Client had had a physical brain injury making it impossible for him to trade successfully in the market with real money Client purchased our program with the stated goal of wanting to become a profitable trader with real money They purchased months of time, personalized mentoring sessions and a Mind for Success program Client has been an active client for nearly months - times longer than originally contracted They traded their sit down training for additional time in our program and also in the Mind for Success program They spent weeks every day 1:over the phone with one of our mentors actively trading the futures market Client has gone to several additional classes without paying because we wanted to help him I received a call from client several months ago thanking me for all the time and effort we'd spent on him as he was now actively trading live money in the markets profitably Client has received the training we guaranteed which was that he would become a profitable trader with live money

Mr [redacted] 's main complaint seems to be that our education did not meet his "requirements" for joining the program Yet he doesn't mention in this complaint exactly what his requirements are which seems to be consistent in his interaction with us During his time with us, Mr [redacted] attended the foundational class he purchased times live and also watched class recordings He also watched all of the self-study modules associated with this class He called in to complain so we moved him to our other foundational class teaching the same principles but with a different instructor He only attended three live classes before calling in again to complain Over the next few months, Mr [redacted] was enrolled in the What are Options class, The Wendy Kirkland Foundational class, the Leverage Your Trading with Options class, the Advanced Technicals class, the Safe Options Strategies class, and the Chris Verhaegh Foundational class In all, Mr [redacted] attended classes and received well over hours of live or recorded, interactive investment training He watched several self-study modules in the various classes in addition to those he absorbed in his initial foundational class He also spoke with his student counselor times and Brenen, his director, for one time He also sent and received responses to emails from his student counselor, MrKurt W [redacted] In every instance, we worked hard to meet his requirements for joining our program He was consistently negative and vague as to why he was unhappy and what his requirements were We work very hard to provide a valuable educational experience to our students Our mission is to help each of our students become successful traders This sometimes requires the difficult effort of shifting thought processes to better understand and react to market movement A consistently negative outlook makes it very difficult, if not impossible, to find success as a trader or investor We believe that one of our duties is to help our students through this initially challenging period of overcoming self-sabotaging thought processes so they can break through to the other side with consistent profits We feel Mr [redacted] was unwilling to make this transition despite our best efforts to help him do so We did our part by providing so much education and phone time with Mr [redacted] and believe this complaint is yet another indication of his negative approach

The company does offer funding through third parties Originally, the company entered into an arrangement with a funding source willing to partner with clients on wholesaling propertiesThis funding source would provide a proof of funds to help secure the deal and would work with the client in assuring a profitable sale This source would only partners on deals which met a few, specific criteria The company believed this relationship was a unique value proposition in the market and began making sales We quickly found a need for funding for deals outside of this narrow band of acceptable criteria Unfortunately, within a few weeks after launch, this funding partner was admitted to a hospital with a serious and potentially fatal condition which put a kink in the planned funding solutionSo the company was faced with a need to replace an existing funding source (which provided proof of funds - a key differentiator) and also which could fund a broad range of deal types and price points The company has now secured two funding sources One is a traditional hard money lender with great terms and a willingness to invest in a variety of real estate projects The other is a source which, among other things, provides proof of funds to help investors secure properties quickly.Mr [redacted] makes reference that Mark "set him strait on that." Mark understands our funding needs and parameters In all the calls Mark had with Mr***, he never said we don't offer funding We do offer funding At first for very specific deals However, now the company is even better positioned to provide funding We look forward working with Mr [redacted] and funding his deals in the future

Greetings, We work hard to provide an excellent education and experience for our students We continually invest significant resources of time and expertise to improve our curriculum Whenever we engage with a student, we provide these services and education as part of the contractMr [redacted] enrolled with us on September 28, Over the course of the next three weeks, Mr [redacted] completed all lessons in the first course and started all lessons in the second course of which he completed He also attended live classes during this time After consuming so much of our education, he asked for a full refund We refused the full refund as Mr [redacted] had already received significant value from our education and because he was way past his right of rescission timeframe He then decided to pursue a chargeback and a pre-arbiteration chargeback both of which we wonFinally, after losing both chargebacks, Mr [redacted] let us know that he didn’t have money to trade We offered to refund him half of his tuition simply to give him the cash required to invest He refused our offer It was after all this that Mr [redacted] told us of his medical excusesWe offered Mr [redacted] a partial settlement of half of his tuition to give him the funds needed to trade despite already winning two chargebacks We also offered Mr [redacted] access to other classes and trading techniques more in line with his financial situation once we finally understood what they were We understand how hard it is for our students to bridge the gap between wanting financial freedom and actually obtaining it It takes diligent effort and a willingness to be uncomfortable for a while until trading becomes comfortable and part of the new normal Because we know how hard it is, we willingly work with students who need us to be flexible As we showed in Mr [redacted] ’s case We were under no obligation, and we willingly offered a half tuition refund to help him accumulate the funds necessary to begin trading He refused Thank you,Lincoln H [redacted] Lincoln Institute of Financial Education

