Review: On 9/** & 9/**/13 respectfully I backed the Kapture project on Kickstarter. The two dates were for two Kapture devices. On 6/* & 6/**/15 respectfully this project shipped to me. After trying the product out I decided that I did not like the build quality and on 7/** I contacted Kapture, the project's creator, for an RMA to receive a refund. I was authorized by 'Keith' at Kapture to return by devices. [redacted] reported that the devices were received by Kapture - [redacted] - and signed for. But Kapture refuses to admit that they received them and/or issue me the refunds they agreed to. After some back and forth and I contacted Kickstarter on 7/**. Kickstarter said they would contact the project creator who again did not get back to me. Kickstater also said it's not their problem.Desired Settlement: I believe that Kickstarter, as the payment portal and business that I used to review and support the Kapture project has some responsibility to make things right. I have done just about everything I can do to resolve this with the project creator that used Kickstarter's system. I would like Kickstarter to provide me with a refund for my purchases on 9/** & 9/**/2013. Thank you.

Response:

Hi there,Thanks for reaching out and bringing this to our attention. We're sorry to hear that backing the Kapture project has been an underwhelming experience, and that you’re dissatisfied with the backer reward you received.Kickstarter does its best to maintain an ecosystem that gives project creators the support and freedom necessary to bring their creative ideas to life. This often means that when projects launch on Kickstarter they’re still in the early stages of development. This gives backers an opportunity to be a part of the creative process from the beginning. It also makes backing a project on Kickstarter very different from purchasing an item in a store. We expect that creators will make every effort to complete the project as promised. We apologize that in this case, the finished product was ultimately different than what the creator originally presented or what you expected to receive. As a backer of the project, you played an important role in its development. In cases like these, we encourage backers to contact a creator directly with input regarding the reward received. While Kickstarter is the platform for the agreement made between a backer and a creator (as per our Terms of Use), we are not a part of it. Each project is the responsibility of its creator, and it is ultimately it is up to a creator to determine whether or how to approach refunds and complaints about their product. Again, as per our Terms of Use, while we do reach out to creators and encourage them to follow up with backers, as we have in this case, Kickstarter cannot force a creator to issue refunds, respond to messages, or ship replacement rewards. If there are issues with refunds or rewards, it's up to a creator and a backer to come to a resolution on their own. Thank you for your understanding.Best,[redacted]

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

As Kickstarter already knows I've made multiple attempts to contact the project creator to resolve this issue and they refuse to deal with it. Kickstarter processed my purchase and ultimately was the infrastructure that screened the project creators. They bare some responsibility either to process the refunds or to be advocates for customers. All I am asking for is to receive refunds for the items that I did return.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Nonsense. You happily accept a fee for the transaction yet you accept no responsibility when things go wrong? That is not how things work. Even [redacted] will step in to make things right when you buy things through a 3rd party using their system. This is not a 'you break it you bought it' situation. All I asked at the beginning was for you to get your project creator to make good. Since they have refused and since the money was processed by you, you have some responsibility. Simply own up to that. Be a good corporate citizen.

Response:

Hi there,Supporting projects on Kickstarter is different from buying a product from a retailer. Projects that launch on Kickstarter are often very early in the development process. This gives backers an opportunity to be a part of the creative process from the beginning, but this aspect also makes backing a project on Kickstarter very different from purchasing an item in a store. Our Terms of Use specify that, "By backing a fundraising campaign on Kickstarter, you as the Backer accept that offer and the contract between Backer and Project Creator is formed. Kickstarter is not a party to that agreement between the Backer and Project Creator. All dealings are solely between Users."In addition, our Terms of Use establish that,"Kickstarter is not liable for any damages or loss incurred related to rewards or any other use of the Service. Kickstarter is under no obligation to become involved in disputes between any Users, or between Users and any third party arising in connection with the use of the Service. This includes, but is not limited to, delivery of goods and services, and any other terms, conditions, warranties, or representations associated with campaigns on the Site. Kickstarter does not oversee the performance or punctuality of projects. The Company does not endorse any User Submissions. You release Kickstarter, its officers, employees, agents, and successors in rights from claims, damages, and demands of every kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and the Service."You can read our full Terms of Use here: [redacted] . While we have reached out to this creator, and while we do realize that this particular situation is frustrating for you, Kickstarter cannot intervene further. Thank you again for your understanding.Best,Kickstarter

Review: I provided a monetary contribution to a company that was fundraising, upon the understanding that I would receive a certain product by a certain date (christmas). Not only did that company state they won't make the delivery date, but they also said they can't make the product anymore because of manufacturing issues. I tried contacting the company, but they were very rude to deal with. I contacted Kickstarter and they brushed me off and did not reply to my most recent email. I will be contacting my bank as well, but I wanted to see if this can get resolved before I take that step. I will get my money back somehow, so hopefully Kickstarter does it the right way.Desired Settlement: I want a refund to the card I used.

