I received the deposit in the mail in full.The check was cashed.This closes the complaint, but I will continue to dissuade persons from doing business with JM Kennels.My experience in addition to reading other's issues on line I do not feel she is a reputable business person.? Deposits by nature and law are to be held in escrow; her use of the deposit in the care of the dogs makes the deposit just monies to be used at her disposalThe contract is written such that there appears to be no intent to return the deposit and she is released of all responsibility.? I received a text message today from [redacted] asking me to have compassion for her family in the loss they suffered in their experience with a sick puppy and if we could try to get back to a business relationship in getting a puppy to replace the one that got ill and unfortunately diedShe explained that her emotions took over and that she realized she did not handle this situation in the way she would now like to proceedIt needs to be made very clear that Jane S***, JM Kennel owner, never had 'Intent to Harm' by releasing any puppy to anyone whose puppy later became ill shortly after leaving our kennelFrom August - September 2015, puppies were effected by a parasite called Cryptospordium, which creates a deadly bacteria in the intestinal trackOnly puppies were released at that time, and the rest were held back from leavingThis was an unknown issue and not familiar to the vets I contacted including the team of vets at CSUWhen Ms ***'s new puppy became ill, my daughter contacted a veterinarian, who is from out of State and works at company we buy our vaccines from ( [redacted] )In talking with him, he believed that the puppies were dealing with this particular parasiteThere is a web page on their site that explains what this parasite is and how to treat for itI forwarded that information to Ms [redacted] to see if her vet would treat for thatWhat is unfortunate, is that when you give a puppy a vaccine containing the Parvo virus, when conducting a Parvo test within days of the vaccine, the result will be a positiveFor whatever reasons, Ms [redacted] vets would not look further into the possibilities of it being something other than Parvo because the test said positive for ParvoIt was at that point that the verbal attacks started, implying I was in denial of my puppies/kennel having ParvoWhat is terribly sad to me, is when another puppy became sick here soon after at the JM Kennels and was given a different antibiotic (Neomycin) that fights this type of bacteria per the web site information, the puppy responded in less than hours and is alive and thriving todayThankfully, this issue at JM Kennels has been eradicated and to date have not lost any more puppies born after September 1, I do realize that under emotional stress of trying to save a puppy that a contractual agreement may not be in the first fore thoughts of the consumerMs [redacted] implied today that the vet costs they incurred were her decision and not holding JM Kennels responsible for those costsI have asked Ms [redacted] for a public apology to both the Revdex.com and to [redacted] as an amends to Jane S [redacted] and JM Kennels and to "Cease and Desist"I, in the same, will honor the contract originally signed and will give free of charge a 'replacement puppy of equal value' to the [redacted] familyMs [redacted] asked about puppies listed on the website as a replacement, but those puppies were placed in their new homes over this past weekend prior to our conversation todayI have not had the time to update my website and I apologize for that hopeWe have more litters expecting soon and I will notify the [redacted] family when those litters arrive and will give them first choice puppyThe take home date will be between January and February 2016, as we have no new litters as of yetI will await Ms ***'s commitment to make right and we will proceed from there

First and foremost, I am truly sorry for the heartbreak for not only Ms ***, but for the other people involved in receiving a puppy from this litterI will make it very clear that there was no ill intentions of sending home ANY sick puppiesIn August, shortly before the first litter Ms [redacted] is speaking about, I had a month old Bernese Mountain Dog that became ill and was hospitalized for daysShe was tested for Parvo and tested negativeThe vet did not know what she was ill with and treated her for the days and sent her home with medication for possible Giardia, which is a single cell organismWithin a few days of her being ill, another month old Bernese Mountain Dog puppy became ill and was hospitalized for days, still testing negative for ParvoShe returned home but I could tell both of the girls were not feeling themselves even with the hospitalization and medication givenThey did not start to feel good for almost daysIt was assumed by the vet as an 