I am rejecting this response because: The loan I had with my credit union has now expiredWhen I tried to get lithia nissan to transfer my loan before I contacted the Revdex.com they said it was too late because the loan had already fundedThey can do it now, when they couldn't before? Now switching would require running mine and my wife's credit report again, which would negatively impact our credit scoresIt appears that we may be stuck with the finance option that they chose for us

No one falsified anything Customer took delivery of the vehicle with spare tire However we will provide customer one just out of providing customer service Please have customer contact [redacted] at # [redacted] Thank you

Initial Business Response / [redacted] (1000, 5, 2016/02/08) */ Contact Name and Title: [redacted] GSM Contact Phone: XXXXXXXXXX Contact Email: [redacted] @lithia.com Please notify customer to come and see me to see if we can come to a amicable solution to her concerns Initial Consumer Rebuttal (The consumer indicated he/she ACCEPTED the response from the business.) I just want to thank [redacted] and the staff at the dealership [redacted] did listen to what was going on in my situation and got right on the ballHe told me that if he knew about this sooner instead of almost two months later it would have been fixedHe had my car tow in that same day and was ready the next dayThe Service department also let me know that my car battery died so I had to replace thatThe dealership took care of the cost for the replacement including the towing and I just paid for my own battery which was $(from another store)I'm thankful for his serviceI know he told me that he was looking into my tampered extended documents and would try to fix that issue

I am rejecting this response because: I do not accept this response because I think that the vendor or them knew because I did not inspect the truckThen I realized that the spare tire was not thereI called to speak to the vendor “ [redacted] ***” and he never answered my calls or messages that I would leave with the secretaryI also think that they knew because they falsified my signature in a document “delivery confirmation”The vendor [redacted] ***, offered to give me a used tireHe was going to take a truck out and take out that spare tire but I told him that I wanted a new oneAlso, the day I went for the tire [redacted] told me to not ever show up again at the dealer

I am rejecting this response because:
I only had the vehichle for no longer then days and should have last longer for the amount of mileage on the vehiclewhen I called for information under what cause the problem I was first told it was a small problem not that the engine had given out and they had no idea of the cause and was told they had no maintenance records of the vehicle's past, before they had gotten it to the dealershipIf the vehicle was in good condition it would still be running and they would have the vehicle's maintenance reports and records saying it was good showing the compression of the engineThey took longer then the 2weeks they had promised and came out to a bigger problem then first toldThe vehichle was under the manufactures warrenty that is the reason it was covered and payed for yet it doesn't make up the fact I was sold a vehichle that last only two days and the engine gives outIt may not be a old vehichle but it was a defective one making it fall into the lemon law criteria how it only last a couple miles and less then daysIn other words I was sold a lemon for they had no past maintenance records not knowing how constantly they changed the oil or the services that have been done to itAlong with it lasting me less then a month and driven less then 200milesI've gone the whole first month with out the vehichle and been riding around in a curtisy car that isn't of the same value as the vehichle I'm purchasing, so in my point of view its like I'm paying for a car to be in a garage Through out the time of trying to handle this alone I've gotten sent around to workers who can't get anything done for there position or I just get the run around and sent to people who can't help me or have no access for they can get rid of me, there service is absolutely horrible and disrespectful for I am seen as a child of my age too them. This is my resin for not accepting the business response

The first concern customer had regarding the brakes was on X-XX-XXXX with XXXXX miles on vehicle customer stated at times the brake light comes on, the technician inspected the vehicle found the brake fluid to be full and brake pads were above
the measurement for replacement could not verify concernOn X-X-XXXX with XXXXX miles on vehicle customer brought vehicle in for an oil change and inspection with no concerns regarding the brakesOn July X XXXX the customer stopped in to have her brakes checked technician took vehicle for a test drive no noises coming from vehicle when braking and did a quick visual inspection on brakes and the measurements were over minimum specificationsIf the customer needed brakes at that time we would have gladly performed a brake service for her and charged her for the repair

Sorry I accidentally reuploaded their file by mistakeHere is the one I meant to submit
This business is being shady! They ran my credit unauthorized on 2/4/2016; the credit form they have on file was authorized on 2/6/when I actually came inI think the date would have been important enough not to blank outThankfully, they gave me a copyIf the business wants to try to cover up their lie then I will take legal action

I would still like to know how my credit was ran two days prior to signing an applicationWhere was the information needed obtained from? The text message between the employee and I says it was pulled from another Lithia dealer but I am confused as I was told that was not possibleThis is an extreme privacy concern for me