Hello,When a creator provides a shipping date for rewards on a Kickstarter project, our site clearly displays it as an estimated shipping date. As these products and rewards are creative in nature and do not yet exist, it is not possible to have guaranteed shipping dates. It's unfortunate that the creator was not receptive to your messages. While we can encourage creators to respond to their backers, we are unable to force them to do so. The responsibilities of fulfillment are strictly between the creator and backer. [redacted]'s original request for a refund was responded to by Kickstarter Support within four hours upon receipt, and the response included details about Kickstarter's refund policy and instructions to reach out to the project creator. The follow-up response received by Support from [redacted] did not include a question that required additional action or a response. At Kickstarter HQ, we expect creators to fulfill rewards, offer refunds if they’re unable to complete their project, and communicate with backers at every step along the way. While Kickstarter is the platform for this agreement, we are not a part of it. We do not investigate a project creator’s ability to complete their project, nor do we facilitate refunds or the fulfillment of rewards. This information is publicly available and provided for all users on our Trust Page: [redacted].When a user backs a project on Kickstarter, they enter into an agreement with the project creator, as described in our Terms of Use: [redacted]. Each time a pledge is made on the site, a notification appears to each user that states, "Kickstarter does not guarantee projects or investigate a creator's ability to complete their project. It is the responsibility of the project creator to complete their project as promised, and the claims of this project are theirs alone." Below this, we link to our Trust Page, which outlines additional details. Our Terms of Use outline the responsibilities of backers and creators. This information can serve as a basis for legal recourse if a creator doesn’t fulfill their obligations under the agreement. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.Best,Kickstarter

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Taking yourself out of the equation because you are simply a "platform" is not an acceptable response. Kickstarter makes money from a portion of the transaction amount and reserves the right to hold "creators" responsible if they feel the need to.I feel your platform, in which this transaction occurred, did not effectively protect the consumer. I was not aware that a creator could provide a product, in exchange for funding, and then completely back out of that promise. That's a very unreasonable outcome for a consumer to have to accept and likewise, an unreasonable outcome for the platform to not take any accountability in. The creator actually emailed all parties involved stating that they would like to hear from us about what we want to do. Unbelievable. Just give our money back, crooks.Using another platform as an example, [redacted] provides a guarantee that the transaction is protected, as it should be. They aren't the seller, but they acknowledge that the transaction is taking place within the confines of their system, so they express accountability. Your hand's off response and approach is very disappointing and lacks in the accountability your company should have in the matter. As I mentioned, I will get my money returned in some fashion, even if it has to be in the matter of a chargeback. I will also do what I can to let others know in my network about the unfriendly consumer practices you uphold in your business. I'll definitely never use your service again. And for the record, my initial email was replied to in 4 hrs, but my response was never replied to.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I completely understand [redacted] is different in some respects, but don't agree that they are completely different. You both are platforms that connect two parties to a transaction. What you do, that is beyond what [redacted] does, is that you are actually processing the payment for the transaction. Your company name is on my bank statement. By involving yourself at that level, you are an integral piece in a consumer facing transaction, like it or not. If you had simply allowed the two parties to enter into a transaction exclusively, like [redacted] or [redacted] does, you'd likely have more ground to stand on with taking a hands-off approach. Your company is collecting the funds, based on your name listed in conjunction with the charge, so you are just as accountable, if not more. You are welcome to continue replying with links or verbiage associated with your ToS, but it's irrelevant. I'm not a lawyer and not planning to sue you. I've already processed my chargeback and have no doubt my funds will be returned. More important for you is to understand there is a major flaw in your business, at the customer experience level. Now that I have researched this particular issue and have found many many complaints online that are inline with my own, I am confident I won't use your site ever again. It's just unfortunate that you continue to reinforce your stance, when you really should be actively engaging someone that is providing you with critical feedback that if properly received and acted on, would likely change the level of satisfaction with your operation.

Response:

Thanks for reaching out and for taking the time to send along your feedback. At Kickstarter we are constantly working to improve the experience for both our backers and project creators. Thank you for being a thoughtful member of the Kickstarter community.

Review: Kickstarter received payment (approximately $3,750) from 1424 backers for a project started by [redacted]. Though Kickstarter has received this payment, they have not provided any assistance to the 1424 backers who were scammed by the project creator. Kickstarter indicates that backers should contact the creator via social media, however the creator does not respond. It has been over 2 years since consumers have paid Kickstarter and the project creator.Desired Settlement: As Kickstarter benefited from this transaction, I would like Kickstarter to assist the 1424 backers who have been scammed by this project creator. I would like a public response from Kickstarter and assistance in recovering the stolen funds. I would not like a link to the Kickstarter FAQ - I've already read them.

Response:

Hello,

We're sorry to hear about this user's negative experience with this specific creator. Kickstarter is a platform where one party, the Creator, runs a campaign to raise money from other parties, the Backers, to fund a creative project. The filmmakers, musicians, artists, and designers on Kickstarter have complete control over and responsibility for their projects. Kickstarter is a

platform and a resource. Kickstarter is not involved in the development of the projects themselves.

