Dear Revdex.com,With regard to the customer's complaint and proposed resolution, we continue to offer full repair of items covered by the new home warranty per the statute.  We offer to do this work per the callback procedure disclosure. We stand by our commitment to correct every item covered by the new home warranty in accordance with the procedures set forth with our customer. If our customer has any question about what items are covered by the warranty, he is welcomed (and encouraged) to follow up with our Callback Department and redirect this discussion to ICI's main office.Respectfully, ICI

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For the Revdex.com's and ICI's reference, I have attached a letter from our lawyer, [redacted], which states he received our email requesting that we no longer needed his services and where he states that he was stopping work on our case effective May 18, 2015 for ICI to now be able to contact us directly to get the courtesy repairs done for the 13 items previously agreed to by ICI.
I have emailed and left a phone message with Mr. [redacted] for him to contact [redacted], ICI's attorney, but I have not gotten a response as I am assuming since he is no longer working on our case, he may or may not do that but I believe the attached letter from him to us should be sufficient for ICI to ascertain that we are now representing ourselves are not being represented by a lawyer, Mr. [redacted].
I am giving ICI until June 19th, 2015 which is one week from my response today in which to contact us by phone at ([redacted]) [redacted] to schedule a time to have the 13 courtesy repairs/fixes agreed to by ICI by April 7th, 2015 letter from their attorney, [redacted], or I will be filing a small claims court case for $25,000 with General District Court in Roanoke County to have the small repairs done and to have a judge decide what is going to be done about the damage to our hardwood floors done in construction of the house based on the letter provided in my last response from [redacted] the manufacturer of the hardwood flooring installed by [redacted] through ICI. I am tired of going back and forth with ICI as this is the way they do business on everything and I want the public to know that if they are going to buy a new house or have one built and pre-pay for it that they shouldn't use ICI as they are not customer service oriented and you will not be handled with white glove service like their ridiculous website attests to. They should use another builder such as [redacted] or anybody else as they would be 100 times better than ICI, [redacted] and Robert Fralin the President in dealing with issues you have on a brand new house which you had custom built by them.
I am giving them one week to respond favorably and contact us about the 13 courtesy repairs/fixes or they can respond to a subpoena and appear in General District Court in Roanoke County for a small claims case brought against them for the repairs along with the flooring.

This email is in reponse to the Revdex.com claim from [redacted]  [redacted] on 1/27/2017. R. Fralin Construction is committed to fixing the items under the Construction Warranty which includes, the fireplace, water damage and removing the silt fence. All vendors and contractors have been notified and will schedule the repairs accordingly. All other communication must come through the office by email to [redacted]. In their response, Fralin stated that my issues/concerns should be submitted through a callback email address. This is the first time that I was told to send an email. Since closing in August 2015, I was told to fax concerns to a number provided. There was also a form (fax cover sheet) that was given to be used. In the past I was told that only issues faxed to them would be addressed. This is why I have faxed my concerns to them on multiple occasions. Since the complaint was initially filed with the Revdex.com I was contacted by someone from the sales department at Fralin. I was told that [redacted] was working on my concerns. I asked this person what I needed to do to make sure the issues are resolved. She told me that she was from the sales department and she could not answer my questions. She said that she was told by [redacted] to call me and that she knew nothing about my situation. I contacted [redacted] the next day and was told that she had called the HVAC and flooring companies and to expect a call from them. Of course I received no phone call.  I called [redacted] a few days later to make her aware that I would be home the next two weeks. Within an hour after making that call I received calls from both the HVAC and flooring companies. During this call with [redacted] I was told that some of the things on my list had been removed. She could not specifically say what was removed from the list. This situation has been going on for over a year. Per our conversation yesterday, below is the list of issues that are still outstanding.  1. Fireplace changes (flooring company): I have chosen the materials. Still waiting on work to be completed. 2. Water damage on walls and ceiling in bedroom and kitchen (source to be identified and repaired): HVAC company checked furnace. The leak in the basement was rerouted to go down the drain so I will not know when/if it leaks again. More importantly, they found no issues with the furnace. He observed problems with the siding that is likely the cause of the damage to the walls and ceiling. 3. Remove silk fence in backyard: We have to wait until the seasons change because the yard was never inspected by the county. The front lawn did no grow. I sent in a response on August 25 indicating that only one if the items to be fixed were actually fixed by [redacted]. The rest of the items have not been fixed and several items have not even been addressed to my satisfaction. Please refer to that email for details.

In response to the most recent posting by complainant #[redacted], on 6 June 2015 ICI requested the [redacted]s simply have their attorney confirm that we may work directly with them to resolve the matter. We simply request their attorney confirm this is permissible with ICI's representation.ICI will await confirmation as specifically instructed on 6 June 2015. We look forward to bringing resolution.Thank you.

They did nothing in their last response to resolve any of the issues that I discussed.
[redacted] has not resolved all of my issues that have been submitted per their warranty request procedure.[redacted]
[redacted] is slowly sending a token person by every other week but they
have not even fixed the mailbox which has never been correct since
closing, over 6 months ago. The back yard also has not been reseeded in
proper fashion. They claim they have done all they have to do. The issue
is that it was not done correctly the first time. All subsequent [redacted]
[redacted] construction has had seeding done the proper way. I simply
require my yard to be done with the same care and in the same fashion as
all the other yards done subsequent to mine.
They fix an item here and there to curry favor with the Revdex.com but it's just that, an attempt to get by.I am very grateful for the Revdex.com, before deciding to contact you, I wasn't able to get anything fixed.

ICI has been in touch with Mr. [redacted] to ensure the plumbing repairs have occurred. The mailbox repair has occurred. To best serve the customer, we recommend Mr. [redacted] defer to the callback procedure to ensure appropriate steps are being taken to warrant his home.
