Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that the response would not resolve my complaint For your reference, details of the offer I reviewed appear below The advertised incentive, although not intended, was still advertised with no term or limitation for section onlyThis incentive was the deciding factor for us to decide to build with Westport Homes Regards, [redacted]

Because the home is years old, Westport Homes will not repaint the exterior trimHowever, Westport Homes is willing to purchase one gallon of exterior trim paint, a small brush, and a small roller for the customer so that it is easier to keep up with the maintenance of exterior paintWe will also send this information in a letter to the customer on Westport letterhead

Good afternoonAfter researching the details of this complaint, we learned the siding on this home was installed in accordance with the manufacturer's specifications at a time just before [redacted] realized there was a problem with their fiber cement productA claim for the fiber cement on this home was started in May and denied by [redacted] The claim appears to have been denied because the shrinkage did not exceed the product specifications at the timeThe settlement process remains open to original/current homeowners until If the customer could contact us by phone or email, we're happy to share the original claim form and also a link so they can open a new settlement claim with [redacted] for the fiber cement product

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that the response would not resolve my complaint For your reference, details of the offer I reviewed appear below. What the business stated in their response is true with one exceptionThe business employs a management company (Ardsley Management) who is responsible for seeing that the covenants of the community are followedOne of covenants pertains to allowing your dog(s) to run looseTherefore, if the covenant was not being enforced and Ardsley Management represents the business (Westport Homes), then the dog tracks were their responsibilityI don't believe this is a matter of whether it is covered by a warranty or not, but more of an instance of negligence on the part of the management company and the issue was noted at the time of the final walkthrough of the home which was prior to my taking possession of the home and prior to any warranty exclusion agreement being signed as stated in the businesses responseIn conclusion, the repair offered by the business is not acceptable because the repair does not return the item to its original condition and it would be obvious that it had been repaired Regards, [redacted] ***

As of today it is my understanding Mr***'s master bathroom has been repaired and all of the miscellaneous items (i.e., drywall repairs, paint touch up, cabinet doors) have been completed to his satisfaction. The only outstanding items are completing the exterior finish grade and sodding the
entire home siteBecause of current conditions, this work will be completed when weather permits in the spring of 2018. Mr*** is aware of this situation and is understanding of the escrow completion process.Again, I apologize for the ***'s frustration and appreciate their cooperation in resolving the noted matters promptly. If you need any additional information, I can be reached at 614-891-9545.RegardsJack M***Division PresidentWestport Homes, Inc

Whether the dog running loose is anyone's responsibility or not doesn't change the fact that these were items noted on the final walkthrough as being unsatisfactory and I was told they would be taken care of the following spring as a condition of me accepting the homeThe sidewalk in front of the home was replaced this spring, but nothing elseI don't see offering to do a promised repair as a courtesy, but more on the side of being a requirement and if I had been told at the time that this was the way you planned on fixing it, I most likely wouldn't have agreed

The warranty on this home is expired, but we were not aware that the homeowner was unhappy until we received this complaintWe would like the opportunity to discuss the coverage for each item with the homeowner privatelyPlease have the homeowner contact us by submitting a service request through
our online portal at http://www.westport-home.com/contact/service-request/

Good afternoonThe warranty superintendent should never document a non-warranty item on a list of approved warranty repairs, but every homeowner has the ability and the right to submit a list or service request for review at any time to Westport Homes via the online portal or by fax or mail
According to my records, nail pops & cracks were repaired on 1/18/and the service request for paint touch ups and having paint splatters removed from cabinets was completed on 1/22/Condensation on windows is a result of relative humidity when cold air on one side meets warm air on the other side and is not covered under warrantyThe window manufacturer, Jeld-Wen, handles the product warranty and can be reached at 1-800-535-to discuss condensation in further detailThe homeowner was informed to contact Jeld-Wen and was given the contact information at the 90-day inspectionI was not aware of any electrical issues until this afternoon, but a 5-second delay seems significant and I will ask an electrician to contact the homeowner as soon as possible to inspect and make any necessary repairsThe furnace filter was dirty at the 11-month inspection (photo attached), which could have voided the warranty on the system, but I sent a work order to the HVAC contractor at that time to have the system checked for defectsWestport Homes does not offer a landscaping warrantyThe landscape is a starter package and requires diligence on the homeowner's part to maintain and establishThe superintendent should have called about the tree and I'm very sorry that didn't happenI asked Dealers Wholesale to reach out to the homeowner regarding the fireplace as a result of the 11-month inspection and I'm sorry to hear the homeowner's concern was not resolved to her satisfactionI believe a blower can be added to an electric fireplace, but that would be at the homeowner's expense and would need to be set up directly with the supplierI'm not able to speak for the sales staff regarding what was discussed about the fireplace during selectionsThere is also an outstanding work order for the trim carpenter to secure the kitchen backsplashI sent a follow up request to the trim carpenter upon reviewing this complaint

I am aware of what I signed regarding the landscaping and there is no warranty, which is why I replaced the trees myself. However, my argument is the sod was not completed at the closing or at the time I signed those documents. There was an escrow set aside at closing for the sod to be completed. The completion of the sod work was not done from the get go satisfactorily. In fact the backyard was initially hydro seeded by mistake. That is my complaint which is not warranty related. I just happened to bring it back up during my day warranty walk through because the issue had still not been resolved. As far as the maintenance of the sod goes it was well watered per the landscapers instructions, and I have the water bills to prove it.I am very happy with the house construction and Steve and Mike were great through the planning and construction process

I was just informed yesterday that this homeowner has been without use of his bathroom and I am actively working with this him on a resolution I'm working as quickly as possible and will continue to work with him until the warranty service repairs have been completed

Neither an HOA nor a builder can control where an animal walks. Whether this was a dog or a wild animal, it was out of the control of the HOA and the builder. Westport Homes offered to make the appropriate repairs as a courtesy and the homeowner declined.
