Complaint: [redacted] I am rejecting this response because: Regards, [redacted] MrJoe Percario was contracted to replace the in tire roof down to the rafters plywood everythingWhy would you leave an old rotted hatch inplace on a total roof replacement? If not integrity shouldn't common sense kick in at some point, Sense any handyman could have done it why wasn't it doneYes MrPercario came to see if I needed anymore work done on or about june 15ththat when I told him about the problem, He said he would remove the hatch an close it off with plywood for $and to give him or weeks to get back to memonths and or phone calls later nothing, all I got was someone would be out to do itWhen you get a roof replaced you expect it not to leak..Where only talking about a x foot square it would have taken min to brake it out

Although Mrs [redacted] wrote up a thirteen-page punch list with items which she deems unacceptable or un-finished, the fact of the matter is that a great majority of the items she has listed are not in the contract and not in the scope of work at allI have attached the executed contract so that you can see that these items were never agreed uponThere was a payment due upon final inspection that was never made, and there was also a verbal agreement for partial payment of her final balance when the checklist was startedHowever, when we began to work on the checklist, she refused to pay, and told our employees working on her premises the same, so we pulled backMany items that we had performed were not included in the contract, such has finished spackling, sheet rocking, and painting of her garage which is cost us $1,800, the final grading which cost us $3,800, the contaminated soil removal, which cost us $5,800, and the professional white glove cleaning service for a story – bathroom – bedroom home that we had come in to professionally clean, which is valued at $This is some of the verbally agreed upon work that the customer has benefited from and has yet to payWe have a “Final Punch List” that we went through with Mrs [redacted] , checked off items that were accomplished, and had her sign and date on 06/06/showing that she agreed upon what was performedThere are items that we still need to service, but we require payment to proceedI’ll respond to certain items here so that you can get an idea of what is work was performed, the hyphenated statement will be her item verbatim, and in parentheses will be our response: - We are only able to supply a workmanship warranty because we are not a manufacturerWe cannot control manufacturer’s products because we do not produce them ourselvesThe product was demonstrated and selected by the consumer prior to installation and at the time of sampling, we provide consumers
with any available manufacturer’s care, maintenance, and warranty informationThe product used on this home is the (standard composite) decking product Rhino Deck by Master Mark PlasticsThere is a recommended care and cleaning guide from the manufacturer that was given to the consumer and should be in her recordsIf she has misplaced these records, we can provide her with the proper care guide for her filesI have already forwarded her a PDF document of the product just in case, and she can call us directly should she need any further assistance

We had our windows done by Percario in our sun roomBut they took completely wrong measurements and brought in the wrong size windows Not only that without our knowledge they cut down the wood support between two windows and they didn't even ask usNow only support we have is only windowsVery unhappy with their job

Complaint: [redacted]
I am rejecting this response because:it is not fact based or accurate. The repair dates have changed AGAIN.
I will assume the writer to be general manager for this firm, who, among others (owner, various assigned project managers) has been copied on all correspondence regarding their failure to satisfy their Nov 2015 contract for months.  Percario was never denied access. Percario was asked to demonstrate a plan to complete this work, so that the plan could be reviewed for accuracy and work could be scheduled. They do not communicate amongst themselves, with their sub contractors, or with client and are now trying to hide behind their failure.  This became extremely apparent in March of this year and at that point- every conversation, text and email was documented & retained. I have attached a partial pdf supporting what has really been going on for your records and will happily provide all documentation referenced in my response at your request. I am quite sure the only reason why they finally responded was due to this complaint- and as you can see, the response was valid for less than 24 hours  and their new "projected" resolution date now a week away due to their own error.

Complaint: [redacted]
I am rejecting this response because:As discussed with [redacted] [redacted] on Friday Sept 16- I am rejecting the contractors response. 1- I requested an extended warranty with bond due to the lack of cooperation and poor quality of work despite ample opportunity to properly remediate their poor performance on this contract. 2-In addition, a review of the permit plan submitted to the town of [redacted] shows that they were supposed to pour a solid concrete footing for the tenant porch steps. Instead, they repurposed bricks from the excavation of the demolished steps. This work was done after the inspection of the my front porch steps excavation and footing and I do not believe they had the tenant steps inspected before covering the bricks with mortar and capping them with bluestone. 3- I am concerned about the company's response that they "chose not to collect". Given the company's inability to communicate internally with each other, I don't want to worry about more of their mistakes and a potential lien. Per email from the second assigned project manager in June, and verbally from the Joe P (owner), the remaining balance of the contract was waived due to the inconvenience they caused.  I want a written confirmation signed by a legally authorized signatory for the company with the accurate reason why this balance was waived. I have already provided a partial file of all correspondence from May 2016- August 2016. I am attaching remaining correspondence from December 2015- May 2016. I carefully documented this as best I could when it became clear how poorly this company was performing.
Regards,
[redacted]

When we had scheduled for the Friday the 19th, we had disclosed that Saturday the 20th would be the tentative rain date. Our house mason was delayed in returning home from vacation and we had to reschedule, but we had rescheduled for the following day, August 20th, and the project was finished on that same day.  Ms. [redacted] refused to pay her remaining balance of approximately $2,600 because of residual mortar on the stones.  All stones were replaced, all new stair treds were installed, and some j-channel on the existing siding was installed that was in the proximity of the steps.  Mr. P has agreed to not collect the remaining balance to compensate Ms. [redacted] for any inconvenience she may have experienced.

We have come to resolve issues on your check list, some of which were already resolved and spoken to you about.Page 3 and 4 of the contract that was signed by you has warranty information.  The roof passed inspection from the town, we did build it according to plans.

We do honor the roof workmanship and the manufacturer warrants the material that was used. The hatch that [redacted] is referring to was not installed by our company, and is not part of the scope of the work. It is not even in our contract. Furthermore, the hatch must be locked and latched from...

inside otherwise it would blow off during inclement weather conditions. We did not make manufacture the roof or the hatch, we only re-roofed the house. The hatch is like a small door to the roof, and it is a small job to repair. Something a handyman or someone could replace with a new one. We actually had spoken to [redacted], came out to his house, and offered to install a new hatch for him, but he declined and stated that he couldn't afford it. We did not install this hatch, therefore, it doesn't fall under our 12-year workmanship warranty. Only the roof itself does.
