I am rejecting this response because: the only mailing I received from the fraudsters in January showed a zero balance. Nothing else. I still have the envelope and complete mailings. It appears this may only be resolved by litigation

Our client notified us of the update and corrections were made in the relevant file on 02/23/2016 after the call.DataSearch does not compromise professional conduct, operational procedures or compliance due to a consumer's bad faith. However, we can assure consumer that all FDCPA, FCRA and Tex, Finance Code compliance conditions have been fulfilled.In conclusion, we have sent notice to our client requesting confirmation be sent to consumer. Although his matter is closed, [redacted], would like to thank the consumer and the Revdex.com in advance for allowing us this opportunity to explain further. First, [redacted], works off the information provided to us by the original creditor. By law, pursuant to the FDCPA 15 USC 1692 we are only obligated to 'send' one initial written communication. The FDCPA requires only that an initial notice be 'sent' and [redacted].does not need to stablish actual receipt by the consumer. Furthermore, Under the FDCPA, Tex. Fin. Code, Business and Commerce Code and the FCRA, there is no duty to phone attempt anyone. However, as a curtesy, we may attempt phones calls but we may not leave a message in order to protect consumer irivacy and to avoid third party disclosure, since we do not know who will listen or overhear that message. [redacted]. would encourage anyone who keels they are receiving SPAM, Scam or otherwise unlawful phones calls to contact the Federal TrLle Commission, register their number with the National Do Not Call List or seek legal counsel. Rebuttal:Thank you for the second inquiry into this matter. We have investigated this matter in depth. We've confirmed on January 29, 2016 a representative with our clients extended business office confirmed the mailing address with consumer over the phone, in which the consumer promptly confirmed but corrected the apartment number. After confirming the corrected apartment number, the consumer also wished to be communicated by mail. The consumer also made financial commitments that same day. In fact, the consumer called our clients business office back 45 minutes later to finalize thosearrangements. This fact shows consumer had our client's phone number and could have easily contact them in the event additional information was missing or needed. Mail notifications were issued by our client's business office two additional times. Our client made adequate communication attempts prior to assignment. No response was received.Our office goes off the information provided at the time of assignment. Mail notifications were in fact issued by this office as well. We have not been contacted by our client.We would like to take this time this opportunity to explain that the FDCPA nor the Tex. Finance Code does not require this office to communicate by phone. We merely make phone attempts as a courtesy, in which we did ten times prior to the consumer's response.About Desired settlement:The Federal Trade Commission does issue guidance under the FCRA in regards to these matters and appropriate steps will be taken in conclusion. Because of consumer protection laws and privacy acts, we are unable to disclose the outcome via this forum We will, however, investigate our client's claims and mail such findings to consumer within 30 days. I am rejecting this response because: The client (University Hospital ) erroneously passed along a wrong address and I did not receive any written communication. They had an address of [redacted] instead of [redacted]. I called the university hospital and corrected the address after the account was reported as delinquent. Equifax also had confirmed that the address stated on their file that was sent by DataSearch inc was [redacted] Evidently, someone made a mistake during the initial entry of my data, which is not a fault of my own.They always asked for the ID card to input the Name and Address. I even called University today (9/7/16) and they also had the wrong apartment number on file. I am sure the IT department at the Hospital can provide the logs when changes were made to my meta data.

I am rejecting this response because:  This business is completly sidestepping the issue of failing to contacat an individual through the mail or by telephone that they have a bill to pay.   [redacted]'s policy of not leaving a message on voicemail to call them is wrong and with all the "ROBO Call" spam I receive I don't answer the phone and check my messages.   In addition, they failed to check my address which is of Publc Record to enssure they had the correct address.   This is totally unacceptable way to run a service that can ruin anyone's credit rating.

to our attention and the call was escalated to our dispute resolution department. We promptly began investigating our clients claim. In accordance with all Federal, State and local laws governing our industry, we must cease communication and obtain verification before any actives can begin again. We cannot ignore these obligations. The investigation has been completed and all compliance conditions met. We mailed the outcome of our investigation today, 03/22/2017. We would ask that the consumer and the Revdex.com please allow time for this information to be received at the consumer's residence. We will not be able to fully satisfy consumer desired settlement due to strict adherence to company policy, State and Federal guidelines. Failure to receive subsequent notifications does not affect the validity of the debt and it is the consumer's responsibility to update all information with his/her creditors. After reviewing the history related to this matter in length, it is found that DataSearch Inc. has made sufficient effort to reach the consumer by phone and mail. DataSearch Inc. has handled this matter in accordance with the [redacted] and the [redacted].
