This letter is in response to the complaint filed with your office on December 16th, The only standards/codes for a toilet is how many inches it must have on either side (left/right) and how many inches it must have from the front of the toilet I have included a copy of the code/regulations We have, however, spoken with the plumbing company, that installed the toilet, to figure out how to accommodate the homeowner’s preference with the least amount of inconvenience to her We have ordered a new tank for the toilet and once it has come in, we will contact her to schedule the replacement of her tank The homeowner has also been notified of this replacement Sincerely, Nina B [redacted] Warranty Coordinator

Home Purchase Agreement that the purchaser signed states "Builder does not guarantee a completion date"And although construction started in October there was an additional delay during the excavation of the foundation because of debris found from the previous house that needed to be handled.Locating clean fill required for backfilling a home can be difficult during wet and cold seasonsIf the dirt is too wet or frozen it can't be graded out properly.When/if electrical rough Issues arise we normally have the electrician rework the items when they complete their finish work prior to drywall and paint touchups.Our prints show the railing upgrade at the first floor stairs and the framing contractor missed that whenhe framed ItWe removed this and prepped it for the stair railing which will be installed as part of the trim punch work.The front door with the transom was not available at time of framing so to secure the home we used a temporary door to be able to secure the premisesThe correct door has now been delivered and installed.There was a revision to the print that affected sidingThe vendor we used installed the siding based on a previous version of the print and missed a portion of shake siding and installed horizontal siding in that areaThey have been notified to replace the section and will schedule accordinglyThe majority of the siding was installed correctly and only a small portion on the second floor was affected but will be corrected before the home Is complete.Change order #was written 10/8/just before start of construction which relocated the island to a different locationWhen the electrician provided his pre-wire he wired it as if it was installed in the standard location for an island.Electric services are anticipated to be live by April 81h• The power company that services this home is in the process of processing our order and once electrical services are available we can complete the home.Thank you in advance for your cooperation In this matterShould you have any question please call me at *** or you may email me at ***Sincerely,Tony ***

For your reference, details of the offer I reviewed appear below.This response is also falseThe Davis Homes warranty representative, Rob, has showed up once and repaired some cabinets and a doorHe was overwhelmed by all that needed done and admitted it was a lot more then what he could do. Rob was on the phone begging for vendors to make the major repairs, openly acknowledging the horrible workmanship done by Davis Homes, and hasn't returnedWe have contacted Davis Homes and submitted repeat requests with no response. Due to Rob not having any help the one day he did show up I actually had to spend my day helping him do what he did doDavis Home's has "no-showed" multiple times and hasn't done any additional repair work since the one day they did show upDavis Homes also refuses to repair the major defects in the home, instead expecting payment because they "substantially built" the home. Stating Davis Homes is honoring their home warranty as MrR*** has done would mean Davis Homes should be repairing all the construction defects within the home as required by Indiana lawThey have failed to do so as evidenced by several documents submitted to the Revdex.comNot only have they failed to perform warranty work, but they also failed to enroll our home in the third party insurance program as required by Indiana law to prevent homebuilders from doing as Davis Homes didOur bank understandably has similar doubts about the competence of Davis Homes and they have the final paymentRequesting payment for a home with severe defects is bad enough, demanding it because it is owed to you is just absurdWhat other Revdex.com A+ business would get away with leaving an incomplete defective product and pretending to be the victim when they weren't paid? Both Brad Davis and MrR*** have not made written guarantee of repairs once payment is madeInstead they deny these obvious defect exist, even motivating us towards protecting our investment even further. Brad Davis using his brothers legal firm to intimidate buyers into paying for horribly built homes is very pertinent and represents a small sample of the business ethics utilized by this firmBrad Davis and his company have repeatedly shown that they are lacking in the area of business ethics and the multiple complaints being submitted to the Revdex.com supports thisThey were caught lying about inspections, caught lying about repairs, caught lying about enrolling my home in a warranty program, caught using a home builder named *** *** on my home who was arrested for various home building fraud related offenses, they were caught setting up companies with their sales employees posing as independent realtors (indyhomesolutions.com), they were caught with employees posting several deceiving star reviews on google, they were caught trying to bypass us and get our money directly from our bank, etc..MrR*** claiming his law firm has been trying to work with us is nearly falseThey did tell us to pay $2000+/- in arbitration feesThey also emailed an offer months ago that was heavily favored towards Davis Homes and made us give up even more protectionsWe responded with an offer that was more reasonable and haven't heard from them ever sinceAs I informed MrR*** at that time, they are always welcome to come repair their defects, as an honest company would. In reference to the document stating they were contractually complete, this was presented to us as an "early move in form" that was post dated and that the defects would be repaired that weekWe have documentation from Davis Homes VP MrC*** stating suchThis is a prime example of how this company uses jargon filled contracts to get away with taking advantage of the common personKnowing now that this company was ran by a lawyer makes it obvious where this behavior comes fromAn A+ rated company should build quality, this company builds junk and hides behind their contracts afterwards. So again, Revdex.com, I am begging you to please acknowledge this company as being the dishonest company it is and please lower their letter grade from A+ before more people are taken advantage ofThey continue to fight a losing battle because as much as they try you can't dispute the pictures of nails sticking out of my roof or my sinking in second floorThe number of complaints this company has received is adding up yet they somehow remain an A+, leaving us to question the neutrality of the Revdex.com after a company pays to become accreditedThey also repeatedly ignore the timelines set be the Revdex.com for a response without consequencePlease do the right thing and protect homeowners from this companyNew homeowners will look to your review as a sign of quality so please, I beg you, help stop them from taking advantage of people like us. Since then, Davis Building Group has been in contact with me stating that they have the wrong tub and that problem halted construction. It seems to me that these people are not together in their planning. On top of the other situations that have occurred, only today, four months after they were informed about needed correction, was the light/fan fixture moved, they neglected to move the outlet into the laundry room. The insurance company has stopped making our rent payments saying the house should be complete and now we have to pay our own rent. Also, since the house isn't completed, the people we purchased our furniture from want to charge us for storage since they cannot deliver it.  What I would like to see happen is that Davis pay our rent while they take their time building my house along with any other expenses that build up (furniture storage rent, etc.). They have already received $145,000 and we don't feel they deserve another penny until the work is completed. Hopefully, this will be an incentive to finish our house. Sincerely, [redacted]
