Hi [redacted] , I just talked to you on the phone about reopening my case against Hubble HomesI didn't respond immediately to Hubble's resolution because I was dissatisfied with it and I had a disaster recovery person scheduled to come out soon and do an independent assessmentI got that assessment, but before I could respond on the Revdex.com website, the case was automatically closed I've attached the assessment I received from the disaster recovery specialist, which stands in contradiction to most of Hubble's claimsIn a nut shell, Hubble claims the flooding in our crawlspace is strictly the result of irrigation problems as controlled by the HOA, but the disaster recovery specialists believe the primary cause is a perched water table and a lack of a drainage system which should've been installed when the house was built Please let me know what I should do next to keep this case going Thanks, [redacted]

Local building inspectors agreed with the rectification of your construction changes that needed to be made during construction, it is unfortunate you did not Hubble Homes building standards are highly regulated by both local and state inspections and we feel strongly about the quality of craftsmanship we provided you and your family in your new home purchase

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]It doesn't matter that those "Lawsuits" were in a different city - the point is that those homes who had those issues were built by Hubble Homes and it is only Hubble Homes that seems to have these issues and they seem to keep arising, because there are corners cutI have four other home owners in Saddlebrook who are seeing the same issues in there crawlspace and have paper trails of back and fourth's with Josh from Hubble.I also found out from the board of Saddlebrook, Hubble used a loophole in the Saddlebrook CCRs to build without getting plans preapproved, which is how they were able to build without installing drain systems and never told about the water table when selecting lots. So with that being said, unless all other home owners who are experiencing these same issues have the same sprinkler problem than I guess your claim would make sense BUT that is not the caseAll home owners whom have these issues, were all built by HubbleInterestingMy attorney will be in contact.

This area has been re-inspected since construction was completed by a city official and it was determined that the area of concern has met all the requirements of state and local building codes. There are other municipalities that require this metal flashing on every home. The flashing is installed as well as there is more than sufficient grade of the concrete patio to allow water to run away from the dwelling

Ref #*** Hubble Homes strives to maintain in good standing with their customers and the communityThe home in reference was completed during the winter months and at the time of occupancy was not able to be painted due to weather conditions. There was a with-hold agreement signed by both
the seller and buyer at time of closingThis agreement stated that the home would be painted on or before June 30th 2017. These obligations were met with the exception of some touch up items that we have since gone back and completed. We are unaware of any items that are outstanding on this home. We would be more than happy to address any concerns once they are brought to our attention by emailing [email protected]

For your reference, details of the offer I reviewed appear below.Regards,*** *** On Wednesday, August 12, 2015,** *** ***Mr***, The HOA has had the irrigation system check several time, as recently as last week and has never found any evidence or indication that the system is or has been leaking that would suggest it was the cause of the problem that you mention. Hubble Homes made the same claim early in the year, before the irrigation system was even turned on and while the canal was still empty. The HOA could not understand how when the canal was empty, the pumps were not in operation and all of the mainlines were empty and had been drained since the system was shut down and blown out from the previous season, that the irrigation system could be suggested to be the cause of the problem. What you may want to consider is that the water table in Star and specially in Saddlebrook is extremely shallow. When working with ACHD last summer, on the storm water retention areas, a measurement was taken from the monitoring well that ACHD had installed and in the middle of summer the ground water level was less than feet from the surface. The Design Guidelines for construction in Saddlebrook require that builders install foundation drains around the structure during construction because of the high water table. When builders apply for construction approval in Saddlebrook, they are required to submit a set of plans which are reviewed by an independent architect, contracted by the HOA, to ensure that the plans conform to the Design Guidelines before the HOA accepts the proposed construction. The installation of foundation drains is one of many items that are checked in the review process. When Hubble Homes purchased the properties in Saddlebrook, they did so from the bank that had received the properties back from the developer as a result of his bankruptcy. At the sale, the bank transferred to Hubble the developers "Grantors Rights" which basically means that they did not need to abide by the rules and requirements of the CC&R's and as such, did not need to obtain permission from the HOA to build nor to submit plans for the architectural review. That being said, the HOA has no knowledge if Hubble installed foundation drains in the homes that they built and the HOA has never received a response when the question about installation of foundation drains was asked. If in fact the water issues you are experiencing are related to the known issue of a high water table in the area, this is a matter you and your builder need to resolve. If at any time the irrigation system can be found to be leaking, the HOA will make any required repairs to the system but at this point after several inspections no issues have been found. We have investigated this homeowners concern and have sent him a letter stating our findings as well as our professional opinion as to why this is not a ground water issue I have attached the letter that is in the mail on its way to him if he has not received it yet There are multiple
items that may be contributing to the issues with water intrusion on this home including but not limited to: lack of gutters on the home to direct rain water away from the home, landscape up against the foundation, and it was witnessed that the homeowner has sprinklers that are hitting the siding of the home There is a water meter that is lower than the crawl space on the South East side of the home as well as an irrigation curb stop on the North West side of the home that are both free of standing water If this was a water table issue on this home both of those lower points would have standing water in eachIt is the opinion of Hubble Homes that this is a surface water issue and is outside of the control of the builderWe are unaware of any, "suits" that were brought against Hubble for similar situationsWith regards to the improper construction comment Hubble Homes has multiple inspections performed by the State of Idaho as well as the municipalities confirming that construction was performed to the standards required by both parties