sessions and a Mind for Success program.  Client has been an active client for nearly 30 months - 5 times longer than originally contracted.  They traded their sit down training for additional time in our program and also in the Mind for Success program.  They spent weeks every day 1:1 over the phone with one of our mentors actively trading the futures market.  Client has gone to several additional classes without paying because we wanted to help him.  I received a call from client several months ago thanking me for all the time and effort we'd spent on him as he was now actively trading live money in the markets profitably.  Client has received the training we guaranteed which was that he would become a profitable trader with live money.

I am rejecting this response because: Business responseMr. [redacted]'s main complaint seems to be that our education did not meet his "requirements" for joining the program.  Yet he doesn't mention in this complaint exactly what his requirements are which seems to be consistent in his interaction with usI have written 30 emails with plenty of details on this issue.  All of which is well documented so here is my first initial email from 10/06/16 (exact email word for word of what I wrote)Last week I had a long discussion with Brenen in regards to my progress with your program and at the end we reached the following conclusions: 1. There was obviously a huge miscommunication between my expectations from the program to what the program delivers.  Before I signed up, I had spent a considerable amount of time with Brenen to explain to him what was it that I was looking for in this class.  I had said very specifically that I am not a beginner trader, that I was looking for a more advanced class and I had limited funds to invest in my trading ($2500 to be exact).  I also said very clearly that I was looking for a program that will have a blue print with specific rules or guidelines as to how to manage a trade form A-Z (WHICH INCLUDES HOW OR WHEN TO ENTER A POSITION, HOW TO ADJUST THE POSITION INCLUDING THE TIMING OF WHEN TO ADJUST AND WHEN TO EXIT THE TRADE) my model was a company by the name options animal.  They have a specific program with modules from beginners to advanced with the same cost as you have with a big difference is that they have specific rules and guidelines for each strategy not recommendations but guidelines.  At the end of our initial discussions Brenen assured me that the chuck hughes program can and will deliver to my expectations.  At the end of my discussion with Brenen last week he admitted that he is not knowledgeable about the content of the classes and his job is only to make sure that the right people are being admitted to the program (so why did you sign me up in the first place if you do not know if you can meet my expectations?) 2. I was told by Brenen that Kurt is the student adviser and all my student needs will be answered by Kurt.  So my first experience was that I was given the chuck hughes class which is a beginner class.  After discussing my needs again with Kurt it was clear to me that Kurt did not know either the structure or the content of the classes.  His response to me was go look at a bunch of classes and see what make sense to you, rather than try to help me find the class that really fits my needs.  so I had to spend a lot of time and sign up to a bunch of classes to find out a possible match.  well I am sorry to tell you that none of these classes meet my original expectations as was articulated in point 1 above.  The closest class was safe options strategies with Jeff D[redacted] but even his class and tutorials do not cover the timing of the adjustments which is the most important factor for my success.  I even tried to email jeff some specific questions last Sunday in regards to adjustments but never got a response (so much for your promises that instructors will be accessible via email or phone). 3. Make a long story short I am frustrated that I am not getting what I signed up for and would like to terminate my membership as soon as possible so I can move on and find the right program for my needs. I am looking forward to your response. [redacted] Here is word for word the response that I got from Kurt (student advisor) on 10/11/16 Hello [redacted], Looking over your email you are right, I only know some of the basic content of the classes, I am not an expert and I do not get a chance to attend the live classes. There is one thing that is for sure, the classes will change day to day because of the markets and how they are to be reacted to, so for me to know the exact structure from day to day would require me to be in classes 8 hours per day, impossible. All your concerns can absolutely be addressed by simply attending the live classes and asking questions This assertion by the business that I did not provide an explanation of what my requirements are is so ridiculous.  Not only did I provide details of what my requirements were, I also told them what my “gold standard” was which is the education provided by options animal.   In addition, I even told them that there was actually one class that was fitting my requirements but unfortunately, I was not allowed to fully participate in all aspects of that class so it did not meet my requirements.   