HMH Lifestyles, LP’s Chief Financial Officer, [redacted] , researched the facts leading up to the complaint by Ms [redacted] and spoke to her on 7/26/ An agreement has been reached between the parties and we request the complaint be formally closed.Principal Management Group was hired by the Declarant for the HOA, [redacted] (also the developer), on January 29, as the first step in activating the HOA and turning it over to a homeowner controlled board The first notice to homeowners was mailed by Principal Management Group on May 1, The board was elected and the HOA dues were set at $per home, per year Stewart Title collected the HOA dues at closing for all homes that closed subsequent to the activation of the HOA on May 1st, The first closing, which had fees collected by the title company, occurred on May 17, HOA dues have been collected on all closings that have occurred since that date.In corresponding with [redacted] , Regional VP for Principal Management Group, we discovered that they were given a list of all current homeowners when they were engaged on January 29th, 2016, but they admitted that the list was not updated between January 29th and May 1st when notices were sent to homeowners [redacted] said they checked ownership via the Tarrant Appraisal District (TAD) website later in the year and sent notices out for the dues for all owners reflected in TAD’s website We are unaware of the steps that were taken by [redacted] , the newly appointed HOA board or Principal Management Group to contact the homeowners regarding elections, business meetings, etcand do not have a listing of which homeowners received notices Ms [redacted] purchased her home on March 22, 2016, and stated that she never received notice that the HOA was activated until weeks before her dues were due.Principal Management has agreed to waive the dues and fees and HMH Lifestyles, LP has agreed to pay the dues and fees on behalf of our customer, Ms*** Ms [redacted] has accepted this offer and has acknowledged that she knows the HOA is now activated and she has agreed to pay dues going forward She plans to contact Principal Management Group directly to discuss the board, planned meetings, the budget and other items and she understands that the HOA is a homeowner run company established to directly benefit the homeowners of Wellington Point and protect the value and the beauty of their neighborhood.Should you need anything further regarding this complaint, feel free to contact [redacted] , Chief Financial Officer of HMH Lifestyles, L.Pdba History Maker Homes at [redacted] .Thanks,***

We appreciate the opportunity to offer a response to Mr [redacted] ’s letter to the Revdex.com dated March 13, History Maker Homes uses model homes to showcase the features offered in our homes, some standard and others optional, as well the fit and finish of the homes These model homes are often the primary setting of homeowner interactionThe features and colors for each model home are carefully selected from the list of available options While not the case in this circumstance, we reserve the right to change products as the market or our construction means and methods require Our Homestead model, the community of the subject home, showcases ceramic tile in the kitchen and carpet the adjacent living room, we offer the attached pictures showing the kitchen and living area in this configuration (Please see attachments titled REF#and REF#2) The only area with hardwood flooring is in our sales office space, which is temporarily located in the garage space and is not a permanent part of the featured home At our showroom, located in North Richland Hills, Mr [redacted] requested hardwood floors in the kitchen and our design staff informed him that it was not an available optionWith respect to the kitchen cabinetry, the cabinets featured in the model are available options, which Mr [redacted] chose to add to the home With regard to the sanitary sewer line break, we sincerely apologize for the inconvenience that Mr [redacted] and his household experiencedAs soon as Mr [redacted] notified us of the plumbing break, our personnel and plumbing contractor promptly responded The repair work was completed and the sewer line operation was restored very quicklyOur records indicate that Mr [redacted] did not submit any additional or supplemental repair requests after this incident Further, our records show, and Mr [redacted] verbally confirmed on March 16, 2016, that there are no open issues with the subject home Mr [redacted] has requested that History Maker Homes purchase his home because of these events While we regret that Mr [redacted] experienced the sewer break we expediently responded and corrected the problem and to this day the system operates as it should As such, we have informed Mr [redacted] that we will not purchase his home It is our understanding that Mr [redacted] has placed his home on the market and has or is in the process of relocating from the Fort Worth area

Complaint: [redacted] I am rejecting this response because: as I have stated before, before the 1year builder warranty expired, I have met with [redacted] (builder warranty rep) to make a list of issues to be resolved and the cabinet paint peeling is one of themOver the period of months, I have called [redacted] but always got push aside [redacted] mentioned he will put this list into his databaseAnyhow, I have just completed the warranty written request as suggested but I need a resolution to this complaint (not just being redirected once again) Regards, [redacted]