When users back a project, they enter into an agreement with the project creator, as described in our terms of use. Though we encourage backers to make every attempt to resolve issues directly with creators, they have the right to seek legal recourse against a Creator who does not fill their obligations on the basis of that agreement. Kickstarter is not a party to that agreement between the Backer and Project Creator. All dealings are solely between users.

We hope this answer helps.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Kickstarter did not respond to the fact that they benefited financially from this transaction. Kickstarter earned $4,000 from this failed project and has done nothing to ensure that the project creator is held responsible. Kickstarter's financial gain gives them a responsibility to see through the completion of the project.

Kickstarter failed to address any of the concerns addressed in my complaint and instead copied and pasted the exact same reply that attempts to remove any responsibility from their agency. If Kickstarter did not benefit from this, I would agree, however, they were paid, just like the project creator.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

This response still does not answer or address the complaint. Kickstarter financially benefited from this transaction. Since your company received $4,000 from this project, there is a responsibility to assist the backers. The project creator is not responsive to backers, however Kickstarter has not attempted to help, though they, along with the project creator, have taken money from the backers.

Hello,

Once again, in spite of any label the payment processor may have attached to the transaction for the backer's reference, Kickstarter does not hold, transfer, or collect funds from backers. Review: I funded a project through Kickstarter called BauBax. The original amount was $109 for a travel jacket. (pledged July **, 2015). On September *, 2015, I pledged an additional $30 to the same project.

When the surveys by BauBax were sent out (to order color and style of your travel jacket), I did not get one.

I reached out to BauBax and was told that my initial amount of $109 has been removed from Kickstarter but I paid this amount (and have emails as well as credit card statements to back this).

I was told by BauBax to "be patient" and have not heard from them since. When I reached out to Kickstarter, I was told they cannot refund money and told me to reach out to BauBax. I told them I already did that and got no resolution.

This issue is with Kickstarter because when I go on my account on Kickstarter, the initial $109 backing of this project is gone from my account. It was removed by Kickstarter.Desired Settlement: I want my money back at this point. I do not appreciate the way I was treated by Kickstarter. This is a deceptive practice for a business.

Business

Response:

Hi there,Sorry for the confusion. I see that this backer initially pledged $109 to this project in July. However, she then adjusted the pledge to $30 in September. It sounds like the backer tried to add an additional $30 to her pledge.Unfortunately, at this point, it's not possible to change the pledge/reward selection on Kickstarter. I would encourage her to continue to reach out to the creator to try to work something out off-site.Best,[redacted]

Response:

Hi there,On Kickstarter, a backer can only make a single pledge to a project. If you select a new reward after you've already selected a different one as part of your original pledge, your new reward selection will replace the old one. In this case, it looks like there was some confusion about how reward selection works. The creator of this project encouraged backers to add an additional item to their reward request by increasing their pledges, but here it seems that instead of increasing the existing pledge, selecting the new reward (in this case, the blanket at the $30 level) replaced the existing reward selection (of the jacket itself) and decreased the pledge amount. While we understand the frustration of this situation, any issues with messaging about rewards are the creator's responsibility, as are any pledging issues caused by this. Since rewards are being produced, managed, and shipped by the creator, not Kickstarter, you will need to reach out to the creator about this issue. It's possible that you may be able to arrange for additional payment to them, outside of Kickstarter, in order to receive the reward you had hoped for when you originally pledged to this project.Best,Kickstarter

Review: The project ( [redacted] ) was originally funded on June [redacted], 2013, since then they have made major changes to the product and encountered delays. They gave us the option to receive a refund instead of the modified product. At this time I had requested a refund. Since then they have delayed the refund and they have also delayed the date of shipment of the 3-D printer. On the last communication, they have announced that they spent all the Kickstarter funds and will now take orders from non-backers to be able to raise more money. I have tried to contact Pirate 3D several times asking if they had an estimated date on the promised refund, they have never responded to my emails other than an automated response stating that I would receive an answer shortly. Removal from the Kickstarter website is necessary because the negative and disparaging comments on the Kickstarter website will otherwise be seen indefinitely by potential customers, investors and our community. These comments are the direct result of Kickstarter's irresponsible generation of innuendo via their (literally) incomplete and disparaging email sent to our project's pledgers.Kickstarter continues to take no responsibility what-so-ever to clarify, provide comment or explanation for their actions that have generated this damaging innuendo. After approving our project, we launched it exactly as we had described it to Kickstarter. Kickstarter then suspended our project without notice or explanation and then sent a disparaging and suggestive email (attached) to pledgers from their "Integrity Team." The text of the email is literally incomplete. It says we have "demonstrated one or more of the following:" but in fact provides no list of the "following." It further states that they "find strong evidence" that we are "misrepresenting" ourselves. The email generated innuendo and negative comments on the Kickstarter website, which remain accessible to the public and search engines. We have no ability to defend ourselves or respond. This is wholly unfair and damaging to our company. Review: Kickstarter takes a percentage of money raised by people thru their website

If these people fail to deliver or refund, Kickstarter does not stand behind the backer; stands behind the project creator; censors comments & therefore people's freedom of expression; amongst other things

In my particular case, I've not received a product or refund now 13 months after Kickstarter took my money. I've been told to not expect anything for at least another 6-12 months.

