This describes the accrual process, and provides a Schedule of Minimum Charges (Finance Charges), which displays the amount of that fee in relation to the specific amount of the principal balance that is carried over.? ? Payment plans are offered as a courtesy to assist customers who have difficulty making paymentsas originally agreed when they accepted the Elastic Credit Agreement and Terms and Conditions.? The payment plan that we previously offered was to repay principal onlyIf *** *** accepts a payment plan, Minimum Charge fees will continue to accrue (and will be accounted for on periodic statements); however, we will not require repayment of the fees as long as *** *** complies with the payment plan.? If *** *** does not pay as agreed to in the plan, the account will revert to the original terms, and the accrued fees will be due in accordance with the Elastic Credit Agreement and Terms and Conditions ? As we have advised previously, we do not formally participate in debt consolidation, but we will accept and apply any payment submitted to *** ***’s account, whether it is sent directly or from her debt consolidation companyShe was explicitly advised during a call on November 16, that ACH payments from her debt consolidation company would need to include her name, but was advised that a paper check would likely be best? Again, the plan we previously offered is the best plan currently available to assist *** *** with repayment over time; currently, a maximum of twelve monthsHer account has been charged off.? I am most certainly willing to begin making payments each month with what I can affordElastic deserves their money, however, they are not very helpful when it comes to making payment arrangementsThey proposed one option and that was it and said that is all they can doDefinitely not understanding of people in hard? financial times.? If Elastic will accept payments from my Debt management program, *** *** *** ***, I will be begin making payments to them to begin bringing this balance down

*** ***? no I HAVEN'T HEARD ANYTHING FROM ELASTIC CONCERNING THE INCREASE UNTIL I GOT SOME MORE MONEY FROM THEM.? THAT WAS SUPORT TO BE A ONE TIME? FEE ON EACH WITHDRAW OF MONEY I GOT FROM THEMALL AT ONCE I GOT AN EMAIL TELLING ME ABOUT THE INCREASE ON EVERY TIME GET SOME FROM THE ACCOUNT.?

We agree that such a message is unacceptable, and suspect that she may have received a call from a phony debt collector, misrepresenting themselves as Elastic.? She may call 888-225-to verify the validity of any communication she receives purporting to be from Elastic? We believe that our initial response addresses the concerns that *** *** has raised regarding Elastic feesWe reiterate that all of the terms specific to her application, and to her account, were disclosed before she accepted any funds*** *** agreed to the Elastic Credit Agreement and Terms and Conditions when she submitted her application on 11/11/In addition, each time she initiated an advance transaction, she was presented with a screen that displayed the amounts due for her next three payments.? Please note that she took seven separate cash advances (the first one on 11/28/2016, and most recently on 3/4/2017).? Our records do not indicate that *** *** ever contacted Elastic (prior to this complaint) to discuss her apparent misunderstanding of the fees charged, or to notify us that the terms of her account conflicted with the “ad” to which she has referred? Elastic does not advertise ??" the Elastic product is available by invitation only, which means that *** *** received a letter or an email, inviting her to apply for an Elastic account ??" perhaps she is referring to this invitation.? The invitation included the following statement: ? Each Cash Advance from the Elastic line of credit is subject to a 5% or 10% Cash Advance Fee depending on your billing cycleA portion of your principal is due each billing cycle, and if you have an ongoing balance, a Minimum Charge of $to $will applySee the Elastic Credit Agreement and Terms and Conditions for additional information at www.Elastic.com/Terms-And-Conditions? As we advised in our previous response, *** *** recently agreed to a repayment arrangement.? She initially agreed to a payment plan on 4/13/2017, with the first payment due on 4/18/She did not keep that arrangement, but on 5/11/2017, we agreed to a new payment plan with the first payment due on 5/15/2017.? She did not make a payment, so that payment plan was also cancelled.? The debt was charged off in the amount of $on 5/20/when the account reached days past due*** *** called and spoke to an agent on 5/23/2017.? In reviewing the call, we found that the agent did not refuse to accept a partial payment, but did accurately advise *** *** that the account was no longer eligible for a payment plan, and that making a partial payment would not prevent the account from potentially being sold to a third party.? ?
