Hello,
As previously explained, while Kickstarter is a platform for the agreement between creators and backers, it is not a party to this agreement. The terms of the agreement (found in our terms of use) outline the responsibilities of backers and creators. This information can serve as a basis for legal recourse if a creator doesn't fulfill their promises. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.

For each project, we’re presented with the same information that backers are and we hold each project accountable to the same rules. This is a space where creators are able to test and find support for new ideas, not to present items that already exist. We’re unable to vet whether each idea is completely realistic or whether a creator has qualifications to finish their projects; that’s up to backers to decide.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
This product was originally expected in February 2015 and it is now estimated to be available June 2016, although it has been delayed so many times that I am highly skeptical that delivery will even be made by that date.  My issue is not with the delay, as stated previously.  The product is being sold retail prior to the original backers receiving the product which is unacceptable to me.  My concern is that this product is being sold on the internet before the backers ($13 million dollars worth!) receive the product.  I am doubtful that I will ever receive the product that I backed in August 2014 and according to kickstarter rules, Projects must honest and clearly presented and I do not believe this has been the case.  Although the Coolest continues to send out "updates" they are simply excuses as to why they are not moving forward with the product that was backed and started to be produced and is still not ready to ship.  This is unacceptable.

Hi there,
On Kickstarter, a backer can only make a single pledge to a project. If you select a new reward after you've already selected a different one as part of your original pledge, your new reward selection will replace the old one. In this case, it looks like there was some confusion about how reward selection works. The creator of this project encouraged backers to add an additional item to their reward request by increasing their pledges, but here it seems that instead of increasing the existing pledge, selecting the new reward (in this case, the blanket at the $30 level) replaced the existing reward selection (of the jacket itself) and decreased the pledge amount. While we understand the frustration of this situation, any issues with messaging about rewards are the creator's responsibility, as are any pledging issues caused by this. 
Since rewards are being produced, managed, and shipped by the creator, not Kickstarter, you will need to reach out to the creator about this issue. It's possible that you may be able to arrange for additional payment to them, outside of Kickstarter, in order to receive the reward you had hoped for when you originally pledged to this project.

We've reached out to them with a reminder of their obligations to their backer community, in addition to having forwarded along your concerns and those of your fellow backers. While we're disheartened that they have not yet updated you and other backers on the status of their project, we're unable to force them to do so. It's the creator's responsibility to communicate and complete their project as promised.As we've previously shared, our Terms outline the recourse that a backer can take if they believe that a creator has not made a good faith effort to complete their project as promised. This answer is given to every other  complaints in here as you may see from their previous response. I don't see any good faith for a resolution.I am not able to get any update or a refund. If we look at Kickstarters terms  [redacted]It clearly states - When a project is successfully funded, the creator must complete the project and fulfill each reward. Once a creator has done so, they've satisfied their obligation to their backers.Clearly they did not follow kickstarters terms. I want Kickstarter to take an action on them and get my money refunded.I also asked Kickstarter to give me the project creators information, so I would take them to the small claims court. Yet they don't share this information. On the other hand, creator does not gibe me this information as well.  I believe that Kickstarter needs to give this information since I am not able to get it from the creators.Thanks,[redacted]

Aso kickstarter created this message they are responsible for ensuring the creator is held accountable. I also took time stamped screenshots of this message on your website and emailed them to myself and other in case it was taken down.

Hello,   Thank you for your email. As explained, when an individual like [redacted] backs a project, he enters into an agreement with the project creator. Under the old Terms of Use, the creator would be in breach of that agreement between the creator and backer if, after failing to fulfill a reward, the creator also does not offer a refund. As such, [redacted] is free to attempt to enforce this agreement against the creator.   While Kickstarter is the platform for that agreement, it is not itself a party to it, and does not itself offer rewards or mediate these disputes between creators and backers.   We hope this helps.   Regards,   Kickstarter

The response from the business is not the truth.  I did nothing to violate any of their terms or conditions.  I DID NOT violate any of their policies.  If they consider any of my actions to be in violation of the perceived policies, they should refund all monies they took from me under false pretenses.  This entire situation was caused because Kickstarter has an unwritten policy that Black campaign creators may start a racist campaign, but that would not be acceptable for other ethnic creators.  I objected to this policy and "ruffled feathers" out of fear that I would make this practice public knowledge.  Therefore, if I am an unacceptable campaign pledger, I need to be refunded all of my monies.  This solutions, by the way, had been concurred with by [redacted] Payments (a branch of [redacted]).

