Thank you for the opportunity to respond to the consumer’s concerns.Linear Title & Closing, Ltd does provide title and settlement services to alarge number of transactions that are facilitated through [redacted] In eachcase, prior to Linear's involvement with the consumer, the consumer will beprovided a disclosure of fees and a contract that outlines the manner in whichtitle and closing fees will be broken down In this case the consumer's contract provided for the buyer (consumer) to payfor both the seller’s side and buyer’s side of the title and closing feesA fee breakdown disclosure was also provided to the consumer prior toLinear's involvement which disclosed a range of possible settlement feesIn preparingfor the closing Linear must follow the contract and allocate the closing andtitle fees accordingly.While the payment of fees by the parties is something that is negotiated priorto Linear's involvement, Linear often works with consumers on our fees to tryto reduce what we can given facts specific to each transaction Providingconsumers with exceptional service and reasonable fees is Linear’s highestpriority.The consumer also made a comment about a loss of depositThe payment of anearnest money deposit is dictated by the terms and conditions of the contractbetween the seller and buyerAs with the title and closing fees Linear's roleas an escrow agent is to follow the terms of the contractIn the case of fees,we portion our fees between the buyer and seller as the contract indicatesInthe case of the deposit, Linear holds the deposit in escrow and if either partybecomes entitled to receive the deposit then we disburse the deposit accordingto the terms of the contractIf any money is considered disputed funds thenLinear will hold the funds until a court or the parties resolve the issuesLinear understands that the terms of eachcontract is unique for every transaction and the amount of fees each party(buyer/seller) is responsible for can vary greatly; therefore we strive toprovide the consumer with fee transparency and work with them to make sure theyare comfortable with the details of the closing transactionLinear encouragesconsumers to contact our team to discuss any questions and concerns they mayhave about our fees so they can be promptly resolved

Thank you for the opportunity to address the issues raised in this complaintThis sale concerned an REO property and experienced delays due to the foreclosure documents not being recorded in a timely mannerThe recording of the foreclosure documents is the responsibility for the foreclosure attorneyThe foreclosure deed on this file was recorded on 7-10-which unfortunately was after the estimated closing date 7-6-Linear acknowledges that delay in recording of the foreclosure deed and the subsequent delays in the closing process caused by the delayed recording were not properly communicated to the buyer Our process is to alert buyers of any closing delays once they are known to Linear, in this instance the buyer was not properly informed of the delays cause by other partiesDuring subsequent conversations with the Buyer on this file it was determine that the buyer was communicating with Linear's work share partner (Linear utilizes a work share partner in [redacted] to provide title and settlement services) regarding the closing of the fileLinear had not informed its partner of the closing which caused confusion on our partners end(Linear's process is not to inform its partners of a closing until the foreclosure work is confirmed to be completed.) We have addressed communication protocols with our partner and asked that communication on pre-closing items be direct to the appropriate Linear teamRegarding the timing payment issues in the closing, Linear notified the buyer on 8-10-of the need to wire funds into escrow however the email made reference to a hour time period and that reference should have been removedThis was an automated email that is typically sent out at least hours in advance of a closingTeam members have been altered to review timing provisions in emails to ensure buyers have adequate notice of the need to wire additional funds for closingRegarding the buyers fees, additional fees were paid by the buyer due to the need for Linear to use a work share partner in **Linear has reduced its fees to match the buyers expectationsLinear has worked with the buyer since receiving this complaint and he has been indicatedthat he is satisfied with the resolutions Linear has implementedWe hope to confirm that through this portal

Good afternoon,Thank you for bringing this concern to our attention The lender provided a payoff amount and a per diem schedule An amount is calculated based on this information to ensure that the payoff is not short and will cover any instances of delays in closing This is a standard practice Linear wired this amount to your private mortgage holder to payoff the prior loan The lender is then responsible for sending a check for any overages to the you, the borrower If you have not received a check for the overages from the lender, you will need to reach out to them to find out when this will be sent I will send you an email with the contact information for your private lender Thank you,