'unknown virus'The next to fall ill was a litter of - week old puppies, one of which Ms [redacted] is speaking aboutThe first puppy died suddenly with what the vet assumed was from a poisonous insect bite, not relating the other dogs to this issueBut note that the puppies are still 'my puppies' until they are paid in full in which Ms [redacted] had only selected her puppy at weeks of age, never receiving the puppy nor paying in full for the puppyMs [redacted] never had possession of the puppy at any timeShortly after that puppy's death, the rest of the litter took ill in a very short timeNone of the puppies were sent homeOne went to CSU as per the customers request, as we both agreed that the money she was to pay for the puppy would be better invested in trying to find a reason for the litter being illThere was a 2nd litter just days younger that I feared were going to take ill as well, as I had no idea what might be wrongI took all puppies to a vet out in [redacted] , as their hours are for emergency services and after hoursOne puppy tested positive for Parvo but when the vet called the company that makes the test, said it would be a positive if in fact the vaccines were given within a day period, in which they had been given the vaccine just days prior.? The vet took the temperatures of all puppies and basically said to take them home, that I was over reacting, that the puppies would be fineLater that day, I took the whole litter to my vet in [redacted] , who had treated my older dogs who gave me enough medication to treat all puppies at home in the same way the older dogs were treatedThe runt of the litter never got sick, one of the puppies was sick for only a few days and went to his home, but other puppies remained very illThe medications were not working During the time of medicating the remaining puppies, what was not told to me is that a puppy that has low protein levels, is anemic and dehydrated, that if too much IV fluids were given, the puppy would not absorb the liquid and would, in fact, die from drowning (pneumonia)It was unfortunate as of the remaining puppies responded to the treatment in that way and died from non absorption and developed pneumoniaThe remaining puppies continued on the protocol, and one survived and one died after days of treatmentThe puppy that survived finally went home to his new owner at weeks of ageIn the past, all my puppies were treated with Ponazuril Rx for Coccidia, (a parasite now common in Colorado) and this was the only treatment that these particular puppies were not given, as my vet of years had retired and I could not find a vet that would prescribe the medication for meI have veterinarians that I use and one of the vets gave me the prescription to start treating the newer litters, believing this was the missing linkIt was also noted to me to increase the worming medication that is normally given puppies at and weeks of age from days to days.? This protocol was followed and the newer litters seemed to be thrivingEach puppy at weeks of age had soft stools and was assumed the soft stools were going from mom's milk to their dry foodPuppies do not have the enzymes developed to digest food and can have loose stools until the enzymes are createdAll those, including Ms ***, were allowed to pick up their puppiesWhen each person places a $non refundable deposit on any given puppy, they also are receiving a page contract explaining each health guarantee in full, who is responsible for what (which is attached in this report)It is clearly stated that if a puppy was to become ill, that the puppy would be returned to JM Kennels so that my personal vet could assess the puppyIn a timely manner, a puppy would be replaced if the said puppy should not thriveIt also clearly states that if this is not the direction the new owner takes, that JM Kennels/Jane S***, would not be responsible for any such veterinarian costs on any said puppyMs [redacted] reported to me that her puppy had been seen by her vet within the hour time frame and that there was no reason to test the puppy for anything as the puppy past his hour examMs [redacted] has accused me of sending home a 'sick puppy' when even her veterinarian passed the puppy at his first initial visit after leaving my homeI was later notified that the puppy had become ill and was in the hospitalMs [redacted] was insisting that the puppy was stricken with ParvoMs [redacted] was unaware of the numerous vets involved in trying to eradicate what ever this was the puppies were dealing withI tried to explain that the other litters were testing positive for Parvo but that we were not dealing with Parvo, that in fact, they had all received there vaccine within the day time frameI sent her a link via text message(http://www.revivalanimal.com/articles/Cryptosporidium-another-Coccidian.... to what was suspect of a parasite called CrytospordiumIn that link, it