Kickstarter, however, has also kept it's share of my money and is fully aware that 364 people have been waiting for 13 months.

Personally, I will never use Kickstarter again and will tell whomever I can to really BEWARE, as Kickstarter does NOT care about the person who gets shafted via their websiteDesired Settlement: I want the money taken from me 13 months ago refunded

Time Kickstarter steps up, refunds all backers and sues the project creator.

Perhaps they can address the fact that thousands of dollars have been stolen via their business; they keep there % regardless if a creator fulfills their requirements or not; and they censor backers (victims) comments.

Perhaps addressing ing the initial complaint instead of a blanket statement of what you want people to believe as opposed to the reality would be nice.

Hi there,Kickstarter is a platform where creators come to launch new ideas, with the support of backers. Creators on Kickstarter have a remarkable track record, but there are no guarantees that a project will work out. If a creator can't complete a project as promised, their contract with backers requires them to bring the project to the best possible conclusion, as detailed in our Terms of Use ([redacted]).Best,Kickstarter

Hi there,For each project, we’re presented with the same information that backers are and we hold each project accountable to the same rules. This is a space where creators are able to test and find support for new ideas, not to present items that already exist. We’re unable to vet whether each idea is completely realistic or whether a creator has qualifications to finish their projects; that’s up to backers to decide. For more information about backing a project on Kickstarter, see our Trust page: [redacted]Best,Kickstarter Support

Review: I have contacted Kickstarter several times about a project on their site that I backed that has broken their rules as regards to deadlines and updates. They refuse to do anything except "suggest" that the project manager make an update. I've complained to their customer service about the project manager slandering me personally and refusing to give me a refund when I asked for one because of his slander.

Kickstarter does nothing, I contacted [redacted] who collected the money, they say contact Kickstarter or my bank. I contacted my bank but because the project manager is WAY past the projected delivery date of his project, the 180 days allowed for a charge back have past. The bank suggested I contact [redacted], I did, they said contact Kickstarter and my bank. NO ONE is looking out for the consumer. NO ONE is offering a way to get a refund and NO ONE is doing anything about the slander.

Kickstarter says "If you think the project is in violation report it" I have, no one answers it.

Customer service is pointless, the only ones protected on Kickstarter are the people getting the money. The people funding the projects have no protection from anyone. I basically paid someone $55 to slander me.Desired Settlement: I would like a refund, an apology and I would like to see a change in policy so that the consumer has some protection.

Hi there,We're sorry to hear that this backer has had a disappointing experience on Kickstarter. Project Creators are bound by our Terms, [redacted], which state that a creator should fulfill rewards to backers, or refund backers whose rewards they cannot fulfill. That said, the timeline of these actions is up to the creator to communicate. We do see that delays sometimes occur in bringing creative projects to fruition -- as long as a creator remains communicative about their progress, we do not find them to be in poor standing on our platform. Though the project has exceeded the creator's estimated delivery date, this feature only serves as a guideline for backers for when to expect to receive their reward. It is not a guarantee. It looks like this project creator most recently posted an update on December **, 2014, about his project's progress, and announced a ship date. He is being active in the comments responding to backers' concerns. His project is slowly coming to completion and we are happy to see that he was able to work through his creative process to success.I also see that we last corresponded with this backer on January *, 2015. In this correspondence it appears that the creator did get in touch with the backer and offered to refund her at the same time this project fulfills rewards. To this end we see that the creator is trying to work out a resolution with this backer and hope that they can be understanding in this process. Apologies for any inconvenience this may cause in waiting for a refund, however it is up to the creator to communicate a timeline they can offer refunds, as long as they are communicating openly and often about this.Best,Kickstarter

The answer is incorrect. I have NOT received a refund. The person has stated that he will not refund my money until the book ships. Since there is no guarantee that the book will ship, there is also no guarantee that I will get my refund. And that does NOT solve the issue of the inflammatory comments from him or incited by him. I have multiple graphics showing where he has attacked me and where he has refused a refund. I have brought this up to Kickstarter and they simply say "Oh we will ask him". Time frames are set so that banks will not allow charge backs, processing companies will not handle refunds and Kickstarter "customer service" only helps the people who are actually making them money...the people who put the projects up on the website and the projects that are funded, the projects that they get a percentage of the money from. They do nothing to actually help the person who spends the money.

