Grand Rapids Painting Reviews (31)

Dear Sir or Madam,I have had the opportunity to investigate this situation.    I have since had our [redacted] inspect the building and the facts are that there are still leaks, and we have qualified the repair properly.     I expect that the ridge of the...

building will be properly repaired prior to 9/4/15.  During my review of the file I do not see that we have done "a dozen repairs", but we certainly have been there multiple [redacted]es in attempts to resolve this issue.   Which is what we need to do to provide the client with a building that meets his and our expectations.    If there are further questions I can be reached at ###-###-####.   Thank you.[redacted]Cleary Building Corp.

Dear Sir or Madam,We made contact with this client immediately upon receiving her response to the Revdex.com.  We will save disputing each and every statement, but we do st[redacted]gly feel that many of the statements made are not only one sided, but untrue.  We are working to find optional mold remediation products that the client will accept since she refuses to let us use the one recommended and that is commonly used in this type of situation.  It should be noted that the proposed product to be used is the one specifically asked for by the client, and now she will not allow us to use it.  We have mutually agreed that any questions or discussion regarding potential compensation is not warranted until we have come to an agreed upon resolution to her mold concerns.  We still maintain that 5 years is an unacceptable mold warranty when we have no control over or envi[redacted]ment inside the building during this timeframe.  We are fully aware that this building will be used for animal confinement, as well as calving operations, and those conditions are not conducive to maintaining a dry envi[redacted]ment.  As discussed with this client, we will continue to work with her to rectify and remedy her issues and concerns to the best of our ability, and we are to speak again at the end of the week to discuss additional options for remediation.  [redacted]General Manager of Operations, Western Division

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
After reviewing, we reject the response from Cleary. There are several inaccurate facts stated that we are able to document in the response back to my initial complaint.
Regards,
[redacted]

First of all, the complaint came from MRS. E[redacted], not Mr., which makes us think Cleary didn't pay any attention to the content of the complaint.  We signed our contract in July of 2016 and were told by our salesman that if we would go ahead and commit and put down 20% by August 1, we were guaranteed a construction time in October.  He even looked at his construction schedule on the wall, and said we will be on the October schedule.  Maybe it's not Cleary Corp. as much as it is the salesman who is not being honest with us?  Yes, concrete was poured in October, and we were again told by the salesman he was working on a crew to be there late October.  The response from Cleary to my complaint states the job was taken off hold shortly after the concrete was poured.  Yes, our materials were FINALLY delivered Monday December 12.  The stickers on the boxes say the job was processed November 21.  The crew showed up Wednesday December 13, in the afternoon.  Didn't see much progress.  Thursday they were back and began framing.  Friday, it was cold and wet, they showed up for a very short time and left for Christmas vacation.  We are told they will return the week after Christmas.  In the meantime, our materials are sitting out in the weather, including open boxes of nails and screws, as well as all the lumber, doors and windows.  What we are most upset about is that we feel like we have been continuously lied to about starting dates, and excuses for everything...the crew quit, someone broke his arm, the weather..and on and on from our salesman.  We are in possession of texts and emails from him containing his broken promises.  We also are in possession of an email which he forwarded to us (surely by mistake) containing comments from Ron Kempkers regarding TJ Construction and some information regarding the "Koster" job.  Please let Mr. Kempkers know that we also work hard for our money and we deserve respect from Cleary, just like the subs..  "Give this the urgency it deserves, get me the document required, and let’s get this sub taken care of.  He has earned it, he deserves it, and it is up to us to take care of our team." - Ron K[redacted] E[redacted] I have a real problem with.  When you were at MBA, we had several discussions about urgency and expectation.  It is very disappointing that you have a sub crying out for help, desperate for money, let we leave the resolution in the fate of an email to the client, and his discretion as to when he returns a vital document to    you.  He has a home, he has a place of work, and we should be on his doorstep to get what is needed to take care of our sub.  Give this the urgency it deserves, get me the document required, and let’s get this sub taken care of.  He has earned it, he deserves it, and it is up to us to take care of our team.

