KHovnanian is willing and ready to complete the install within the next daysWhile there were delays in completion on both sides, we still want to complete our work as per Contract. I am rejecting this response because:KHov did not bring our a landscaper to confirm/perform the scratch test, nor were we as the homeowners provided proof of this test. We watered the front & back tree the same frequency & the front tree is alive & growing. KHov has had numerous complaints from other homeowners in our neighborhood about dead trees & KHov has replaced several trees due to the same issue - they were dead. These issues were also submitted after moand after the sign-off had occurred. I've spoken to our neighbors about this. At this point, we are being discriminated against as KHov is not being consistent in the treatment of their customers

ticket out for the leaking gutters and microwave. While the garage steps are Fully code compliant, as a courtesy we have attempted on two occasions to change the garage steps, but no one was available. As far as the Garage tape and mud, the home has been prepped to the same finish as all our homes and nothing further will be done. In regards to the Bathroom door hole, this is a Homeowner maintenance issue and non-warrantable.KHovnanian Homes

I am rejecting this response because: After all the trouble KHOV put me through and me wasting so much of my time and energy ( I was literally doing khov's job following up with the *** folks multiple times sending them 100's of emails) At this point the damage has already been done, and I think I am being fair in am expecting a refund!! This has been going on for months.I really dont understand why I am not entitled for a refund? As to why even after months of KHOV not able to install is still pushing for installation instead of refunding for the trouble they me put me through.I really would appreciate if I get a refund and we close this case at the earliest!

We received an email from the *** on Saturday January 6th regarding possible issues with broken plumbing pipes that the home owner believed were the result of foundation problems Monday, January 8th, the plumbing contractor visited the home and sent a camera down all the drain
lines to find any potential leaksThey also performed a water test on everything within the slab The plumbing contractor did not find any evidence of leaks from the plumbing at this time*** has also provided a letter to the home owner stating the same for their records Our personnel also visited the home on Monday January 8th. When we arrived we noticed that the carpet had been removed and there was a Wood Floor (Flooring Gallery) contractor installing wood floorsThe homeowner then showed us the area of concern in the Family RoomThere were areas on either end of the room with small circle spotsI explained that these areas would not typically have plumbing running through the slab as there are not bathrooms on the back or sides of the roomFurthermore, there are no supply lines in the slab either as those are run overhead through the framing part of the home Next, I knelt down and smelled these spots, there was a very strong smell of urineThe Homeowner did confirm that they in fact do have a dogThe homeowner told me they initially thought it was urine as well but that the wood floor contactor told them it couldn’t be because it had not totally dried up at that pointI reiterated that we are confident they do not have any leaks in the foundation and that these spots are from their dog The Homeowner was also concerned about a 2-wall off the front bay window of their home being out of square and an area of sheetrock where the tape had come loose in the archway to the breakfast roomI confirmed that even though they were out of their year warranty, we would agree to fix both the wall and the loose sheetrock tape* *** *** also asked me to fix the corner of their entry gutter as it leaks in the degree joint when it rainsI also agreed to fix this as well. I am rejecting this response because: There is no point in trying to counter this since you guys are so very adamant and making all claims! There is no point in proceeding in this route.I am only willing to accept the installation if you can finish this by end of this month, Since you claimed you are ready to install and that you have all the equipment, you should be able to finish this by end of this month.If KHOV can guarantee that and make sure they are installaing each and every part of the packages as per the contract and should in working condition.Since they wasted a lot of my time, I would like them to install it over a weekend.If you fail to do this, I need a counter resolution as a refundIf you can promise all this , I am ready to accept the agreement.

I am rejecting this response because:
I have received only one email from Mrs J[redacted] and she has not been in constant contact and has provided zero resolution. I have the paperwork outlining that a fully sodded lawn is to be included and completed per the PA.Completing the final zone of the sprinkler system is due to KHov's negligence for inability to complete this on time and thus the company hired to install the sprinkler system is no longer available so this now falls on KHov.

I am rejecting this response because: I have attempted many times to contact KHov and they refuse to answer. Part of the agreement was for them to do the entire yard space, this includes the full area of the berm.

Hovnanian no longer has a Division in [redacted] and has since sold its Operations to [redacted]  In addition, [redacted] was kind enough to shed some light to K. Hovnanian on the situation. [redacted] has sent us photos which show the K....

