To ask one or two of your building employees to take on this dangerous and risky undertaking tells me that you don’t care about their exposure to cancer causing chemicals Well, we care about them and our cows and calves Cleary Corporation is a self-serving business with a long history of unsatisfied customers They claim that the customer matters but only want to do things their way That’s not how it’s supposed to be If there is a problem due to their negligence then they should do the right thing (the right way) to fix it; not put a Band-Aid on it and call it good In fact, they are claiming that we requested a specific mold inhibiting spray, but the truth is that we didn’t Cleary Corpis the one who chose this product and showed up to apply it without consulting us first This problem would never have happened if they would have listed to us and insisted on bringing the building materials to our farm We had specifically requested that they wait on delivering the building supplies until the weather was forecasted to be drier They didn’t listen, and now there is a bigger problem with black mold Their only concern is to get as many buildings made, delivered, and paid for so they can make a lot of money As soon as the last payment is made the customer is forgotten Cleary Corporation knows that there is a big mold problem and refuses to fix it in a safe and professional manner Why can’t they just do the right thing and get it done? I guess they are worried about losing money and not the safety and well-being of their customers, employees and our animals We feel that they are a company with people who are hardened and comfortable treating their unhappy customers in a manner that threatens them with ultimatums We have tried to reason with them, but they refuse to listen I guess they are too busy to really pay attention to our request All they want to do is sell, sell, sell and move on Again, buyer BEWARE!!! Dear Sir or Madam,I have had the opportunity to review the information filed with your office by Mr [redacted] We are well aware of this situation at the corporate level as we have had multiple communications with the [redacted] 's over approximately the past month Mr [redacted] is very accurate in stating that there have been issues getting to the site and completing this project But the issues involve what has been the ongoing delay involving the site and the proper readiness of the site that would allow us to work safely and efficiently on the building site We did ship the project on or about November 10th, and have attempted to commence work on the project 4-times since, but due to muddy conditions and/or standing water on the site, as stated we have not been able to get on site to work efficiently or safely.We have been in regular communication with our client throughout, and will continue to do so At this point we are evaluating day to day to attempt to get on the site to work further on the project And the expectation now is that the recent colder temperatures will firm up the ground and we will be able to work on the site once againThank you[redacted] ***

We are in receipt of the E***’s latest post, and will address their concerns in bullet points below Cleary Building Corp did absolutely pay attention to the content of the complaint. We take each and every complaint very seriously, no matter how big or small. Customer service and satisfaction is the utmost priority, and we make every effort to not just meet, but exceed their expectations. We are not perfect, nor do we claim to be. The E***’s are correct that they signed a contract in July for a tentative erection date of October/November. There were still changes being made to the building via change order as late as October 3rd. As explained to all our clients, that tentative erection date (TED) represents a tentative date to start construction. Due to various delays outside of our control, construction commenced on December 14.They are in possession of an email that “he forwarded us”. That confidential information was not forwarded by me, but inadvertently by the branch manager. I have no issue with how important it is to us that we take care of our vendors. We have very stringent requirements to become an authorized sub-contractor for Cleary Building Corp, they are some of the best in the business, and they deserve to be taken care of. That said, I also know how hard our clients work for their money, and it is an honor and privilege each and every time they trust us to a project of theirs. Upon receipt of their first post, a region manager was dispatched immediately to the site to ensure that we were progressing to the E***’s satisfaction. We remain on site, and this project is scheduled to complete in the next 7 days. Again, we are not perfect, however we pride ourselves on righting what is wrong. heard from this client since that time. Dear Sir or Madam,Dear Sir or Madam, I am in receipt of the information filed with your office by Mr*** ***. I have had the opportunity to review this information with management at the division level that works with this branch office, and also discussed this matter with our
current Branch Manager.Reviewing the information, as well as the file involving this contract, it is apparent that Mr*** did not follow the warranty procedure, which states that if he has a warranty or service item he can contact the Corporate Office to ensure any service items are corrected promptly. I show no record of any contact from this client to the corporate office to address repair concerns. The manager he references in his complaint, "***" has not been with our company for months so I am unable to verify what, if anything, was ever discussedIn regards to the comment that he has talked to "***" the manager, Mr*** did speak to *** *** per my discussion with Mr***. But in that discussion he was not asking for warranty work to be performed, he was demanding monetary compensation since Mr*** had already done specific inside work on his building. Which we are not in agreement with compensating him an arbitrary amount for any alleged repairs. Namely due to the fact that if the terms of the warranty were followed properly, we would have executed the service work promptly. We are in in receipt of MrE***’s post, and have worked directly with him on his concerns and issuesThe original contract was signed with a tentative erection date of October/November. As explained to all of our clients, that is a tentative date to start erection, not a date to
complete. Owner sign off plans were reviewed in September, concrete was poured in October, and the job was taken off hold allowing materials to be ordered shortly after that. We have experienced some minor weather and crew delays this fall, but nothing outside of construction related conditions. As explained to MrE***, his building has been delivered, his concrete is complete, and a crew is to arrive at some point today (Tuesday 12/13) to begin erection. We sincerely apologize for the delay, but again they are not outside any scope of construction, and are committed to completing MrE***’s building in a timely manner Ron K*** General Manager of Operations, Western Division

