Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. Erie's decision was based on their own roof inspector and the decision of an engineering company which they employ. (Neither are Revdex.com rated). Erie did not consider the opinions from two separate roofing companies who provided us with photographs and analyses but instead labeled them as biased. Both of these roofing companies are highly rated by Revdex.com and I wouldn't believe you would just put your symbol on "ambulance chasers". I have to wonder why out of homes in our cul-de-sac, needing new roofs to date plus about a dozen more just in this subdivision to date that we have seen - when I removed inches of hail from my front porch, and high winds through out a wide area close to us loosened shingles and siding, damaging and loosening our shingles as well. There are at least roofing companies involved in these area roof replacements. Erie has paid for at least one replacement located a few doors from our house, same age and same original roof installer, same location, same storm. All houses in this cul-de-sac area are 10-years old and all had original installation of their roofs by the builder MI Homes, highly respected and highly rated. We have yearly paid Erie to insure our home and roof for the years of its existence. Now suddenly Erie refuses to cover the roof

This is in response to your letter of July 4, 2018, which we received on July 5, Ms***’s request that ERIE cover 100% of the charges for the June 22, 2018, claim and subrogate against the at fault parties insurance carrier for recovery.According to our claim file, Ms***’s father,
*** ***, was the vehicle operator during the June 22, 2018, lossMr*** had permission to operate the vehicleERIE obtained a statement from Mr*** who states that the claimant’s vehicle came along side of him in the left hand lane and struck the vehicles driver’s side mirrorPer our claim notes, Ms*** is waiting for ERIE to obtain the claimants information and attempt to go through their insurance carrier for repairs to her vehicle.Ms*** is requesting in her complaint that ERIE pay the full amount for the damage to her vehicle without subtracting her deductibleUnfortunately, we have not yet received the police report for this loss, nor do we have any of the claimant’s informationTherefore, we are unable to waive her deductible at this time. Please see our policy language below:OUR PROMISE-Collision CoverageIf Collision Coverage is indicated on the “Declarations,” “we” will pay for “loss” to an “auto we insure” and its equipment caused by collision or upsetIf the “loss” is to an “owned auto we insure,” “we” will only pay if “you” purchased Collision Coverage for the “owned auto we insure.” “We” will pay for “loss” less the deductible shown on the “Declarations.”“We” will not subtract the deductible if the accident is between an “auto we insure” and another “auto:”1.insured by the Erie Insurance Group not insured by the Erie Insurance Group, if:athe “loss” to the “auto we insure” is greater than the deductible amountbthe owner of the other “auto” has been identified;cthe owner or operator of the other “auto” is solely liable for the “loss;” anddthere is adequate property damage liability insurance which protects anyone responsible for the “loss.”Regardless of fault, Ms*** is responsible for her $deductible at this timeIf ERIE finds that the other party also has ERIE Insurance, or if the other parties insurance carrier advises ERIE that they have accepted 100% liability, we will then be able to waive Ms***’s deductible.Ms*** does have the option to utilizer her policy and pay her $deductibleOnce ERIE receives the police report, as long as it corresponds with Mr***’s statement and places the other party 100% at fault, ERIE will attempt to subrogate the claimant’s insurance carrierIf the claimant does not have automobile insurance, ERIE will attempt to subrogate the claimant directly. We apologize to Ms*** and for the burden this has placed on herIf we can provide additional information or clarify any item, please do not hesitate to contact me at ###-###-####.Sincerely,Becca S*Executive Resolution ExaminerOffice of the PresidentEnclosures:c: Hallman Agency LLC, AA6005c: Leah M***,Pittsburgh Branch