As explained in my previous response, There was no switch and bait, Unfortunately computer was not updating sold units quick enoughWe have sales documents with customers signature with date and time stamp showing when the car was soldIf you wish, I can show you those docs, unless as a car dealer you think they are wrong tooAs far as the credit pull, As I mentioned that clearly my sales person jumped the gun and assumed the when he said we are going to check everything meant credit to and that was wrong and we have corrected that situation, it does not happen againPulling credit does not help us in any other way than to sell a car, so this was not done for any other reasonAs you stated your concern, We have taken steps so that we do not make any more assumption and have clear understanding with our customersWe take pride in keeping our customers privacyAs far as your records, we have shredded all documents

The vehicle was delivered with the spare tire Customer came back weeks later after he discovered it missing As far as the airbag light customer was explained that all he had to do was take the vehicle to service as it is under warranty Stolen spare tire is an insurance issue

Customer is coming in to resign so this can be corrected Sorry for any inconvenience

We are closing this on our end. We have tried to reach out to the customer and he asked us not to talk to him and contact his son. Since son is not on the contract we can not discuss any details. If they need any more details they can come to the...

store and meet with me. I am closing this case and will not be responding anymore on this matter.

according to the bank. Down payment was refunded and charges for use of vehicle should have been charged. Customer is responsible for payments and made no payments on either vehicle loan during this time .

(The consumer indicated he/she DID NOT accept the response from the business.)
From the date on the last contract signed I have called to find out where to make my payment and I called to ask if the altima was taken care of because of the calls I was getting from the altima finance company. On October 26,2015 I went in to have service done on the 2016 maxima for a part that flew off the 3rd of October. My husband and I went in concerned that we would continue to have problems with the brand new vehicle. My husband spoke with [redacted] on that day and he never said anything about the finance not going through. On the 26 of October I took the car to get fixed and I was never told of anything. The calls that I made to him to make a payment was his responsibility to return my call. I can't send my payment to just any company. I called to find out what company financed me. If it is not his responsibility then [redacted] should've told me that from day one. When I took the car back after I receive the certified letter that they were having so much problems they should've kept the car. When the finance company called to ask for a payment I told them exactly what [redacted] told me. Had I been told that I needed to make payments until [redacted] decided to get me financed I would have. I had the money to make the payment to the maxima but with no information on where to mail it I couldn't do anything. I never took advantage of any deal. I did what I could to try to make a payment. I want my credit fixed because I was not late on my altima until now. They are a big company and I don't really think they let anyone take a car just like that without really getting financed. I don't think it's my responsibility to keep checking if I was financed after I signed the last contract. They should have sent me another letter to return the car a.s.a.p
Final Business Response /* (4000, 9, 2016/01/06) */
Again, Customer failed to meet the requirements. Income that was stated on the credit application could not be verified. It is customer's responsibility to provide the verification required by the lender. As far as the money, as we did not charge the customer for using our car, they should pay for their car. YOU ARE NOT EXPECTING TO GET EVERYTHING FREE IN LIFE RIGHT ? IF YOU MAKE PAYMENTS ON OUR CAR, WE WILL PAY FOR YOUR CAR. At this point we are closing this case from our side as there is nothing else we can provide.
Final Consumer Response /* (4200, 11, 2016/01/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
It is my responsibility to make payments but if you have an irresponsible person like [redacted] who doesn't return phone calls what is one to do. I never asked for anything got free nor did I fail to give you my income information. I gave all the dates I tried to find out information. This business failed to contact me if I was not qualified for the car just like they did the first time they sent me a letter. I want my credit cleared because this is not my fault. I never knew that a business like this can do that to a pwrson. I don't know what else to do nor say

(The consumer indicated he/she DID NOT accept the response from the business.)
I got a key that is generic and doesn't turn the alarm on and doesn't lock the doors automatically. You should have given me the real keys that unlock all the doors and turn the alarm on. You shouldn't sale a car without the keys that is bad customer service anyone will tell you that. I cant drive to Fresno I am legally disabled and you at the dealership know that I cant drive there. You came and got me in Lathrop to buy the car 2 hours away. My disability wont allow it. Capitol one doesn't know I don't have keys and that a generic key that wont unlock all doors was given to me not the automatic keys. I have to go the the front drivers lock to unlock the car only that s wrong.
If you mail the keys to a close to me Lithia store I would be happy. Thank you

Customer has been provided a copy of his contract

This was your fault that you redlined the engine.
This your mistake, not ours, Subaru tech has proof the you redlined the engine. We as a customer service fixed the car under warranty. You had to pay nothing to get a new engine. Be thankful and move on. Take responsibility of your mistake. There is nothing we are willing to do at this point. We consider this case closed.

Vehicle was put in service after customer complained. Vehicle was found by Technician to have been red lined. Luckily we were able to get the manufacture to replace motor under warranty even thought the damage was caused by operator error. Please be aware that high performance vehicles require care...

and need to be operated according to manufacture guidelines. Dealer is not liable for consumers driving habits but was happy to assist in help getting vehicle repaired but has no liability or burden to reimburse for misuse .
