I am a Realtor and Real Estate investor and I suggest you contact the township - IN WRITING - when you have problem with Kay They take the money and run They do not finish the yards or streets Come see Cumorah Avein Center Valley The township will sue them and it saves you having to get a lawyer They won't push the township that far however They dance on the line of what they can get away with If you are nice, they will have a feast on you It really saddens me that they do not care about doing what is right, honoring the contract, and that they lie so much I am too old for this I just want to enjoy my home and not be fighting or have drama Of all the homes I have built, and my clients and friends have built, I have never experienced anything like this

I am rejecting this response because: The drywaller came out today to assess the damage He stated that Kay Builders had not contacted him before, and that last Friday was the first he had heard there was still an issue at our home After assessing the hundreds of nail pops and some major cracking upstairs, he informed me that Kay Builders may not 'want' him to repair all of the nail pops because it's outside of the specks of the warranty However, we were told when purchasing, that they would in fact fix all the nail pops

I write this review as a concerned consumer looking to share my experience with others as they decide whether to do business with KayDo NOT do business with this builder - periodWhen you make such a significant purchase, you want to work with someone you can trust, a company with ethics who delivers on their commitments, and communicates and respects you as their clientThis is not Kay, and they showed us that right from the get goHome was promised by Sept-Oct in our contractAfter signing contract and depositing our 10% down payment, their sales agent went dark, and no one reached out to provide us with updates on constructionWe anxiously waited, knowing our first born is on the way and our lease is up during SeptemberWe thought -what is going on? Why is no one saying anything to us? For a large purchase like this, as a client, you deserve proactive and clear communicationI had to keep asking and asking when they would start building our home and when would it be ready, and was only given minimal information - "sometime before end of year" was all I could get out of them, which is later than what was agreed in writing in our contractAfter many emails and threatening to contact senior management to get more specifics, I was finally told construction of our home would start in July (months after contract signing) and would be delivered by December - months later than promised and stated in writing in the contractBeware of their new construction contractAs the client, the standard contract offers you minimal protection, but Kay gives themselves every break you can think of if they don't get the job done on timeWhat is the penalty if Kay delivers your home late? NOTHINGOn the other hand, what happens if you, the client, don't settle when they are ready? How about a fine of $PER DAY? Seem right to you? Pay close attention to how they respond to this reviewDo they attempt to make things right, ignore it, or just deny any wrongdoing and put me down as a client? You be the judge

***UPDATE 12/4/- days away from closing, builder tells us closing will be pushed out weeks with *no specific date* they can shareWent to see the home, and many critical things still not doneThe way these guys operate is to blame everyone and everything else they can instead of managing and showing accountability, which is how a well managed business is runThis is the second delay from Kay in delivering our homeThe first delay was a huge push back from Oct, which was written in our contract, to DecWe lined everything up only to have Kay tell us days away from closing that they won't be ready

After numerous roofing issues and multiple shingle repairs, my roof is leaking now damaging my personal property.The roof is years into a 10year builders warrantyKay Builders has failed to provide me a roof free of leaks and despite numerous attempts by me to address the issue has not done the replacement of the section of faulty roofing

your situation, we are sure you have by now been informed that the sound attenuation rate provided by block walls with drywall exceeds code requirementsWe have chosen block walls, although more expensive than other type of party walls, because it provides greater structural support and much greater levels of fire protection while providing good sound protection We have also chosen block walls because other party wall systems must be precisely installed according to manufacturer specification to reach their stated levels of sound attenuation We have found that a proper installation of these materials is almost impossible to achieve in the field while block installation is very straightforward yielding less installation error Therefore I stand by all marketing claims we have made and continue to make. There are many factors that impact sound transmission and acoustics is a very subjective art Depending on the configuration of your unit, versus neighboring units, sound transmission may be greater in one multi family unit than another multi family unit Each unit has different acoustics and how they are configured with other neighboring units causes variance in the amount of sound you might hear It also depends on ones sensitivity to noise and the time and level of noise output from neighbors We have also found that talking to neighbors asking them to reduce noise output later in the evening works well and people usually understand this part of multi family living. Fitting certain parts of your new home with a customized sound mitigation system recommended by a sound specialist could potentially help reduce the problems you have explained to me In addition to thickening the wall or adding acoustical tile in certain areas there are other tips that can help. We are sorry for the problem you are having, but we hope you have found some ways to improve your living situation Just keep in mind that sound transmission, sound attenuation and acoustics are a very subjective art and no one can claim to eliminate noise Unfortunately there may be some trial and error involved as you seek a solution. after Kay built our home we put up a fenceWe were told we needed to leave ft outside the fence for the easementKay just build a wall on the property next store they did not leave any room for the easement, now we can't even get a lawn mower thru to cut our grass
Why does the easement only apply to us and not the builder

Two issues identified during the new construction walk through (lifted siding over the garage door and soffit over the front door) were not addressed since closing on 08/30/ One in particular, the soffit over the front door overhang, was identified months prior to closing Kay supervisor disclosed the potential problem, stating that the front porch was disassembled during construction, and then most likely did not get reinstalled correctly I have provided Kay with photographs before and after the siding was installed, and even placed a level under the soffit during the walk through to show the Kay supervisor that it is off by nearly inches This issue was noted during the walk through, which states repairs will be addressed within days I have emailed multiple times asking if the siding contractors have been scheduled Recently, I do not even get a response to my inquiries

