According to your response, you are suggesting that we talk to companies which can help improve our situation in regards to sound proofing. You are telling us that we will have to bear the cost to have this done. You are therefore admitting that you charged us for a service, which you were not able to provide. We therefore expect a full refund in the amount of $ 1,350.

Kay Builders has responded to the Customer’s questions concerning their driveway. Kay Builders at no time ever indicated corrections would not be made. Driveways are excluded from coverage under the Warranty provided to the customer before settlement.   However, Kay Builders is...

aware that new driveways can experience settlement.  Our policy is to let new driveways go through a full year.  If significant settlement occurs, at the request of the homeowner, Kay Builders will evaluate to determine if the settlement is more than normal.  Repairs are offered on a case by case basis, depending on conditions and severity of settlement.   Because of the above policy, others in the community have had driveway repairs or replacement depending on condition and severity of settlement. Customer purchased July 18, 2016.  Reported settlement of the driveway December 8, 2016. Kay Builders responded to the customer advising that It is normal for driveways to experience settlement during the first year.  It is best to let the driveway go through a full year going through all four seasons before making a determination. Kay Builders asked the customer to please continue to monitor the driveway for any sinking, cracking, through the winter and spring. Should they feel there is more than normal settlement cracks or sinking, contact Kay Builders and request an evaluation inspection. December 14, 2016, the customer reported that the driveway settled more.  Kay Builders advised that driveway repairs/replacements are not done during the winter since asphalt is not available.  However, with the customer’s authorization Kay Builders will fill the settlement with stone as a temporary measure until later in spring or early summer when macadam is available. Customer contacted Kay Builders December 26, 2016 to advise that additional sinking had occurred. Kay Builders again responded yesterday December 27, 2016, repeating the above and advising the following: “Because of the amount of settlement you are experiencing, with your authorization, Kay Builders will fill the settlement with stone on top of the macadam, as a temporary measure until later in the spring or early summer 2017, when a larger scale repair or replacement can be made. Please advise if you will authorize Kay Builders to add stone as a temporary measure.”

I am rejecting this response because: Thank you for your response. 
I understand Revdex.com don't deal with pain and suffering and its only in courts. 
After paying such huge amount for buying home, why should I take responsibility and sign papers with kay builders that I agree to break and rebuild the basement. Kay Builders is asking me to sign papers to rebuilt the basement. I need them to compensate for the inconvience that is going to cause for me due to the reconstruction work that's going to happen at my house for their mistake. 
My expectation from Kay builders is that they pay be compensation for breaking my house and rebuilding it again. I am asking for $5000 compensation for this as its their mistake. Why would any body let their new home be broken just because builders made a mistake and not honoring the agreed plan. 
 I am hoping Revdex.com can help resolve this matter.

First let us start off by saying that Kay Builders has address all issue brought to their attention and that the issues mentioned were not included in the 60 day...

Per-settlement Walk-Through List, but where items submitted after that list was completed, such as the drywall and door issues.  During the first year of the house being built, drywall cracks are common and to be expected.  As a standard practice, we address those issues as part of their Year-end Request for Service because the house needs to go through the natural settlement process.  In an effort to accommodate the buyers, we make a conscious effort to make those repair now rather than later.  A work order has been sent to the painter and he has assured me that he will contact them this week to schedule.  
The doors that do not shut properly were not related to the service department, but now that we have the list, we will contact homeowner to be schedule next week. 
The crack in the granite countertop has been repaired and if the crack worsen we will re-address, but cannot warrant replacement due to the nature of the material.
Regarding the misplacement of windows, data lines, etc., in an effort to ensure that our buyers received what is requested, the buyers receive prints and paperwork that they review and sign for accuracy.  Those prints and paperwork indicate additional items requested to the Sales staff, such as phone jacks, windows, data line, dedicated circuit line, etc.  Our records indicate that those items were installed as per the paperwork signed by the buyers.  On several occasions, the buyers and the Sales staff have discussed this issue and it was determined that a refund is not warranted.
Now that spring is upon us, grading issues will be addressed.