The shower pan is installed by the Plumbing company. Most tub shower units are freestanding and do not require any type of added supportYour home passed all local and state inspections when it was constructed including the state plumbing inspection. Our records indicate that we were notified of two small cracks in the shower on 12/6/and this is shown as being completed 12/20/2012. This was over years ago and was not brought back to our attention until November 2016. I regret to inform you that this is not something that is covered under the warranty provided by Hubble Homesthank you, Hubble Homes

Hubble Homes has been investigating issues with common areas with the HOA and the board We have determined that this is not a builder issue and we believe the water is coming from multiple breaks or fractures in the Pressurized Irrigation Main line, which is owned and maintained by the HOA
We met with the board members of the HOA on 9-2-on site and they are having a board meeting September 9th to discuss a course of action This is not a result of a high water table as there is not any standing water in any of the water meter vaults in the front yards that are well below the depth of the crawl space If this issue was caused by a high water table there would be standing water in all of the meter vaults and irrigation isolation valves The HOA is working on a solution to trouble shoot this issue

Unfortunately I cannot accept that as a valid excuseIf I did live in one of those municipalities then I would understandHowever, I do not and I do not see any other houses that are forced to have this due to a mistake caused by HubbleI understand that an inspector has looked at it and marked it as valid, but it does not explain why I have to live with the appearance of the resolution when another resolution and the correct resolution is simple
I chose to build with Hubble and have a turn key homeNew constructionI would like to receive the feeling of a new home, rather than a home where mistakes were made and now I have to live with a blemish (a big one I might add) due to the builders mistakesThe price of the resolution to remove that 10xpad, re-hang the flashing that slipped, and re-concrete that slab would be nothing compared the 205,I paid for that houseIn fact, Hubble can have it done cheaper than I canAs I mentioned before, either way the flashing is going to be removedIf Hubble refuses to make me feel like I received what I had paid for, I will fix this myself and have to present the fee's to Hubble in court.
I do appreciate all the help you have given with my other requests, however this is one that I can not let stayThis is something Hubble should be able to do right for with a customer

To Whom it May Concern,
Let me first express our sincere apologies on any miscommunication. We work diligently to educate our buyers about the floorplans and available options, however in this case it seems there was a lack of clarity felt by the client. Our contract
stipulates that $of the earnest money is nonrefundable at the stage of the process the Buyer is in. Additionally, Buyer acknowledges this fact, both in the initial contract as well as in her termination notice, requesting only $500 of her earnest money fund back. However, in an effort to provide the highest level of customer care and illustrate our positive intentions, we will be refunding the remaining $disputed here in this complaint, returning all funds presented by the Buyer.