had been explained that Azithromycin would arrest the bacteria that was caused by the parasite but that further treatment would need to be taken by using a medicated powder called TylanNot ever once did I hear from her veterinarian to discuss the problems going on with previous puppiesIn fact, Ms [redacted] then decided to make public on my [redacted] account under JM Kennels, that I was in denial of Parvo, that I was uncaring and sending puppies home ill, and she in fact posted pictures of her dying puppy to cause harm to me, my family and my businessI wrote Ms [redacted] that if she did not stop her Public Accusations without proper facts, that she would hear from my attorney for Defamation of Character, and Cyber BullyingI explained that first of all, she would need solid proof that in fact my kennel was suffering from this Parvo virus and secondly, that if that proof was in hand, and if I was placing puppies in homes knowingly that they were ill, then her blasting the public with such information would be within her rightsI understand the emotions involved when going through what the [redacted] family endured.? Number one, Ms [redacted] was in breach of contract when the puppy was not returned to me in the time frame of when the puppy became ill per the contract she signedTwo, even though she refused to return the puppy to me, I was still actively trying desperately to work with her and her veterinarian around the concerns of another matter (Cryptospordium) other than Parvo, that was not being looked intoUnfortunately, for the life of the puppy, it became 'a personal attack' for Ms [redacted] around my practices and my abilities to raise puppiesHad her veterinarian called me and asked for details on other puppies who had suffered this illness, the pneumonia might have been eliminated for this puppy and proper treatment would have been givenTo date, the puppies that were born after the puppies in the previous litters, were treated with Tylan powder starting at age weeks, but began to have symptoms of diarrhea at weeks and days of ageThey were treated with the proper antibiotic (Neomycin) and miraculously recovered in a matter of hoursMost veterinarians are taught to treat animals with specific antibioticsUnfortunately, the bacteria created from this specific parasite is of the "Streptococcus" family in which the typical antibiotic treatment will not killI for one am not a veterinarianIt seems that not one of the veterinarians would consider my experience of being a breeder for over years and that my information was unimportant to eradicate this deadly issueEven the veterinarians I use for my dogs could find no answersIt has taken a team of numerous people and outside veterinarians to conclude what JM Kennels and our puppies were dealing withIf you read the link on this parasite, it is very difficult to test forIt was my hope that these vets would have treated for 'symptoms' rather basing their treatment on testsAll involved veterinarians treated the puppies "as if Parvo" but then realized that the puppies were not responding to the medical protocol for ParvoMs [redacted] is asking for a refund for her puppy that she claims did not surviveThe contract she received clearly states that no money under any conditions would be returnedThe contract clearly states what is covered and is not covered when taking a puppy at weeks of ageNot only did Ms [redacted] not return the puppy to me when the puppy became ill, she never sent me confirmation within a day period stating that the puppy had diedShe sent me an email telling me the puppy died days earlier and it was my responsibly to contact her veterinarian, which is not how the contract reads that she signedIt was her responsibility to gather that information to me along with the deceased puppyThere should have been an option for a post mortem examination for me as the breederMs [redacted] received her contract several months before she adopted the puppyMs [redacted] had ample time to read the contract prior to picking a puppy up at weeks of age, to follow the procedures that should have been taken.As a counter complaint, I am requesting that Ms [redacted] make make a public apology to me, my family and my business (JM Kennels) for her outburst and public accusations not based on factual findings against me, my family and my business (JM Kennels)I also am asking for in writing an agreement to Cease and Disist

Refunds will be sent out within the next 45- daysJM Kennels was under quarantine for several months and is in the process of recovery, so there has been very limited income to accommodate extra'sOur deposits, per written contract, are non refundable, therefore the time frame for refunds has been extended out to those who were 'offered' a refund toJane S***, owner of JM Kennels, is not under any 'obligation' to refund any such monies as per the signed contractIt is important that live animals needs be taken care of first and foremost and JM Kennels is unwilling to offer a 'set date' for requested refundsOur intention is to follow through with our offer of a refund when we see that the kennel is in good condition financially

