Merchants Acceptance Corp(MAC) has completed an investigation into this complaint and determined that the negative marks incurred on this account are reporting correctly and exactly as the customer has paid the account Mrs [redacted] provided a credit card at loan setup to automatically make the payments on the loan each month The card information provided by Mrs [redacted] was entered correctly into our system The first payment on 6/24/declined On 7/5/a late notice was sent to the customer At this point we attempted repeated phone contacts with no success Mrs [redacted] finally contacted our offices on 8/13/to provide new card information for her automatic payments, Mrs [redacted] explained the previous card information provided was compromised due to fraud On 8/24/the new card information provided declined On 10/27/we contacted Mrs [redacted] and she informed us that she was unemployed and could not make a payment On 11/3/Mrs [redacted] contacted our office with new card information for automatic payments She made increased payments in November 2015, December 2015, January and February and finally on 2/29/Mrs [redacted] made a large payment of $to get the account current Mrs [redacted] ’s statements in her complaint are not consistent with the facts of how this account was paid There was not a data entry mistake on behalf of MAC as suggested by Mrs [redacted] The account is reporting to the credit bureaus exactly as it has been paid, therefore no adjustment to the reporting is warranted

All call recordings with the customer have been reviewed, including the initial verification of the loan terms on 2/8/as well as a courtesy call placed to the customer on 2/10/to make sure that the customer was satisfied with the purchase At no point was it ever discussed with the customer that the payoff date on the new loan would be the same as the already existing loan The customer has never indicated that she has not received a DVD that was promised by the seller, we will contact the seller and make sure that the DVD is delivered to the customer The customer did communicate that a part for storing the cord was not working properly, a new part was sent to her and was fixed to the satisfaction of the customer We do apologize that Mrs [redacted] feels like the terms of the contract were misrepresented, however they are very clearly indicated on the contract that she signed and also very clearly disclosed upon verification of these terms with the customer In my many years of doing this business I have never encountered a situation where the customer would get a brand new product and only pay what was owed on the initial product that was purchased, in essence getting a brand new product for free

Default Judgment was filed against [redacted] on 3/10/2010, earning interest at 22.87% The Writ of Garnishment was filed at $1,on 5/27/also earning interest at 22.87% We received garnishment payments totaling $1, We were later informed that [redacted] was no longer employed at the employer that was served the Writ of garnishment We also received $from the trustee pertaining to [redacted] ***’s bankruptcy on 4/4/ The unpaid balance has been accruing daily interest at the rate of 22.87% resulting in a current payoff of $1,that is good through 5/30/ A detailed statement of account and transaction history has been emailed to the customer along with a thorough explanation of the history on the account Our accounting department has also audited this account and the balance reporting is true, accurate and owing

We have investigated this complaint and determined that all balance and fees on the account were correct and there was no error on behalf of Merchants Acceptance Corp To appease the customer we have decided to close this account as PIF with the last payment made of $on 7/21/ The payoff that was agreed to by the customer on 7/11/was setup for $120.68, however the card provided for this payment was invalid

We have reviewed the account for [redacted] After reviewing the file it was determined that the autopay schedule that was setup on this account was setup outside of the customers day grace period causing the late fees We have waived $in late fees on this account We hope this resolves this complaint to the customers satisfaction

Merchants Acceptance Corp.(MAC) apologizes to Mr [redacted] for causing any frustration or confusion and has completed an investigation into this matter MAC assumes that Mr [redacted] is referring to the recent payment he authorized on the account in the amount of $to be processed on 2/21/ MAC setup and processed the payment for the amount and date authorized by the customer The payment was made with a debit card and when MAC processed the transaction, was declined This transaction would not appear in pending or approved transactions on the customers bank statements as it did decline and did not process It is standard procedure in these cases for MAC to request documentation that funds were available to process the transaction in order to waive any fee’s created by the declined transaction It is not MAC’s intention to have this implied that we think the customer is lying and we are simply following good business practice and procedure in requesting validation to support the claims as the initial investigation determined that the payment was setup as agreed upon and authorized by the customer Unfortunately we are unable to agree upon Mr [redacted] desired settlement of returning the Kirby and getting his old one back as the cancellation of the purchase is well passed and the current contract will need to be honored As resolution, MAC is willing to waive the recent return payment fee charged to the customers account associated with the 2/21/transaction We recommend that MrGate make his future payments on our website and receive immediate notification that the transaction is approved or declined, he is also welcome to mail in future payments If Mr [redacted] should need any further assistance in this matter or at any time in the future please contact me directly at 425-974-(Jarod Y [redacted] – VP of Business Operations)

