On March 12, 2018, loanDepot reached out to Mr [redacted] based off an online inquiry from Bills.comMr [redacted] spoke briefly with a Licensed Lending Officer about mortgage optionsMr [redacted] received the TILA-RESPA Integrated Disclosures (TRID) dated March 14, It is mandated by the Consumer Financial Protection Bureau as part of the Dodd- Frank Act that these disclosures are sent out to consumers when information, such as property address, estimated value, customer name, social security number, and income is given to the lenderThe TRID Package is required to be sent to the consumer days after the initial phone application takes placeIf it is determined at the end of the phone application that there is no benefit to the consumer, the TRID Package will still generate as an application was takenThe TRID Package contains information such as interest rates, monthly payments and the cost to do the loan if the consumer chooses to proceedMr [redacted] requested that we remove all information he provided to our Licensed Lending Officer from our database, however loanDepot holds all consumer information for up to seven (7) years for audit purposesMr***’s information will not be released from loanDepot, with only certain employees able to gain access into the loan file for legal and compliance purposesThe file will remain inactive, and the loan team originally assigned to the file no longer has accessIf Mr [redacted] has any additional comments, questions, or concerns, he is welcome to reach out to loanDepot’s Customer Care Team at 888-337-extCustomer Care is available Monday – Friday from 7AM-7PM PST

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below RE: OMB # [redacted] I would like to point out to Mr [redacted] the attorney representing Loan Depot that his generic answer to my complaint covers a scenario where a property is refused a loan on the basis the real property did not appraise which is not the case in my complaintMy complaint is different because of the fact that after Loan Depot approved my loan they demanded I cancel four of my five credit cards and that I increase my hazard insurance policy coverage as the only conditions for them to draw up loan closing documentsAfter demanding these credit card cancellations that negatively affected my FICO credit score as well as costing me additional money Loan Depot actively followed up demanding written proof from the credit card companies that I had cancelled these credit cardsThis was all done after my loan was approved by Loan Depot's real estate broker/mortgage loan underwriterAfter completion of all that was asked of me and with assurances I had a loan that would be funded within a short time I proceeded with improvement plans including ordering kitchen appliances and scheduling carpet and vinyl flooring installation datesI wish to express that shortly after these demands which included cancelling credit cards that could not be reopened were met Loan Depot began a protracted five weeks plus stone walling of my repeated requests for information on a closing date all the while not giving me any reason for their delayAfter this unexplained holdup their loan processor told me they were not going to make the loan that had been previously approvedThe loan processor in fact stated she was amazed because all she was waiting for were the loan documents package so that we could closeThis is why I am making a complaint, the loan was approved by Loan Depot's licensed real estate broker/underwriter then after I cancelled the four credit cards the underwriter demanded I cancel in order to fund my then approved loan Loan Depot damaged me by canceling my real estate loan approvalThis cancellation caused me to be damaged on several levels including my FICO score being negatively affected because the lender required me to cancel credit cards as the only condition of final loan approvalIn addition Loan Depot required me to rewrite at additional cost my hazard insurance policy with additional conditions and coverage.The resolution to my complaint is simple, I am requesting Loan Depot fund the approved loan which they have a fiduciary obligation to close after their real estate broker/ loan underwriter approved it.Sincerely, [redacted] Regards, [redacted]

When I asked about a no cost loan, the interest rate went from 2.75% to 3.3%My suggestion to anyone dealing with this company is "read the fine print" and ask questions Borrower’s Desired Resolution: The borrower’s only resolution is to warn other borrowers to be sure they are getting the correct loan for their needs loanDepot’s Borrower Complaint Summary: The borrower feels he explained his desire for a “no closing cost” loan on the first call to loanDepot.The borrower feels we were fraudulent in providing a “no out of pocket cost” loan to the borrowerWhen the borrower received the “no closing cost” loan he was requesting, the rate was adjusted upwards and made the borrower feel loanDepot was behaving in a fraudulent manner loanDepot Findings and Response loanDepot apologizes that the borrower felt we did not offer the correct refinancing information on the initial call loanDepot provides the borrower the best offer to meet our borrower’s needs, while at the same time making sure there is a net benefit to the customer The information provided on the initial call between loanDepot and the borrower was saving the borrower $a month.loanDepot apologizes that the borrower did not understand the loan would have cost associated, but would be absorbed by increasing the loan amount and avoiding the need for the borrower to bring funds to close.Once loanDepot learned the desire of a “no closing cost” loan from the borrower, we were able to quote a rate higher than the “no out of pocket loan” This loan did not have a cost benefit for the borrower, and it was quickly determined to not to be of value for the borrower to refinance at this timeIn summary, loanDepot sincerely regrets that Mr [redacted] feels he was not given, the correct loan at the start of the loan process loanDepot tries to accommodate the borrower’s desires while at the same time making sure there is a benefit for the customer loanDepot offered the borrower a “no out of pocket” loan to benefit the borrower with a lower monthly mortgage payment loanDepot apologizes the “no closing cost” loan did not give the borrower any monthly savings and was of no benefit to the borrowerAgain, loanDepot strives to make sure there is a tangible benefit for the refinance of a borrower’s mortgage with best loan program at the time of applicationTell us why here

