We have only worked on this car on separate occasions and show invoices totaling $I can not find record of the additional $in repairs and that may shed light on this situation if the customer can provide the additional documentation pleaseI do not have any record of doing any work
that may cause the engine to failThe bulk of the services that we have performed has been tires, brakes, steering, oil change, spark plugs, and a valve cover gasketI did see that the car is years old with 187,miles on it and we had noted that there was excessive sludge build up in the engine and oil leaksIt would not be unreasonable for this engine to fail given these circumstances but I do not know how it could be our fault

This vehicle was towed in on July 18, 2017 with NO BRAKES at around 4 pm without a prior appointment. We got the car in the shop and checked it out and agreed on the needed repairs. We explained that it would be the next day until the extensive repairs could be completed and that was not acceptable...

to the customer. Therefore we stayed after hours to finish up the car to get her on the road. WE DID NOT PERFORM ANY OIL RELATED SERVICES ON THE CAR NOR DID WE CHARGE FOR ANY. During one of the phone conversations with the customer’s mother from [redacted], she asked if we could check the fluids. In an effort to get the car out that night, we were able to complete the agreed upon repairs but did not check the fluids. We received a call a couple of days later that the car was stranded in Arkansas and it was low on oil and the engine failed. The customer said we should be responsible since they ask us to check the fluids and we didn’t. This is a 2005 Subaru with 176,855 hard miles on it and has not been maintained. The customer admits to having to carry a gallon of oil in the car with her so she is obviously used to checking and adding oil to the car. She said that her daughter checked the oil in Detroit a few days prior and it was ok and by the time she drove to Arkansas it was multiple quarts low on oil. I ask her if it either uses oil or leaks oil and she said neither. I then asked “where did the oil go then?” She had no answer. In summary it is a fact that the Manufacturer puts safeguards in place, i.e. low oil indicator light, so that this does not happen. The driver must have ignored the warning light and continued to drive the car anyway and damaged the engine. Regardless it does not make it our fault. Just because they can’t afford to have the car repaired does not make it our responsibility. If we were contracted to do an oil change on the car and messed something up it would be a different story, but we did not. We decline to be responsible for her engine when all we worked on the brakes and tires!
