I am rejecting this response because: Well I understand the warrenty issueBut what about the improper installation of the shower pan supportI had a warrenty repair on cracking in the shower the second month after closing that work "repair" is documentedHowever it has still had the same problems with cracking and has gotten worseThey apparently put a bandaid over the issue with some sealant and airbrushing but it never fixed the problemI would like this problem fixed and not patched over like they didI quit inquiring about it after the first repair because of hubbles one year warrentyIt's the same shower same issues that have gotten worseSomeone from the builder installed the shower apparently incorrectlyWho is responsible for the insulation issue

Complaint: [redacted]I am rejecting this response because:I had asked to be included in the meeting with the inspector, which your staff decided to not do. Instead, I had an inspector of my own review the work performed and he had included the following standards that are not met within new construction -
SECTION R703
EXTERIOR COVERING
R703.1 General. Exterior walls shall provide the building
with a weather-resistant exterior wall envelope. The exterior
wall envelope shall include flashing as described in Section
R703.8. The exterior wall envelope shall be designed and
constructed in a manner that prevents the accumulation of
water within the wall assembly by providing a water-resistant
barrier behind the exterior veneer as required by Section
R703.2. and a means of draining water that enters the assembly
to the exterior. Protection against condensation in the
exterior wall assembly shall be provided in accordance with
Chapter 11 of this code.
 
This is due the exposed MDF behind the siding which is not protected from wind driven rain or snow pack. Regardless of the "solution" performed, it is hideous to say the least and no other homeowner here has to settle for such a half-assed fix. Hubble has not once made an effort to meet with me in order to come to terms or speak professionally on the matter to find a resolution, and simply, a fix is easy. Rather, I am "bullied" with no's. I take pride in the things I own and would like to take pride in this house, but not while it looks like a mobile home was parked on a cement pad. I would simply like to meet with management, let them visibly see the issue at hand and how frustrated their PAYING CUSTOMER is. If a Hubble employee had purchased a home and was given the same "solution," would they be so willing to accept it? I don't think so.
If Hubble still refuses to do so, I will gladly have the correct resolution put in place and settle the cost of which with Hubble in claims.Sincerely,[redacted]

With the difficulty of your vehicles symptoms there is no way to be able to determine that your vehicle had 1, 2 or 3 different issues which is why the dealer was not able to determine anything initially. We had an architect review the plan on your home and his findings showed
that the square footage of your home is 2804 square feet.  Hubble Homes follows the approved city set of
plans when constructing your home.  Many
times appraisals are an approximate square footage and may not be 100% accurate.  The plans that we follow are from exterior

I just talked to you on the phone about reopening my case against Hubble Homes. I didn't respond immediately to Hubble's resolution because I was dissatisfied with it and I had a disaster recovery person scheduled to come out soon and do an independent assessment. I got that assessment, but before I could respond on the Revdex.com website, the case was automatically closed.
I've attached the assessment I received from the disaster recovery specialist, which stands in contradiction to most of Hubble's claims. In a nut shell, Hubble claims the flooding in our crawlspace is strictly the result of irrigation problems as controlled by the HOA, but the disaster recovery specialists believe the primary cause is a perched water table and a lack of a drainage system which should've been installed when the house was built.
Please let me know what I should do next to keep this case going.

bottom of the crawl spaces. I am unaware of any guidelines where the HOA requires any builder to install drainage systems in the homes.  If you have documentation of this please provide this.

