Dear Ms. [redacted]:  I represent Davis Building Group, LLC ("DBG") with respect to its dispute with its home buyers, [redacted] and [redacted]. This letter is in response to your communication to DBG dated December 21, 2016, in which you requested a response to the [redacted]s' rebuttal to the complaint response submitted by DBG.   The [redacted]s' first complaint is that DBG allegedly failed to state that its legal counsel is "[redacted]' law firm, the former owner of Davis Homes and brother of Brad Davis, the current owner". It is true that [redacted] is Brad Davis' brother and is a partner at [redacted]. However, DBG fails to see how this is relevant to the issues present in this matter. DBG is an entirely separate legal entity from the entity that [redacted] had an interest in. Further, I am also a partner with this law firm and have no connection to Brad Davis and/or DBG other than that DBG is one of my clients. The choice of law firm that DBG chooses to represent its interests in this matter is irrelevant.   The [redacted]s further claim that DBG's attorneys sent a letter to the [redacted]s ''trying to intimidate" them. Enclosed with this letter is a copy of the letter that I sent to the [redacted]s on September 29,2016 in an effort to work towards a resolution of this dispute. Attached to that letter (and also enclosed herein) is a copy of the Certificate of Final Acceptance that the [redacted]s entered into with DBG in which the [redacted]s certified that all work had been completed on their home except for items documented on a Final Closing Walkthrough Form, that DBG had fulfilled all contractual obligations, and that DBG was entitled to receive the final contract payment of$20,182 on or before June 6, 2016. The letter sent to the [redacted]s on September 29, 2016 was not an effort to intimidate them in any way. That letter was sent in an effort to work toward a resolution of the longstanding dispute between the [redacted]s and DBG which, at that time, had already been pending for several months. Since September 29,2016, DBG has held off on pursuing legal remedies in and has continuously endeavored to attempt to resolve this matter  amicably with the [redacted]s by, among other things, performing warranty work on the home despite the fact that final payment on the contract price has not been received (which was a condition precedent to warranty rights), and attempting to work with the [redacted]s on establishing a framework for the parties to move toward a resolution of this dispute by agreement. Sincerely, Joshua T. November 10,2017 •     Rerouting of the tile is in progress •     Repair of the front  inlet is the responsibility of Boone County or the City of Zionsville •     Grading completed on December 1, 2017 •     Relocation of ceiling fan rough in was completed on November 30, 2017 •     Cabinet installation completed on December 4,2017 •    Flooring completed on November 30, 2017     On November 6, 2017 there was an onsite meeting with Denny B[redacted] to discuss concerns. There was another meeting on November 21·2017 with Denny B[redacted] and Tony M[redacted] to discuss concerns regarding the project and the estimated completion date. At this time, the estimated completion date is December 21, 2017. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  They fail to mention that their "legal counsel" is [redacted]' law firm, the former owner of Davis Homes and brother of Brad Davis, the current owner. They failed to mention this in their letter trying to intimidate us as well. Disturbing Brad Davis is using his brother to attempt to intimidate homeowners into paying for "substantially built homes," which is hidden in their contract as all they will build for customers. Seems like it would be a lot easier to do the proper thing and stop being dishonest and repair their poorly built homes like an A+ rated business should, which is why this company does not deserve this rating.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  We did meet with Davis to compile a list of items and a few things have been fixed.  My concern is that many items still have not been scheduled for repair and the office still has not made an effort to resolve the issue of incorrect items in the house (appliances, light,  cabinets).  We have been in our home for nearly 2 months and feel the time frame has been sufficient for scheduling which has not happened to this point.  The response from Davis is the same one that we have gotten since the beginning.   They say will will get things scheduled and get back to us, but that doesn't seem to happen nor in a reasonable amount of time.

Davis Building Group met with [redacted] on 2/4/16 to compile a complete list of items that need to be resolved.  We are currently in the process of building a schedule with the contractors and customer to remedy these items.  Davis Building Group did have the concern of mold addressed on...

asked us to fix his emergency brake cable. We informed him that there was cucrently no warranty and that we had already taken care of everything he asked us to when making the agreement. He was also extremely rude to me and my employees. From his over-reaction, I can tell this man is not used to being told no. We will not be paying for his emergency brake cable repair. I would also like to kindly ask him not to purchase another vehicle from us ever again.

