She also states that she spoke with an individual named [redacted] and was directed to send various amounts of monies in order to receive a loan. Advance America does not show any open or closed accounts in the name of the [redacted] with the corresponding address. Additionally, Advance America does not request that consumers pay a fee in advance of receiving a loan. Unfortunately, Advance America has encountered complaints of this nature in the past. This communication appears to be part of an effort by criminals to defraud consumers by falsely claiming to represent Advance America. Advance America has previously communicated similar efforts to state and federal regulators as well as the Federal Bureau of Investigation and local law enforcement agencies. Advance America does not operate brick and mortar locations in Pennsylvania, nor does it offer online loans to Pennsylvania residents. I have reviewed the response made by the business in reference to complaint ID[redacted], and have determined that this does not resolve my complaint. 
I am rejecting the offer because I have already had to submit all applicable documentation to the state department, I will not trust E-Tax with my information again.
I would like a refund for the service they did not provide ( the correct filing of my state tax).   The E-Tax representative suggested that the branch and I supplied him with that information. 
 
E- Tax  owes me and the Advance America branch an apology.

Upon receipt of [redacted] complaint, we performed a diligent search of our records and we have identified [redacted] as a former customer of Advance America. Advance America respectfully states that it is not responsible for the alleged conduct in [redacted] complaint. Unfortunately, Advance America has encountered complaints of a similar nature in the past. We have posted a Consumer Alert in all of our locations regarding the dangers of scam calls involving fraudulent collection attempts.
[redacted] states that he was told he was approved for a $5000 loan. Additionally, [redacted] claims that he was instructed to purchase a “vanilla reload network” card and load $110 onto the card in order to receive the loan proceeds. Advance America’s loan process does not include payment in advance of receiving a loan. Further, Advance America has not operated in the state of Pennsylvania since 2007.
According to our records, [redacted] opened a Choice Line of Credit account with [redacted] of Delaware, LLC d/b/a/ Advance America on April 19, 2007. [redacted] has a remaining outstanding balance of $500.00. This balance does not contain any fees or interest, which were waived from his account in 2007. Advance America is not actively collecting on any Revolving Credit Agreements in the Commonwealth of Pennsylvania.
We recommend that[redacted] document all details of any such offers in the future, that he not disclose any personal information to the caller, and, if appropriate, report such calls to law enforcement.

We appreciate the opportunity to respond. In Ohio, Advance America is registered as a Credit Services Organization. Advance America assists customers in gathering information to provide to [redacted] Finance Ohio, LLC (the “Lender”), so that the Lender can make a decision whether to issue a loan to the customer. The customer is approved or denied based on the criteria set by the Lender. When a customer is approved, the Lender then funds the loan in the amount identified in the Promissory Note. At the customer’s request, and in consideration of a loan extended by the Lender, Advance America issues a guaranty to the Lender in the amount identified in the Promissory Note. In the event the customer defaults, the Lender calls for payment on the guaranty to the extent that it is outstanding. Due to the customer defaulting on the loan for non-payment, and the guaranty being called by the Lender, the customer will then owe Advance America the unpaid loan amount, which was originally loaned to the customer by the Lender. According to our records, Ms. [redacted] entered into a Promissory Note with the Lender on October 28, 2014. On December 24, 2015, Ms. [redacted] entered the Advance America center and contracted with Advance America to arrange a refinance of the previous loan with the Lender. On February 21, 2015, Ms. [redacted] entered the Advance America center and again contracted with Advance America to arrange a refinance of the loan with the Lender. As of the date of this letter, the loan that Ms. [redacted] entered into with the Lender is in current status and has not been assigned to Advance America. If Ms. [redacted] would like further information about her loan, she may contact [redacted] Finance Ohio, LLC by mail at [redacted], Dept. Yet they call me everyday asking where the money is for the loan. They call from the same number [redacted], I have blocked the number , so now I get calls from unknown numbers, or from different areas in Florida all day long and if I answer them its the same people. they are very rude now and I want them to stop and I really would like to get the money I gave them back. they are scam artist who pray on people with bad credit. I feel terrible for falling for their scam. Please help me , they are not being truthful with you .