Linear Title & Closing has reached out to the borrowers to supply them with copies of the complete closing packageAt this time the borrowers have been supplied with the available scan copies which include a complete record of the closing packageWe have also offered to send the borrowers a complete hard copy as well which is more legible when printed out then when viewed electronicallyIn addition we have offered to supply copies of the electronically recorded documents which are clear when viewed electronicallyWe will continue to follow up with the borrowers to supply whatever information and documents that we canWe have supplied, at this point, all of the signed documents within ourescrow file

We disagree with your answer and feel it is exceptionally poor from a customer perspective. You have "emailed" us a stated business response. We have requested documentation that supports you have these systems and items in place. Also, there is no follow through or up with our persons that dealt with us. If this is your resolutions - we will disagree and follow next steps.

Thank you for bringing this issue to our attention. Linear Title & Closing, Ltdwas the title and settlement agent for this closing which occurred on 11/30/2015. Prior to the closing, we provided the attached tax certificate to the lender. This tax certificate shows the amount
of taxes paid the previous year. The previous owner received a homestead exemption on Parcel ***, and paid $for Parcel ***. As the title company, Linear uses these amounts to determine the tax credits for the buyer and the seller which appear on the settlement statement. However, the lender is responsible for determining the amount to be held in escrow for future taxes. If this property is your homestead, you may be eligible for a homestead exemption as well. You will need to contact the county and obtain their homestead exemption application in order to do this. It is the owner's responsibility to do so if claiming the exemption. Please also reach out to your lender for further clarification on how they determined the amount to be held in escrow, we unfortunately do not have information on their process. Good afternoon, Thank you for bringing this issue to our attention. Linear Settlement Services, LLC is the title company providing the title work and settlement services for this transaction. The property is currently vested in an individual who has signed a Deed in Lieu of
Foreclosure transferring the property to the Seller, *** *** *** *** as Trustee for Mortgage Equity Conversion Asset Trust 2011-1. Linear does not hold title to the property and is not the Seller in this transaction. Linear is not the listing agent and did not list the property for sale nor is Linear the owner of the property. To clarify, Linear’s role in this transaction is that of the title examiner and while examining the title we have discovered that there is a missing Assignment in the chain of title which has created a delay in the Seller and their Attorney’s ability to record the Deed in Lieu. We have notified the Seller of this issue and we are unable to proceed with insuring the transaction until this has been remedied. We have reached out to the Seller’s Attorney and have been advised that the Assignment has been made and that they will have this recorded with the land records along with the Deed in Lieu. We have also been advised by the Seller’s Attorney that this may take a few more weeks to complete. Unfortunately, Linear is not in a position to speak for the Seller or their attorney and we are only able to provide the information that they provide to us. We apologize for the misunderstanding and delay in the Sale of the property; however, we are unable to control this aspect of the transaction since we are not the Listing Agent, the Seller, nor the Seller’s Attorney.Thank you,

We tried to provide you with the comprehensive answer you were looking for regarding our process and procedures and also explain how our process was followed and that it meets all relevant laws. It was completely tailored to your question. We have followed all security protocols required by applicable law. The only follow up/follow through we can provide is with respect to the lack of communication you experienced, and as mentioned in our initial response, the relevant employees are facing the appropriate disciplinary action. It is also important to note that the refinance transaction was done in your husband's name, therefore we only had your husband's social security number. While you signed a few documents as part of the transaction, we did not and do not have you or your daughter's social security number, therefore any suspicious activity with that information could not have come from a breach on our side. title.  Unfortunately, this error occurred during the foreclosure process and needed to be addressed before we could move forward with insuring title.  Linear Settlement Services, LLC was not involved in the foreclosure, however, we did notify the seller and the foreclosure attorney of the issue and asked for an expedited response.  We did make several attempts to find an alternate route, however, the seller did not agree to the alternatives.  Therefore, we were not able to move forward until the issue was resolved by the seller and the foreclosure attorney, and the manufactured home was converted to real property and the new Affidavit of Affixture was recorded.Within a few days of escalation, the lien was released and a new Affidavit of Affixture was recorded allowing us to close.  Again, we apologize for the inconvenience that this may have caused you and your business in the meantime. Thank you,
