I am rejecting this response because:I understand their cancelation terms at this point but that is not the reason for my complaint although it is ridiculous to make a customer jump through hoops to discontinue service.My complaint is that the first person I spoke to at Lifetime fitness did not make me aware that I could cancel by sending a letterShe told me I MUST come to the club and sign some papersI live hours from this club now and that was not possible for me to drive thereIf their employee would have told me to send a letter I would have done thatThe next person I talked to said I could send a letter and I did that immediately. When I complained that the first employee didn't give me that option they said "it is your word against ours"I have made monthly payments to these guys every month for the past years, why would I lie about this??? They need to refund my original request since that is the right thing to do

I am rejecting this response because:
As stated I could cancel the membership under medical circumstances, LifeTime told me I could cancel and did not specify how the doctor's note should be addressed to themThey back tracked on their statement by then saying my provided doctor's note should specifically say how long I will not use the gymThat is not what the "Contract" specifies on cancellationsThe circumstance was unforseenThey used this has a way to keep me by playing on words, in which I have recordings of to further proceed with the law for making this difficult for meI'm assuming they think I'm bluffingFurthermore, my Dad has NOT signed any documents and will not utilize the gym as long as I cannot, being that I pay for both membershipdHe does notTheir attitudes are the worstCareless, inconsiderate, and senselessAll 3, God depises

I began the discussion via email with LifeTime in novemberThey agreed to cancel finally without written consentWhat I’m asking for is that I also be credited back to November in good faith as their cancellation

complaint filed with your office by Ms*** regarding an incident*** presented a liability claim against Life Time, claiming that she sustained "chemical burns" in the pool at our Orland Park, IL location
Her claim was submitted to Life Time's liability insurance carrier, Travelers, for investigation
Travelers investigation determined that the chemical control system which constantly monitors and controls the pools chemicals was fully operational and nothing out of the ordinary on the date in question, 4/24/In addition, the operations team manually tests the water every hours
On 4/24/15, the water was tested at 7:a.m., 10:a.m., 1:p.m., etcand all readings were limits*** checked in at 7:a.mthat morning, shortly after a reading had just been taken
There were no other complaints or issues by any other members
*** submitted medical documentation to Travelers which gave a diagnosis of "dermatitis", not chemical burnsDermatitis is an itchy rash which can be a result of any number of causes
Travelers denied ***'s claim, finding no negligence on the part of Life TimeIn addition, Rene signed a Member User Agreement when she joined the club in which she agreed to assume the risk of injury, and waive liability and the pursuit of claims against Life Time (copy attached)
*** was advised of the basis of the liability denial both by Travelers and the Risk Management staff at Life Time's corporate office

