From the start of construction, as an inducment, to allow Holiday Homes exclusvie right to be the only builder in [redacted] we agreed to put the bond in place as [redacted] did not have the ability to obtain a bond at  time of construction.

The [redacted] subdivision was developed by [redacted]. Randy  applied for and received approval to build the sub division from the villiage. At no time did Holiday Homes or Freedom Homes become the developer of the sub division.
Holiday Homes and Freedom Homes did purchase lots from...

[redacted] to build houses but took zero responsibilty for the sub division requirements such as roads or a punch list. In addition to buying lots and building houses Holiday and Freedom Homes did sell several lots to differnt builders who also built houes in the sub division such as Ryan Homes, HB builders and Potterhill Homes.
The village has contacted us about road and punch list concerns and I have explained the same senero.
We have built and sold houses along with lots in the sub divison over the years. We have also placed signs  for marketing purposes giving the illiusion we owned the sub divison and develpted it. I don't know what to say but [redacted] is the individual who has the responsibilty to address the homeowners needs.

It is my understanding the Village has agreed to complete the roads.

[redacted] is the developer of record. Holiday Homes/ Freedom Homes, [redacted] and Potterhill Homes purchased lots to build houses. None of the builders listed above have any responsibility for the develpoment or the street repair. Any builder can purchase a lot in a sub division and build a home or re sell the lot without having development responsibilty.
When lots were purchased from [redacted] we were also told the final lift on the streets would be done by him. As a result, we passed along the information we obtained from the developer.
I can't speak for [redacted] who was a Potterhill Homes employee not a Holiday Homes/Freedom employee.
I do agree with [redacted] when he said that the street repair was not in the budget because no budget should have been established to perform work on a development that [redacted] has the responsibility. 
Freedom signs are placed in many sub divisions we don't own for marketing purposes. A sign in a sub division does not denote ownership and none of our signs said we own or developed the property.

When we take a deposit on a home that means that customer has first right of refusal to purchase that lot model. Nothing more!The sale is final and the home is locked when the customer has given us all the down payment, finance approval including a good appraisal for the project. We always continue to display inventory until we know the sale is  100% solid and will go through. In this case a small deposit was given in December 2016. A final contract was not written until March 25,2017. Then we did not construction close on the loan giving us the ability to break ground until July 31, 2017. Again if a customer can move financing fast and wants the home locked, we lock the home. If the transaction is working toward final approval for any reason we keep the home open and continue to use the inventory as normal until we have a solid deal. In addition, the carpet was was professionally cleaned and signed off by the customerWe have evidence that a mouse or other type pet chewed through the water lines under the sink twice. When we completed the house we check all water lines and run the dishwasher for proper functions. After the customer moved in they had a water leak.After we looked into the situation it looked as if a small animal had chewed through the line. We do have the water lines that had been damaged for review.Doors had damage front and back. Again the house was purchased as is but we replaced both doors at no expense to the customer because it was hard to determine if the doors had been damaged at set-up of after the customer moved in.Any cosmetic issues with the tub is the tub manufacturers call on how to make  repairs. We turned over the tub issue to the manufacturer for a determination how to correct the problem. The said the repair is done on site. In addition, it has been explained to the customer and us that the tub is set in the house and the house is built around the tub. The house manufacturer explained tub repairs are done on site and the tub unit can't be removed and replaced. A finish grade seed and straw was completed before closing as it was a lender requirement. The lender does a final inspection to verify these items have been done. Grass is not present do to the time of year. I'm sure the yard is a muddy mess due to winter and all the rain we have received over the winter. ThanksPaul

I would like some type of action done with them, with all the people involved. They do not want to give us our deposit back and they want us to give them money. . I don't think so, they wasted our time and other money we put out for this,  we put out of pocket for septic evaluation and for perk test and for the contractor to come dig up wholes for the test. Also for the evaluation of the land, the appraisal,  and site inspection. . We paid for these things, and now they trying to get money from us. . In the contengenties, it stated we would get our money back if anything didn't pass. . Well they said that the land didn't appaise very well, but what it was they knew my husband was approved for a loan up to  $400,000 ,and was trying to make us spend more money. . They said they wouldn't put double wide on the property, it's 20 acres and has a house on it, the appraiser didn't even come out to check out the property or the house that was on it. .they wanted us to purchase a stick built home, or a modeler,  they were trying to get more out of us. .they wanted our payments to be to high so they they could repo the place and turn around and make a profit. We found out that they have been doing this to people. . The girl that we were dealing with since April, didn't turn anything in til last min and she knew it was important for us to get this property and get it ready for winter,  the things they kept doing was horrible, even our realtor said what they was doing was wrong. . I even talked to their competition down the street to see how they do things. . The gentleman there said since we have found the land we wanted he said he would have us do a contract on it then he would have us close on it that they would put a lein on it and we would pick out the home we wanted and they would order it and set it up and it would take 45 days or little longer. . Not this whole mess holiday homes was doing. .they kept lolligaging around, and beating around the bush and in the end trying to push a different home on us with a bigger payment. . We want our money back on everything, plus time and aggravation. .. something needs to be done here before they hurt more people