Dear Ms. [redacted] of Ohio, Inc. d/b/a Advance America (“Advance America”) is in receipt of the additional information provided by [redacted] in answer to our response to her complaint. We appreciate the opportunity to respond.
Upon being provided the location at which the incident described in Ms. [redacted]'s complaint took place, we were able to further research the matter. We have determined that Ms. [redacted] regularly accompanies a third party in the Advance America center located at [redacted], Ohio. According to our records and eyewitnesses, Ms. [redacted] has, on many occasions and through various means, attempted to obtain information about the third party’s account. She has not been able to provide a Power of Attorney for the third party, and center team members have repeatedly advised Ms. [redacted] that they are unable to discuss the account with Ms. [redacted].
On the day of the incident referenced in Ms. [redacted]’s complaint, Ms. [redacted] entered the center with the third party. She became upset about activity on the account, which was shared with her by the third party, and began verbally abusing the Advance America employees. Team members attempted to resolve the issue, but Ms. [redacted] continued being loud and disruptive in the lobby of the center, where other customers were present. Ms. [redacted] was asked politely to leave the center and advised that the police would be contacted if necessary. When Ms. [redacted] still refused to calm down or leave the center, team members called the police who escorted Ms. [redacted] from the center.

The above-referenced complaint has been received and reviewed by the Legal and Regulatory division of Advance America, Cash Advance Centers, Inc. on behalf of its subsidiary, [redacted] Small Loans of Ohio, Inc. d/b/a [redacted] (“[redacted]"). We have reviewed the complaint and appreciate the opportunity to respond.
[redacted] serves as the Electronic Return Originator for [redacted], Inc. d/b/a [redacted] (“[redacted]”). In this role, [redacted] collects and transmits the customer’s tax information to [redacted], who is the tax preparer.
According to our records [redacted] filed her Federal and State tax returns through [redacted] on January 28, 2014. Per [redacted] services, [redacted] was charged a tax preparation fee amount of $211.00, and when [redacted] elected to receive her tax refund check through a direct deposit refund anticipation check, she was charged $108.95 by the issuing bank. [redacted] elected to sign-up for audit defense and was charged $49.90. By selecting a direct deposit refund anticipation check, [redacted] made no upfront payments, but had her total fees of $368.95 deducted from her refund anticipation check. The fees associated with the[redacted] services were explained to [redacted] by our center employees. After the potential tax preparation fees were disclosed to[redacted], center employees explained all possible refund cap-liens available to [redacted]. Although her forms were already prepared the center could not have processed
her infomation with [redacted] until [redacted] had counted in the service, after being told what the service would cost.
[redacted] had a federal refund of 745.00 and a state refund of $109.00 before fees.[redacted] received a total refund of $485.05 after fees, which cleared the bank on February 14,
2014.

Upon a return call, Ms. [redacted] was instructed to complete a MoneyGram transfer for $250.00. She refused this directive. Since that time, monies have been withdrawn from Ms. [redacted]’s account. Neither Advance America, nor any of its affiliated companies, request that consumers pay a fee in advance of receiving a loan. According to our records, Advance America does not have a customer or an applicant with the name and address provided. The customer is approved or denied based on the criteria set by the Lender. When a customer is approved, the Lender then funds the loan in the amount identified in the Promissory Note. At the customer’s request, and in consideration of a loan extended by the Lender, National Cash Advance issues a guaranty to the Lender in the amount identified in the Promissory Note. In the event the customer defaults, the Lender calls for payment on the guaranty to the extent that it is outstanding. Due to the customer defaulting on the loan for non-payment, and the guaranty being called by the Lender, the customer will then owe National Cash Advance the unpaid loan amount, which was originally loaned to the customer by the Lender. According to our records, Mr. [redacted] entered into a Promissory Note with the Lender on December 5, 2014. Pursuant to this Promissory Note, Mr. [redacted] agreed to repay the loan to the Lender in two payments. The first payment, in the amount of $155.78, was due on January 4, 2015. He paid that payment to the Lender as agreed. On January 2, 2015, Mr. [redacted] made an additional cash payment of $44.22. Mr. [redacted]’s second payment, in the amount of $1,150.62, was due on February 3, 2015. On February 3, 2015, he made a cash payment of $250.00. When Mr. [redacted] failed to make any further payments, his obligation to repay was transferred to National Cash Advance as outlined above. As of the date of this letter, Mr. [redacted] has a remaining past due balance with National Cash Advance in the amount of $861.05. Mr. [redacted] states that, on February 3, 2015, he requested an extension to repay his loan. National Cash Advance cannot offer an extension on behalf of the Lender, but Mr. [redacted] was eligible for a refinance. When Mr. [redacted] entered the National Cash Advance center on February 3, 2015, the customer service representative attempted to explain Mr. [redacted]’s options. Mr. [redacted] became visibly upset and he stated that he did not have the 5% buydown amount required to refinance a title loan. He then threw $250.00 at her and left the center. The $250.00 was applied to his account. National Cash Advance strives to offer excellent customer satisfaction.
