This Agreement, which [redacted] indicated she had read and understood, includes a table that provides the specific amount of the fee that will be charged in relation to the amount of the principal balance.? Again, the Elastic Credit Agreement and Terms and Conditions explains all of the terms of the Elastic account? [redacted] has taken two advances: $on 1/13/2017, and $on 4/3/2017.? On 4/3/2017, she also submitted a separate cash advance request for $420, but she called us to cancel that request so it was not funded, nor has she been charged any fee in relation to that amount.? Her monthly payment has increased in relation to the $increase in principal, but will also decrease over time as this balance is paid down (as long as she does not borrow additional funds)? We want to assure Ms [redacted] that Elastic complies with all applicable state and federal law.? The Elastic website provides detailed information about Elastic, what it costs and how it works.? Also, each time that Ms [redacted] requested a cash advance, she was presented with a screen that displayed the due dates and amounts of her next three payments.? ? When Ms [redacted] initially submitted her application on the Elastic website, she consented to the Elastic Credit Agreement and Terms and Conditions.? This Agreement contains various disclosures, including Truth-in-Lending Disclosures.? These disclosures state that the account will be assessed two types of fees ?" a Cash Advance Fee equal to 5% of each advance, and a Minimum Charge fee, which may accrue to the account each billing cycle for which a balance is carried over.? The Agreement provides a Schedule of Minimum Charges which displays the exact amount of the Minimum Charge assessed per billing cycle in relation to the principal amount carried over.? We do not charge a “processing fee” and Ms [redacted] can verify the fees (Cash Advance and Minimum Charge) charged by logging into her online account and accessing her monthly billing statements on the Elastic Website.? ? Ms [redacted] ’s billing cycle is monthly ?" statements are issued mid-month, and the payment is due on the 29th of the same month.? Because the Minimum Charge will be more or less relative to the principal balance, the monthly amount due may be higher or lower as the principal balance is increased or decreased.? We agree that such a message is unacceptable, and suspect that she may have received a call from a phony debt collector, misrepresenting themselves as Elastic.? She did not make a payment, so that payment plan was also cancelled.? The debt was charged off in the amount of $on 5/20/when the account reached days past due [redacted] called and spoke to an agent on 5/23/2017.? In reviewing the call, we found that the agent did not refuse to accept a partial payment, but did accurately advise [redacted] that the account was no longer eligible for a payment plan, and that making a partial payment would not prevent the account from potentially being sold to a third party.? ? I just talked to someone and I told them I would be paying on the and they said that was fineNow they are telling me they can't take a payment unless it is the whole balanceOn top of that I received a recorded message that said I committed a felony and I was going to be arrested for not paying this bill! I knew that was a lieI am contemplating contacting an attorney for threats!!

The balance and fees are increasing the first time I got it, spoke with people and woman said one time fee each time you get it and balance would decrease, instead of decrease they said on warranty the fees would go up on balance this month went to $and was supposed to go down $in August $130, got an advertisement thru mail got $900, first time fee $one time on each transaction you do, if you pay balance off, next time you don't pay a fee, but got some more and there was another --From the beginning was advised of one time fee, each time I pay monthly dues the balance was supposed to decreaseThe fee was a one time fee on the amount that you borrowI borrowed $and paid one time $feeThe first amount I paid was $that was bringing the balance down, the next month it was $and continued to go up that I needed to pay, but they had said that the amount I pay each month would decrease, they emailed me after the online application--it said there was some changes to my Elastic account saying that the balance went from $to $that each month when I pay monthly dues fees would be added to the monthly dues and it wasn't like it was firstGot the email last month 3-later when the amount and fees had changed, if I don't agree with fees and amount that I would have to pay the whole balanceOver the phone I was told my monthly dues would decrease every monthWhen I contacted them the money that I send would go to the principal and if I didn't agree with it I would have to pay the whole total offNow the total amount $1,600, last month it was $1,I didn't sign for any of it, I didn't get anything in the mailEach month on balance I pay different fee on the balance, they changed everything from the beginningSometime last month you borrowed $800, they had added $to the $don't know why they did thatThe way they keep going up it seems it was added onThis month got an email to pay $and then in July trying to go down saying it's $263, it's up and downAugust is $303, that's when the $fee is added on to thatWhen got $that was another fee, I was not supposed to be charged a monthly fee on my monthly duesI have a credit limit of $that's what I paying down.