I reject this answer because Kickstarter makes their money off of a service. The service being a platform for people to gather donations. Kickstarter takes a percentage of the funds gathered as a fee. However, Kickstarter does nothing to protect the people that they are taking the money from, they only protect the people placing project on the site and making Kickstarter money. I have reached out to Kickstarter, I have reached out to the project creator and no one wants to help. The project creator says "I'll send you a refund when I get around to it but you aren't a backer anymore and I won't respond to you." I've contacted my bank and just by the way Kickstarter is setup to much time has passed for a charge back. Kickstarter is protecting a project creator who is taking people's money, harassing them, slandering them and victimizing them. Because this is being done on Kickstarter's website, Kickstarter is just as liable. Given a few minutes of research, this is not the first time that Kickstarter has run into problems between backers and project creators. You have a TOS for project creators however, you don't enforce them. You have a project creator who is in clear violation of your TOS yet, you do nothing to help those he has scammed. Is that because you will lose your 5% of his over funded project? All I'm asking and have been asking is that you work with the project creator to get my refund just as timely as you worked with him to remove the money from my bank account. I've been asking him for a refund since October. I've been asking for Kickstarter's help since December. All I've gotten is "oh not our fault". Apparently no one is at fault, but you got your $2400 from the project, he got his $46,000 from the project , he's got several people asking for refunds and several people asking Kickstarter for help. And people have been asking for your help on getting refunds on this project since November. Why are you all about helping those who take the money but not about helping getting the money back from those who have scammed and victimized backers?

Hi there,I’m sorry to hear that the creator has not done a better job of communicating. We've reached out to them with a reminder of their obligations to their backer community, in addition to having forwarded along your concerns and those of your fellow backers. While we're disheartened that they have not yet updated you and other backers on the status of their project, we're unable to force them to do so. It's the creator's responsibility to communicate and complete their project as promised. As we've previously shared, our Terms outline the recourse that a backer can take if they believe that a creator has not made a good faith effort to complete their project as promised. We are not a part of this agreement that the backer enters into with the creator when they back a project. Best,Kickstarter

Kickstarter does not conduct proper due diligence on what are purported to be entrepreneurs and inventors. For example, a new product called AutoSteady is reported to be not from an inventor, but rather from a Chinese exporter/distributor posing as an 'inventor' or whatever terminology Kickstarter uses. Moreover, by their own admission, Kickstarter does not support 'funders' nor do they stand behind the products funded. Their people do not have their own email so everything you contact them its a different person (feels like a shell game). When asked specific questions about returns, their due diligence process, etc., they selectively choose which questions they respond to. Lastly, their is no phone number to contact them with.

I have a defective product called AutoSteady (as do a number of others).

I am giving 'AutoSteady' and Kickstarter 30 additional days to refund my money or I will begin writing to the Attorney General, posting to blogs about Kickstarter and making consumers aware on social media to avoid this organization.

Review: I backed a project on Kickstarter for a fitness band, and the project was not fulfilled at all. The project creators made another product altogether, with collaboration of the parent company they worked for, and passed it off as an original product, which it's not.

I contacted Kickstarter to help resolve this, and to in some way either refund me or stop these people from taking so much money and essentially abusing their backers. Kickstarter pretty much told me "[redacted]" even though I explained very thoroughly.

Not only was Kickstarter not helpful, but this really goes against what they claim is "warranty and trust." When it came time to back me as a user of Kickstarter, they essentially ignored me and didn't help me, because they had already taken my money.

This is why I'm coming to the Revdex.com--I want Kickstarter to be held accountable to the consumer.Desired Settlement: I want a refund, and I want them to modify how they advertise about what they'll do if a project creator decides to not actually fulfill something.

Hi there,Hi there,Sorry to hear that this backer has not yet received their reward. Section 4 of our Terms of Use specifically provide more information regarding the relationship between backers, creators, and the Kickstarter platform:"Kickstarter provides a funding platform for creative projects. When a creator posts a project on Kickstarter, they’re inviting other people to form a contract with them. Anyone who backs a project is accepting the creator’s offer, and forming that contract.Kickstarter is not a part of this contract — the contract is a direct legal agreement between creators and their backers. Here are the terms that govern that agreement:"[redacted]We do our best to maintain an ecosystem that gives project creators the support and freedom necessary to bring their creative ideas to life. This often means that when projects launch on Kickstarter they’re still in the early stages of development. We expect that creators will make every effort to complete the project as promised, but we are sorry to hear the finished product was ultimately different than what the creator originally presented. If the backer would like a refund, they will need to reach out to the creator directly. I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