We appreciate the opportunity to provide a response to Mr***’ complaintAs a home builder, we take the privilege of building our customers’ homes very seriouslyAt History Maker Homes, we partner with our trade partners to build each home with the utmost care and qualityPlease find the following documents attached to this response:• Two service calls conducted at the residence dated 7/20/and 8/31/2017.• The calculations, ( [redacted] *) done on his home to determine the correct equipment and tonnage neededWith respect to the service call dated 7/20/2017, the technician noted, “I didn’t see anything wrong with the cooling system.” (See Notes)Per Mr***’ request, another service call was conducted on 8/31/The technician noted a problem that needed attention and offered the homeowner a resolutionThe homeowner declined and stated “I believe the unit is too small”He agreed to coordinate with the technician by phone to correct the issue after verifying the unit sizeTo our knowledge, the repaired work has not been performed to date(See notes)As shown on the attached [redacted] calculations, the home requires a 2.5-ton system, which is what is currently installed.It should also be noted that Mr [redacted] closed on his home 11/30/and that the first request made to us was on 8/8/2016, well outside of the warranty period.We are confident that we have honored the terms of the home warranty and have the correct unit installedWhile we understand that homeowner maintenance does carry various costs, we respectfully decline the homeowner’s desired settlementAgain, thank you for the opportunity to respond

HMH does not make good homes, concerning the yard and the warranty, if the would truly read whst they have written, we have been accused of covering the swell with dirt AGAIN [redacted] told us he would not give us any info cocerning our windows blinds, because that is giving away trade secertsWe do not know whst is covered, who makes our blinds or windThis is house is trash, those roses has died because of the lack of water drainage According to the people who build the HMH The bulder [redacted] does not truly inspect the homes, he sits in the truck, while not inspecting the home correctly

HistoryMaker Homes is grateful for the chance to respond to Mr***’s complaint We have been working with the homeowner and the contractor that installed the dehumidifying system in order to find a solution to the condensation issuesThe current action plan includes replacing the dehumidifying system, replacing the windowsills and a thorough cleaning of the windows Mr [redacted] is amenable to the plan and the contractor will be scheduled to commence work as soon as possible The homeowner is a conscientious participant in our repair efforts and we are confident that the issue will soon be resolved

We appreciate the opportunity to provide a response to Mrs***’ commentsAs a home builder, we take the privilege of building our customers’ homes very seriouslyHistory Maker Homes and our trade partners endeavor to build each and every home with the utmost care and attention to high qualityHowever, like the majority of home builders, we provide a home warranty in the event of any defects in the material used or defects in workmanshipThis home warranty does have coverage terms as well as limitations which are detailed in the warranty coverage booklet that is given to our homeowners after closingThe workmanship and materials of the roof are covered by the warranty for a period of one yearThis is the standard term of coverage for a roof under all the major home warrantiesIf for any reason a repair is required and completed within that coverage timeframe, this work does not restart the warranty coverage termFurthermore, general guidelines for roof maintenance suggest that the roof be inspected by the homeowner, using a licensed roofer, on an annual basisWhen the homeowner last contacted us on July 31st 2015, our customer service representative explained the warranty coverage limits to the homeowner and as a courtesy had the exhaust cap on the roof replacedThe homeowner stated to our representative that they understood the warranty coverage terms and that they would be completing the drywall repairsWe are confident that we have honored the terms of the home warranty and while we understand that home maintenance does carry various costs, we respectfully decline the homeowner’s desired settlementIf Mrs [redacted] would like to contact our trade partners to receive quotes for repair work, we are more than happy to provide that information as well as provide home maintenance advice and guidelines for their homeAgain, thank you for the opportunity to respond

I am rejecting this response because: I am unclear by the clarification/Correction to my statements; "History Maker Homes has never been the Declarant for the HOA, nor the developer over the Wellington Point Community*** ***, owner of All American Homes, developed the community and sold some of the lots to History Maker HomesMr*** was in charge of the HOA as “Declarant” and he retained oversight of the HOA, until he retained Principal Management Company to manage the HOA, at which time the HOA transitioned to a residential controlled board." I have reread my statement and I do not see an accusation that History Maker was the "HOA Declarant." I would like clarity in History Maker's role in the purchase of the lots and responsibility as a developer in the Wellington Point Community since they are stating they were not the developer over my communityI am aware the *** *** was the declarant because I have been told this same information many times(by two History Maker representatives and the property manager at Principal ManagementMy overall complaint is who is responsible for me, the customer purchasing, closing paperworkIt was stated that History Maker was not privy to the closing papersWho is responsible for knowing what documents are in my closing papers? I would like to continue this resolution via Revdex.com until there is more information on this matter