They never should have sold the auto workout a working emergency brake.Therefore they should pay for

complaint.  For your reference, details of the offer I reviewed appear below.Re: [redacted]      Thank you for taking the time to review our response to Davis Homes. This is in reference to their documents submitted on 11/23/16.  Upon reviewing their documents we noticed only one thing missing, honesty. This is an ongoing issue with Davis Homes and a large reason we feel their A+ rating with the Revdex.com is misleading consumers. Please find the below response and the attached documents for your review.   o In reference to the defective roof installation caused by their poor workmanship: ? “We have already repaired areas on the roof that he questioned originally and then had an independent inspector come do a complete review of the roof ( A copy of this inspection is attached).  We also had the manufacturers rep review the roof back in April of 2016.” o The response by Davis Homes is partially true. They did repair some roofing issues that were caused by their unskilled labor and poor workmanship. It is also true that they had a manufacturer’s representative review the roof beck in April. What they neglected to tell you is they refused to provide any documentation of the manufacturers inspection despite several request, which is what led to us doing our own inspections and discov[redacted]g that the repairs they made were the least of our roof’s issues. Our roof requires a complete tear off and replacement due to improper installation and this is supported by contractors and inspections. Davis has been informed of these construction defects on several occasions, their claims that they were repaired represent their dishonest business practices.  Davis also failed to tell you that the manufacturer’s rep that they claimed guaranteed proper installation and warranty requirements never even went on the roof. We contacted the representative for IKO shingles, her name is Laura and we can provide her contact information separately since asked not to include it in our response to Davis Homes. According to Laura she doesn’t even go on roofs, she doesn’t do warranty verifications, and that she definitely doesn’t do roof inspections. She stated Davis Homes contacted her with the odd request to look at a roof because the homeowners were concerned because “due to the cold temperatures the shingles weren’t sealing down.”  She stated she agreed to go look at our home to see what they wanted, but that none of the things Davis Homes told us (and now you) are true. We also contacted Reese Wholesale, the supplier for shingles for Davis Homes. The gentleman for Reese Wholesale gave a similar response. If you need any further evidence of roof defects please see the attached document “[redacted] complaint” which is full of photos and “[redacted]” which contains all the dates Davis Homes was notified of these issues. We also attached the home inspection containing more documentation of their improper roofing.  In reference to the roof inspection provided by Davis Homes you will note the comment “Shingles sealed nicely,” an odd comment to make and one that likely is related to Davis Homes attempting the same scheme with this inspector that they did with the previous ones. The roof inspector missed obvious defects, nails poking through the roof, and shingles not even extending to the edge of the roof that any truly independent inspection would have noted. The same day Denny and I were working to have the home inspected again Brad Davis instead had a lawyer start sending threatening letters and stated they would no longer be working on the home. Brad Davis’ lawyer informed us that the progress we were making with Denny towards repairs was no longer valid. See attached.   o In reference to the shingles not cov[redacted]g our roof, and terminating before the edge of the roof, Davis Homes responded: “Roof repairs were made on July 29, 2016” o This is false. See above.  o In reference to the improper installation of drip edge/gutter apron: Roof repairs were made on July 29, 2016 o This is false. Please reference the home inspection report provided, their roof inspection report, or the photos in the attached “[redacted] complaint” for verification.  o In reference to the improper nailing causing damage to shingles, and nails to poke through the shingles exposing the roof to water intrusion: :  We have already repaired areas on the roof that he questioned originally and then had an independent inspector come do a complete review of the roof ( A copy of this inspection is attached).  We also had the manufacturers rep review the roof back in April of 2016. o This is false, see above.  o In reference to complaint about Davis Homes lying about roof inspections, demanding payments for defective work, and refusing to repair their poor work caused by their unskilled labor Davis Homes responded: .  Shingles are installed year round in our market and will seal as the weather warms up.  I am not aware of any blow-offs due to cold weather on his roof but if there was we would replace those until warm enough to seal on their own.  Attached is an independent inspectors report of the roof. o This addresses none of the concerns in the original complaint, and avoids addressing the dishonesty and defective work done by Davis Homes.  