This is Kickstarter's policy on fulfillment: Project Creators are required to fulfill all rewards of their successful fundraising campaigns or refund any Backer whose reward they do not or cannot fulfill.---What Kickstarter is currently saying is that they don't take any legal part in helping the backers if there's any issue, HOWEVER: they require the project creators to refund any backer (me) whose reward was not fulfilled. So what is Kickstarter really requiring? I've been in contact for months trying to get a solution, explaining how the Project Creator has not held up their end of the bargain, so what will Kickstarter do to "require" them to do this? Because right now it feels like Kickstarter is only "suggesting" that the Project Creators fulfill this, as opposed to actually "requiring" it. This leaves me, the consumer, in the dust, because Kickstarter says that they're going to require it--the language of which implies that Kickstarter is going to enforce something--and now, after I've invested in their system. On their Trust and Safety page, [redacted] says We listen. We didn't just build Kickstarter — we've been lovingly tending to it since we launched in 2009. Our Integrity team is always watching over the platform and reviewing reports from the community. Our community helps us make sure this is the safest, most effective platform around. We monitor the system. Our Integrity team uses complex algorithms and automated tools to identify and investigate suspicious activity on projects. We take action. Sometimes that just means asking someone to fix a problem. But when we find users or projects that abuse the system, we don't hesitate to suspend them.--But right now, after I've asked Kickstarter to address this multiple times, they have not TAKEN ACTION, like it says on their website. They have not asked someone to fix the problem, and they haven't suspended or done anything to the backers. As a customer of the service, Kickstarter is not addressing me or helping at all. This is unacceptable, as they explicitly say that they do take action.

I spoke with some representatives at [redacted], and they indicated that it was corporate policy to not refund even clearly fraudulent funds in certain circumstances, and after they put a hold on the account of the criminals in this case they will eventually open it to allow them to obtain the funds. Kickstarter has completely ignored the issue despite many victims trying to contact them about it over the months.

This is one of those situations where some degree of common sense would be appreciated, as one of those who committed the fraud even posted that nobody should expect their desks and they should get a refund if they can (knowing that they would not be able to in this situation).

I am disappointed with how Kickstarter and [redacted] have handled this situation, so I am filing a complaint against both companies.

Hello,We're very sorry to hear about this user's negative experience with the project. Here at Kickstarter HQ, we expect creators to fulfill rewards, offer refunds if they’re unable to complete their project, and communicate with backers at every step along the way. Here, it appears that the amount the complainant pledged to the project creator was returned by the credit card company. Unfortunately, we do not have anything to do with any additional payments made between backers and creators off of the Kickstarter platform. While Kickstarter is the platform for projects and for the agreement formed between backers and creators when a project is backed, we are not a part of that agreement. We do not investigate a project creator’s ability to complete their project, nor do we facilitate refunds or the fulfillment of rewards. While in most cases you’ll find that rewards are delivered as promised, it’s also important to realize that some projects might not fulfill as planned. We hope this information is helpful.Regards,Kickstarter

Review: I donated to a project on kickstarter more than 2 years ago and I still haven't received what was promised. (as well as the 300 plus backers who believed in the artist in question) I emailed Kickstarter to see what could be done about this and the basically said that that project creators are legally obligated to follow through on what they promise when they raise and collect the funds. But they also said that things must be resolved between the backer and the creator and that kickstarter would not themselves get involved. I emailed them back and asked if a person would have to hire a lawyer in order to make the creator follow through on his legal obligations to deliver their finished project. I never got a response so I am assuming that's a yes. (which makes no sense since a lawyer would cost more then what was donated.) I guess my biggest concern about all this is how they've left the door wide open for fraud. If they won't get involved with people who don't do as they promise then anyone could start a project on kickstarter, take peoples money and not do anything. What I would like to see happen is to make them more accountable. More needs to be done to prevent people from getting taking advantage of because right now it's far too easy.Desired Settlement: It's been more than two years since the fundraising for the cd ended, in that time the artist has hardly communicated with his donors. (probably once every 6 months or so, and only when someone complained, which I am still mad about.) Would I like my money refunded? A part of me does, but that's not what's important. People need to be protected here. And I hope Kickstarter will be made to do more.. I would like 2 things: 1;) change the policy, Kickstarter needs to get more involved in making sure the backers get what they were promised 2:) I want my money back, 2 years is far too long to wait for a cd

Kickstarter takes accusations of fraud very seriously, and monitors activities on the site vigilantly.

That being said, when users back a project, they enter into an agreement with the project creator, as described in our terms of use. While Kickstarter is the platform for this agreement, we are not a part of it. Kickstarter itself cannot force the creator to fulfill rewards, offer refunds, or communicate with backers (though we encourage them to do so). Kickstarter cannot issue refunds, as transactions are between backers and the project creator.

We encourage this backer to contact the creator about her issue by clicking the "Contact me" link in the profile pane of the project page.