We appreciate the opportunity to provide a response to Mrs*** We have requested information from Stewart Title Company and Principal Management to try and ascertain why Mrs*** received the notice that she did at closing As Seller, we are not privy to all of the Disclosures
signed by the Buyer at closing The document she referred to in her complaint was not one that we prepared The Closer for Stewart Title is currently on vacation, but should be back in the office next week We will be in touch with her to discuss the document and will respond further to Mrs*** once we have all the facts. To clarify our position and correct a statement made by Mrs*** in her complaint, HistoryMaker Homes has never been the Declarant for the HOA, nor the developer over the Wellington Point Community *** ***, owner of All American Homes, developed the community and sold some of the lots to HistoryMaker Homes Mr*** was in charge of the HOA as “Declarant” and he retained oversight of the HOA, until he retained Principal Management Company to manage the HOA, at which time the HOA transitioned to a residential controlled board We will be in communication with Mrs*** by the end of next week in the hopes of resolving this issue to her satisfaction

filed by Mrs***Our goal as a company is to delight our customers one
home at a time and our philosophy is to always do the right thing for the right
reason. When situations such as the one
experienced by the *** family
occur, we do our utmost to correct the issue and
to do so as efficiently as possible. We
understand the ***’s frustrations and are dismayed that the chimney leak
occurred again and that the *** family has decided to sell their home
After the leak was reported on November 29th,
2015, our customer service representative contacted all of our vendors that
would need to be involved to repair the leak and scheduled them to begin work
as soon as possible. The roof flashing
was repaired, the affected area was caulked and painted. The carpet was pulled and the carpet pad and
tack strip were removed. As a
preventative measure, disinfectant was sprayed along the baseboards and the
floor. The carpet pad and tack strip
were then replaced and the carpet was re-stretchedAll repair work was
completed by December 4th,
As for the other issues referred to in the complaint, the
laminate floors were inspected by our customer service representative and the
scratches were not visible to him however, our representative provided the
contact information for our flooring professionals so that the homeowner could
have the floor inspected by a flooring expert
HistoryMaker Homes assessed the concrete floor in the garage
and found that resurfacing was not necessary however, we made a commitment to
the homeowner that we would resurface the garage floor nonetheless. We have attempted to honor this commitment more
than once and need only for the homeowner to provide access so that the resurface
work can commence.
In regards to the grading of the lot, standing water is a
occurrence in yard swales right after a rain event. Should the water not drain after hours
then there could be a possible issue.
Due to weather events and uncharacteristic amounts of rainfall this
year, some homeowners are experiencing ablandscaping issues that would
not have presented themselves in conditionsIn a previous request to
visit the home, our customer service representative did notice standing water
and a service request was made. Repair
work of the yard, along the retaining wall, was completed by ProEarth however,
we are amenable to scheduling another visit to review the grading of the
backyard
In summary, while the leak issue is unfortunate, HistoryMaker
Homes has done everything we could to rectify the issue in a timely
manner. We have fulfilled our warranty
responsibilities as outlined in the home warranty policy and have done so in
agreement with our company’s philosophyWhile we are disappointed that we
could not delight this homeowner, the reimbursement of the down payment is not
an equitable request. If the homeowner
would still like to have the garage floor resurfaced, we would like to move
forward with that service and we would like to schedule a visit to reassess the
grading

qualityLike most builders, we provide a home warranty in the event of any defect in the material used or defects in workmanshipFurthermore, this home warranty does have coverage terms as well as limitations which are detailed in the warranty coverage booklet that is given to our homeowners after closingSection 10:1: a: If a Warranted Defect/ and or Deficiency occursYou must notify the Warrantor (Builder) in writingAt this time we show no record of a submitted request from the homeowner, but look forward to assisting the homeowner in reviewing the item(s) as stated in the warranty coverage bookletTell us why here

