Columbia stated previously on 9/18/that they would refund my deposit within daysThis was on 9/18/It is now 10/25/15, I have not received my deposit refund

Columbia Kitchens and Bath had a date set with me to perform "stage 1" of a job as agreed upon with the general manager.I took the day off from work; Business failed to show up on the date agreed upon, and there was serious lack ofcommunication before and after Business has failed me once, which is one too many

Response to complaint # [redacted] To Whom it May Concern:I have attached the contract that was signed August 5th, between the customer and Columbia Exteriors, LLC for the amount of $16,with a deposit of $1, As you can see this contract has nothing about pending credit approval We did submit her credit application and was able to get her approved for 8.5% which we called and notified her She then wanted additional work so we sent our representative back out to her home and wrote up another agreement in the amount of $22, She wanted to get her own financing for the second agreement so we did not ask for a deposit I have also attached that agreement which is dated August 28th, 2014.The customer was contacted on several occasions and was told selections will start once she is approved for the loan she applied for in order for her to get the additional work done.The customer contacted us on September 29th, to inform us that she did not get approved for the additional money for the second project and she had decided to cancel.There is a three day rescission period once the contract is signed where a customer can cancel This never happened.We feel that she is responsible for the first agreement and did not cancel in the time that is necessary so we will not refund her $1000.00.We would like to start the selection process and get this project completed for her If you have any questions or concerns please feel free to contact me directly.Traci B***Marketing Director###-###-####

To whom it may concern:In response to the claim that Columbia has committed fraud against [redacted] This is and her nephew's (who wasn't present at any meeting) story doesn't reflect what actually occurred.I went out to estimate the relining of her box gutters She had the job scope thoroughly explained to her and understood that it is a labor intense projectShe was given the opportunity to ask questions and have them answered before and after she was presented with a priceCustomers are only presented with a price after the job scope has been thoroughly explained and all questions are answered as per our company policy, so they know what to expect for the money they are spendingShe was presented with the price which she declined accepting at that timeShe said she had to think about it and talk to her nephew and get back with meI told her that I would be happy to follow up in a week or soWhen I called to follow up she requested that I come backI came out and met with her once againWe met and discussed a discounted rate and she said she was going to get other estimates.After I had left on May 14th, she called me on my cell phone and said that she thought about it and talked to someone and that she knows its not a cheap and easy job to do, that she felt the price including the discount was fair, and that she wanted to move forwardI told her that I needed to sign a contract and collect the depositShe agreed to have me come out and complete the process with herI came out and wrote everything up and we signed itShe was informed that it would be half down and half at completion, which was reflected in the contractShe happily paid the deposit and was excited to get the work doneWe discussed a start time roughly and she had no more questions or concerns.She called almost two weeks later and said her nephew thought it was too much money and that he told her to cancel the contractThe rescission period to cancel is only three days, so therefore it was past the rescission I responded and said what I can do is come back out, write up and sign a change order to the original contract for a less expensive alternative, and reduce the price to make it more affordableShe said that was fine to come out.I went back out to her house and wrote a change order for a different job scope and reduced the priceIt stated that it voids the original contract, but that only goes in effect if the change order is signed and agreed uponShe said that she was told not to sign anything until her nephew says it's okSo she didn't signSo, she was still under the original contract, she had the option to go with the less expensive alternative but tried to cancel the contract well past the rescission and in an improper fashionIt clearly states at the bottom of all of our contracts, that in order to cancel you need to write on the original contract, "I here by cancel this contract" with your name address and signature and it needs to be delivered to Columbia's office (or at least post marked) by the end of the third business day after signing the contractShe did not at any time do this.I hope this thoroughly explains the situationIf you need any more information, please feel free to let me knowThanks

