Review: I received notices of CC&R violations, which involve weeds and plant debris in the lawn. I believe it was the third one that had a date stating to resolve the CC&R violations before November 18th or fines will be charged against my lot. I had my dad come over and help me with my yard a day before the date posted. Within a couple weeks after, I received a letter saying I failed to resolve the CC&R violations and am being fined for 170 dollars(All the CC&R notifications stacked up plus late fees and my monthly assessment was included).After receiving this letter stating I had all these fines, I tried to contact Cypress on Sunland HOA many times by phone and kept being transferred to the property managers voicemail. After being unsuccessful getting contact with the property manager, I asked to speak to someone else and that's when I finally spoke with [redacted] asked me to take pictures of my yard and email them to her. I did so but because it had been a couple weeks after I had pulled the weeds, some had grown back. [redacted] advised me to pull the existing weeds she circled in the pictures, so I did and sent her more pictures. She then told me the yard looks great and she would submit this to the Board of Directors. [redacted] told me this 12/18/14. I haven't received any word since but I have received at least three additional statements showing the fines still exist and [redacted] isn't responding to any emails now.I still have most of the letters and I believe I have all of the emails.Desired Settlement: I resolved the CC&R violation prior to the posted date of November 18th. I'm asking to have fines removed because I resolved the CC&R violations within the posted date. Any late fees regarding these fines not being paid should be removed as well.

I have received your letter advising us of the above referenced complaint and I am happy to respond.After researching [redacted]'s account, we have found that all the CC&R fines were waived in January and March of this year. I have attached his account summary for your review. We are disappointed to hear that [redacted] did not receive any response from personnel here at Kachina Management and felt he had to write a complaint. I will address the issue with my staff so that it will not happen again. There is no excuse for not returning a phone call or e-mail in a timely manner.Please pass along to [redacted] if he ever receives this type of service again to contact me directly at [redacted]I hope that I have answered [redacted]'s questions adequately. Please do not hesitate to contact me if you have any questions regarding this issue.

I have had to deal with this HOA company for 6 months now since I bought my house. If you are buying a house with HOA's make sure it is not with this company. They have hidden fees and lies everywhere. They return bank checks after holding them for three weeks and then try to charge you a late fee. Not trustworthy at all.

Review: Charges for name changed from daughter Jessica back to me.

Charges for the front yard. It was corrected every time we received the notice for violation. We called to get adjustments but never get any responses whether were taken care or not. We had been keep on contact them by phone calls.

Couple of time leave messages and no response from HOA. We also talk to the other officers to handle this matter and show no responses.

We paid our HOA from the Wells Fargo banks for the past years. Never miss any payment. Only time they change their bank in June of 2014. So we had to go to the bank get the address changed accordingly.

Just today I got the e-mail from the bank said that they return the payment of December, 2015.

We received bills several times that we owned them money and I just do not know how they calculated the fines. They never tried to explain when we called them each time. They always put us on hold and still never got any answers.

They keep on sending letters that cost the stamps and added the money they spend to our account.

We felt like they are the owners and we are the tenant being watched all the time to spired us and felt no security and safely in our home.

They spend the money on finding faults on the owners and it will added to the expenses in our HOA fees. The more they sent out the violation notices they more funds that we had to pay. We feel we have no quiet time live in our own home.Desired Settlement: We always try to keep our front yard best we can. We would like them leave us alone as home owners. They still get pay through our HOA payments.
It will better to leave alone and they will have less expenses and they will get more salary by not spend time and money finding faults of the homeowners. We all like to a clean and quiet homes.

We like them to waived all the fines.

Kachina management is a poor company that has no idea about customer service. I have been dealing with them for over 2 years and have constantly been met with little to no responses to several issues that they were legally contracted to manage. They have been provided with multiple examples of their lack of service and yet they still refuse to acknowledge their poor service or breach of contract. Often times it takes 3-4 emails to solicit a response from our agent and unfortunately, this has cost our community a fair amount of money. Please, consider a different management company if you are researching one.

