The client has already submitted for HOA approval and once it's granted we will continue with the project construction

Perhaps I should have been more clear from the beginning, this is not Mr. [redacted], I am a new project manager that is here to complete a few of the projects that were left unfinished while he attends to his family overseas.
Mr. [redacted] has no more money to make from you, so the fact that he hired me and specifically instructed me to complete your project should say something.
At this point, he is not even sure when and if he will be return.
I have gotten paid in advance to complete and manage those unfinished projects till the end of May. The sooner I go to work is better for you. 
Oh, also this whole letting everyone know is really pointless because he's not in this business anymore. I'm sure you know that a judgement in your favour is meaningless if you can't collect on it. I understood you were in touch with the Geisers so you should know where this road is leading.
There are maybe 2-3 weeks tops to finish your pool.

We obviously believe that the price you've been quoted to finish this project is a complete scam because what that price means is that digging the pool, rebar, gunite, running the plumbing, doing the tile, coping, rock work and pouring the concrete is around 22K. It shouldn't take a math genius to...

realize someone is trying to take advantage of you.
We will continue construction on the project on 4/16 and complete the project as originally contracted. (weather permitting)
As for the the sprinkler system, you were advised that the entire sprinkler system will have to be redone after we finished because we are taking the entire back yard for the pool, so any previous plumbing that was running would have to be taken out for excavation of the pool.
"Shutting the hot water" - if you refer to the part where the gas was shut off in order to disconnect the outer gas connection in the old outdoor kitchen, then you were asked if the water heaters in your house were electric ignitors or gas and you said electric. turning the "Hot water" back on would have simply require lighting the pilot on the water heater. Not sure why this is even mentioned, unless it was meant to "fluff" this complaint
If there is a problem with drainage on the new concrete slab, then that can be corrected by floating the necessary areas while installing the tile, but breaking the concrete and pouring a new slab means you get to charge more and make more money. Oldest scam in the book
Continuing were we left off is the only solution we are proposing.

As you can see in his responses, Mr. [redacted] refuses to  acknowledge that he abandoned the project for 6 weeks after being paid  in full and only now, through this website does he say, "I'm here, I'll finish it now,"with no explanation of his mysterious disappearance and lack of communication.   He left me no choice but to get an attorney because he took the money and was gone, and when I reached out to him he ignored every call, text, and email, and left me a mess for me to clean up.  I guess he expected me to just wait around, hoping he might someday return.
He accuses everyone of trying to scam me or take advantage, but to this point, only he has accepted money, around $65,000, and not delivered the equipment, tile, fence, outdoor kitchen, mosquito system, etc. All of which he said would be done in January of this year.
I hate throwing more money at this problem, but people need to know what type of person they are partnering with for expensive projects.

not resolve my complaint.  I did not ask for work to stop and await HOA approval.  Work stopped and communication from the contractor became very scarce prior to the HOA cease and desist request.  We have 30 days to cease and desist from 11/14, which would allow the contractor to make significant strides in fixing the mess in which he has left my property.  Workers have left garbage and open ditches in my yard, which I have asked to have cleaned up and the contractor has ignored this request.  Workers disassembled my fence and left it that way for us to repair.  
I have asked for the framing materials to be delivered which I have paid for - our agreement states payment is made the day of work commencing on that stage.  I paid for framing materials on 11/4 and materials have not been delivered.  There is no reason the framing materials cannot be delivered at this point.
The contractor has promised to be onsite, deliver materials, or return calls several times, none of which has happened.  I am not prepared to close my complaint until the contractor has completed the work per the agreement or at least has shown good faith effort in proceeding and communicating as demonstrated by him at the beginning of the project.

proposed action would not resolve my complaint.  The work is definitely not complete. No additional work was done on the column therefore this charge is unnacceptable. In fact, my pool contractor came back to finish the column because we were sick of waiting on Infinity. There is additional stone work required to fit the grill properly, there is a gas leak and nothing is finished out. [Provide details of why you are not satisfied with this resolution.]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  What Mr. [redacted] doesn't acknowledge in his response is that after starting the process, and collecting payment in full for the entire project, he abandoned the job, leaving an unfinished pool, no outdoor kitchen, no mosquito system, and no fence.  All equipment including pool equipment and tile has been paid for in full, yet never delivered.  Over the last two months I've reached out to Mr. [redacted] over 30 times by cell phone, text, business phone, email, and even facebook.  He hasn't responded once.  I think it's important for people in Houston to be aware of how Infinity Outdoor Living and Mr. [redacted] do business so they can make an informed decision on who they choose for this type of work.
Edward [redacted] and his company Infinity Outdoor Living continues to be in breach of our agreement. He refuses to perform the work promised and refuses to refund the money he has taken from us. We have tried to resolve the matter but are being forced to avail ourselves to the legal system to sue and recover our money from [redacted] and his company.