SELLER will not be responsible for any vet costs and will ask BUYER to return the puppy promptlyAt that time, it will be disused as to whether a replacement puppy will be honored by SELLER or if said puppy recovers to the satisfaction of the BUYER."Puppy was picked up on 11/21/at approximately 7:AM by BUYERSWhen BUYER returned to the BREEDERS home, unsatisfied with the vet report, the BUYER refused to return the puppy and would not take her out of their carI, the BREEDER asked them to give the puppy back and I the BREEDER would return the monies to them within a day period and offered to give that in writing, even though the puppy did not have a LIFE THREATENING health defectI did not want the puppy to experience not being in the right home and felt it was best the puppy return to the BREEDER.The husband clearly stated that he had trust issues in the money being returned, although I had already reimbursed $in cash to them on 11/21/to refund for air fare that in fact would not be usedHad the BUYERS paid for the puppy on that day of pick up 11/21/16, BREEDER would have been able to refund the money in that momentThe puppy had been paid for 7-days prior because the original plan was to fly the puppy to the BUYERS home airport and pre payment is requiredThe puppy was examined by BREEDERS veterinarian at weeks of age, prior to the BUYERS ever seeing the puppyThe BREEDERS vet decided that she was not big enough to fly at weeks of age weighing merely pounds, and was determined at that time that she would need antibiotics for a skin infection and possible parasites that infected her skinThe parasite is not LIFE THREATENING and was treated along with liquid antibiotics to ensure no other infections to occurdays had passed when the BUYERS asked if they could come and get her, to which I agreedThe puppy was eating and in fact had gained almost a 1/pound in those few days since first being seen by BREEDERS vetIf the puppy had been is a grave physical health issue, as described by BUYERS, BUYERS should have returned the puppy promptly! I, the BREEDER, continued to find a solution to the issue, offering solution's not listed in the contract, but BUYERS insisted on #1, keeping the puppy :#2, demanding a full refund :#3, plus being reimbursed the travels costs or else they would call the policeBUYERS continually called me a liar and threatened to call policeI, the BREEDER, had offered several solutions, #1, return the puppy for a full refund within days written contractually as funds were not available to return, #return the puppy unitl she can fly at BREEDERS expense, in to which none of them were satisfactory to the BUYERSI, the BREEDER, told them they can't have the puppy AND a full refund, plus travel expenses in which $had already been returned to them to cover their travel expenses.One Year Guarantee quoted here:ONE YEAR HEALTH GUARANTEE This puppy is guaranteed to the original BUYER for (1) ONE yearSELLER states that at the time of sale and to the best of SELLERS knowledge, this puppy is free of any congenital birth defects and illnessThis health warranty DOES NOT include kennel cough which much like a common coldKennel cough must run its course, recovery is expected and kennel cough is not life threatening. An agreement was attmepted by the SELLER to have BUYER return the puppy and the refund less the deposit would be givein within a day periodThe reason being is, the puppy was paid for in full days prior to picking the puppy up and other arrangements had been made for the puppy to fly to the BUYERTo conclude:Buyers had refused any type of resolution, continued to make threats of contacting the police and would not return the puppy nor accept any written agreements as a solutionThey drove off with the puppy in the car and I, the Breeder, said as they drove off, that if they left with the puppy, that this was their decision to keep the puppy as isTo claim that the puppy is in 'grave' health and "may not live" is so exaggerated and if they were responsible pet owners, would have returned the puppy for proper care or hospitalized the puppy at the vet they claim they took it toI, the BREEDER, never received a copy of examination from the Buyer's vet examination as per the contractual agreementThe wife did not want to return the puppy, but continued to ask for unreasonable solutionsAs policy, we always ask for the puppy to be returned if health satisfaction is not in the best interests of both partiesTruth is, all puppies, from time to time, suffer parasitic issuesIf in fact the puppy was not well enough for travel, the Buyer should have returned the puppy back to the