I am rejecting this response because:Yes, the roof was put on in 2013; however, as of this date, May 12, 2016, we still have not received the Texas Windstorm Certificate that was part of the contract. Also, as of this date, all we are requesting is the Judgment to be paid to us, by [redacted]/Jet Roofing, in which was awarded to us in Civil Court by Judge [redacted], so we can have a new roof put on our house. Not only did we not received a windstorm certificate after the roof was installed, we also discovered that the roof was installed with damaged decking that is required by the Texas Windstorm Dept to be able to get a Windstorm Certificate. The story that is being told by [redacted] about us offering to have a Inspector come is not stated correctly. We only said that we were going to have one come out because [redacted] was not responding to our phone calls and/or messages when inquiring about when we would receive our Certificate. Why would we offer to pay EXTRA MONEY when our original contact included a certificate?? As far as us paying [redacted] the remainder of the payment, he was ONLY given the remainder of his payment because he told a us a story that “his truck broke down and he really needed that money to get it fixed”. Due to the fact that [redacted] and I are genuine people, we felt sorry for Mr. [redacted] and paid him the remainder of the money with the belief/understanding/his word that he was “working on getting our roof a certificate”. The fact that [redacted] is saying that a signature was never obtained on the “original proposal” is correct. HE IS THE BUSINESS OWNER, we did not realize that a signature was needed since most of the communication was originally done by email. WE TRUSTED THAT MR. [redacted] was a man of his word and had a legitimate roofing business and knew the order in which the Texas Windstorm Dept. required during the roofing process. We are not in the roofing business, we had NO IDEA that the Inspector had to be present AS THE ROOF was being installed. He (being the owner of a roofing business) should have known this and communicated that we needed to wait to put the roof on. We only insisted the roof be installed pretty quick because 1.) a weeks’ worth of rain was on the way and 2.) the roofing supplies had been dropped off in the front of our driveway and we did not want anything being stolen and us being responsible. [redacted], THE OWNER OF JET ROOFING, should have known and informed us that if the roof was installed BEFORE the Texas Windstorm Inspector was able to come and witness the process, than more than likely a Licensed Inspector would not approve the roof, especially since the roof was not installed to approval standards. The “documents not being real” is false. The Inspector that we used has no reason to communicate with [redacted]. All of the facts listed above were presented in Civil Court to Judge [redacted], Pct. 1 Place 2 on April 13, 2016 and we were awarded a Judgment against [redacted]/ Jet Roofing for the amount that a new roof would cost us today. A quote for a new roof was also presented to the Judge. Again, all we are requesting now is that we be paid the amount of the rewarded Judgment to be able to put a new roof on our house and get a Texas Windstorm Certificate that is now required by the Insurance companies in order to have Home Owners Insurance in our area.