We are in receipt of the E[redacted]’s latest post, and will address their concerns in bullet points below   Cleary Building Corp did absolutely pay attention to the content of the complaint.  We take each and every complaint very seriously, no matter how big or small.  Customer service and satisfaction is the utmost priority, and we make every effort to not just meet, but exceed their expectations.  We are not perfect, nor do we claim to be.  The E[redacted]’s are correct that they signed a contract in July for a tentative erection date of October/November.  There were still changes being made to the building via change order as late as October 3rd.  As explained to all our clients, that tentative erection date (TED) represents a tentative date to start construction.  Due to various delays outside of our control, construction commenced on December 14.They are in possession of an email that “he forwarded us”.   That confidential information was not forwarded by me, but inadvertently by the branch manager.  I have no issue with how important it is to us that we take care of our vendors.  We have very stringent requirements to become an authorized sub-contractor for Cleary Building Corp, they are some of the best in the business, and they deserve to be taken care of.  That said, I also know how hard our clients work for their money, and it is an honor and privilege each and every time they trust us to a project of theirs. Upon receipt of their first post, a region manager was dispatched immediately to the site to ensure that we were progressing to the E[redacted]’s satisfaction.  We remain on site, and this project is scheduled to complete in the next 7 days.  Again, we are not perfect, however we pride ourselves on righting what is wrong.  We will continue to work tirelessly on this project for the E[redacted]’s until it is complete.   Respectfully,       Ron Kempkers General Manager of Operations, Western Division

The purpose of this response is to ensure we have explained our numerous offers and solutions thoroughly in a final attempt to resolve this customer’s issues and concerns amicably.  To date, none of our proposed resolutions end up acceptable to this client, and we feel st[redacted]gly that her solution is neither necessary nor warranted.   In review, her issue is a concern for black surface mold on some of the wood that was used to erect her building.  When first reported, a team was dispatched, the lumber was power washed, and one round of treatment was applied to specific affected areas for remediation.  She then notified us that this did not cure the entire problem to her satisfaction, so we began dialog as to possible solutions.  Despite my many attempts to provide solutions to resolve the remaining mold in her building, she has chosen to decline any offer by us to treat and remediate any more mold that may remain.  Her position has been first this was going to be dangerous to her animals, so we offered to use plastic to cover the ground.  Then she felt it was too dangerous to the health of our work force, so we offered to provide them protective gear for this application.  Despite the addressing her concerns thru the use of plastic to protect the ground, and protective gear for the employees, she still refuses to accept this as a solution.  She also refuses to let us take any sheets off of the building to inspect or possibly replace wood on the structure (despite no evidence of mold in this location) for fear of compromising the structures integrity.  We have confirmed this will have no structural effect and is well within normal industry practice.  She has stood firm that she believes a professional company must be brought in, the building must be sealed off, and remediation must take place under those conditions while consistently monitoring air quality.  As we discussed with her in detail, we would agree with her position if this was an encapsulated space such as a residential basement, however in an open air building, this procedure is simply not warranted.  We stand ready to assist her with any mold issue she may have, but only within the necessary required scope of work for this type of issue, and within industry standards and guidelines.   Her position with the Revdex.com is that she is requesting a five year mold warranty, and concession of $2500 off the final payment that is due and owing at this time.  Our position remains that a mold warranty is not an option given her intended use of the building in question.  She has indicated that she will be housing animals as well as performing calving operations in this building, and both are very conducive to moisture.  Without any control of the envi[redacted]ment inside this building, there is no way that a mold warranty can be given.   Next, we understand that it is her position that the branch sales specialist stole a paper(s) with notes she had on the design of her building from her home.  I have reviewed this in detail with all parties, have researched her customer file, and have no evidence of the notes in question that she is missing.  The sales specialist in question adamantly denies taking these notes from her home.  Should we find these lost notes anywhere moving forward, they will be returned to her immediately.   As stated, we remain committed to assisting her in resolving this issue, but can only do so if both parties are willing to reason.  At this point there is only one person doing the negotiating.  We still stand ready to complete the originally agreed upon repair, which was to place plastic on the ground, and apply Crobium mold remediation products to all interior areas not reachable by her animals.  We further agreed to replace any lumber that could not be successfully treated.  We will also pull several sheets from each exterior wall and review for any mold issue.  Should any be found, we would treat or replace as needed in these areas.    As we have communicated to Ms. [redacted], we need to get to an agreeable solution and move forward or we will have to take the necessary steps to protect our interests.

Dear Sir or Madam, After a complete review of the contract and interviewing the personnel involved on this project, we have determined that we have fulfilled all contractual obligations of the contract with Ms. [redacted]. Heated floors were not part of the contract with Cleary Building Corp. and...