The advertisement templet they sent is not what I received and I find it convenient for them that they were just now able to find the advertisementRegardlessThe offer I was sent was similar however the verbiage was in that there was no interestI specifically remember thatIt stated there was a cash advance fee, then a minimum payment each month thereafterThis in fact, lead me to believe there was the one time cash advance fee, then a minimum monthly payment that I thought would go toward the amount I borrowedIn charging a cash advance fee with a monthly minimum additional fee, that would be the same as interest, only using different language so that I, or any customer, would think this was better than taking out a personal loanWhich is why I was misleadThere are fees, which basically works the same as interest, actually, you are paying more than a typical loanI would not have taken out the amounts if I thought there would be two additional fees each month!

We are in receipt of the above-referenced consumer complaint and appreciate the opportunity to respond*** *** is a customer of the Elastic revolving line of credit product offered by Republic Bank & Trust Company (“Republic”)When *** *** initially applied for her Elastic line of credit on July 15, 2018, she provided an account number that contained a bad digit and was one number too short. Our records indicate that *** *** initiated a cash advance request on July 22. When *** *** called on July to inquire about the status of the direct deposit, Republic discovered the error with *** ***’s provided checking account number. On July 26, *** *** provided documentation for her checking account, and her account number in the system was updated to reflect the correct twelve-digit number. The same day, the initial cash advance requested by *** *** using the incorrect account number was cancelled. Unfortunately, this cancellation caused a debit transaction to be transmitted to the updated bank account identified in the system. The agent who changed the bank account information did not realize that the pending cancellation transaction would process to the new bank account. We sincerely apologize for this error on the part of our agent and assure *** *** that we will address this misunderstanding with our agent through appropriate coaching to avoid this type of error in the future. We spoke to *** *** about this erroneous transaction on July and offered to conduct a conference call with her bank to confirm that the transaction posted/cleared, so Republic could expedite a refund*** ***’s bank’s representative indicated that the transaction was still in pending status, so we asked *** *** to call back the next day to make another attempt to confirm that the transaction had posted/cleared. While we did not hear back from *** ***, the transaction was stopped and returned unpaid due to a “stop payment” originating from *** ***’s bank on August 1. The result of these actions was that funds were never debited from *** ***’s account. However, it is possible that the pending ACH debit may have impacted *** ***’s available account balance temporarily We sincerely apologize for any inconvenience *** *** experienced in relation to this matter. If she was charged a “stop payment” fee by her bank, we would be happy to reimburse her. I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is mostly satisfactory to meHowever, I would suggest to the company to offer more training to not only the agent that processed the transaction but to their customer service and technical support agents as wellIt wasn't until I demanded to speak to a supervisor, Eduardo, that this resolution was madeThe other agents seemed clueless every time I called as to what was going on with my situationThis was also not the first error that occurred by the companyOne agent even suggested I call my bank and give them the other checking account number which the money was supposed to be withdrawn from to resolve their error on my own, that is absurdMistakes happen, and I would urge Elastic to train their agents how to own up to the mistakes and not make their customers feel responsible, that is customer service I will pay back the money owed to Elastic through my line of credit, but after that I no longer trust doing business with them and have urged others to avoid them as well. Eduardo was the only empathetic, understanding, and concerned person from Elastic I have spoken to, and the first week after applying for a line of credit through them I had to call numerous timesHaving that large of a sum of money being withdrawn from my account erroneously caused a great deal of stress to me and I frankly do not feel like the company did nearly enough to make up for thatYes, the payment was eventually stopped and ** *** was extremely understanding and did not charge me any fees; however, it took 24hrs for my checking account to return to positiveI hope they take this matter seriously and look into each customer service representative I spoke with, those folks have no business being in customer service

I am willing to repay this debt but I simply cannot afford the payment agreement of 200+ per month for 12? months that was offered to? meThat amount seems to include all of the? fees that have been accured as well as my outstanding principal balanceI am not sure how you are willing to accept payments from my debt management company if you have already charged off my accountI'm willing to settle this in a fair manner but it doesn't seem like elastic is willing to do the same or to settle for a lump sump payment split up into monthly? payments? I am at a loss with this company and most certainly will not use their service again or recommend them to anyone who is having financial difficultyI don't accept Elastic latest response but at this point it appears there is nothing more this company is willing to do to help those in difficult times
