A review of the account opened by Mr [redacted] was conducted On February 17, Mr [redacted] made a payment of $1,which was in excess of the balance reflected on the statement dated January 26, However, charges made by Mr [redacted] between the January and February statement, plus interest, left a balance of $owing on the account in February As Mr [redacted] mentions in his complaint, he has scheduled automated recurring payments to be made to his account at MerrickThe recurring payment schedule authorized by Mr [redacted] was to pay the statement balance and this is what occurred in March (the February balance of $was made on March 20, 2016, as shown on the March statement), and in April when the payment for $173.62, which was the balance shown on the March statement, was made on April 20, The April 20, payment of $was subsequently dishonored by Mr [redacted] ’s bank as being unauthorized, which is shown as an “adjustment” on the April statement Mr [redacted] received email reminders of the scheduled recurring payments and an email confirming the payment was made for the amount he had previously scheduled as recurring Copies of those emails are attached Mr [redacted] discontinued the recurring payment schedule on April 25, 2016, after the April 20, payment had been processedIt is Merrick’s policy to close accounts where the account owner indicates that payments received by Merrick have not been authorizedThe cardholder agreement explains that Merrick can close accounts at any time for any reason or no reason Mr [redacted] indicates in his complaint that he had paid the balance in full but there is still a balance on the account as shown on the statement dated June 24, This balance has not been paid as of the date of this response I have attached copies of the statements reviewed for this response and the emails referred to above

Complaint: [redacted] I am rejecting this response because: Sincerely, [redacted] ***I checked my bank statement regarding the date for July 17th of I didn't see where my account hadbinsifficient finds before that payment was madeIt shouldn't have been listed as a returned paymentI have been having issues with accessing website in order to pay bill on several occasions

A review of the account was conducted Except for this complaint, according to Merrick’s records there has been no written communication from Ms [redacted] regarding possible identity theft on the account under her nameThe account was opened in and was used for the purchase of goods and services until February when it was charged off for non-payment Ms [redacted] can contact Merrick’s security department at 800-215-to file a fraud claim on this account

Mr [redacted] opened an account with Merrick in January He has used the account for the purchase of goods and services since that time I requested a review of Mr [redacted] ’s account to determine if the account would qualify for a lower rate and it appears that the account has the lowest rate available for his credit profileIt is Merrick’s policy to not honor borrower requests for APR rate reductions If Mr [redacted] needs assistance with a payment plan or other information about how to pay down the balance of the account more quickly he can contact us at ###-###-#### and we will be happy to discuss what options may work for himTell us why here

Merrick’s records show that Mr [redacted] opened an account in April and used the account for the purchase of goods and services The current status of the account is charged-off for non-paymentThe balance owing on the account is $1, If Mr [redacted] wishes to find out what options are available to pay the balance of the account he can contact the current collection agency, Carson S [redacted] at 877-487- Merrick has not received any credit bureau disputes from Mr [redacted] The status of the account as reported is correct and accurate according to Merrick’s records and will not be deleted or modified To do so would be a violation of the Fair Credit Reporting ActIf Mr [redacted] settles the account, the credit reporting will be updated to reflect that settlementT

Merrick has no further response to Mr [redacted] 's issueI will close the account today and the deposit will be used to off set the balance owed

Ms [redacted] opened an account with Merrick in December and had used the account for the purchase of goods and services In October and November Ms [redacted] did not make the minimum payment due which resulted in a past due payment report to the credit reporting agencies The account was paid in full on February 22, The credit reporting history of the account is maintained by the credit reporting agenciesGood credit information can remain on a file indefinitely; derogatory information can remain on a file for 7-years Merrick is required under the Fair Credit Reporting Act (“FCRA”) to accurately report the status of accounts it reports to the credit bureaus The various status’ reported on MsYoung’s account were and are accurate for that given point in time and Merrick will not remove or alter that information To do so would be a violation of FCRA

A review of Ms [redacted] ’s account and the issue set forth in the complaint was conducted It appears from the review that there were some issues regarding a payment Ms [redacted] made on September 15, The representative who took the information processed a payment using the wrong bank account information When Ms [redacted] contacted Merrick regarding this issue the representative told her that the September call recording would be pulled and reviewed When Ms [redacted] contacted Merrick again on September 27, regarding this payment issue she explained that the error was causing problems with her employer She asked for a supervisor but one was not available She left a message for a call back after the review begun on September was completed It appears that the supervisor reviewed the account and made notes concerning this issue, but never called Ms [redacted] back regarding the status or results of the reviewOn October Ms [redacted] received a call from a Merrick representative regarding the status of the account The representative had full access to the account notes but did not offer any help to Ms [redacted] regarding the September payment issue, and during the call Ms [redacted] asked how to make a complaintWhile the representative was describing the process, the call was dropped Because of the issues set forth above Merrick has sent a letter of apology directly to Ms [redacted] The status of the account has been changed from revoked to open but suspended, and a payment plan has been put into place on the account The Assistant Vice President of Operations will contact Ms [redacted] directly and discuss the issues and work with her to ensure she understands the payment plan and resolve any remaining issues she may have at that timeThe representatives who spoke to Ms [redacted] and the supervisor who did not return the call as requested will receive additional training and coaching on the proper handling of these types of issues

