We have a 30 Day Cancellation Notice Policy as stated in the agreement with the Member (attached). We did receive a 30 Day Cancellation Notice on 09/03/2017 (attached), which would make the last day of the membership 10/03/2017. Any charges/dues that were agreed upon within those 30 Days would have to be paid and current for the membership to cancelled.

Our records show that you signed up on 04/11/2017 and made a down payment of $121.00.  I do not show any other payments made to the account to account for the $132.00 disputed amount you are requesting.  Please double check your records.    We have another facility located on...

The account 7289-96-0807 was cancelled on 12/08/2017 with the last payment date of 11/22/2017.  Our records indicate there was not a cancellation notice sent in for the clients Personal Training contract.  A copy of the contract is attached for review along with our cancellation...

policy.  I spoke with Ms. [redacted] and informed her of the cancellation policy and told her I would waive the 30-day cancellation notice.  I also discussed coming back into the facility to utilize the sessions that have been paid for as well as a comped 1year membership to utilize the sessions.

an auto-renewal to pay the monthly payment on a month-to-month basis until client provides a written 30-day notice as required per the terms of the contract to cancel the account.      A cancellation notice was received from the client and the auto-renewal on the account was cancelled as the terms of the contract had not been fulfilled as they agreed to pay a total of $769 for the total contract price.  Early cancellation terms are stated on the contract and the attached letter was sent to the client to remind them of the terms and conditions of the contract they signed.   No refund is due as Fitness 1 has and can fulfill our obligations stated within the terms of the contract.  The attached letter states how to cancel early.

Please see attached document. I filled out this cancellation notice in person at the gym in March 2017. I was not aware, nor was I ever made aware that my account had two separate account numbers (one for general gym membership and one for personal training classes). When I went to the gym to cancel my intention was to cancel ALL services. The employee who signed the attached form did not cancel all services as requested, nor did he inform me that there were separate accounts. The contract does not indicate that my accounts are not linked within the gym - I believe this is fraudulent and misleading on the gym's part. The billing staff member did indeed indicate that I could continue attending the gym for one year to utilize the 56+ personal training classes that have compounded on my account; I informed her that I did not want to use these classes and that I would like the money refunded since I had cancelled my services in March. The manager acknowledged that the employee who signed the cancellation form in March should have notified me that there were separate account numbers within the same gym. At this time, I would still like to have the money I have been charged since 30 past the March 2017 cancellation refunded back to me. This gym misleads its members by putting services under multiple accounts and not informing them of such. This is poor and fraudulent business practice and extremely poor customer service, as reflected in their Revdex.com rating of "F", and the many complaints that can be found online about this gym.

A refund in the amount of $174.12 will be mailed to you.  This refund is the unused portion as well as the 25% fee we assess as part of the early cancellation terms state on the back of the signed agreement. Tell us why here...

The reasoning I am rejecting this is because I did not sign up for that location, it does not offer the amenities I was looking for.  There is no childcare, or classes.  I signed up for Greenway and 303, and I have already cancelled my account.  Therefore, I better not be getting billed any further.  I would really like a refund, since I was mislead to the growth of Fitness 1.  I now have to join another gym, but have already spent that money on this gym.  Please issue refund.

I have submitted a refund for the $29 facility fee taken.  I apologize for any inconvenience this has caused.  We are slowly working through these issues due to the closure of our Greenway location.