Hovnanian homes and we did not sod over the berm on our homes. [redacted] (who has built in the community) did sod over the berm on their homes. K. Hovnanian is attempting to obtain a copy of the Homeowners sales contract to see if there is an verbiage regarding this area and what was to be done.  We have since been in contact with the Homeowner and will continue to be until this issue is resolved. K. I am rejecting this response because:
Buyer contacted MUD office prior to contract signature back in 2016.  Statement from MUD was that facility had pumps running only 3-4 times a week for 30-45 minutes each time.  Community is gated and closed off during non working (non construction) hours.  Lot was last lot of community with construction constant all around.  Opportunity was not present to witness zero outside noise at site prior to contract signature.  Buyer made every independent effort to investigate facility.  K Hovnanian withheld information that buyer directly requested.  Buyer only discovered noise consistency by requesting a technician to the facility and talking to the low level facility employee.  K Hovnanian acted unethically with intent to misguide for financial gain at expense of consumer causing loss of finances, stress, pain, and anguish.

This home closed on January 27, 2017.  At the time of the Orientation (GKO) and Delivery (GKD), the trees in the yard were dormant.  The customers were concerned about the dormancy, and thought they may be dead.  Because of their concern, the items were noted on the GKO form as “Front...

tree looks to be dying” and “Tree in back yard appears to be dying”.  It is common practice for the Homeowner Service Manager to write down issues as the customer says them, so there is no mistaking what the concern is.  After the GKO, the Construction Manager handles the items as needed.  He determined that the trees were alive, and in fact were in the dormancy phase.  One way that this occurs is to either have a landscaper come to the home and check, or perform the same test as the landscaper would – the scratch test.  When a tree is dormant, and the bark is scratched, there are two results-green under the bark or not green.  In the case of the two notes tress, there was green, which means that the tree is alive.  At GKD, this was explained and signed off on. Also reviewed at the GKO are the warranties that are extended to K. Hovnanian customers.  The customer is given a Customer Home Care Guide as well.  Within this book, it is noted in several places that there is no warranty on landscaping.  In addition, at the time end of the GKO, the customer signs off that they understand the warranties.  This form even specifically indicates a list of items that are NOT WARRANTED after Move-in.  One of those items is “Sod, Landscape and Shrubs” (attached and highlighted). Because of the nature of landscaping, it is important for the customer to understand that K. Hovnanian has no control over their care of the landscaping once they take possession of the home.

The Company respects the Consumers' right to terminate their contract.  However, the written terms and conditions of the sale  and of...

any termination of the transaction are clear.  At all times related to this matter, K. Hovnanian fully complied with its responsibilities and obligations.  More specifically, the Consumers were aware of the location of the facility in question at the time that they entered into the contract.  Also, they were urged in writing to make their own independent investigation into any matter they deemed important to their decision to purchase the home and specifically those matters related to adjacent land, land use or facilities.  It appears from the Consumers' own statements to the Revdex.com that they waited to contact the governmental agency responsible for the facility only after they entered into their contract.  That was their decision.  They were also told in writing not to rely on statements made by the sales associate regarding matters related to adjacent property.  This is because that information may be incomplete or may change.  At no time did K. Hovnanian do anything to hide the existence or location of the facility.  The facility is not owned, operated, or managed by K. Hovnanian nor does any associate of K. Hovnanian have any expertise or special knowledge regarding such facilities.  Again, the decision to terminate their purchase of the home has been acknowledged.  However, the earnest money deposit under the circumstances of this matter is non-refundable because at all times relevant to this matter K. Hovnanian fulfilled its obligations to the Consumers and complied in all ways with the terms and conditions of their written agreement.

understanding that the storm water discharge pipe was blocked, broken, or otherwise not working.  While the process was frustrating it appears that part of the concern has been resolved.  In order to accomplish this part of your driveway was replaced.   According to your complaint you have the following issues with the work to date: Concrete spoils that have been placed at the end of your driveway have not been removed You are concerned that the concrete installed has been discolored either during the install or the next day while it was sawcut. Your landscaping and grade at the driveway and in the trench that was worked on has not been restored.   K. Hovnanian Homes, Cleveland is committed to removing the concrete, assessing the coloration of the driveway, and restoring the grade to the areas worked on.  Meaning at the driveway and in the trench.  We are committed to completing these tasks no later than 12/15/2017.  Based on our phone conversation (12/5/2017) you stated you would prefer to install your own grass.  I am agreeable to reimbursing you for the required seed and straw to accomplish that task.  I require an estimated cost prior to your purchasing the material that I may agree to, and a receipt of purchase in order to process the reimbursement.   You have stated concern about the grade of the property at a side swale.  K. Hovnanian homes warranty does not extend to the property grade beyond one year.  The term settling, and the settling that is covered during the warranty period of one year, refers to the settling that is common in backfills and utility trenches. RK, Senior Construction Manager; K.