Breeder immediatelyThey were angry and unreasonable and not very truthful as to what they wanted as a solutionMoney was the issue for them, not the welfare of the puppyThey felt that they should have the puppy for free, plus make it my responsibility to pay for their travel expenses when in fact they were reimbursed $cash for their travel expenses already and kept the puppyNot returning the puppy is now considered their responsibility and per the contract agreement, SELLER is not responsible for any such debts for vet bills etcBuyers received a FREE health insurance policy for the puppyWhether they exercise that gift is up to themI will sue for "DEFAMATION OF CHARACTER" for any gossip, threats or otherwise that incriminates JM Kennels, Jane S*** as owner or any of it's employeesThe Buyers posted several negative comments public on JM Kennels Facebook page and will be used as evidence of BULLYING JM Kennels and its owners/employees if this behavior shall continueThere is no proven evidence of the puppy being in grave health, nor was the puppy returned for such accusations, nor would BUYER accept any solutions for what they felt they had been wronged by

I am rejecting this response because: the breeder never told us that the puppy might have parasitesWe were told that the puppy's brother had chewed on her ears and it had caused an infectionIf we hadn't have taken the puppy to a vet who contacted her vet, we would never have found out that the puppy was being treated for parasitesWe would have taken the puppy straight home and it would have infected our other two dogs, one of which is years old and might not have survived such a thingWe also did not ask to both keep the puppy and receive a full refundWe were willing to return the puppy for a full refund, but at that time, the trust was gone and we were not willing to leave the state without our moneyAt that point, I'm not sure any wise person would have trusted her to send the moneyRegardless, my complaint is not asking her to take the puppy backWe just want the puppy's paperwork as the contract says we're entitled toIf you want the whole truth about how things went, ask the breeder She claimed that she recorded the whole thing.

SELLER will not be responsible for any vet costs and will ask BUYER to return the puppy promptlyAt that time, it will be disused as to whether a replacement puppy will be honored by SELLER or if said puppy recovers to the satisfaction of the BUYER."Puppy was picked up on 11/21/at approximately 7:AM by BUYERSWhen BUYER returned to the BREEDERS home, unsatisfied with the vet report, the BUYER refused to return the puppy and would not take her out of their carI, the BREEDER asked them to give the puppy back and I the BREEDER would return the monies to them within a day period and offered to give that in writing, even though the puppy did not have a LIFE THREATENING health defectI did not want the puppy to experience not being in the right home and felt it was best the puppy return to the BREEDER.The husband clearly stated that he had trust issues in the money being returned, although I had already reimbursed $in cash to them on 11/21/to refund for air fare that in fact would not be usedHad the BUYERS paid for the puppy on that day of pick up 11/21/16, BREEDER would have been able to refund the money in that momentThe puppy had been paid for 7-days prior because the original plan was to fly the puppy to the BUYERS home airport and pre payment is requiredThe puppy was examined by BREEDERS veterinarian at weeks of age, prior to the BUYERS ever seeing the puppyThe BREEDERS vet decided that she was not big enough to fly at weeks of age weighing merely pounds, and was determined at that time that she would need antibiotics for a skin infection and possible parasites that infected her skinThe parasite is not LIFE THREATENING and was treated along with liquid antibiotics to ensure no other infections to occurdays had passed when the BUYERS asked if they could come and get her, to which I agreedThe puppy was eating and in fact had gained almost a 1/pound in those few days since first being seen by BREEDERS vetIf the puppy had been is a grave physical health issue, as described by BUYERS, BUYERS should have returned the puppy promptly! I, the BREEDER, continued to find a solution to the issue, offering solution's not listed in the contract, but BUYERS insisted on #1, keeping the puppy :#2, demanding a full refund :#3, plus being reimbursed the travels costs or else they would call the policeBUYERS continually called me a liar and threatened to call policeI, the BREEDER, had offered several solutions, #1, return the puppy for a full refund within days written contractually as funds were not available to return, #return the puppy unitl she can fly at BREEDERS expense, in to which none of them were satisfactory to the BUYERSI, the BREEDER, told them they can't have