o In reference to a large section of our second floor “sinking in,” Davis responded: We would require more detail on who stated the would have to pay for repairs.  Our Director of Construction stated the floor is within tolerances. ? This is a confusing response from Davis Homes. To add more detail... Davis Homes made a major mistake and missed a major concrete pillar while building our house, their unskilled labor ignored this and simply kept building the home causing our house to sink in in the middle of our kitchen (see "[redacted] complaint" for photos). Our new contractor believes due to the home sinking in during framing due to the lack of support our second story now has an approximately 6X8 area that sinks in. This area was measured by Denny B[redacted] with Davis Homes and exceeded the standards for uneven flooring allowed by both the Builders Association of Greater Indianapolis as well as RWC Home Warranty standards. Davis was to have this repaired and had Kerman’s flooring came to measure and evaluate the floor, who also stated the floor exceeded the acceptable standard for uneven flooring. Shortly after this Davis Homes decided they no longer wanted to pay for this and decided that our floor no longer qualified for repair. The standards are very clear, the floor has been measured twice by Davis and decided it was to be repaired, and our photos in "[redacted] complaint" and "[redacted] issues" prove Davis is again lying and trying to not meet their obligations. We  o In reference to Davis Homes providing homes insufficient insulation, they responded:  We have sent the insulation contractor out on several occasions to add more blow insulation in the attic.  When Mr. [redacted] informed us of settlement we would send him out again.  Our insulation company has assured us it is blown to the right values. o They have sent the insulation contractor out on several occasions because they use a dishonest contractor who was caught four times shorting the home on insulation and not meeting building codes. According to the manufacturer of the insulation that they use the insulation should have an initial depth of 11.5 inches and a settled depth of 10.3 inches. The first time they installed the insulation they blew in 3-5 inches, second and third times only adding a couple more inches each time. The home currently still has areas with as little as 7.5 inches on insulation, far short of what is required.  Davis Homes claiming the insulation is “Settled” and that’s why it was measuring 7 inches below manufacturer standards is so dishonest it’s comical. Sadly, this is just a small example of how dishonest they are. Davis Homes claiming that the insulation company assures them it is installed correctly, and refusing to verify despite photos proving otherwise, is another example of their dishonest operations.  ? In reference to Davis Homes improperly installing the drip edge and gutter apron, Davis Homes later stated: We were prepared to repair this and Mr. [redacted] told us we couldn’t have any more contractors at his home.  We will forward the email he sent regarding this. o This contradicts what they stated previously in their response, but is still false. They were advised we requested no more work was to be done at our home until further notice, this was be because we wanted to consult with a lawyer. However they didn’t tell you that 1.5 hours later we received the attached letter from their lawyer stating they would be making no more repairs and we were to immediately pay them for the “substantially built” home. It also stated that all offers from Denny to make repairs to the house were no longer valid. Davis Homes has been advised multiple times they are welcome to return and make repairs, claims that we banished them and that’s why no repairs have been made are false. As you can see, it is Davis Homes refusing to return.    In reference to Davis Homes refusing to provide their bonding information, they responded: Not sure what he is wanting.  We have had our attorneys reach out to him to resolve issues and have gone above and beyond in many areas to satisfy his requests throughout the process. o This is another bogus response. First, it is obvious what we want. We want them to provide the insurance and bonding information that they advertise having that covers their work. Unlike an honest and quality company, Davis Homes continues to refuse to release this information. It’s pathetic. Also, Davis Homes claiming they had their attorney reach out to us to resolve issues are also false. All their attorney has done is send us the attached letter demanding payment, and send us information for an arbitration company with fees approaching $1500 just to file the claim. Their attorney took over a month just to respond to our banks lawyer. Their claim that they have gone above and beyond to satisfy my requests is alarming coming from an A+ Revdex.com rated business, seeing how all our requests were simply attempting to get them to repair all the construction defects. Please reference “[redacted]complaint” for a list of some of the “requests” that according to Davis Homes they went above and beyond by repairing, such as the mold filled crawlspace due to them not meeting building code.      Sincerely,