We are unaware that pumps were installed in all the other homes.  To our knowledge there is not mention of Pump being required in the HOA's that you speak of.  Hubble Homes still believes that the water issues you are experiencing are that from irrigation and or surface water.  As we have stated before there is not water in the water meter vaults in the fronts of the home that are lower than the crawl space.  This clearly confirms that the water table is well below the level of your crawl space.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]With all do respect, Hubbles professional opinion does not come close to the 2 separate 3rd party water restoration experts, Hydrologists with the Idaho Water Resource Board and the President of Star Sewer and Water of whom all confirm - Star indeed has a high water table.  To make a claim that it could simply be from not having enough "rain gutters" is beyond ridiculous since we haven't had much rain and if you would have come out and gone down into our crawlspace... the amount of water infiltrating is not caused by rain and or sprinklers when the sprinkler hits the back house for 10 second intervals for 15 minutes run time. You can find a link here which shows Hubble Homes being involved in class action law suits concerning water infiltrating crawlspaces causing "mold" due to improper construction practices and knowingly sold and built homes on lots where they knew there was ground seepage and water issues. Also in here, it states homeowners haven't been able to get anywhere with fixing the problem and kept a "steady pattern of ignoring homeowner's concerns" Interesting, that we are and have been experiencing the same "no help" response. http://www.hbsslaw.com/newsroom/boise-area-housing-developer-target-of-class-act... - You can find the lawsuits against Hubble all over the internet, its no big secret, lets add 1 more home to the problem.Here attached is also a live video that was shot explaining the issues, the cause, and the fix by a 3rd party professional in this space and this is all he does. Hubble Homes argument to me is "Of course they are going to tell you that, they want the job" Regardless of the cause of this issue, they have a job. Hubble Homes is simply skating around the problem to protect costs. I would like to address the locations and time frame of the, Lawsuits" that you are referring to.  This was in 2002 on the opposite side of the Valley in a different city all together which has not correlation to your home.  As stated in the previous letter there is not water in the water meter vault nor the irrigation isolation valve, which are on opposite sides of your home.  Being that the bottom of both of these are lower than your crawl space and have not standing water in them would suggest that you are stating that water is running uphill into your crawl space.  This defies physics.  There are numerous other builders in the immediate area that have built homes close by that are not having water table issues and many of these are at a lower level than your home.   As stated this is a surface water issue and not a ground water, or water table issue.  Please refer to the previous response as to what we recommended to aid you in re mediating the issue at hand.

We are glad your initial experience was great, and received a great value on your home compared to the current market in Caldwell!  Local building inspectors agreed with the rectification of your construction changes that needed to be made during construction, it is unfortunate you did...

Mr. [redacted],We have been out and adjusted your gate a few times already.  The last time our vendor went out and the gate was adjusted and both myself and the construction manager inspected this and there was not any issues found. Everything was level and the gaps were all even.  A few...

weeks ago both myself and the on site Project Manager noticed that the gate was  left open and not secure.  Not sure who opened it but when I witnessed it both sides of the gate were moving from the wind. There are steel sleeves in both of the posts where they need to be.  Hubble Homes can not be responsible for gates that are left open and allowed to move from the wind.  This caused damaged to gates from being overextended and from slamming open and shut. When I drove through the subdivision yesterday the reveals on the gate are no longer even and the gate is bowed out from being left open and damage caused by circumstances outside of our control.

As we stated previously this is not a water table issue.  Please ask your specialist why there is not water in the water meter vault, or any of the vaults in the area, which are well below the level of the crawl space. If this was in fact a water table issue there would be standing water in the water meter vault.  Hubble Homes is still of the stance that this is surface water caused by irrigation water.  The HOA is currently troubleshooting the possibility of potential leaks in the pressurized irrigation system.

I am rejecting this response because:our purchase was made with the attached appraisal which reflects the square footage. Regardless if Hubble Home was following the city set plans, these plans did not seal the financial commitement, like the appraisal. This is a misrepresentation of product. I was committed to the floor plan I2,618 and style and never was I told at the purchase of this plan it would not reflect that on an appraisal. In your letter you state that it is 2,804 which a huge difference from the original plan. My concern is this misrepresentation (false advertisement. How many home owners pay for a set floor plan and are shorted on square footage? Hubble Home owes me the difference. The product I purchased was not delivered.

Stucco.  The stucco system that is used is a western one coat system and is used throughout the valley and is well within the standard of stucco installation. Mr. [redacted] had another company come out and give him an estimate for redoing the stucco on his home and this individual, from my understanding, was going to use a completely different application that what our standard is. Per the building standardGuidelines Section 5-5-1Observation: An exterior stucco wall surface is cracked. Performance Guideline: Cracks in exterior stucco wall surfaces willnot exceed 1/8 inch in width. Corrective Measure: One time only during the warrantyperiod, the contractor will repair cracks exceeding 1/8 inch in width. Caulkingand touch-up painting are acceptable.
