This has already been a complaint once and with all of the changes we have made and the new account manager this has slipped through the cracks.  We apologize and promise the money will be sent out be weeks end.  Thanks for your patience.

The customer canceled after the three day rescission and tried to dispute the charge on their credit card which was denied.  They finally agreed to let us complete the work for them.  They spoke with our accounting department last week and just wanted another representative from the...

company to handle job.  The office manager called and left them a message to call along with our production manager.  We are awaiting a call from the customer to schedule a final visit to review the scope of work and schedule the job.

Columbia stated previously on 9/18/15 that they would refund my deposit within 21 days. This was on 9/18/15. It is now 10/25/15, I have not received my deposit refund.

Response to complaint # [redacted]To Whom it May Concern:I have attached the contract that was signed August 5th, 2014 between the customer and Columbia Exteriors, LLC for the amount of $16,369 with a deposit of $1,000.  As you can see this contract has nothing about pending credit approval....

 We did submit her credit application and was able to get her approved for 8.5% which we called and notified her.  She then wanted additional work so we sent our representative back out to her home and wrote up another agreement in the amount of $22,571.  She wanted to get her own financing for the second agreement so we did not ask for a deposit.  I have also attached that agreement which is dated August 28th,  2014.The customer was contacted on several occasions and was told selections will start once she is approved for the loan she applied for in order for her to get the additional work done.The customer contacted us on September 29th, 2014 to inform us that she did not get approved for the additional money for the second project and she had decided to cancel.There is a three day rescission period once the contract is signed where a customer can cancel.  This never happened.We feel that she is responsible for the first agreement and did not cancel in the time that is necessary so we will not refund her $1000.00.We would like to start the selection process and get this project completed for her.  If you have any questions or concerns please feel free to contact me directly.Traci B[redacted]Marketing Director###-###-####

We spoke with [redacted] to resolve this issue.  We will call her before 5pm this Friday to schedule a date to complete her job.

We called the customer, well after the three day recission period to schedule the work.  He told our production manager that he had canceled.  He said that he faxed in the cancelation and that he had the fax confirmation.  The production manager said that we never received a fax but...

that all he had to do is show us the fax confirmation and that we would refund his money.  Our production manager told him that he would have someone stop by to see the fax confirmation and he said fine.  When we had someone call him he refused to let them come out and said he would see us in court.  The bottom line is all he has to do is bring in the fax confirmation and we will be happy to refund his money.

Business indicated they have been out and are working on the job and it should be completed shortly.

[redacted]  - [redacted], their Job Foreman, has made several incorrect statements again about the work done. His only correct statement is where he said that they didn't do the roof. Meaning the shingle part. We had contracted with another person for the job. When they had almost finished the shingle part, the owner had a heart attack and died. His son closed his business and refused to finish the job.  He gave us a refund on the balance of the work that they would not do. We then contacted Columbia and they reviewed what else was to be done and wrote us a contract to finish the work. We have not had any troubles with the shingled part of the roof.  Their agreement was to finish the shingled area over the freeze line, rebuild and reline the box gutters, steam clean, repair and put on two coats of Gecoflex paint on the seven flat metal roof areas, rebuild two chimneys and place bird screens on them, replace the back porch with a deck that would be on the second floor and new railings around the bottom for our part of the porch. The wooden soffit around the house, the freeze boards and Fascia were all to have new wood. They refused to paint all the new wood being used stating that it wasn't written into the contract. We wrote an addendum to the contract for $ [redacted] because I insisted that they do the painting while they were up there already and I didn't want to hire another person to do that work. I purchased all the paint for the wood and metal roof areas as well as brushes and rollers for them to use.. We gave them $ [redacted] to begin all the painting and was supposed to pay the remaining $ [redacted] at $[redacted] per month for 10 months. Three months after they had left, we started having a leak in the front flat roof area and birds were coming down the chimney. That was when we decided to hold off on paying the balance of $ [redacted] until these problems were corrected. [redacted] came and looked twice without doing anything for us stating his hands were tied until we paid the balance in full. I showed him a check made out to him for the balance and told him that I would hand it to him after he satisfied my complaint and corrected the problems, He refused and left. I getting sick and tired of all of his incorrect statements about this work. I am sending you a copy of the contract and several pictures of the bad workmanship.  Please try and get this settled before the cold weather begins again - Thanks  [redacted].

