Please consider this Lease Finance Group, LLC’s (“LFG”) formal response to the above-referenced complaints.
LFG is a commercial equipment lease financing company specializing in the financing of merchant card processing equipment. It does not, however, provide merchant processing services.
The complaint herein alleges misrepresentation by Lessee’s sales representative concerning the lease agreement (the “Agreement”).
On May 9, 2016, Complainant contact LFG requesting breakdown of the remaining term of the lease [redacted] advised Complainant of the End of Lease Term Options under the Agreement for effective termination, and quoted a buyout amount of $251.95. Equipment was received on May 11, 2016. Buyout check was received on May 12, 2016. Lease will be terminated and release letter will be sent to Complainant.
Complainant claims that equipment was returned for lease [redacted], but equipment was not returned to a location designated by LFG and complainant otherwise failed to exercise any of the End of Lease Term Options per the contract. Therefore, Lessee is not due any refund lease will not be terminated until the End of Lease Term Options are executed.
In response, as stated in the Lessee’s Agreement, LFG is “an entirely separate and independent company from the vendor, equipment manufacturer and/or credit card processor doing business with Lessee.” Independent vendors do not have the authorized agency power to waive or alter any terms or conditions of LFG’s Agreement.
Additionally, the “Lease Acceptance” provision of the Agreement provides that “no attempt at oral modification or rescission of this lease or any term hereof will be binding upon the parties.”
The provision also states that Lessee “has been given an opportunity to read and make a copy of the Agreement and agrees to be bound by all terms” thereunder.

Thus, any alleged actions, promises, or representations by vendors made contradictory to the Agreement will not release Lessee from any obligations thereunder.
In summation, the Agreement does not provide for Lessee’s unilateral termination of its terms and obligations. Rather, it expressly sets forth the absolute and unconditional obligation to continue all payments due thereunder.

The complaint herein alleges equipment is not working. Complainant would like to be provided with working equipment, or else would like to cancel the contract.
A representative from LFG reached out to the Complainant on June 10, 2016. Complainant is currently being assisted with equipment issues. LFG has provided Complainant with the information required to get up and running.
In the interim, Lessee’s account currently remains in good standing with LFG.

[redacted] 25th Ave I do not agree with the answer given because I did not receive any such letter stating that I had "returned the wrong equipment" and because the machine associated with lease # [redacted] was returned in 2012.  However, I am willing to pay the stated amount of $501.25 with the condition that I receive in writing a statement from LFG that this finalizes All of our business together and no further attempts will be made to withdraw money from my [redacted] business account nor I receive any future statements concerning ANY past leases with them. Thank you.

MAINTENANCE
Dear Revdex.com:

Please consider this Lease Finance Group, LLC’s (“LFG”) formal response to above-referenced complaint.
As stated in the Agreement’s “End of Lease Term Options” provision, Lessee had the following options upon expiration/termination of the Agreement:
a) Return the Equipment to LFG in good repair, condition, and working order,
b) Opt to purchase the Equipment at the end of the Agreement for fair market value, or
c) Extend the Agreement on a month-to-month basis (under the same terms and conditions)
The provision also states that failure to exercise either option above would result in an Agreement extension on a month-to-month basis at the same monthly payment and terms and conditions therein.
Applied here, as Lessee has failed to exercise either of the above-detailed options, Lessee’s account will remain active on a month-to-month basis until either such option is executed.
On June 8, 2016, Complainant contacted LFG requesting options to cancel. Complainant was advised of instructions to pay off the past due balance and return the equipment. Complainant advised LFG that she will attempt to locate the equipment.

However, in an effort to amicably resolve this matter, LFG extends the following settlement proposal options:
a) Upon receipt and successful negotiation of payment in the amount of $271.14 and return of equipment, LFG will release Lessee and Complainant (as Personal Guarantor) from any and all obligations under the Agreement.
b) Upon receipt and successful negotiation of payment in the amount of $320.70 without return of equipment, LFG will release Lessee and Complainant (as Personal Guarantor) from any and all obligations under the Agreement.
LFG’s proposal is merely an accommodation and will not be construed as an admission of any wrongdoing or liability whatsoever. .
