Dear Ms*** [redacted] , We have reviewed the pictures and still determine that this does not evidence any improper installationThe windows are not caulked from the interiorThe window installation includes caulking behind the nailing fin as an air barrier and the flange is taped to the weather resistant barrier as the waterproofing methodsAlthough there are countless accepted methods of window installation and sealing, this is one method that we adapt and we do not subscribe to the notion that there is only one acceptable method nor one appropriate brand of caulking (***)The cardboard behind the sheetrock simply acted as a shim and has no structural or sealing purposeShould you have further questions, feel free to reach out to us through our customer service portal, HaustalkRespectfully,InTown Homes, LTD

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint The reason for rejecting the response is because this is a "latent construction defect" for which the builder needs to be accountable forThe problem arose not from a lack of maintenance per se, but due to a deficiency in the sealing of the windowsThis became evident when we cut open all the windows and confirmed that there was a lack of sealant both inside and outside of the window frames (see attachments and for examples) We also discovered the utilization of inappropriate materials in the windows (cardboard, see attachments and 3618), and can support with evidence the claim that there is negligence in the constructionWe have documented our findings carefully (dozens of pictures from damaged windows), and are prepared to share them publicly and proceed via the legal route if necessary to get the builder to be accountable for cutting corners in the construction of our house.A cursory inspection of the pictures attached will reveal a lack of an appropriate sealing material (***) or even caulkingThe only thing that can be seen is a pink foam that does not seal the windows correctly (if at all), therefore exposing them to water damage.

There is a separate city water meter with each homeThe home owner is confused; we have other developments in the area that are served by community water meters, and those are included in the HOA fees.We cannot add the water bill to the HOA fees.Sincerely,*** ***InTown Homes, Ltd

Tell us why here...Dear Revdex.com, This home closed in 2011, and the warranty ticket was submitted on 03/29/2016, once it was already out of warranty for this type of issueWe still had a project manager visit with the homeowner who agreed that no maintenance had been done to her home and agreed
that it was no longer under warrantyBefore 03/29/2016, another warranty ticket had been submitted which was in regards to a stain on a wall - we later found that this was most likely due to the elevator being installed on the 3rd floorNo window leaks had been reported at that time or before. Therefore, InTown Homes cannot be responsible for the costs that the homeowners have spent on inspections, sealings, clean up costs, etc. Thank you,InTown Homes, LTD

we had already received a message stating that the complaint had been resolved,
and we had already scheduled an in-person meeting with Mr[redacted] in regards to
this complaint, we did not believe that we needed to respond any further to the
messagesOur warranty manager has since inspected Mr[redacted]' home, had holes
cut in the ceiling to locate the leak, and had a contractor seal all
penetration points and add flashing where it was neededWe were to have the
holes patched up the next day, but the homeowner did not allow it, as his
family was going to be visitingTomorrow, on 05/20/2015, we will have a
contractor patch up the holes that were made in the ceilingInTown Homes has
also agreed to wash bricks that were stained due to the A/C drain, address the
peeled paint on the exterior fence, and double check the sprinkler system that previously
had a leakWe were also recently notified that there was an undetected leak in
the 3rd floor guest bedroomWe will make sure to repair this leak as well and
follow up after a few heavy rains to make sure the leaks have been sealed
correctly
The
homeowner is now requesting $13,for "late closing costs and buyer
agent costs", exchanging lamps for ceiling fans in two rooms, move light
switches in three areas, and he would also like for InTown Homes to stain a key
holder to match his floorsAs a courtesy, we have agreed to see if our floor
installer would be able to stain the key holder or notThe other requests are
still being addressed

Complaint
During the negotiation phase of the purchase of our townhome, on several occassions, the developers real estate agent [redacted] indicated the HOA dues which were rather high compared to other townhome / HOA comps in the area included waterWe had our agent double check with [redacted]
several times, each time of which she indicated the HOA dues included water chargesAfter we closed on our townhome several months later we were very suprised when we received notification from the city of Houston that we had not paid our water bill and our water would be shut off on September 22, We've since contacted Intown Home about the water bills and they have now changed their story and have stated water is not included in our HOA duesWe have socially polled our neighbors and each of which were told the same story that water was included in the HOA duesIn addition, we contacted our real estate agent [redacted] to verify what was told to us before, during and even after close regarding the water and she sent several HAR listings from our development with Intown Homes advertising that water was included in the HOA dues
Desired Resolution
The desired outcome at this point is to include water fees that were advertised to be included in the annual HOA dues or lower the high HOA dues that appear to include water charges being collected

Please note that this is not typically included in the construction of the home and this is done at your request. The trellis on your home has also been repaired. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.   Half the issues that were in my complaint have not been discussed or addressed.   The pool was closed for a month due to not being managed properly.  The contractors stealing my electricity causing my electricity to go out thus, losing my meat and fish due to the contractor’s neglect. Ensuring a safe work site for residence.  IN the past the contractors would put a black tarp to keep paint and debris and dust from falling on citizens.  Another report can be made with the police regarding the incident.  The constable at the time of the incident opted not to do a report.  Throwing debris off high floors is common around this construction zone.  No Solid fence has been built to protect my utility connections. No compensation for damaged goods (see original complaint) Partial refunds for pool being closing from Jun7-July 8. A police report will be made.  The constable opted not to do a report at the time of the incident.  There is a significant amount of incidents to report and a report will be generated as soon as my schedule permits. Since half my issues were not discussed in the reply from Intown, my complaint is UNRESOLVED!