As such, in the spirit of delivering best-in-class facilities, amenities and programming, we have implemented consistent membership guidelines to provide a uniform member experience.By way of background, Life Time Fitness’ General Terms Agreement states that a member may terminate the membership for any reason by giving advance written notice. Advance written notice is described as submitting a termination request at a Life Time center or by sending a written termination request stating that the member is terminating their membership by certified mail, return receipt requested. We believe that it is in the best interest of our members to have a receipt of cancellation to prevent any possible miscommunication. Life Time does not accept cancellations via phone, fax or email. For reference, I have included a copy of Mr***’s General Terms Agreement and Member Usage Agreement.Additionally, the General Terms Agreement states that all cancellation requires written termination by notice. Members will have active membership and pay for days following cancellation receipt. (ex: cancellation received September 15, member will have an active membership through October and pays days of October on October 1.) Upon reviewing Mr***’s membership, Life Time Fitness has no record of a proper cancellation request for Mr***’s membership. Without a proper cancellation, Life Time declines to remove the current balance owed. If Mr*** can provide proof of a proper cancellation, Life Time is more than happy to readdress this complaint at that time. The last membership change completed by Mr*** was on April 30, when requesting to downgrade the membership to Life Time Health hold. I have included this documentation for reference as well. The current balance on Mr***’s membership is $21.66. ***’s for submitting her complaint so that we could address her concerns further Upon reviewing MsRobinson’s membership, Life Time has record of Ms***’s signing up for the year Loyalty membership. For reference, we have included Ms***’s General Terms Agreement for further clarification After reviewing the notes on the membership, Life Time has explained to Ms***’s multiple times that she must provide Life Time with some proof of relocation should she wish to terminate the Loyalty contract immediately, or provide a medical note from her physician should she wish to freeze her portion of the membership. Life Time received the medical documentation on June 15, 2017, so Life Time has honored to remove Ms***’s from the membership, leaving the membership as a Single membership for MrGary ***’s. Dustin Oignores the fact that the Lifetime representative who provided the agreement expressly represented to my wife that no additional charges would follow from accepting the free swimming lessonsHence, this is a case of fraud in the inducementThe language of the putative Lifetime agreement does not, in fact, reflect the parties' understandingHence, although I appreciate the response, it would be helpful if the response had come from someone with knowledge of the actual facts, instead of someone completely divorced from the situation, apparently in Minnesota, relying in paperwork
If Lifetime believes that it would be better served by my filing a civil action in Tulsa County, Oklahoma and suing for fraud and rescission, as well as attorney fees, please advise

It appears as if the request to receive a refund for the months that the service was not cancelled as requested was purposefully ignored in this responseTherefore I am not satisfied with this response
Furthermore this is a boiler plate response that demonstrates that this organization does not truly care to rectify the offending policy that caused this grievance in the first place and will continue conducting business as usual with no intent of preventing this recurrence with other potential customers
While most month to month services offer an easy method of cancellation, this organization forces customers to jump through hoops in an attempt to keep them on the hook for as long as possible, taking the money of hard working folks well beyond the actual use of their membership
A change in policy that would allow customers to cancel their membership via email and a refund for the months of service that I was charged for when I first attempted to cancel are the terms I would accept

I received your complaint dated Thursday, October 8, containing a
complaint filed with your office by Mr*** *** regarding the cancellation of his Life Time Membership, and final August membership dues owed to Life Time
By way of background, Life Time Fitness' General Terms Agreement states that a member may terminate the membership for any reason by giving advance written noticeAdvance written notice is described as submitting a termination request at a Life Time Fitness center or by sending a written termination request stating that the member is terminating their membership by certified mail, return receipt requestedWe believe that it is in the best interest of our members to have a receipt of cancellation to prevent any possible miscommunication
Additionally, the General Terms Agreement states that all cancellation requires written termination notice by the end of the month in order for the termination to be effective on the last day of the following month (e.g., written notice received by Life Time Fitness between May and May will be effective June 30)For reference, I have attached Mr***'s General Terms Agreement signed at the time of joining
Life Time Fitness respects that there are countless situations which pose special circumstances to our members across the country and may require a member to cancel their membershipAs such, in the spirit of delivering best-in-class facilities, amenities and programming, we have implemented consistent membership guidelines to provide a uniform member experience
Upon reviewing Mr***'s membership, Life Time does have record of Mr*** requesting to terminate his Life Time membership on July 10, Per the billing cycle notice to cancel, the membership pended termination for August 31, For reference, I have attached a copy of Mr***'s Termination AgreementMr***'s final monthly dues for the month of August did not successfully process through, and remains outstanding at this timeI can assure Mr*** that the past due balance does not affect his credit score at this time, but is rather an outstanding debt owed to Life TimeIf Mr*** happens to wish to rejoin Life Time in the future, Life Time will require this balance to be resolved prior to rejoiningLife Time respectfully declines to waive the current balance owedFinal payment can be made by contacting Member Relations at 888-430-

Life Time has processed a refund in the amount of $for the final prorated dues for November, as Dr***’s last visit to the club was on October 30, 2017. The refund can take 2-business days to post back to Dr***’s bank account due to bank processing guidelines.