I have reviewed the response made by the business in reference to complaint ID#[redacted] and have determined that my complaint has NOT been resolved because:

It has been over 2 years and in that time the creator in question has been pretty bad about communicating, only doing so when someone complains. (About every six months or so) When me and other people who contributed brought that fact up he got extremely defensive and rude and stated that he isn't comfortable with social media so that is the reason why he doesn't communicate. So what do you suggest I do when the communication is so one sided?? I no longer want this cd, I really regret contributing anything at all because I know nothing will come of this. My biggest complaint about all this is the fact that you, (Kickstarter) is content with sitting idly by and doing nothing while people have been screwed out of their hard earned money. Like I have been saying before you NEED to get more involved. Otherwise anyone could start a project, collect money and not do anything more. You've laid down the welcome mat to fraud. As far as I'm concerned I've been cheated and you don't care about that, you got your money out of the deal.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Review: I ordered a iControlpad2 product for $87 including shipping. [redacted] The project was supposed to be completed in November 2012. The [redacted] strung us along stating various delays, and recently late last year cancelled the project. They refuse to give us refunds. Kickstarter says that they must give me a refund or provide a product, neither of which they have done. Kickstarter terms of service say the [redacted] needs to follow through, but will not step in to make sure they do so. After consulting with a lawyer, I have been advised that Kickstarter wrote their terms of service in a manner that there are no clear consequences if a project fails to deliver. Kickstarter says they need to follow through, but nothing happens if they do not. The project in question was in the UK before Kickstarter allowed foreign projects. The [redacted] setup a shell company in the United States ([redacted]) to collect the money. The money was then sent to the UK, where the [redacted] ([redacted]) has taken the majority of the money and has essentially left the project. I have already filed reports with UK Action Fraud, as well as Her Majesty's Revenue and Customs. Since this is happening outside of US jurisdiction, actual refunds may never be delivered. I also filed with the attorney general of Vermont.Desired Settlement: Kickstarter has a terms of service that requires the [redacted] (Product 3 LLC) to give me a refund or the product I ordered. They write it in a manner however that protects them (Kickstarter) from being liable if the project refuses to deliver the product or a refund. Even though the project was cancelled and refunds have not been given out, Kickstarter still continues to host the project website. I feel that it is proper due diligence of Kickstarter to continue to pursue the project they are hosting. There is no public evidence of this other then that they sent an email to the [redacted] asking them to follow through on project completion. What good are their terms of service unless they actually enforce them?

I would like a refund from Kickstarter for the service fee they collected from my submitted payment. I feel they are liable for that portion of the refund I am due. According to their page, that fee is 5% of all collected funds. I paid $87 for this project. I feel they are legally obligated to return to me 5% of the $87 I spent for their failure to hold the [redacted] accountable. That works out to $4.35. After receiving a refund from Kickstarter for $4.35, I will consider this case closed.

You took 5% of all funds collected by the project [redacted], yet you will not keep after the [redacted] to complete the project. You write in your terms of service that [redacted]s are responsible to deliver me the product I ordered or a refund, yet you have absolutely no consequences for failure to do so. You recently achieved a 1 billion dollar milestone for projects hosted on your website. While you didn't collect 1 billion dollars, you did collect 5% of that money. When projects do not deliver and you continue to host these projects, these scam artists will continue to prey on your member community. You occasionally update your terms of service to help protect yourself from liability, but not that of your backing members. We don't have a voice, and it's about time we start to get one.

Hello,

We're sorry for [redacted]'s negative experience. As previously explained, project fulfillment and/or the issuance of refunds are entirely within the project creator's control. Kickstarter cannot issue a refund of its fees under these circumstances, but we encourage the backer to reach out directly to the project creator to request a refund or seek a resolution. With that being said, we have reached out to the creator to encourage them to update backers on the progress of the project.

Finally, Kickstarter's Terms of Use give backers a legal recourse if a creator doesn't fulfill their promises. We hope that backers will consider that option only in cases where they believe that a creator has not made a good faith effort to complete the project and fulfill. If this backer believes legal action is appropriate, we encourage them to talk to an attorney about how to proceed.

Hi there,Supporting creative freedom is a fundamental part of our work; we strive to maintain a secure and vibrant community, while allowing creators to autonomously execute their projects. Each project on Kickstarter is an independent work by a creator. They receive funding directly at the end of a successful funding period in order to fund their project and fulfill rewards. That money never actually passes through our hands — we only receive a small fee. Since funds go directly to the creator, only they can issue refunds. If you haven't tried reaching out to the creator directly through Kickstarter yet, we highly recommend doing so. Ultimately, creators are responsible for their own behavior — from communication and engagement to fulfillment — and while we can and do enforce our terms of use, we can’t force anyone to actually write their book or send off their designs to the manufacturer. A big part of Kickstarter’s mission is to support creative freedom and independence; we don’t step into the actual creative process or fulfillment process itself.Kickstarter's Terms of Use outline the responsibilities of backers and creators. Review: I launched a Kickstarter campaign on January **, 2015 for my upcoming book and documentary, "[redacted]". On February **, 2015 I received a $10,000 from someone named [redacted]. I did not know of this individual but I was very thankful for their contribution. After the $10,000 I started to pick up momentum from family and friends as well as on Kickstarter's website. My project was posted in the "Popular Projects" category. I was just a few hundred dollars away from reaching my goal.