Mr [redacted] opened an account with Merrick in May, Mr***’s account has had a zero balance and there has been no activity for a year or more Merrick’s decision to close the account was based upon the inactivity of the account and no other reasonThe cardholder agreement between Mr [redacted] and Merrick allows either party to close the account at any time, and allows Merrick to do so for any reason without prior notice Merrick will not reopen ***’s account

A review of the account was conducted Ms [redacted] opened an account with Merrick in December She has used the account for the purchase of goods and services On or about January 8, Ms [redacted] notified Merrick that she had not received the card she requested in her married name Merrick did not show any returned mail and Ms [redacted] indicated that the address on file was the correct addressMs [redacted] account has an annual fee that is billed monthly at $per month The account became days past due as of February 10, The balance owing was $which was monthly annual fees and $of interest on those fees The credit reporting that was sent to the credit reporting agencies was correct and accurate reflection of the account status at the time The reporting done on the account was correct and accurate and in full compliance with the FCRA However in the interest of resolving Ms [redacted] ’ concerns, Merrick has sent a request to delete the days past due report from her credit fileThe request can take up to days for the reporting agencies to completeMerrick has done this strictly as a courtesy to Ms [redacted] who was an excellent account holder with Merrick

Merrick has removed the email address that was associated with the account MsF [redacted] indicated was not her account We apologize for any inconvenience that this might have caused, but the account owner had input that same email address on her application MsF [redacted] should not receive any further communications from Merrick Bank

Complaint: [redacted] I am rejecting this response because: When a participant purchases a Money Order in the amount of there choosingAll you have to do is endorse the money order in Merrick Bank namePut the account number on the money orderThe participants addressTear off the receipt that had the amount of the money order on it and when it was purchaseSo, if the money order was cashedThen someone in that department to cash it in after it was received with my name on the statementIn the amount box of the statement it is written in what the amount his accredited towards my account Sincerely, [redacted] ***

Otha W [redacted] opened an account with Merrick in September and used the account for goods and servicesThe account became delinquent and subsequently charged off by Merrick A charge off is an account function and not a forgiveness of the debt Consumers with charged off debts are still obligated to pay those debts The account which has been owned by Merrick since it was originated is currently being reported as a charge off The account was charged off July The reporting of the account status to the credit reporting agencies is correct as is required by the Fair Credit Reporting Act Merrick will not change of delete that reporting to do so would be a violation of the Act Enclosed are copies of statements reviewed on the account

Merrick conducted a review of Mr [redacted] ’s application submission When Mr [redacted] submitted his application it triggered the automated question and answer authentication provided by TransUnionThe questions are not created by MerrickThe questions provided to Mr [redacted] pertain to his personal credit history as it appears at TransUnionThese are questions directly related to him, or in some instances they may not be However, if any one of the questions have a response that did not apply to him, he could have selected “none” or “does not apply” as his answerMerrick is required to specifically identify the person who is applying for an account, and TransUnion, who provides Merrick’s credit bureau reports for new accounts, conducts the identity verification process Because Merrick could not verify Mr [redacted] ’s identity using the questions and answers presented to him at the time of application, his application was declined Merrick will not be able to open an account for Mr [redacted]

We appreciate Ms [redacted] ’s proactive notification that her payment may be late due to fraud on her checking accountAs a courtesy we have waived the late fee assessed to the account as a result of the late payment in February in the amount of $ Ms [redacted] should see this adjustment on her next statement

In March Ms [redacted] requested help with her account and she was approved for an Account Restructure Program (“ARP”) offered by Merrick A letter dated March 13, was sent to her which outlined the program and how it worked Ms [redacted] made her first payment under the program, but that payment was returned unpaid This is the reason that her account was charged off and the online access to her account was blocked Ms [redacted] replaced the returned payment within daysTherefore, Merrick has made an exception and reinstated MsWinter’s account into the ARP The credit reporting has been updated to remove the charge off previously submitted However, Ms [redacted] will need to make payments of $each under the program before June 10, to avoid being removed from the ARP againThe changes to the credit bureau reporting can take up to days If Ms [redacted] has questions she may contact Merrick customer service at 800-253-

Ms [redacted] opened an account with Merrick in January She applied for the card in response to Merrick’s offer to double the credit line after seven consecutive on-time payments were made on the account Her due date is the 21th of each month The payment made on the account on June 21, was returned unpaid for non-sufficient funds Therefore, MsPraccia did not meet the conditions for the credit line increaseThe account will still be considered for credit line increases in the future Merrick sometimes delays credit line availability on an account while Merrick waits for payments to clearThis delay can be longer on accounts where prior payments have been returned unpaidUnder Section of the cardholder agreement titled “About the Credit Limits on the Account” it states as follows: We may in our sole discretion decline to permit use of a portion of the credit limit equal to the amount of the payment or credit for up to days from the date postedThis delay in increasing your available credit will not affect the proper crediting of your payment or credit to Purchase, Cash Advances, and finance charges, and will not alter the calculation of finance charges According to the notes on the account, the Merrick representative explained to MsPraccia that she could request a release of the available line if she would fax a copy of her bank statement or other proof that the payment had cleared her depository bank MsPraccia declined to provide such information Therefore, the open-to-buy for the amount of her most recent payment became available on December 30,