Kay Builders will return to redesign the basement as per the plan signed at contract.  The modification to the plan was made to providing him with a much more user friendly floor plan.  Unfortunately, we did not close the loop with a written confirmation with the customer.  For this we are willing to adjust the living space to his original request.  To accomplish this, we will remove a section of the currently finished basement, reframe and finish that section and frame and finish the area as per original plan.  Mr. [redacted] should visit the sales office to sign the necessary paperwork for us to proceed.
 
Aside from this, we have gone above and beyond on this house.  We made several modifications to the home at cost, for the windows and installed the stone on the side free of charge.

do we claim that sound attenuation options will block all sound.It is merely a way to attempt to improve the sound transmission that is inevitable and all multi family living.  Sound attenuation and soundproofing are subjective and can only be applied on a best efforts basis.As such there is nothing more we can do for this customer. We can suggest companies they may talk to to improve their situation but obviously doing so will come at a cost that they will have to bear.

In connection with the purchase of the home, the Customer received a 10-year Limited Warranty Agreement issued by Quality Builders Warranty Corporation.The Warranty is broken into three sections.  Year One Warranty Coverage:  Materials and workmanship coverage.  Manufactures Warranty...

for mechanical equipment.  Heating and Cooling, Electrical and Plumbing Systems.  Major Structural load bearing elements of the dwelling. Year Two Warranty Coverage:  Heating, Cooling, Electrical and Plumbing systems.  Major Structural load bearing elements of the dwelling.  Balance of Manufactures Warranty that may apply. Years Three through Ten Warranty Coverage:  Major Structural load bearing elements of the dwelling. Warranty Coverage for this home is currently in year Five. Workmanship for installation of roofing shingles fall under the year one of the warranty. The home has been experienced some roofing shingles to blow-off at some point each of the five years. Kay Builders has come back each time to replace the shingles which have blown off. Kay Builders Current Roofing Vendor has agreed to replace an entire tier of roofing shingles all the way from ridge to fascia, including all flashings.  Work to be completed later this coming spring 2018, when weather conditions are ideal. Until that time Kay Builders Roofing Vendor will continue to replace any shingles that blow-off. The Customer has previously agreed to the above resolution. Additionally, Kay Builders is scheduled for February 5 & 6, 2018 to address affected interior drywall and insulation.  Scheduled dates confirmed in agreement by the Customer.

I am rejecting this response because: We were  told by the builder that 1 foot was to be left by each owner and now all of a sudden this is not the case. If this info was relayed to us before we put up the fence, we would have put the fence on our property line .Now we are unable to access our back yard. And both homeowners are responsible to cut this grass were a lawn mower can not reach. I guess were are not able to reach an agreement on this this issue If I can't get help on here I will have no choice but to get an attorney and have the courts resolve this matter. The roof was repaired as indicated by the Kay Builders representative, however, I am still awaiting repairs for the damage that the ongoing leak has created. These damages which need to be resolved include replacement of drywall, inspection of wall for rotting wood and replacement as needed, repaint exterior trim and/or replace, and fix the driveway depression created from concentrated flow washing out subbase.

Kay Builders is sorry that the Customer remains in disagreement with our responses.The regulation for fencing requires fencing to be set back one foot minimum.  Can be more, but one foot is minimum. Customer should have inquired and requested, as to requirements, from the Township, before installation of a fence. Plot plans provided to the Customer at time of closing, call out dimensions indicating location of the property line, in relation to the house foundation. Regarding new construction at the neighboring property.  There is no regulation for landscape rock.  However, Kay Builders installed landscape rock set back off the property line. Kay Builders offer remains to install weed block fabric, with river rock on top to be installed between the properties.  By doing so will eliminate the need for lawn mowing in that area. Because the homeowners fence is restricting access to the rear of their property.  There is nothing Kay Builders can do to facilitate customer’s ability to roll a mower to the rear of the property without crossing a neighboring property. If the Customer chooses to move their fencing, Kay Builders, as a courtesy will offer to repair the grade and lawn affected in that area.