To whom it may concern,This is regarding the *** family's complaintThe problem that we are experiencing with this customer is that the job was completed and never paid in full.Our contracts clearly state that the customer warranty isn't in effect until the customer pays for the job in fullUntil the time that happens, then there is no warranty on the whatever work was performedThe ***'s signed a change order for $*** to add extra work to the job, and once it was completed they never paid the differenceWe were even gracious enough to set them up on a payment plan for the amount (which we never do) and they failed to make the first payment.The other problem is that they are experiencing leaks and issues on things we did not work on (such as the roof) or things that aren't warrantied (such as a metal roof that was only painted not repaired or replaced)They said water is spilling over one of the gutters, but that has to do with the design of the home and not work that we performedThe box gutters are built on, we merely re-lined them.We can help to alleviate their issuesBut, they are incredibly unreasonably understanding people who only want to argue and not listen to factsThe issues at hand are both not our fault and not under warrantyIf they were under warranty, then they still wouldn't be fixed until they've paid in full, which they have still failed to doWe have addressed all of this with them several timesThese issues can be easily corrected but they would have to pay us the $*** they owe us first, then agree to a p*** to fix the other issues which were never addressed in the original contract.Thank you for your time and consideration on this matterPlease feel free to contact us with any additional questionsProfessionally yours, *** ***Columbia Exteriors, LLC

Mr C***'s stated course of action is acceptable in principle, but until we have our funds returned to us we cannot accept this matter as finalHis proposed resolution is open ended with no date for the funds to be in our possession. I would prefer picking up the certified funds / cashiers check from his place of business to avoid the opportunity for further delays in resolving this matter

Business has tried to contact the customer numerous times and the customer did not cancel before the day right to cancelBusiness apologies for not calling the customer right after the contract was signed but it's their practice to contact the customer once the selections are ready to be chosen, which is up to days after signing of contractBusiness does not plans to release customer from contractPlease call Traci at ###-###-#### to get immediate contact between the hours of 8am - 5pm M-F

Columbia was scheduled to be at my home at 10:am todayNo one has arrived and no on has called to update meIt is now 10:45amColumbia has failed to show or respond on at least occasions that I have documented, so this is not a surprise.If Columbia was actually concerned about the customer they would at least communicate with the customer instead of being so completely inconsiderate

Mr and mrs *** may have a replacement certified check in the amount of the check plus feeDue to the fact that my bank states as I have stated to the *** during every conversation that the check is not showing as being presented to my bankI will stop payment on the check they were issued
and mail their certified funds to their home address

Regarding *** ***.She was dealing with our General Manager who has since left the company. We have tried to reach out to her several times to expidite her project. In order to process and begin a project all of the selections need to be finalized. We have not been able to get with the customer to do this because she will not let us come to her home. Our Production Manager called her and explained that Ken was no longer here and that he wanted to come out personally to meet her and to finalize everything so that we can begin her job. All we need to do is get the selections finalized and we can begin the work. We feel that we can not refund her money at this time because it is well past the three day recission and there has been a lot of time and effort put in by our staff to prepare for this project. Our suggestion is that the customer let us do what is needed in order to do a great job for her as per her agreement

The customer signed the contract on 6/11, we tell all customers it generally takes two weeks before we call and set up a remeasureOnce the remeasure is completed we invite the customer into our showroom for selections, once all the material comes in we put the customer on the production schedule
It has been two weeks and the customer just went off, she sent two emails out to us on 6/which we responded to bothNot sure what the real reason isThis customer has been provided with all the information, I told her that her remeasure will be next week

They missed an appointment that had been set to do part of the jobAll communication from them stopped days beforehandNo preparation was done for the jobNo word form the company until days after the missed appointmentNo work has been done at all, the deposit needs to be refunded

Someone from the company did come on November 17. At that time, I provided them conditioner and stain for the woodwork that I had matched at the Fairfield [redacted] location. David tested the stain in terms of how long to leave it on the wood and we found an acceptable match.  David took the woodwork to be stained.  We discussed possible solutions to the damaged counter and vanity.  They may or may not work.  We agreed that I would be in contact after the Thanksgiving break to finish the job.  I texted yesterday that I would be home today, December 3, and received a response that David would be in contact soon.  No one has contacted me as of this moment, 3:39 pm, December 3, 2015.Fixing the counter and vanity are more significant repairs since there is a chance that the vanity doors will not correctly line up, so there is significant skilled labor needed to complete this project.  I should also point out that I have not had a properly functioning master bathroom since March 17, 2015.

We have spoke with customer and we are scheduled to go out next Friday 11-6-2015 at 10am

Customer invited us out to provide an estimate. Customer filled out the docs to obtain financing, it is the customer's signature on the paperwork. Customer canceled contract well after the 3 day of rescission and did not allow us to come out and do the work. There is no refund of down payment.