I am a real estate veteran (investor, landlord, own a mortgage company and am a Realtor) and recently downsized to a $400,kay homeI deter anyone I know from buying their homes I posted a video on Youtube of them illegally dumping on private property despite being asked not to and despite being video taped (google it)Then I reported them and they were cited This is how I have to deal with them to get things done My experiences with Kay have nothing to do with that dumping incident but how they operate Be a smart homeowner Use the authorities, not a lawyer! Here are some tips for dealing with Kay Builders and which authorities to use:
Before signing Tips: Use a buyer's agent It is a Realtor that Kay Builders pays The agent is like Kay Builder provided legal protection to help you with all aspects of contract review and any issues that come up before closing You will have the whole weight of your Realtor's office behind you if Kay tries to victimize you It may save you a lot of money, and prevent problems to take advantage of this free service DO NOT Be swayed if you are being talked out of it by Kay There may be a reason for that! Don't worry about giving them their way to try to make them like you They have a legal obligation to pay for your agent as they advertised on the MLS Let your buyer's agent do all of the talking
After signing tips:
If you are victimized, and you don't have a Realtor, chances are you aren't going to want to spend $5,000+ on a lawyer, only to have no guarantees Plus that takes forever Doing that also allows Kay to keep slapping homes up and not providing service Here is what I have found to be more effective and much faster, plus FREE and fast, ways to resolve things with Kay than using a lawyer:
1) If it is a building code violation or township violation (check your statutes online), email or fax your townshipHold them accountable for passing your house inspections They have a lot of power By putting in in writing you will be taken seriously This puts liability on your township
2) If it is a mortgage issue with Kays Mortgage company:
aIf something seems off, for example by if a lender is trying to inflate your sales price and or loan amount to give you cash back at closing or pay off other debt, report them! You are not permitted to get cash back at a purchase closing (only refinance) The loans they make get sold to other lenders and must meet requirements established by the secondary market

I am responding to the complaint submitted to your office by *** ***. ***?s complaint contains
several issues I will address each of these in this response.
Part of the problem is that *** is not being truthful in his complaint. I am a bit irritated about having to continually respond to complaints that have no merit and are fabrications, which is why the delay in the reply. It is unfortunate that any individual can file a frivolous complaint to your company and that we always have to respond. We hope it is apparent from the numerous replies we have given your company in the past that explain in detail every complaint that we do business the right way and go beyond what our customers pay for. Kay Builders has policies and procedures in place to accurately represent the grading of a plot of ground. Our sales staff absolutely did not represent that the property would be flat. There are very few flat lots at the subdivision, all of the lots have some topography changes in this community and *** knew very well, given the location of his home, that a flat lot was impossible. In addition, *** signed a grading plan, which we have attached, that shows he knew he would not be getting a flat lot. The main reason we have our buyers sign the grading plan for their lot is to provide them written disclosure of the matter so that no party is relying on a verbal representation of the matter Having said all of this, we will be inspecting the lot to see if there is some way to provide a little more flat area. *** is also free to hire his own landscaper to try to make further changes to the lot
Regarding the driveway, weather plays a significant role in the completion of certain items. ***s driveway has been repaired once and is in fact in in need of another repair as the ground settled further. Settlement is a circumstance of new construction and some areas have more settlement than others. This work is scheduled to be completed shortly as we are now catching up with paving from the harsh winter. This has been relayed to ** ***. The driveway will not be replaced and replacement is not necessary. Per our contract, the builder has the right to repair or replace items at their discretion and we are certain that we can do a much better job this time around with the repair. We will also repair any parts of the front landscaping that have shown further settlement now that we are getting caught up on landscaping
*** is also not being truthful with his claim that he was guaranteed no HOA fees for years. This is an absolutely absurd claim that has no merit. One only need to ask the other or so others that have settled in the community whether such statements were ever made to them and consider the likelihood that *** was the only one that was ever told this. Kay Builders does not collect HOA fees from homeowners immediately upon settlement on their home unlike other builders who begin charging HOA fees right at settlement. Unfortunately our world has evolved to such a state where more and more people try to get something for nothing and never show appreciation for the gifts they are given As far as we are concerned, any time after someone owns the home without paying the HOA fee is a benefit to them
I have personally talked with *** on these matters and in fact have met with him on two different occasions to discuss his concerns. *** continues to raise issues because we have not agreed to refund him $8,from his purchase in July of 2012. This will never happen. He was charged a lot premium because he was on a corner lot, his lot is much larger than most of the others in the community, and he backs up to open area

***, Reply to ID of ***:Kay Builders will return to redesign the basement as per the plan signed at contract. The modification to the plan was made to providing him with a much more user friendly floor plan. Unfortunately, we did not close the loop with a written
confirmation with the customer. For this we are willing to adjust the living space to his original request. To accomplish this, we will remove a section of the currently finished basement, reframe and finish that section and frame and finish the area as per original plan. Mr*** *** should visit the sales office to sign the necessary paperwork for us to proceed. Aside from this, we have gone above and beyond on this house. We made several modifications to the home at cost, for the windows and installed the stone on the side free of charge

Kay Builders examined the booster pump and determined that the one installed was not sufficient to obtain the pressure homeowner desires. Kay Builders will change out pump