This is Kickstarter's policy on fulfillment: Project Creators are required to fulfill all rewards of their successful fundraising campaigns or refund any Backer whose reward they do not or cannot fulfill.---What Kickstarter is currently saying is that they don't take any legal part in helping the backers if there's any issue, HOWEVER: they require the project creators to refund any backer (me) whose reward was not fulfilled. So what is Kickstarter really requiring? I've been in contact for months trying to get a solution, explaining how the Project Creator has not held up their end of the bargain, so what will Kickstarter do to "require" them to do this? Because right now it feels like Kickstarter is only "suggesting" that the Project Creators fulfill this, as opposed to actually "requiring" it. This leaves me, the consumer, in the dust, because Kickstarter says that they're going to require it--the language of which implies that Kickstarter is going to enforce something--and now, after I've invested in their system.On their Trust and Safety page, [redacted] says We listen. We didn't just build Kickstarter — we've been lovingly tending to it since we launched in 2009. Our Integrity team is always watching over the platform and reviewing reports from the community. Our community helps us make sure this is the safest, most effective platform around.We monitor the system. Our Integrity team uses complex algorithms and automated tools to identify and investigate suspicious activity on projects.We take action. Sometimes that just means asking someone to fix a problem. But when we find users or projects that abuse the system, we don't hesitate to suspend them.--But right now, after I've asked Kickstarter to address this multiple times, they have not TAKEN ACTION, like it says on their website. They have not asked someone to fix the problem, and they haven't suspended or done anything to the backers. As a customer of the service, Kickstarter is not addressing me or helping at all. This is unacceptable, as they explicitly say that they do take action.

It also makes backing a project on Kickstarter very different from purchasing an item in a store. Project creators on Kickstarter choose an “Estimated delivery date” when crafting their rewards. This date serves as an early estimate as to when the creator may be able to fulfill, but could slip based on the demands of a given project. As such, creators will occasionally miss the mark on their initial estimated completion dates. Delays can occur for any number of reasons, but they are almost always in order to maintain or improve the quality of the project’s end result. Still, it’s important to us that creators communicate this information to backers along the way.When a creator is communicating, we hope that backers are able to return that respect by being patient and supportive. Often, the most productive thing a backer can do is to cheer a creator on despite bad news or delays. Still, if you continue to have questions or concerns regarding the status of the project or rewards, we encourage you to post in the comments section, or even message the creator directly. To message a project creator, visit the project page and click on the creator's profile image. We're sorry to hear [redacted] has had a negative experience with this project creator. We once again urge her to attempt to contact the creator, and remind her that Kickstarter's terms of use provide her with a basis for legal recourse against the creator if she is unable to reach a resolution directly.

Perhaps addressing ing the initial complaint instead of a blanket statement of what you want people to believe as opposed to the reality would be nice.

The fund raising for "[redacted] - The little bunny that wouldn't give up!" is very disturbing!
What a pack of lies! I'm sure that the rabbit breeder under whose care "[redacted]" was born is now trying to make profit from the miserable and very short life of this little baby rabbit! The first time I read about "[redacted]" was an online article of the "Telegraph" which I'm citing here:
"A paralysed bunny has been given the chance of a new lease of life thanks to a mini skateboard ‘wheelchair’ he uses to get around. [redacted], who lives on rabbit farm in New York, was paralysed after being bitten by a more dominant rabbit, with his owners initially fearing he might have to be put down. But the animal fought back to better health and been described as the “little bunny that wouldn’t give up”. [redacted], who was found “stiff and frozen” on the floor of a barn at Overlook Acres farm, now zooms along in a custom skateboard made from pieces picked up from a dollar store."
Immediately after reading this article I asked myself: Why does this rabbit breeder not take care of the newborn rabbits? When there is danger that the helpless little ones get injured by adult rabbits, why are they not separated? How was it possible that little "[redacted]" was found "stiff and frozen" on the floor??? Why does the rabbit breeder not provide nests for the newborn rabbits that make it impossible for the little ones to escape and freeze to death outside???
It is a crying shame that this rabbit breeder neglects his animals so much! I'm sure that "[redacted]" is not the only poor rabbit baby that got injured by adult rabbits, and probably many rabbits regularly freeze to death in this facility because nobody cares for them!
After all this, the neglectful and animal abusing rabbit breeder wants to appear as an animal lover who "saved" the life of a little rabbit. But the baby died! Little "[redacted]" had to suffer, and he finally died because of the miserable living conditions in this breeding facility!
This is a very sad story! It is the fault of the rabbit breeder that "[redacted]" suffered and died, and he should not be allowed to make money with the made-up story about this poor rabbit baby!
Instead of making money with his fake story, this rabbit breeder should be punished to the fullest extent for the suffering of the rabbits in his breeding facility!!!