The company did not tell me it would take 2 weeks or more before they contacted me. I was told I would get a "welcoming call", which I assumed would be shortly after they deposited my down payment check. I have been substantially frustrated regarding my purpose for entering into the contract. No one has called me yet, so I feel like I am not being treated like a client. I got an email saying they will call me next week, in other words, "don't call us, we'll call you", which is no way to do business. I do not wish to do business with this company and I am asking for the contract to be voided and my deposit refunded. [redacted]

Still have not received the promised refund

Per [redacted] of Columbia Exteriors: The service has not been done because the customer has not paid in full. The service agreement can not be honored according to the business unless the $[redacted] has been paid.

[redacted] this is a bold face lie from them I agreed to show them the transaction he said they don't give refunds , that's when I asked him why would he need to come out to my house to see my paper work if you don't give refunds. and  I told him I followed your polices and if I don't get my refund I will take them to court.

The contract was not received until over a week after the estimate and $3060 down payment, though it was dated May 14. The change order is dated May 15, stating "Void original contract." Therefore, Columbia is, to vastly understate, inaccurate about the dates. I told [redacted] we did not want their work, but did expect a refund, well before contract was received in the mail; change order had been hand-delivered to my aunt on May 15, but she never signed her acceptance of it. However, Columbia still has her money despite this and despite their never having done any work, and they apparently still refuse to refund it.

Columbia Kitchens and Bath  had a date set with me to perform "stage 1" of a job as agreed upon with the general manager.I took the day off from work;  Business failed to show up on the date agreed upon, and there was serious lack ofcommunication before and after.  Business has failed me once, which is one too many.

[redacted] I know their contract says on the last line that "there is no warranty or any work cannot be done until the money is paid in full." We agreed to pay them the balance of $ [redacted] in monthly payments of $ [redacted] each. Then the birds started coming down my chimney and the roof started leaking in three places and I knew we had a serious problem. That was when we decided to withhold the last $ [redacted].  Discovery on my fire escape is what led to the full complaint that I filed with you. They have refused to fix any of the problems unless the money is in their bank account. My experience with [redacted] has been one that if I give him the remaining $ [redacted] he will deposit it and then call me and say there is no warranty for the existing problems and that is just unacceptable. They are very poor business people and when the contract was only one-third done their sub-contracting workers were complaining to us that they hadn't been paid and when I told that to [redacted] he said they didn't keep a reserve account in the business and he couldn't pay them unless I gave him about $ [redacted] that would pay their work up to date. Although we didn't have to pay them anything at that time, we gave him a check anyway so their workers would continue working.  [redacted]

thoroughly explained to her and understood that it is a labor intense project. She was given the opportunity to ask questions and have them answered before and after she was presented with a price. Customers are only presented with a price after the job scope has been thoroughly explained and all questions are answered as per our company policy, so they know what to expect for the money they are spending. She was presented with the price which she declined accepting at that time. She said she had to think about it and talk to her nephew and get back with me. I told her that I would be happy to follow up in a week or so. When I called to follow up she requested that I come back. I came out and met with her once again. We met and discussed a discounted rate and she said she was going to get other estimates.After I had left on May 14th, she called me on my cell phone and said that she thought about it and talked to someone and that she knows its not a cheap and easy job to do, that she felt the price including the discount was fair, and that she wanted to move forward. I told her that I needed to sign a contract and collect the deposit. She agreed to have me come out and complete the process with her. I came out and wrote everything up and we signed it. She was informed that it would be half down and half at completion, which was reflected in the contract. She happily paid the deposit and was excited to get the work done. We discussed a start time roughly and she had no more questions or concerns.She called almost two weeks later and said her nephew thought it was too much money and that he told her to cancel the contract. The rescission period to cancel is only three days, so therefore it was past the rescission.  I responded and said what I can do is come back out, write up and sign a change order to the original contract for a less expensive alternative, and reduce the price to make it more affordable. She said that was fine to come out.I went back out to her house and wrote a change order for a different job scope and reduced the price. It stated that it voids the original contract, but that only goes in effect if the change order is signed and agreed upon. She said that she was told not to sign anything until her nephew says it's ok. So she didn't sign. So, she was still under the original contract, she had the option to go with the less expensive alternative but tried to cancel the contract well past the rescission and in an improper fashion. It clearly states at the bottom of all of our contracts, that in order to cancel you need to write on the original contract, "I here by cancel this contract" with your name address and signature and it needs to be delivered to Columbia's office (or at least post marked) by the end of the third business day after signing the contract. She did not at any time do this.I hope this thoroughly explains the situation. If you need any more information, please feel free to let me knowThanks

I attempted to send a certified letter to the business, to the address on the contract, it came back to post office as undeliverable due to outdated address. Business did not keep appointment for job to be done., I have stated this many times. Business has replied TWICE that they would refund my deposit, it has not happened.Desired Outcome:  Business to refund my deposit of $2,265.00