the puppy AND a full refund, plus travel expenses in which $had already been returned to them to cover their travel expenses.One Year Guarantee quoted here:ONE YEAR HEALTH GUARANTEE This puppy is guaranteed to the original BUYER for (1) ONE yearSELLER states that at the time of sale and to the best of SELLERS knowledge, this puppy is free of any congenital birth defects and illnessThis health warranty DOES NOT include kennel cough which much like a common coldKennel cough must run its course, recovery is expected and kennel cough is not life threatening. I am rejecting this response because: the breeder never told us that the puppy might have parasitesWe were told that the puppy's brother had chewed on her ears and it had caused an infectionIf we hadn't have taken the puppy to a vet who contacted her vet, we would never have found out that the puppy was being treated for parasitesWe would have taken the puppy straight home and it would have infected our other two dogs, one of which is years old and might not have survived such a thingWe also did not ask to both keep the puppy and receive a full refundWe were willing to return the puppy for a full refund, but at that time, the trust was gone and we were not willing to leave the state without our moneyAt that point, I'm not sure any wise person would have trusted her to send the moneyRegardless, my complaint is not asking her to take the puppy backWe just want the puppy's paperwork as the contract says we're entitled toIf you want the whole truth about how things went, ask the breeder She claimed that she recorded the whole thing.

I received a text message today from *** *** asking me to have compassion for her family in the loss they suffered in their experience with a sick puppy and if we could try to get back to a business relationship in getting a puppy to replace the one that got ill and unfortunately diedShe explained that her emotions took over and that she realized she did not handle this situation in the way she would now like to proceedIt needs to be made very clear that Jane S***, JM Kennel owner, never had 'Intent to Harm' by releasing any puppy to anyone whose puppy later became ill shortly after leaving our kennelFrom August - September 2015, puppies were effected by a parasite called Cryptospordium, which creates a deadly bacteria in the intestinal trackOnly puppies were released at that time, and the rest were held back from leavingThis was an unknown issue and not familiar to the vets I contacted including the team of vets at CSUWhen Ms ***'s new puppy became ill, my daughter contacted a veterinarian, who is from out of State and works at company we buy our vaccines from (***)In talking with him, he believed that the puppies were dealing with this particular parasiteThere is a web page on their site that explains what this parasite is and how to treat for itI forwarded that information to Ms *** to see if her vet would treat for thatWhat is unfortunate, is that when you give a puppy a vaccine containing the Parvo virus, when conducting a Parvo test within days of the vaccine, the result will be a positiveFor whatever reasons, Ms *** vets would not look further into the possibilities of it being something other than Parvo because the test said positive for ParvoIt was at that point that the verbal attacks started, implying I was in denial of my puppies/kennel having ParvoWhat is terribly sad to me, is when another puppy became sick here soon after at the JM Kennels and was given a different antibiotic (Neomycin) that fights this type of bacteria per the web site information, the puppy responded in less than hours and is alive and thriving todayThankfully, this issue at JM Kennels has been eradicated and to date have not lost any more puppies born after September 1, I do realize that under emotional stress of trying to save a puppy that a contractual agreement may not be in the first fore thoughts of the consumerMs *** implied today that the vet costs they incurred were her decision and not holding JM Kennels responsible for those costsI have asked Ms *** for a public apology to both the Revdex.com and to *** as an amends to Jane S*** and JM Kennels and to "Cease and Desist"I, in the same, will honor the contract originally signed and will give free of charge a 'replacement puppy of equal value' to the *** familyMs *** asked about puppies listed on the website as a replacement, but those puppies were placed in their new homes over this past weekend prior to our conversation todayI have not had the time to update my website and I apologize for that hopeWe have more litters expecting soon and I will notify the *** family when those litters arrive and will give them first choice puppyThe take home date will be between January and February 2016, as we have no new litters as of yetI will await Ms ***'s commitment to make right and we will proceed from there
