Review: Josh hired a contractor to install their walk in tub and he ruined my floors and the tub has broken for the 2nd Time with the air blower. The contractor took out the supports under the floor, this is in California and they were earthquake supports! The air blower and the drain is broken on the tub and my disabled daughter cannot step on the flooring without it sinking, which it did not do previously! I have recently discovered that the contractor he hired to install, a Davis L[redacted] through Frank C[redacted] has never had a contractors license in California! Have spoken to Josh S[redacted] about this many times since July of 2015, recently he said he would pay for all repairs but I am having trouble just finding a contractor give me an estimate since they are all saying that he won't pay for the repairs. I have called several times and left messages and now am not getting calls back!!Desired Settlement: Flooring and bathtub repaired so my disabled family members can use the tub!! I take care of my brother, daughter and son who are all disabled. My daughter is the largest at 360lbs. Before they put in tub had no problem with flooring, now she's scared to go in bathroom! Also want all the supports that the contractor stole replaced since they are a must in California!

Response:

Independent Home has been in contact multiple times to address said issues. This particular customers job sold for $10,800 not the stated $24,000. Based on our investigation the licensed contractor who installed the tub did everything to code. There were never any earthquake braces touched or removed from beneath her home. The licensed contractor never had a need to go beneath the home as all the work was done from within the bathroom. Customer’s stated issues with earthquake supports are due to another company trying to get work from client. We have already dispatched another licensed contractor to get a non-biased opinion, who confirmed to us and informed the customer that the install was indeed done correctly and beautifully. The contractor already has another appointment to meet with customer tomorrow 03/**/16 to replace air blower to tub, and address any other issues she may have. Thank You, Josh S[redacted]

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]Did not complain about bathtub installation itself although it has broken down twice and this second time I've been calling sine July 2015 with no help. I complained about the flooring around the tub because it started sinking! David L[redacted] whom the company sent out to install the tub does not have a contractors license here in California and never has, his brother they said he was working under, Daniel L[redacted] does not have one either. The new contractor, Dave S[redacted] has fixed the bathtub (I asked to see his license), he tried to fix the flooring but I stood there and watched as he pulled back the linoleum and saw there was particleboard placed where there should have been wood. I took pictures and sent them to Josh S[redacted] and Frank who works for them here in California. I also scraped using a screwdriver to show the difference since there is still the regular subfloor near the toilet and where David L[redacted] put in particle board next to the tub. I am sorry but they all saw my daughter is a big girl, she weights 360 and the good particle board groans under her weight. Let alone if she had stepped on the part that was broken! My daughter still does not feel safe going near the tub because it's scary for her even after Dave S[redacted] tried to patch the hole. I just want my daughter to feel safe again and able to take a bath without worrying about falling through the floor.. Still waiting on their response about the floor, just want the particle board or whatever it is out and wood like the rest of my home put in. I did not even put into my original complaint that David L[redacted] didn't even know how to use drywall tape on the wall!! Please, just help me to help my kids!! They are both disabled and have to use the tub!! If they are too afraid to go near it how can they get in it?? Sent all the pictures I took to Josh S[redacted].

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved. Bathtub issues have been resolved to my satisfaction. Flooring issues will be resolved within 30 days, per Frank C[redacted]. I thank the company for helping me with this issue and will be recommending them to my friends and family again.

Sincerely,

We signed a contract on April **, 2015 with Independent Home for the purchase and install of a new walk in tub. The tub arrived on April **, 2015 and that is the day the installer (sales person) started the work. When the tub arrived it was damaged during shipping. One of the leveling feet were damaged. The installer who was also the sale person signed for the delivery. We do not know if he noted that it was damaged on the shipping papers. The bottom of the box that the tub was in had damage. When it came time to bring the tub into the bathroom our son had to help the installer and his co-worker carry the tub into the bathroom. The installer stated that he did not know how to install the fast drain system on the tub and he would refund $200.00 of the installation cost instead of finishing the installation properly. We noticed that the installer was using the wrong thickness green board, two different types of green board, the green board had multiple seems (pieces), and one of the corners were damaged. Also the installer used crews and nails to install the green board. The nail heads were not all set properly and sticking out of the drywall that would damage the surround when it gets installed. When we asked the installer about it he stated that the surround and the trim board would hide everything. We also asked the installer why he was going to use base board trim to finish the edge around the surround and the bathroom walls. We also asked why the rust-oleum spray paint did not match the color of the surround. The installer stated that he could not find any other color that matched the tube or the surround. The pieces of surround that the installer had also did not match in color with the tub. The surround pieces were too small for the job and had bent or broken corners. The installer stated that the trim board hides those issues. After talking to the installer on the phone April **, 2015 about our concerns he stated that he was walking away from the job. The installer stated that he was not a licensed plumber or electrician. He wanted us to pay him $1,200.00 for the work he completed and $1,000.00 for the rest of the tub. He stated that it should cost us about $200.00 for an electrician and about $150.00 for a plumber to finish the job. The installer also stated that he was coming to collect his tools. On April **, 2015 we talked with [redacted] from Independent Homes and he stated that we should not pay the installer anything because the installer did not complete the work and the installer should have found a better surround if that is what we wanted. [redacted] also stated that he was going to investigate this more on the following Monday which would be April **, 2015. When the installer came to get his tools our son requested that the installer grab his tools and leave the house. The installer insisted on going into our basement to grab the surround and our son told him no he needed to leave. The installer took his tools out to his vehicle and then came back into the house. After telling the installer that he was not to go into the basement he still made the attempt by opening the door to go down the stairs. Our son intervened by holding the door closed and told the installer to leave or he was calling the police. After the installer left we noticed that the 2x4 material that the installer was going to use was also twisted and not straight. We have taken pictures of the materials that were being used and the work that was completed.