This is in response to your letter of January 6, 2016, which we received on that same dayYou have asked that
we respond to a complaint filed by Mrs*** regarding ERIE’s decision to nonrenew her family’s Automobile
Insurance Policy effective March 7,
According to our records, Mrs
*** has been insured with Erie Insurance since (years)According to
our records, they have submitted a total of six claims totaling $13,We have collected premiums during
that same time period of $24,As you can see, the ***’s have paid more in premium than we have
paid in claimsHowever, our concern is with the recent deterioration of the overall loss history and driving record
of the ***’sThere have been three at fault accidents in the past three and a half years, as well as Trent
***’s record of two moving violations and a license suspensionEnclosed is a copy of the Notice of
Nonrenewal explaining this information to the ***’s
While this has been a difficult decision for the ERIE to make given the ***’s years with us, and we
certainly understand their frustration with receiving this notice, we believe their driving record has *** to
the point where we can no longer continue to provide their insurance protectionTherefore, we must standby the
nonrenewal effective March 7,
Mrs***, in her letter to your office, alleges that I was “unaccommodating” and was “highly insulting”
during our phone conversationI can assure you that is not true and I remained professional during our
conversationI tried to explain during our conversation the reasons why the ERIE did not want to reconsider our
positionMrs*** became angry and began berating Erie InsuranceThen, she requested to speak with our
president, which I refused as I had already answered all her questions
If you have any additional questions, please do not hesitate to contact me at ###-###-####

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.2012!? I was and living with my parents! So what your saying is agents of Erie slip in extra coverages to trick young kids before they sign??? That is even worse!! I demand a copy of this paperwork for my records so I can show that Erie trucks young kids into extra coverages they do not need just so they can get a extra dime out of them!

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. The response from Erie clarified the dates and situation and also recapped our conversations about the issue. I have not set up a payment plan because I would like to have more detail as to why the error took so long to catch. As the letter stated, I've been a loyal customer for yearsI trusted that the insurance company would not have issued a refund if it wasn't due to me because they would have a checks and balances to ensure payments were credited properly to each homeowners' account, especially before a year's lapse in time. The insurance company should assume the responsibility for their mistake. There have been similar cases where the court stated in absence of fraud, when a refund is issued by a insurance company and then is determined it was paid in error is not the responsibility of the insured to repay. Dear Ms***:Thank you for your letter dated January 18, and received in our office January 18, You request ERIE to review and respond to the insured’s concerns regarding her estimated replacement coverage on her ErieSecure Home Policy.According to our file information Ms***’s
was first written effective February 11, with the *** *** * *** *** agencyThe policy was written with an estimated replacement cost of $267,On January 18, 2017, Hometown Insurance and Real Estate Agency reduced the estimated replacement coverage to $205,This resulted in a $reduction in premium for the to term and $for the entire - term.Effective June 1, 2017, Ms***s requested that her policy be transferred to the *** *** AgencyBoth agents agreed to the transfer and Erie processed the changeDuring the new agent’s review with Ms***s, she questioned why the estimated replacement cost had been reduced to $205,from $267,During this review the agent spent approximately hours going over all of her property’s coverages. In an effort to determine why the estimated replacement cost was reduced we reached out to Ms***’s former agent, *** *** * *** ***, to discuss the application and changes that took place on the policyThe agency principal advised that the agent who wrote this policy no longer works for that agency and cannot confirm what took place and advised there is no written documentation of the changes requested or performed. As far as current policy with *** *** Agency, we have spoken with agency principal and discussed what has taken place since he has took over this policyWe agreed that the agency will perform a New Home Cost Estimator and amend the estimated replacement cost for the insuredI have obtained the new Home Cost Estimator from the agency *** *** AgencyThe new Home Cost Estimator lists $242,The agency will speak with the insured only by via e-mail to confirm if and any changes need to be done.As of Thursday, January 18, 2018, the agency has e-mailed Ms***s regarding the coverage amount and what she would like to do with her replacement costAs of January 19, 2018, the agency is still awaiting her response. The type of policy that Ms***s has is a guaranteed replacement cost policyThe estimated replacement cost is based on the Home Cost Estimator as what it would cost to rebuild the homeThe estimator cost is listed on the policy, but that is not the amount that is guaranteedThe guaranteed amount would be based upon what the replacement cost is.Based on the inflation guard which is outlined in her policy, the estimated replacement guard will slightly increase annuallyIf Ms***s prefers to go higher she would need to review that with her agent and need to be confirmed in writing. If you have any further questions, please contact me at *** ***.Sincerely,Nicholas K*** Executive Resolution ExaminerOffice of the President