Well, just as I stated earlier, escrow and how that would play into the "bottom line" was never discussed over the phone with me All I can tell you is that once the loan papers were received by me I went directly to the page with all the figures Absolutely nothing was as I was told on the phone And most definitely was there ANY out of pocket expenses mentioned other than the apprasial fee, which was to be $ Actually, that is the only fee that matched what I was told on the phone As I mentioned earlier I just received a new packet from loan depot saying the loan was denied because they had insufficient credit info That is simply not true and the first packet with all the loan paperwork included the credit info I had provided The loan was stopped because I STOPPED IT This company has numerous complaints and it is easy to see why I will be satisfied when I receive a written formal apology and a guarantee that I will never be contacted by them again

loanDepot Initial Response:We are thankful for the opportunity to address the concerns noted in the complaint from our customer We have performed a review of the loan process for this customerOn 12/12/16, an email was sent to the customer to inform her that we received final approval from the UnderwriterThe mobile notary was scheduled for 12/15/This signing was to occur during the hours of 8am-8pmOn 12/13/16, we informed the customer that the Notary signing was rescheduled for 12/16/17.On the prior day, an email communication was sent to the customerThe email was to notify the customer that the notary would arrive at her home to complete the closingThe notary’s contact information was providedThe customer concerns have been escalated to our Vendor Management TeamAny notary scheduling conflict will be addressed internally with the Notary Service Company We understand that the borrower had reservations about the new loan program offeredThe loan program initially offered was based on information received verballyDocumentation must be sent to validate the stated informationAfter receiving the documentation and appraisal report, we were required to make necessary changes in the loan program to satisfy investor guidelinesMany factors contribute to determine loan programsCredit worthiness is one of the main factors Additional qualifiers include property type, and how the home was builtThe property type that secured this loan was an investment propertyThe appraised value of the home came in lower than originally estimatedFor these reasons, the loan program terms changedThe LTV was changed to 80%, and PMI was a requirementThis outcome made it necessary to impound for escrowsAccording to the call recording on 12/15/16, the Sales Manager explained the reasons for the changes, and wanted to ensure that the customer was on board, and did not feel misledThe borrower said she would go forward with the new loan program offered, and stated that she can write-off PMI as a business expense.On 12/19/16, the processing manager communicated to the customer the options to remove PMIThe borrower was informed that the LTV needed to be 80% or less to have PMI removedThis could be done as a principal reduction, with the loan servicing payment department, after the loan fundedThe borrower inquired about paying down the LTV at closing, and it was advised that the loan documents would need to be redoneIn addition, the file would have to go through the Underwriting review process againloanDepot must adhere to all guidelines set forth by the government and investors of the loanIt is industry standard that a file must go through the audit process when a customer requests to make changes to the loanAll feedback that we receive from our customers is used as a training opportunity to enhance our customer’s experienceIn regards to the breakdown in communication by the management team, this matter is taken very seriously, we have taken the necessary steps to further our investigation and will address internally.If additional information is needed, contact our CEO Customer Care Team at (888) 337-6888, Ext***, Monday to Friday, 8:00AM to 5:00PM Pacific Time

We are appreciative of the opportunity to address our customer’s concerns When a check by phone payment is processed, there is a computer-generated letter that goes out advising the customer about a $feeThis letter is generated regardless if the fee has been waived We have verified that the $check by phone fee, was never accessed to the customer’s account The Servicing department called the customer, and advised them that due to their forbearance plan, the fees was waivedWe also reiterated to the customer, that the letter sent is a form letter sent to all customers, when a check by phone is completedWe have no record of the multiple calls, and emails the customer said they sent The customer was advised about the fee waiver on 12/12/2017, and 1/10/2018, when he was told again the fee was waived

appraiser to do an appraisal of property which at that time I was lead to believe the loan was approvedAlsofrompast experiences with mortgage company an appraisal is not done until the loan is approvedLoan Depotcharged my bank a count $for an appraisal which was done on 9/2/On 9/09/I received a letter frontLoan Depot along with a copy of appraisal stating the loan was declined on 9/4/due to servicesrendered on your property by an unaffiliated third party appraisal management company OnAugust 18, 2015, Ms [redacted] executed the Appraisal Deposit Agreement that states the following:“The Appraisal Deposit of $is non-refundable if an appraisal has been completed on thesubject property.”Because the appraisal was completed and Ms [redacted] executed the Appraisal Deposit Agreement, arefund of that $is not warrantedBy signing and returning said agreement Ms***acknowledged that she read, fully understood and agreed to the terms and conditions set thereof loanDepot has no control over the appraisal process and cannot choose which appraiser to conductthe inspectionThe appraisal process and inspection must be done independently to ensure there isno bias or predetermined value or Borrower’s Complaint Filed with the Revdex.com:I recently started a refinance with loan depot and they promised me the best deal there was at the time but they were lying as I come to find out from my current lender that they can beat their deal with a lower rate, No points no closing costs and they even pay for the appraisalSo I called Loan depot and told them to cancel my refinance and to reimburse me for the amount I paid for the appraisal which was $and some changeThey agreed to cancel it and they emailed back the cancellationIn the meantime I was in the process of refinancing with my current lender as they wanted to keep me as a customer and they ordered an appraisalI received a call from the appraisal and they came over and did what they needed to doDays later it turned out that the appraisal that was done was for loan depot even though the refinance was canceled but they didn't cancel everything and went ahead sending the appraisal which I was thinking it was for my current lenderI called the agent and complained and he basically told that I shouldn't have let anybody into my home and declined to refund my moneyI would like that I get my money reimbursed and to PLEASE give consumers a good deal from the get go and don't try to beat others once they get a better deal somewhere elseThanks for your timeBorrower’s Desired Resolution:Please refund my appraisal fees loanDepot Findings and Response The customer requested to cancel their application on September 20, Unfortunately, there was a technical oversight in which the appraisal order, with the Appraisal Management Company, was not canceled in time to notify the appraiserAs the customer stated in their complaint, they were under the assumption that the appraiser was from the current lender and scheduled the appointment loanDepot sincerely apologizes that Mr [redacted] ‘s experience with loanDepot has been anything less than satisfactoryAs such, the appraisal fee collected at the time of origination, in the amount of $was fully refunded on October 10, to the credit card on file
