Dear Revdex.com, When the homeowner bought the house, he was well aware that he would be living in a construction zone, where more than 8 houses are currently under construction. We do our best to keep the communities clean during construction; however we are working on foundation, stucco, cornice, etc. We...

have since fenced off phase 1 and phase 2 so that the homeowners of this community will now enter and exit through one entrance, eliminating the issue of having the construction crew in common areas of the community. It was also brought to our attention that Mr. [redacted] spoke with a constable this weekend about general debris. We also spoke with the constable and he agreed with us that we have done nothing wrong. The homeowner wanted him to write a report, but he had nothing to report. The city is replacing water lines in the area and the contractor we have spoken to told us they would not repair the sidewalks until they can repair all of them at once. Thank you,InTown Homes, LTD

  This is not a warranty issue. This is a construction deficiency problem with the house I purchased from you. My neighbors are also experiencing similar symptoms to mine. Given the inadequate response I have received from your company so far, it might be best for me to discuss with them what steps we should take to protect ourselves from this faulty product.

Dear Ms. [redacted], We have reviewed the pictures and still determine that this does not evidence any improper installation. The windows are not caulked from the interior. The window installation includes caulking behind the nailing fin as an air barrier and the flange is taped to the weather resistant barrier as the waterproofing methods. Although there are countless accepted methods of window installation and sealing, this is one method that we adapt and we do not subscribe to the notion that there is only one acceptable method nor one appropriate brand of caulking ([redacted]). The cardboard behind the sheetrock simply acted as a shim and has no structural or sealing purpose. Should you have further questions, feel free to reach out to us through our customer service portal, Haustalk. Respectfully,InTown Homes, LTD

Should you like to review installation details as provided by the [redacted] or the manufacturers, we would be happy to provide you with where those resources may be found. Nevertheless, per the terms of our contracts and the terms of ACES Builders Limited Warranty which covers your home, we have no means for providing reimbursement to homeowners. The lack of sealant and the subsequent water damage is the evidence.  The windows are not caulked from the interior. They should be. The window installation includes caulking behind the nailing fin as an air barrier and the flange is taped to the weather resistant barrier as the waterproofing methods. Evidently your water proofing method allowed water to seep in. Although there are countless accepted methods of window installation and sealing, this is one method that we adapt and we do not subscribe to the notion that there is only one acceptable method nor one appropriate brand of caulking ([redacted]). Your method is substandard, it causes water damage.OK, this is my final position on the issue: refund the $4,000.00 or I will see you in court, and in public social media.

At the time that your purchased your home, the coverage for such issues had already expired.InTown Homes, nevertheless, did make a TPO repair after your initial request but asked that you acknowledge that the work was being done outside the scope of warranty and that the window repair would not be handled by InTown Homes. You signed this document to acknowledge that you are aware of this. we had already received a message stating that the complaint had been resolved,
and we had already scheduled an in-person meeting with Mr[redacted] in regards to
this complaint, we did not believe that we needed to respond any further to the
messagesOur warranty manager has since inspected Mr[redacted]' home, had holes
cut in the ceiling to locate the leak, and had a contractor seal all
penetration points and add flashing where it was neededWe were to have the
holes patched up the next day, but the homeowner did not allow it, as his
family was going to be visitingTomorrow, on 05/20/2015, we will have a
contractor patch up the holes that were made in the ceilingInTown Homes has
also agreed to wash bricks that were stained due to the A/C drain, address the
peeled paint on the exterior fence, and double check the sprinkler system that previously
had a leakWe were also recently notified that there was an undetected leak in
the 3rd floor guest bedroomWe will make sure to repair this leak as well and
follow up after a few heavy rains to make sure the leaks have been sealed
correctly
The
homeowner is now requesting $13,for "late closing costs and buyer
agent costs", exchanging lamps for ceiling fans in two rooms, move light
switches in three areas, and he would also like for InTown Homes to stain a key
holder to match his floorsAs a courtesy, we have agreed to see if our floor
installer would be able to stain the key holder or notThe other requests are
still being addressed

Hello,
We are aware of the 4th water leak
and are currently working on getting it
resolvedWe have our Leak Repair Specialist going to the home on Wednesday,
4/29/2015, at 9:00AMOur Warranty Manager will also be there for inspection
We plan to move as much sheet rock as needed to expose where the leak is coming
from, and will for certain properly seal, caulk and paint where the repair was
performed

They did not troubleshoot the issue thoroughly, instead they simply guessed at where the issue might be and acted based on that. The fixed that was done to the TPO was of no use. They did not even consider the possibility that the issue was with the siding. Instead they jumped to conclusions as soon as standing water was seen on the TPO. If they would have performed a leak test on the TPO, they would've seen that there was no problem with it and instead, could've look else where to see where the problem truly is.