I always find it amazing how people twist things around in order to make someone look bad or to benefit themselves. Where in any of my responses did I say that Edwadd sold the project? I told you that he hired me specifically in order to oversee the unfinished projects and insure their completion.
I will not be communicating with your attorney as it is not my place nor my job. If you do not want me to complete your project, then say so.
I will let Mr. [redacted] know and I will move the other projects with the clients who want their pools finished and realized that blood thirsty lawyers are after one thing only - your money.

  The valves are leaking. They have not been repaired. Proof of payment for the Plaster installation has not been provided. The company, Pool Works, will file a lien against my home if payment is not made by the pool builder. The payment of $6,383.00 is due by October 25, 2014. Also, we paid for the larger mosquito system and the smaller one was installed. Pool builder promised to replace the smaller system with the larger one. This has not happened. The smaller system is not working properly anyway. The tank is not holding the fluids.

Thank you for the constant communication. All conflicts were originally going to be resolved 8/31. That deadline was missed and now he says 9/8 because he is leaving for vacation. The biggest issue we are facing is the proof of payment to the brick supplier and the subcontracted painter. His response to my demand is below in red

The only material that was delivered to the job site was the brick. Once we complete the back and come to an agreement on completing the front I will handle the brick invoice. The rest of the material was brought by me or my crew, thus not putting you or your property at any lien risk (so no other receipts or proof will be provided). The only sub was the painter and he has been paid.
 
He has not earned the right to do the work out front. I also just spoke with the painter and he told me he has not been paid.
 
He is supposed to complete all the required work by 9/8 when he returns from vacation. I would be surprised if we don’t have another missed deadline.

You are saying that Infinity outdoor living is refusing to complete the work, but in our last communication here we have given you a specific date on when the work will be continued.  
It seems you are not interested in getting this resolved, but continue to waste time.
going to arbitration will cost you about 10-15K when it s all said and done. 
You have already paid for this project in full (accept the deco tile upgrade). Are you prepared to pay 10-15K more and 40+K to another contractor to to complete the work? where is your guarantee that you will recover this money? have you thought about that? You have an opportunity here to stop the bleeding. Your attorney only wants your money. the longer this goes the more he makes. Once again, you can finish this without paying more.

The work is completed, there is a fridge that needs to be delivered & the extra charge was for the additional stone work on the column

As I responded in my email to you, once I'm back we will continue.
Also the cease and desist is on all work till approval is granted, not to complete what is unfinished.
Besides it makes no sense to cover the ditches so that we can open them back up.
I will send someone tomorrow to clean the property of all debris and fix the fence in the meantime.

Regarding the complaint below, I am writing to ask you to please not close the complaint as resolved because it isn't, and after trying to reach Mr. [redacted] for 6 weeks by phone, text, and email, this was the only forum he responded to, so I find it helpful in trying to resolve.
After apologizing for disappearing off the grid previously, and accepting $64,800, payment in full, Mr [redacted] disappeared for 6 weeks, with no attempt to contact me and let me know what was going on.  Rather than apologize 
again or even acknowledge what he did was wrong, he accuses everyone of trying to scam me.  
All I am seeking is the pool equipment and tile he collected money for and a check for $16,000 for the unfinished work (Outdoor Kitchen, Mosquito system, Stucco Repair, and Iron Fence).  Or a check for the entire amount.
With this offer, I lose a lot because I will need to pay labor to get the project completed.  Mr [redacted] loses nothing but the opportunity to finish the job.  He's only returning money for the unfinished work.
He says he will finish the job, but neither my wife or I am comfortable having him in or around our home.  Especially since he has entrance into our house with a garage door opener and he refuses to return it.  A positive step in the right direction would be to mail our garage door opener back.