Review: This company is once again sending me harassing letters and assessing fraudulent fInes for violations that do not exist. They have most recently charged me $75 for failure to trim my shrubs and palm trees*. Firstly, I do not have palm trees*, I have one palm tree. The house next to mine has palm trees*. Secondly, I do yardwork each and every weekend and everything that needs trimming gets trimmed. Additionally they have no sense of urgency in processing payments and then they try to collect late fees after letting payments sit around for days before processing them. There are payments that cleared my bank account on the 16th of the month, which means they received and deposited it prior to the 16th which means no late fees, yet they try to collect late fees anyway. I informed them in writing of this issue well over a year ago. They not only chose to ignore my correspondence but allowed the problem to continue. I will not tolerate this any longer, nor will I pay any of these fraudulent charges. Finally, I will not attempt to deal with them directly. All future harassment and incompetence on their part will result in complaints being filed with any and every agency that accepts them.Desired Settlement: Stop harassing people for no reason and go after actual violations such as the 30 foot tall dead pine tree, the grass that's as tall as a fire hydrant, the excessive amounts of weeds, etc.

Mr [redacted] violation letters have a header stating Shrubs/Trees which was first sent as a Friendly Reminder with no violation fee back in July 2014. Per the CC&R's that Mr. [redacted] signed upon the purchase of his home, all lots must be kept cleaned and all plants trimmed. As you can see per the attached picture the front yard shrubs need to be trimmed. Per the communities policies and the violation letter that Mr. [redacted] received he would have fourteen days from the date of the first letter to comply and get his yard cleaned before additional letters are sent with fines. Regarding Mr. [redacted]'s comment regarding payments. Kachina Management and the Association's bank posts all payments the same day they are received. Mr [redacted] states one of his checks cleared his bank account on the 16th yet was not deposited to his [redacted] account. If the check cleared his account on the 16th then it would still be late. Payments are due on the 1st and have a 15 day grace period so the 16th would be a late fee but we would need to know what check number Mr. [redacted] is referencing to look into the deposit date.

[redacted] First of all, the letters do not state "shrubs/trees". They state "palm trees/shrubs". I do not have palm trees.Secondly, I did not state anything about payments not being deposited into my [redacted] account. I stated that when payments clear my bank account on the 16th that means they were depositef prior to the 16th, which would mean no late fees.Third, as I can clearly see from their picture, my shrubs are green and flowering and nothing needs to be trimmed. Until I am provided with a law stating othrrwise, MY yard will be maintained the way I wsnt it maintained.Additionally, this month's payment took over 2 weeks to clear my bank account and mail does not take that long to go from Glendale to Scottsdale so there is no possible way payments are processed the same day they receive them.The fact that I had to correct the company's response in regards to what was stated in my complaint more than proves the level of incompetence I've had to deal with.

We confirmed with the touring property manager the palm tree on his property at the time of the inspections needed to be trimmed. If Mr. [redacted] had brought his property into compliance as he asserts, a request to have the fines waived must be done in writing to remove them. After reviewing our records, there are no notes on Mr. [redacted]'s file that this was done.Nonetheless, in an effort to resolve the matter, we have reviewed Mr. [redacted]'s account and found he has not received subsequent violations for the maintenance of his landscaping for three months. Therefore, we have waived the CC&R fines. Enclosed is an updated account statement for Mr. [redacted]'s review.We would like to remind Mr. [redacted] that he must keep his property in compliance with the governing documents at all times to avoid receiving violation letters and/or fines and to follow the established process to resolve them.I hope that we have resolved Mr. [redacted]'s complaint to his satisfaction. Review: I sent a check straight from the bank which means that the funds were there or the bank would not have sent it. The Association sent me a letter after three weeks of receiving the check saying it was returned and that if I didn't pay it by the 15th there was a late charge. I paid the HOA fee three weeks early and now they want to charge me a late fee I don't think so. They are not honest people and need someone else to take over if they are going to try to steal from home owners.Desired Settlement: Accept online banking payments and not charge a late fee for them