this scope of work was never included in the project price which was communicated to the client several times prior. Additionally, these discussions were held prior to the concrete getting poured and the client instructed the concrete subcontractor to proceed exactly as they performed. There were additional costs for prep work that needed to be done by the concrete subcontractor before the concrete could be poured that are a direct result of the client installing the in-floor heating. The client agreed to handle these added costs directly with the sub prior to any work being done. This agreement was between the concrete subcontractor and the client, Cleary Building Corp. was not involved with this agreement. The sub-contractor invoiced Ms. [redacted] per that initial agreement. There are some areas within the building where concrete was over sprayed on the wall steel that will need to be addressed and cleaned up by the concrete sub. Cleary will assist in coordinating to get this done with the sub-contractor. The client’s statement about receiving the wrong building colors is inaccurate. The colors they received were reviewed in detail and Cleary Building Corp. can confirm that the colors that were specified for in the contract are the same colors that were installed on the building. The last allegation regarding a possible forgery of the contract documents is unsubstantiated. There is no evidence of any wrong doing by any Cleary Building Corp. personnel and all persons involved on this project deny such claim. Cleary management will be contacting Ms [redacted] to reiterate our position and assist her with getting the concrete cleaned off of the interior side of the wall steel.  [redacted]General Manager of Operations, Eastern DivisionCleary Building Corp.190 Paoli Street Verona, WI 53593Office: ###-###-#### / ###-###-####Fax: ###-###-####

This response is in regards to Cleary Building Corporation not wanting to work this mold problem out in a safe or professional manner. First, we do not want our animals subjected to chemicals subjected to chemicals that are clearly stated on the bottle that it is known to cause cancer.  Cleary Corporation has no regard to letting one of their employees apply this chemical by hand spraying it on to the wood frame of the building.  They have tried this method before, and it didn’t work.  There is no way that they can completely spray the wood on both sides.  This building is 104’ long and 36’ wide.  There is tin covering the wood, and you cannot get to the mold on the backside.  In order to be sure that all the mold gets treated and killed is to encapsulate the building with plastic and treat the wood.  There are professional people who can perform this service and know what they are doing.  To ask one or two of your building employees to take on this dangerous and risky undertaking tells me that you don’t care about their exposure to cancer causing chemicals.  Well, we care about them and our cows and calves.  Cleary Corporation is a self-serving business with a long history of unsatisfied customers.  They claim that the customer matters but only want to do things their way.  That’s not how it’s supposed to be.  If there is a problem due to their negligence then they should do the right thing (the right way) to fix it; not put a Band-Aid on it and call it good.  In fact, they are claiming that we requested a specific mold inhibiting spray, but the truth is that we didn’t.  Cleary Corp. is the one who chose this product and showed up to apply it without consulting us first.  This problem would never have happened if they would have listed to us and insisted on bringing the building materials to our farm.  We had specifically requested that they wait on delivering the building supplies until the weather was forecasted to be drier.   They didn’t listen, and now there is a bigger problem with black mold.  Their only concern is to get as many buildings made, delivered, and paid for so they can make a lot of money.  As soon as the last payment is made the customer is forgotten.  Cleary Corporation knows that there is a big mold problem and refuses to fix it in a safe and professional manner.  Why can’t they just do the right thing and get it done?  I guess they are worried about losing money and not the safety and well-being of their customers, employees and our animals.  We feel that they are a company with people who are hardened and comfortable treating their unhappy customers in a manner that threatens them with ultimatums.  We have tried to reason with them, but they refuse to listen.  I guess they are too busy to really pay attention to our request.  All they want to do is sell, sell, sell and move on.  Again, buyer BEWARE!!! Sincerely,   [redacted] Farms Inc. [redacted] & [redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted].The business has completed another repair attempt to the roof by replacing the ridge cap again. However, there is no way at this time to tell if this repair will work or if it will fail as all the previous attempts have. This is the fourth ridge cap system that has been put on this building, and I have no confidence that this one will work. Therefore, I have no choice but to keep this complaint open until this can be assessed, and the only way to do that is to "reject" the response on this site.
Regards,

I have reviewed the response made by the business in reference to complaint ID [redacted]. I accept their response in order to move forward toward a resolution. I disagree with some of the comments in their response and shared this information with the company. I will reach out to the business and work with them on a plan to resolve the leaks.

Dear Sir or Madam,I personally called [redacted] at 9:33am the morning we received this letter (Aug 11th) and left a voicemail.  I emailed her at 9:41am and then was able to speak with her at 9:50am when she returned my call. I apologized for the unacceptable Customer Service and...

assured [redacted] that we do not condone service like that at Cleary.  We reviewed the letter and discussed what Cleary could do going forward, if she would allow us another opportunity to earn her business. She said that she truly liked our products and is still interested in a building.  She would prefer another Cleary representative to work with and that was arranged. [redacted] and her new Sales Specialist spoke late morning and discussed her project.  They set an appointment to meet on 8/20/16 at 9am. I then followed up with an email to reiterate that she can call me if she has any further concerns. Again, this is not indicative in any way of Cleary’s Customer Service standards and we apologize for the trouble it has caused [redacted].  We look forward to providing her with the best building solution and will be pleased if she accepts it. [redacted]
