I have issued a credit for the balance owed by the customerShe has a zero balance as of Friday June 10th The treatments she is disputing was completed with her presentI have issued the credit as a way for us to part ways without further communication with [redacted] She has continually been abusive to my employees and for the better of our business I hope this will end her calls to our office Tell us why here

August 15, 2016To whom it may concern,In response to [redacted] He never signed a contract in or We DO NOT require a signed contract for maintenance servicesYes he moved in as we continued to service the lawn 10/7/and again on 11/24/As you will see in the email correspondence I have enclosed he states that he is trying to sell his home still as 4/26/You will also see in the letters have enclosed mailed him for service that were addressed to his Florida address given to me by himWe would have gladly stopped the service had he communicated this to us before the first serviceWe did not kill any grass on his lawnWe cancelled the account on his first communication of this matter and also offered to collect half the balance to cover time and materialsThat amount would be $which seems more than fair to settle this matter.Also why would he contract for another company to spray his lawn if his home was sold and someone else was living there?Thank you Lawn Doctor

On date of application above, applicator spread chemicals all over driveway and on parking area along side of driveway and garageI called them to come and clean offThey came and swept sidesof driveway about a foot in on each side but not the rest of the center majority of the drivewayI called back and said not acceptableIt was a lousy half [redacted] jobHe gave smart talk backI said I no longer wanted to do business with them, and send me money back for the rest of service remainingHe said "I can do that"I then called NYS DEC they came and agreed this was not acceptableThey made a reportThey visited the company and told them to come back and clean properlyThey didAs of this date I have not received my money back

We have been working with Lawn Doctor for years now and we really love the company The owners are helpful, knowledgeable, responsive, customer service oriented and very pleasant to work with We have used them for lawn maintenance, seeding and mosquito control All have worked great for us When we started our lawn maintenance with them we had many, many weedy areas in our lawn, by the end of the first season using them those areas were all hugely improved and by the start of the 2nd season they were gone Their mosquito control product works very well We were not able to enjoy our evenings outside at all and once they started treating our property we were then able to be outside without being bittenOverall it is just refreshing to work with a company that treats you like an individual, not a number, who is willing and able to work off-plan to address specific needs of your property I definitely recommend Lawn Doctor of Batavia for their service and their products

Please be advised that although the account was not terminated prior to the service date, we will as an act of good faith measure adjust off the service fee for the Early Spring treatment All of our paperwork does indicate that "service does continue from season to season, year to year, for your convenience." All customers are also mailed to letters (November & January) before services begin, to inform all customers of scheduled services, the fees, and has a message to call with changes In addition an automated call was made days prior to the service, and there was no contact from the customer Thank you

To Whom It May Concern, In regards to the complaint submitted by Mrs [redacted] , on 4/23/of applications for Mole Control and Grub Control were ordered with the intention to help control the level of moles in the lawn (it was advised that the program consists of services and more than may be needed) On 4/28/customer called to ask to be informed when the applications would be provided (The action was noted and a courtesy call was made) on 5/20/the customer indicated a concern with the mole activity still being rather consistent, it was at this time we did a courtesy reapplication of the Mole Control (despite it not being guaranteed due to not having ordered the actual Program) we advised that another application was needed at a rate of $+ applicable sales tax That service was ordered and provided at the appropriate time We did get payment for the first application of Mole Control, however statements have been mailed and calls made regularly for the balance of the 2nd Mole Control & Grub ControlThe balance on the account is: $(includes a $court cost fee)We have spoken with the customer a number of occasions regarding the balance, I myself on 11/17/ At which point the customer was complaining that the services made no improvement with the appearance of the lawn The customer was advised that the Mole & Grub Controls are not designed to correct the lawn damaged by pest(s)It is with the intention to lessen the pest activity onlyThe conversation then turned into the customer questioning if services were even rendered, which we not only left service invoices, but we have tracking that allows us to consistently monitor where every driver is and what is being done at all times The customer then stated “she is and is not paying the balance.” At this point we are able to offer the customer a payment plan for the entire balance $or they may opt to have a lump sum settlement in the amount of $to close the matter, which will then relieve it from courtAny arrangements or settlements must be discussed and paid or agreed upon before the court datePlease reach our office to make your payment or to aquire an payment planThank you, [redacted] Lawn Doctor [redacted]

Hello Sir,We sent two letters stating we have you scheduled for serviceOne was sent in December the other was sent in January clearly stating to call us if your status has changedWe also placed two automated calls to his numberOur service and all lawn care service programs are a maintenance service that is time sensitiveWe applied service by the end of March last yearWe had significant snow fall in early March making it impossible to service the lawn earlier in the seasonNever the less the lawn was serviced at the appropriate timeHe had the right to cancel service at any time so I'm not sure why he would wait until after a service was performed to cry my right to cancel was taken away [redacted] also acknowledged that he received and disgard our letters unopenedWe do not want to Service Customers lawns that do not want the service and a simple phone call from you would have stopped services before they were performed and could have avoided this entire situation.In closing we feel the customer is at fault here considering we reached out three times saying "we have you Scheduled for service" with no replySilence is a considered agreement.Thank you AaronLawn Doctor

In regards to the matter at hand, it is my understanding that our service manager Mike spoke to the customer and although was told an approximate price to seal the driveway, was awaiting a written estimate In addition the customer was to get in touch with whom he is getting a written estimate from, to find out if it is best to await spring to seal the driveway Additionally, we are waiting of this information before we decide how we will proceed with the matter Please either email ( [redacted] ) the written estimate and advisement for when to appropriately seal the driveway Once we are in receipt of this we will advise on resolutionThank you, [redacted] Lawn Doctor [redacted]