I don't know what specific date he is referring to, there have been so many dates that the crew has not shown up to work! My favorite was the day that the Safety Inspector from Cleary showed up but there was no crew working so obviously there was no one to inspectThe crew did actually show up and work some this week; part of Monday, all day Tuesday and Wednesday and then couple of hours ThursdayThe crew continues to use my wheelbarrow and pails, funny I thought they were supposed to bring their own equipment (?) I would have appreciated it if they would at least ask before they just use things that don't belong to themI will continue to keep my skidloader up by the house, just so the crew doesn't get the idea that they can use my bucket again. I truly do wish I had a feeling that I could trust this company, but it just isn't possibleThe building was supposed to be done in November and it was notThe crew tells me that they went to work on or other jobs when they knew they should have been working hereI believe them, because they have no reason to lie and they knew this site was ready and workableToo bad the company waited until after all the rain to send them hereUltimately I will end up with a barn that I will not be able to use this winter as intendedMy electrician won't be able to run the electric lines and I certainly won't be able to get a water line run, so it will be just an useable barnDue to the prior wet conditions, they wouldn't even send the crew to work unless we put down gravelObviously they know nothing about livestock, gravel is the last thing you want on the floor of a sheep barn, but it's all about what they need with no regard for what I need or want.Nice Job Cleary, so glad I put my trust (and money) on you!

Mr*** did come out and take pictures of the dented metal and the metal not fitting correctly, he took it back to corporate office.I got a phone call from them and *** did tell me cleary will not ever refund money what so ever, so I told them to come out and replace the metal then and he said that's not a option eitherNow I did foam by building and cleary knew about this when the building was first put up, as everyone can read this they will understand why I continued with finishing my building cause waiting on cleary would take years until hopefully I would just drop the issueSo *** said and by the way he is no longer employed with them like many others that Iv dealt with*** did say we will still carry warranty on the rest of the building just not what is wrong with it nowCleary is only concerned with one thing and that is there money and the clover on the buildingCleary I don't understand why you will not do the right thing for onceI'm asking for a $1,if they would replace the metal and labor it would cost them around $3,with out dealing with spray foam, I got a quote from another companySo I feel I'm being very fair and more than pantient with themSo cleary is sending anther guy out two days from now to speak with meWe will see what kind of stuff they are willing to say nowI have been advised to document everything that is said for further contact with cleary

We have been, and continue to be in contact with this client in attempts to resolve their mold issues and concerns. We have applied one treatment of remediation, and stand ready to do so again with approval from the client We have provided details and specifications of the product that
we use, it is well above acceptable industry standard, and is specifically designed to remediate mold, and ensure it does not return. This “apply and leave on” product also is designed to remove stains from wood caused by mold. Though not necessary, we have even offered a one year warranty on this treatment, however the client is insistent on a five year mold warranty. Five years is not acceptable as we have no way of knowing how this building will be used in the future, and too many variables if used in certain ways without proper ventilation could cause mold issues beyond our controlWe also find no grounds or basis for a $credit for “Flawed cosmetic appearance” that this client claims. We are confident that if they would allow us to remediate the mold and stain issues as we have described to them in communication Friday 7/15/2016, the mold issue would be rectified, as would a vast majority, if not all of the staining on the wood This client refuses to let us do any further on their building unless we agree to their requested five year warranty, and that is not acceptable for reasons stated aboveWe will continue to follow up with our client to attempt to resolve any open issues. Dear Sir Or Madam,We are in receipt of the recent information posted by Mr***. I am not clear as to what exactly occurred in our recent site inspection with Mr***. Our representative was to meet with Mr***, inspect the building, offer that we would resolve any steel panels that were not acceptable to industry standards, thus solving the situation. It was reported to our Divisional General Manager that Mr*** wanted to decide what his best option would be, but we also communicated that we would not pay monies as an offset for the service work. We were informed that the context of the meeting did not leave the situation open ended and that we would not solve the service issues. It appears that there was some type of communication breakdown in the exchange at this meeting. We will now attempt to schedule another site meeting with a Cleary management representative and Mr*** to review all open items and resolve any pending issues.