There agreement with the contractor is between them. It is no different if you sign your name for buying a car its your responsibility to then pay the payment. Further more it was there responsibility to disclose this information to the buyers at the time of sale. But instead we was lied to and told it was going to be finished when 80% of the lots where built on. The legal documents you sign your name to make you liable. I also own and operate a company that is in the same line of work so I to know all about bonds and how they are legally wrote. The bond holder is responsible in till the work is complete. We just want the roads finished paved for that is what we was promised.

I have taken pictures of the job that was done with the straw around the house. It is not done properly. My yard has been left a swampy mess. It literally has a moat around it. Our weather has been in the 50’s for several days and have heard nothing from them making arrangements to fix the standing water issue under the home. I would like to see the paperwork on the straw and grass seed, since not even 25% of the dirt is covered I would love to see what we were charged for it. I can provide the pictures of the attempt of a “complete” job. My lawyer was not impressed by the pictures I showed him. I need a date for the water under the house to be completed, as well as the yard. This has been drug out for months, always being met with excuses instead of fixing the real issue.

When  we completed...

a house a walk through with the customer was done and  all items that require attention are discussed, documented and addressed at that time.
Grass growing and yard maintence is the homeowners responsibility.

Holiday Homes, Inc. dba Freedom Homes is a registered company with the state of Kentucky. We sell both manufactured and site built homes in the tri state area. We are not a broker marking up extras but we are a retailer of manufactured homes and a  builder. Customer hired an outside third...

party to clear the property on their own without our  involvement to ensure the excavation would work for a slab foundation.  When the excavation was completed by the third party  we visited the site to make sure the work was done properly for a slab foundation. At that time we expressed our concerns that a slab would not work due to the change in elevation and the only foundation that would work was a basement.We have reached out several times  over the past month to discuss next steps with no response from the customer.We have an deposit agreement signed by the customer listing potential expenses incurred through the inspection and building process. To date we have incurred expenses in excess of the customer deposit.In good faith I will process a full deposit refund of 500.00.

We have asked several times if the sump pump is plugged in with no response. We visited your house last week to investigate the water but no one would answer the door.Please give us a time to visit your home to investigate. Also please make sure the sump pump is plugged in.

If this is true why did I purchase the land from potter hill homes and why did john firth tell me last year it was not in the budget?  Why was everyone else in the neighborhood and myself told when we purchased our homes from holiday homes that the roads would be paved and turned over to the village when the last house was built in our area?  Are you saying that you and all of the sales people and misled everyone in our neighborhood?  Why would you mislead us by putting up signs and saying it was your subdivision?

In all due respect seed and straw was put down prior to closing. I have the receipts to show the purchase of these items and I personally help spread the seed and straw before the loan closed and the customer moved in. The door being written up before the customer moved in is not correct. The damage ocured while the house was on the customer property.The dishwasher lines were not dry rotted as the dishwasher and home are new and had never been used. I have the lines with teeth makes in them. regarding the water under the home  we have communicated that a contractor will be going to the home to dig up the drain tile to insect for damage and fix the issue. We need the weather to cooperate before this work can be done.

Not left open for 8 months letting there be further damage to the home. The carpet was not in the worn down condition as it is now when we bought the home. Can the business explain why the home was left open after there was a sold sign placed in the window on dec 17th 2016? Why should I have to be responsible for further damage done by you guys thinking it is ok to leave a sold home still open for viewing? As for  the mouse there is no evidence of a mouse in our home. I asked to see the piece that was supposedly chewed but it looked dry rotted and cracked to me. They make it seem like they are doing us a favor by replacing the door they broke, and a door that is not square at all. The refusal for the tub to be fixed is not true at all. Do I think it is right to patch a new tub that should be in brand new condition? No. The tub should be replaced!Our yard has a complete swamp around it, with no grass seed planted. It is a muddy mess. They left a pile of roots in the front yard from the fill dirt.

[redacted] They have made no attempts to contact me, left no messages, no notes on any doors or anything like that. I have phone records to prove this. The sump pump is plugged in properly, verified by electrician, the pump is burning out due to the amount of water its having to move. This doesnt even address the issue with the 220 being improperly installed. Ive decided to move forward with litigation. The attached pictures are the standing water under my home. I have started having trouble breathing. I believe this is due to mold buildup under the home due to the standing water.