January 17, 2017Good Afternoon - [redacted] contacted me on June 6th of and discussed services that we performedAfter going over these services he chose to order 2-The law maintainer package and the yard armour programI personally serviced his property, flagged the yard and left invoices on 6/17/and 7/26/Once an account goes days without payment it goes into credit hold so that the Customer won't get any other services that he may or may not pay forMonthly statements have gone out without payment[redacted] never called and said there was a mistake after service number on 6/and never called after service on 7/The only calli received was after the letter stating the account was going to collections, tried to resolve this but to no availHe insists that there was never a Calf however cell phone records for the business verify the sale on 6/6/2016.My customers call me to begin service, I am the only one working this business.The account has now been cancelled because of nonpayment and we are looking to collect the amount due prior to taking legal action.Any other questions can be addressed to meat ###-###-#### or via email at [redacted] @lawn doctor.comCharles TOwner

On March **, my office received a call from
*** ***, inquiring about our services*** *** stated that he and his wife had just purchased the house and that the lawn had been neglected and had many bare areas as well as hard, compacted soilWe explained to the *** *** that a Core Aeration would be the best way to relieve the soil compactionWe also informed *** *** that while the soil was fractured from the aeration it would be a good idea to over-seed the lawnWe were clear that FALL is generally the best time to seed a lawn but due to the condition of the lawn it made sense to have the seed spreadWe also advised *** *** that depending on the summer and on how diligently he kept up his lawn watering there would still likely be areas that would require a Fall seedingWe are always clear that a Core Aeration with Over-seeding in the FALL usually results in only 50-60% germinationWe were also very clear that the only seeding service that we offer with a 100% guarantee is Fall Power Seeding (approx90% germination)We are always crystal clear as to what a customer can expect with a spring Core Aeration/over-seeding and make certain they understand its limitations before purchasing it*** *** stated that he would think about this and get back to us if he was interested
On April **, *** *** called and ordered a Core Aeration with Over-seeding and a Maintainer Lawn Service Package for their property, ** *** ** *** *** **
On May **, we completed the Core Aeration w/ Over-seed as well as the first of the lawn servicesAll areas of the lawn were aerated, seeded and fertilized
On May **, *** *** called and reported that while my technician was aerating the lawn he must have damage a plastic low voltage lighting fixture on their propertyMy office advised her that we would check with the technician and get back to herOn May **, we spoke with *** *** and advised her that our technician did not recall causing any damage but that if she submitted a receipt for the damage we would credit it to her accountWe never did get the receipt but ultimately we did issue her a credit for for the fixture (an entire set of comparable lighting usually costs between - 65.00)
On May **, 2014, *** *** called and reported that there were still several areas on his lawn that were not filling inWe explained to *** *** that this was not uncommon, it was only days after spreading the seed and explained further that he should maintain his watering, several times a day to keep the seeded areas moistWe also explained that seed germination ranges from 2-weeks if watered properly*** *** was further advised that even though this particular service was not a "Guaranteed Service" we would still come back and re-seed any areas that were not filling in but that he just needed to give it another week or so
On June *, 2014, we responded to the *** residence and used a Mantis Power Rake to cultivate the areas that were still not filling in and re-seeded themWhile my technician was providing this service, *** *** stayed with him the entire timeWhen he was not alongside my technician, *** *** was watching him from the porch (about hours)My Technician did not leave this property until the *** was satisfied that everything was done to his satisfactionAt no time did *** *** indicate to my technician that he caused any damage to his drainageAlso, as an addendum, the Mantis Power rake only scratches the surface of the soil (de-thatcher style), it is not a tiller and is not capable of ripping out a drainage system more than 6" underground
On June **, 2014, *** *** called and inquired as to when her next service would be performed*** *** stated that there were still some browned areas on her lawn and that there had been a weed outbreak since her last serviceWe advised *** *** that there was already a work order on our truck and that the service was going to be provided todayWe also advised *** *** that the technician would also provide some spot touch up seeding to the browned areas at no additional chargeWe further explained that due to the fact that much of the grass that did germinate was still very immature that we would only be able to spot spray weeds and would not be able to use a full strength mixture (We are clear when we sign up a new account that there will be weed outbreaks between the services and that it takes at least a full season of weed control applications to get good control of them)My technician responded as promised, fertilized the lawn, re-seeded any browned area s and sprayed the weedsPlease note, at this time my technician pointed out that the lawn was dry and was NOT being watered regularlyThe full sun "hot spots" was where almost all of the problems wereIt is a simple equation: New Grass + Full Sun - Water = Browned lawn
On June **, 2014, *** *** called and stated that my technician was there days ago and that the weeds were still not dead and that the grass was not filling in the bare areas*** *** was advised that the service was just performed and that she needed to give it time to workShe was also advised to water her lawn more frequently if she wanted our services to work
During the course of July I exchanged a few e-mails with *** ***, basically reiterating what we had been discussing as stated aboveI was away from the office between 7/**-7/** and although my staff was fielding calls, I was not personally available during this timePlease note, I have an *** ***and a *** *** that make it clear they can handle any issues
Ultimately, on July ** we reached an impasse and cancelled all services
Our lawn services are guaranteedIn accordance with our written guarantee, we credited the cost of the last lawn service (88.87) to the accountWe also issued a credit for an addition to cover the plastic light fixture we were accused of breaking
In closing, I feel as though we went out of our way to accommodate this customerWe clearly set realistic expectations as to how the services would work, and what should be expectedWe provided re-seeding services two times (at no added cost) for customer that was not watering and was well aware that the original seeding service was not a guaranteedWe stood by everything that we did and never abandoned this customerAll written guarantees were honored, non-guaranteed services were also honored as if they were guaranteed and generous reimbursement for supposedly damaged property was credited