Unfortunately, just a couple of hours before my deadline I received an email from Kickstarter [redacted], in Kickstarter Integrity, stating that the backer [redacted] was risky and they were going to cancel his/her contribution of $10,000. Once the cancellation took effect the contributions decreased and I didn't not reach my goal.

I did connect with a few other campaign owners who also received a contribution from [redacted]. After emailing these folks I realized that I was the only one who's contribution was canceled. One campaigner did mention that she connected with Kickstarter Support team and was told that this backer, [redacted], has had previous fraudulent activities on Kickstarter. If this is the case, why was he able to make a contribution?

Kickstarter staff should do a better job at policing the backers and projects before approving their sign up. It was in no way beneficial for Kickstarter to inform me of this just a few hours prior to the end my campaign and in no way is this acceptable.

I emailed Kickstarter Support with questions that as yet have been answered. I simply requested that my campaign be extended given the situation. For fraudulent activities such as this there should be some sort of resolution for the campaigners. This was not the case and I am very disappointed with Kickstarter.Desired Settlement: As requested, I would like for my Kickstarter campaign to be extended. If this is not possible, I want my campaign to be invisible so it's not showing up as unsuccessful.

Response:

Investigations on Kickstarter are prioritized based on urgency. Project deadlines are determined by the creator, and Kickstarter cannot extend a project's 'live' status. If suspicious pledge activity arises while a campaign is live, Kickstarter's Integrity team will factor in the time until a project ends, among other things, when determining how swiftly they should act.The Integrity team's processes are thorough. A single investigation may take up to a week to resolve entirely because it takes time to understand the scope of an issue, gather all evidence, and remediate each incident that may be part of a larger case. In other words, many actions are required for cases with a large impact. This chain of actions is executed with timed precision, but looming project deadlines may hasten certain actions, such as canceling pledges and notifying those creators.Unfortunately such is the case with this creator. Our flagging systems caught a fraudulent backer who was part of a network of a dozen accounts very close to this creator's project deadline. As a result, the Integrity team acted quickly to ensure the best remediation course: that no fraudulent money passed through Kickstarter's system. In total, the network affected 15 projects, which were still under investigation at the time that the Integrity team canceled this pledge. For reasons of security and privacy, we do not detail our investigations to our users, but notify them with the actions that will be taken and why they have been taken.

Kickstarter has done nothing to enforce it's own TOS and leaves it's users in the dust to fend for themselves as the project creator refuses to respond and Kickstarter takes their 5% cut of funds while backers get scammed.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Sincerely,

Business

Response:

Hello,

As previously explained, Kickstarter is a platform where one party, the Creator, runs a campaign to raise money from other parties, the Backers, to fund a creative project. The filmmakers, musicians, artists, and designers on Kickstarter have complete control over and responsibility for their projects: we’re not involved in the development of the projects themselves.

When users back a project, they enter into an agreement with the project creator, as described in our terms of use ([redacted]). This agreement establishes a legal requirement for creators to follow through on their projects, and gives backers a recourse if they don't.

Regards,

Kickstarter

Review: I joined the Kickstarter campaign of their product called "Coolest Cooler" on 7/**/2014, pledging $185. They estimated delivery in Feb 2015 and charged me on Aug 2014. It is now January of 2016. I have received NOTHING. They have started selling orders on [redacted], with guaranteed delivery by Jan [redacted] according to [redacted]. They guaranteed with my pledge that I would get my cooler first, that I would also receive a drink guide, a tee shirt, etc. I have received nothing. In all their marketing they GUARANTEED I would get my cooler before anyone else etc. This has been very upsetting and I refuse to back any product ever again on Kickstarter.Desired Settlement: I want my cooler, as promised.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

They charged my credit card on 8/**/2014 for $200. They have taken my money and I have received nothing but their promise, per the emails you mentioned, that I would receive my order first before they began fulfilling non-backer orders. This is not the case. I want my order fulfilled immediately and as originally promised. Otherwise I want my money back, PLUS interest over the past 16 months they have kept it.

Response:

Hi there,We definitely understand your frustrations regarding delays with the Coolest Cooler project. At the same time, we also understand that the Coolest Cooler team is equally frustrated by these delays. A backer's desire to examine the validity of this creator's claims are understandable. Part of what makes our community so special is the vibrant backer community that supports creative endeavors and holds creators to the highest standards for transparency and integrity. That said, we also encourage backers of this project to keep in mind that this creator undertook a highly complicated project, has provided a detailed description of the path, has admitted to mistakes, and has committed to pursuing a positive outcome. When you back a project on Kickstarter you enter into an agreement with the project creator, as described in our Terms of Use: [redacted]. While Kickstarter is the platform for this agreement, we are not a part of it. A big part of Kickstarter’s mission is to support creative freedom and independence; we don’t step into the actual creative process itself. We encourage you to continue to reach out to this creator directly if you have additional questions about your reward and when it will be shipped.Best,Noah