We are sorry to here that this customer is rejecting our response We feel that we have taken steps above and beyond to rectify this customers dissatisfaction All fee's have been waived on this account totalling $ A statement of account and billing history will be sent to the customer to document this Yes the account did accrue these fee's and letters were sent, however the letters were sent before the fee's were waived All documents that were promised to the customer have been sent, with most recently a statement of account and apology letter to customer We would be happy to reconsider any specifics on why the customer believes that we have not followed through on our stated commitment in order to resolve this issue Everything that we stated in the original response has been completed Please contact me directly with any further questions or if you need further assistance at 425-974-

The contract that Mrs [redacted] is referring to was entered into during the marriage The divorce decree does not warrant her removal from the account and discharge her from a debt that she legally owes The divorce decree is simply an agreement between to two parties on who will be responsible for certain items The divorce decree does not change your financial obligation to your creditors, if one party does not pay you are both still responsible

Complaint: [redacted] I am rejecting this response because:I appreciate you finally updating my EXPERIAN credit report when you got the Revdex.com complaint, however you failed to notify me of you also updating my TRANS UNION credit report, which I checked today 11/5/and your account is still showing as open, and past due for the July and August paymentsI would appreciate correspondence and proof that you have also correctly updated this information, and will be corrected within a week's timeSincerely, [redacted]

On 7/15/2015, [redacted] called in to our offices to make a payment on his account He authorized $to be processed from the card that he provided us on 7/31/ The payment for $processed on 7/31/ On 8/3/2015, [redacted] contacted our offices very upset because she had mailed a money order to us for $and demanded that we not process it and mail it back to her We explained to Mrs [redacted] that due to the fact that our payments are processed by a third party and the fact that we process thousands of payments a day it impossible for us to accommodate her request to mail back the money order Unfortunately we are unable to refund the payment authorized by Mr [redacted] or return the money order submitted and authorized by Mrs [redacted]

Complaint: [redacted] I am rejecting this response because:I [redacted] am rejecting Merchants Acceptance response as Gold River Distributing is listed on contract with no LLC Address stated and phone number on contract is falseIf in fact GRD was dissolved so conveniently on 6/21/the same month I discover is , should be investigated as well as M.A.C for defending an illigitmate companyWhen I researched contact infowith another number listed for GRDperson on the other end stated they always get calls looking for this companyThis is an illiigimate company Sincerely, [redacted]

Merchants Acceptance Corp.(MAC) has completed the investigation into this complaint. Mrs. [redacted] (Customer) purchased a Kirby on 1/3/15 and financed it with MAC. The terms were for $1200 financed over 36 months at $46.62/mth.. Customer made payments on this loan and then on... 2/8/2017 she traded in this Kirby to upgrade to the newest model. The contract that she entered into on 2/8/17 was to finance $1080 over 36mths at $42.92/mth..(See attached contract). These terms were verified with the customer on 2/8/17 over the phone on a recorded phone line; the customer agreed to these terms and was informed at the time of signing the contract. The seller did make the final payment on the old account to payoff the loan for the Kirby taken as a trade in.

We wish to respond to each of the statements made by *** ***(Customer): “I have repeatedly requested a physical bill to which they refuse”Merchants Acceptance Corp(MAC) comment: At the inception of the loan Customer gave written authorization to make the loan payments
directly from a checking account. Customer was mailed a Welcome Letter confirming the terms of the contract and a reminder of the automatic payment program on June 23,2015. This notice and all other correspondence was sent to the following address: *** * *** St Kuna, ID 83634. Other correspondence and billing statements sent to Customer on 8/3/15, 8/14/15, 9/3/15, 9/14/15, 10/6/15. We have recently mailed Customer a coupon book to make all future payments.“There is a second person on the contract who was supposed to make the payments to which I was unaware she was not until it was months past due at chich time the began calling me daily and threatening me with law suit and taking my check directly from my employer”MAC comment: At the inception of the loan the terms of the loan were verified with Customer directly over the phone. Customer is listed as Co-buyer on the contract and is equally responsible for the performance of the contract as was discussed with her shortly after the first payment on the loan was missed on August 18, 2015. This was only days after her first payment was due and missed, not month as she claims. It was also during this call that in an attempt to explain her responsibilities under the contract that she signed the Customer was advised of the actions that our company takes if loan goes unpaid, which includes Wage Garnishment. “They are also insistent on charging me for everything from requested a payment book to adjusting my due date for my payments”MAC comment: We have recently sent Customer out a coupon book without a feeWe have also accommodated Customer’s request for a due date change without fee. Upon investigation into Customers claims there have been no violations of the Federal Trade Commission Services laws as stated under her desired resolution. We will always do what we can to help our customers within company policies and in compliance with all Federal and State regulations.