Upon contracting the home, I made it clear to our sales agent that features within the model (specifically the wood floors) were an integral part of our purchasing in the community I also stated we would require cabinets to be built in above the refrigerator and these options/upgrades were necessary for us to move forward in the purchase agreement Our sales representative agreed these options would be made available to us and we proceeded with the sales agreement Weeks later, during our selections at the design center, I was informed these features would not be available to us and should we choose to cancel our sales agreement we would lose the $1,earnest deposit placed and be charged an additional $5,earnest deposit for cancelling the purchase agreement We felt this was advertisement and a misuse of all parties involved in the contract signed by History Maker Homes.In addition to the advertisement we were unaware that our home was built improperly once the foundation was laid We were informed by the plumber, who found the smashed water/sewer pipes under our foundation, "This happened months ago, well before the construction of the home." Somehow, History Makers may have been aware of the damage and contamination building up within the home and used a third party inspection company, Metro Code, to complete all building inspections The final inspection was completed on 10/27/ We closed on our home on 10/29/ The home began to flood and the construction crew was brought in on 10/30/ How is it possible to pass inspections without finding these types of major damage The entire home was constructed upon a foundation that was faulty and contaminated The builder offered a $1,credit towards flooring which cost us an additional $3,just to have the wood floors we were told at the time of purchase we would be able to receive Metro Code owner Jonathan Killabrough informed me the builder should have replaced ALL flooring within the home, including carpet and padding should have been replaced as it may be contaminated as well I have also contacted the Chief Inspector for the City of Fort Worth in regards to the original permit issued by the City of Fort Worth, #*** which can be viewed online at www.FortWorthTexas.gov.We abandoned the home, accepting the first position I could find, which resulted in our relocation to Iowa I have requested and was promised an engineering report and final inspection from History Makers to validate the repairs and verify the home is environmentally hazard free to occupy After months of requesting this documentation, we still have not received these documents The home has been removed from the MLS as we cannot move forward on the sale of the home until we have these documents In addition to the $192,we paid to History Makers, $3,in flooring costs, $12,in medical bills, $3,lost income from my fiancee's earnings from being unable to work we have also had $1,in veterinarian bills, $3,in moving expenses and are still paying $1,per month on our mortgage We have enlisted the help of a rental company, but without soil samples, inspections and a certificate of occupancy we cannot satisfy even a lease agreement of the home.History Maker Homes has an ethical responsibility to ensure the quality and construction of their products At this time, I do not feel comfortable with the sale of the home to another party We have given the company every opportunity to make this right by taking the home back at the price we paid and making the proper construction repairs on their own account We have not hired an attorney to fight the company for $250,or excess to include the health and emotional damages we experienced I feel I have been more than fair with the builder and given them every opportunity to remedy the situation by purchasing the home back at the price paid and not one dollar more As you will see from the pictures, this was not the "New Home Construction" that was marketed to us by the builder advertisement, misleading sales agents and being forced to move forward with a contract could have been overlooked if we received a quality product Instead, living in a construction zone along with the mounting financial costs, health hazards, forced relocation and emotional damages experienced as a first time buyer have placed me in a terrible position In addition to reaching out to the Revdex.com, HUD has opened a formal complaint, case number# CAFto help us move forward in protecting our rights as consumers As of today 3/24/we have filed a complaint with Ken Paxton, Attorney General for the State of Texas (please see attached) Our lender, Legacy Texas has also been informed of the complaint and we have been encouraged by the lender to file a formal dispute with Ditech Financial, LLC which is the current mortgage holder As a consumer, this company misrepresented their product, warranty and our faith in their employees abilities to resolve this issue I ask you to help us find relief from the nightmare we have endured and hold History Maker responsible for the outcome of the final repairs and re-sale of the home with no additional monies paid to us other than the relief of title

I am rejecting this response because:This information does not match the information I got from the City of ***City of *** told me, your original did get deniedOnce you resubmitted, you did not have all the necessary information for permitting, and they waited for you to return all the informationOnce the information was received "We released the permit within days"Not to mention, you said on here that you got the permit on Sept 14th, which is accurate, however, the sales rep stated to me, that it was received on Sept 21stIf you did get the permit on the 14th, why was I told 21st? Why did the slab not get poured till the 27th of October? Then again, two weeks until framing began? Does this sound like a company concerned about the delays thus far? Or does it sound like a company taking steps to intentionally delay a build, because they would not bend to your illegal sales techniques?All I am asking for, is you to return my $earnest moneyIf you do that, I will remove all complaints, and leave this issue aloneIf you choose not to do that, then I will have to take other measuresYou have probably by now realized, the sales technique you tried to use on me, was illegalI am willing to drop all of that, if you just do the right thing, and return my $to meOnce I have a check that clears the bank, you will never hear from me again

Thank you for the opportunity to respond to the customer’s concerns. Our sales and construction staff met with the buyer on Tuesday, June 28th, and together with the buyer decided on and agreed to a course of corrective actionMrs*** stated she was satisfied with the agreement and we
proceeded with the re-grade of the backyard. We are confident that this adjustment will provide the proper drainage without impacting the usability of the backyardSince both the buyer and our personnel were able to reach a mutually agreeable accord, we respectfully request that this matter be updated to show as resolved.