My basic expectation was that a sales person and student advisor would have at least a “high level” knowledge of how the classes are structured.  I was asking a very simple and reasonable question and what I got was “ a switch and bait” deal instead of being honest and straight with me and telling me the truth.  Another point is that usually classes are coming with an outline, so this lame excuse from Kurt is not acceptable.  This is your job as a student advisor to have at least a high-level knowledge of how the classes are structured.  This notion that the classes change every day as the markets change is nonsense.  I attended many of their classes and the framework or structure of each class is the same. There is a consistent and deliberate pattern from the company to “sweep things under the rug” when it is not convenient for them.  They never responded to my original complaint and try to pin everything on the fact that I am “negative”.  Who are you to judge me and label me as such? Please stick to the facts and stay away from judgement because as I documented above there is plenty of blame to go around here. Here is another “beauty” from Kurt on Mar 23 his last communication to me: Hello, I believe we crossed that bridge with Brenen a long time ago and we had that rectified, but now we have not agreed to a refund and now you are circling back around to old mutually settled disputes. There may have been some miscommunication, but there is a side of what someone said and what someone hears and remembers. You seem to have a very good memory on the exact particulars of the conversation but cannot seem to remember if it was a 48 hour cancellation period or a 72 hour period. Not only is 48 hours too short in your opinion, so is the 120 hours you were actually afforded. During the compliance conversation you agreed that 72 hours or 3 days was enough to make that decision, but now that seems impossible. One thing I did notice within the actual 5 days you went through more than 15 modules, it would appear you had gone over plenty of information to determine you would continue with the program.  You mention your “requirements” which is very interesting because you are not as successful in trading as you want to be, but you have “requirements" on how the class should be taught and ran. Remember, these instructors are proven traders, but yet you resist because it does not match your requirements? Even after the program Options Monster in which you call the Gold Standard, you were still not trading at the level you desired, so you continued your journey on finding a course that could help you get results. If Options Monster was indeed the Gold Standard I’m not sure why you would continue looking for courses.  The last thing, I will revisit the miscommunication issue and after that all sales are final.  So finally after 30 emails Kurt responds to my initial complaint.  Even Kurt is admitting “ there may have been some miscommunication….” Really kurt??? And then last sentence “ The last thing, I will revisit the miscommunication issue and after that all sales are final. Never got any response from Kurt on his own promise to me, I wonder why……???? I did not make things up, for the last 6 months I documented consistently my issue with your program and you never ever responded to my issue, instead you labeled me “negative” and you thought that I would just go away, well I am sorry to tell you that you need to be accountable for your conduct and just blame me for it. The second big issue that I still have with the business is the issue of transparency.  They never responded to this issue either.  Do you see a pattern here.  It is amazing that all of a sudden they are documenting how many classes I attended and how many downloads but there was no progress report ever given to me or in a progress summary of my online account.  Isn’t it the job of the student advisor to follow up with the students and alert them to the fact that they are falling behind and are not meeting the contract requirements?? How do I know that this information is correct and credible? So far from my experience I was at best misled on what the classes are and why should I believe them that I am short by 3% on class attendance??  This a big contract issue, in my past experience wherever there is some attendance requirements there is always clear and concise progress report so there is no doubt or issues. To summarize all this, I think I clearly documented that there was a detailed communication about my requirements which were totally ignored by Mr. Brenan.  I was led to believe that the coaching program would meet all my requirements, this was clearly not the case.  In addition the company consistently refused to respond to my issue and even in the last communication on Mar 23 never got back to me on this issue. The second point on meeting the class attendance requirements,  the company lack of transparency and lack of progress reports and/or communication from student advisor (kurt) makes it very difficult to assess my status.  Kurt was stating that it is not his job to be knowledgeable on the classes and obviously he did not provide me with any guidance on my attendance progress, so what is it exactly his job as student advisor???
